The applicant proposes to display hot tubs, barbecue grills, swim-spas, out-door fire pits, and other backyard related products. Two portable restrooms are proposed on site during all hours of the event. 24 hour security will also be provided on site during all hours of the event. The applicant is proposing to have three trucks on site, provided by vendors, that will be for display purposes. The trucks are designed with color graphics showing products made by these vendors (See exhibit 4). A portable generator will be provided on site to meet the vendor's electrical needs. The temporary use will cease by 7:00pm on May 6, 2015. 2. The temporary sales location will stay on the property of 200 SW Grady Way and not use public right-of-way for any activity. 3. The applicant shall apply for separate sign permits for any temporary or permanent sign age associated with the use. 4. The site occupied by the temporary use shall be left free of debris, litter, or other evidence of the temporary use upon completion of removal of the use or when the operation of the use ceases to exist 5. The site occupied by the temporary use shall be restored to the original condition when the use ceases to exist including restoration of site elements such as, but not limited to, landscaping and parking stall striping. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of the permit issuance must be filed in writing on or before 5:00 p.m. on April 24, 2015. Appeals must be filed in writing together with the required fee with Hearing Examiner c/o City Clerk, City of Renton, 1055 S Grady Way, Renton, WA, 98057. Appeals to the Examiner are governed b\ City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. EXPIRATION: A Temporary Use Permit is valid for up to one year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator. Restrictions on Use. In connection with the use of the Premises Tenant shall: (a) Conform to all applicable laws and regulations of any public authority ("Apflicable Laws") governing Tenants use of the premises, and cotTcct at Tenant's own expense any failure o compliance created through Tenant's fault or by reason of Tenant"s use of the Premises. (b) Refrain from any activity that would make it impossible to insure the premises against casualty or increase the fire insurance rates imuring the Premises. (c) Refrain from any use that would be reasonably offensive to other tenants or owners or users of neighboring premises or that would tend to create a nuisance or damage the reputation of the Premises. (d) Tenant shall not cause or permit any Hazardous Substance to be spilled, leaked, disposed of, on or under the Premises in violation of Applicable Law. 4. REPAIRS AND MAINTENANCK 4.1. Tenant's Obligations. The following shall be the responsibility of Tenant. (a) Keep the Premises in good order and condition. (b) Any repairs necessitated by the negligence of Tenant, its agents, employees, and invitees. 5. AL TERA TIO NS. 5.t. Alterations Prohibited. Each exhibit to which reference is made herein and which is attached hereto is made a part hereof by reference. 12.4. Counterparts. This Lease may be executed in several counterparts, each of which may be deemed an original, but all of which together shall constitute one and the same Lease 12.S. Relatiomhip of lhe Parties. The only relationship of the parties is that of landlord mid tenant. Landlord shall not in any way or for any purpose be deemed a partner, joint venturer, or member of any joint enterprise with Tenant. No other party shall be deemed a third-party bendiciary of the rights conferred in this Lease. 12.6. AS-IS Lease.
