PROJECT DESCRIPTION/ANALYSIS: The applicant is requesting approval of a Critical Areas
Exemption for the construction of an eight-foot wide sidewalk and curb, per RMC 4-3-
0SOC.S.e.iii, located in the public right-of-way along the western property lines of two
contiguous parcels (APN 3123059096 and APN 3123059075) which front on Talbot Road S.
The purpose of the proposed project is to provide a safe walking environment along this
portion of Talbot Road S. Additionally, the proposed sidewalk would provide additional
pedestrian access to the Sikh Temple located to the north of the subject parcels. The proposed
sidewalk would encroach eight feet into a Category 2 Wetland which encompasses
approximately 66 linear feet from the southern end of the sidewalk project northerly and eight
feet into the wetland buffer area for an additional 50 linear feet northerly of the wetland
boundary. The sidewalk and curb would also cross a 12-inch culvert and outlet for the Class 4
Stream within the project area. Approximately 254 square feet of the wetland and 400 square
feet of the wetland buffer area would be filled as a result of the proposed project. The
existing 12-inch culvert and outlet for the Class 4 Stream would be replaced with a new 12-
inch culvert and outlet as part of the project construction with a Critical Areas Exemption per

RMC 4-3-0SOC.5.g.i. The proposed sidewalk would extend approximately 260 linear feet
north from the southeast property line of the parcel addressed as 18836 Talbot Road S (APN
3123059075). The proposed project includes two driveways: Driveway 1 is an existing
driveway which provides access to 5218 Talbot Road S (APN 3123059096) and Driveway 2, a
proposed driveway, which would access 18836 Talbot Road S (APN 3123059075). Because no
permits or authorization for parking on the area east of the sidewalk extension is given or
implied, staff recommends that Driveway 2 not be allowed (Exhibit 2).
The proposed project would minimize impacts to the critical areas in that a sidewalk and curb
would be constructed without a planting strip. Because this critical areas exemption
addresses only the sidewalk and curb extension and replacement of the 12-inch culvert and
outlet, at the time of issuance, the applicant would not be required to provide any mitigation
for encroachment into the Category 2 Wetland, the wetland buffer, the Class 4 Stream buffer
or for crossing the culverted Class 4 Stream. At a later time, if and when the applicant
proposes development on either or both of the subject parcels, mitigation for that project and
this sidewalk extension project would be required.

EXEMPTION JUSTIFICATION: Pursuant to RMC 4-3-0SOC.5.e.iii, Roads, Parks, Public and
Private Utilities and RMC 4-3-0SOC.5.g.i, Activities in Critical areas Buffers, of the Critical Areas
Regulations is hereby granted:

iii. Utilities, Traffic Control, Walkways, Bikeways Within Existing, Improved Right-
of-Way or Easements: Within existing and improved public road rights-of-way or
easements, installation, construction, replacement, operation, overbuilding or
alteration of all natural gas, cable, communication, telephone and electric
facilities, lines, pipes, mains, equipment or appurtenances, traffic control devices,
illumination, walkways and bikeways. If activities exceed the existing improved
area ar the public right-of-way, this exemption does not apply. Where applicable,
restoration of disturbed areas shall be completed.

Improvements: Remodeling, restoring, replacing or removing structures, facilities
and other improvements in existence on the date this section becomes effective
ond that do nat meet the setback or buffer requirements of this section provided
the work complies with the criteria in RMC 4-10-090.
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal
law or regulation.

2. The activity will be conducted using best management practices as specified by industry
standards or applicable Federal agencies or scientific principles if submitted plans are
followed and the conditions of approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if
submitted plans are followed and the conditions of approval ofthis exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in
accordance with this exemption, the site will be revegetated with native vegetation as
required as a condition of approval for this exemption.
DECISION: An exemption from the critical areas regulations is approved for the Sikh
Temple Sidewalk Extension, LUA13-000609, CAR subject to the following conditions:
1. The applicant shall not construct the proposed Driveway 2 on the parcel addressed as
18836 Talbot Road S (Exhibit 2).
2. This critical areas exemption does not permit or authorize parking on the two subject
parcels.
3. Areas disturbed during construction must be restored and revegetated with native
vegetation.

The above land use decision will become final if the decision is not appealed within the 14-
day appeal period (RCW 43.21.C.075(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together
with the required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South
Grady Way, Renton, WA 98057, on or before 5:00 p.m., on May 29, 2013. RMC 4-8-110
governs appeals to the Hearing Examiner and additional information regarding the appeal
process may be obtained from the Renton City Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not readily discoverable prior to the original decision is found or if he finds
there was misrepresentation of fact. After review of the reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).
