The applicant proposes removal of 4 non-conforming freestanding signs within the Petrovitsky Rd public right-of-way. The apartment complex is two parcels, PIDs 282305-9024 and 282305-9026, and approximately 908,834 square feet (20.86 acres) in area and located within the Residential Multi-Family Zone. The applicant is rebranding the site as part of different ownership. All signs that are being changed at the site are a combination of wall, freestanding, wayfinding, and building and parking stall signs (8 freestanding signs along streets, 2 wall signs for the leasing office and resident center, 27 building numbers, and 164 parking stall numbers). All signs are similar in design and color scheme and provide property identification and contact information, directions, and numbering for buildings and parking stalls. Associated improvements include landscaping and three, 6-foot high fence sections that screen surface parking. The applicant is coordinating with Bonneville Power for placement of signs within an existing electric utility easement. Temporary signs are not part of this request. The complex has separately applied for 8 decorative flags in the southwest corner of the site along SW Petrovitsky Rd. PROJECT DESCRIPTION/BACKGROUND: LUA15-000281, V-A The applicant proposes new wall, freestanding, and way-finding signs as part of rebranding and new ownership at the Gram mercy Apartments. The applicant is also proposing to remove 4 non-conforming permanent freestanding signs in the public right-of-way along Petrovistky Rd SW (Exhibit 10). The apartment complex site is bounded by SE Petrovitsky Rd to the south and Cascade Shopping center to the north and is located in the Residential Multi-Family Zone and the Design District 'B' overlay (Exhibit 3). The approximate 20-acre site is a combination of two properties: PIO 2823059024 and PIO 2823059026 (Exhibit 2 and Exhibit 11). Multiple public and private streets provide access to the 27 building complex with 378 apartment units, access to parking, the leasing office, and the resident center. The two public streets that provide access to the site are SE Petrovitsky Rd and SE 175<h St. The three private streets that provide access throughout the site are 119th Pl SE, 120'h Ln SE, and 120'h Ter SE. Overhead high-voltage electric towers divide the site east to west. The applicant is requesting that: a) more than 2 on-premises identifying signs be allowed, and b) that proposed freestanding signs be allowed closer than 5 feet from lot Jines. Both requests require a variance from RMC 4-4-100E.4.a. For apartment complexes, the Renton Municipal Code (RM() allows up to 2 on-premises identifying signs of not over 32 square feet in area on one face, and that any freestanding signs shall not have a height greater than 6 feet above any established grade, and a freestanding sign shall be no closer than 5 feet to any lot line per RMC 4-4-lOOE.4.a. The applicant has identified 199 signs in the variance submittal. With 2 permanent freestanding signs that were already installed without a permit along SE 175" St, this is a total of 201 permanent signs. rhese are 8 freestanding signs along stn!ets (Exhibits 4 and 7), 2 wall signs for the leasing office and resident center (Exhibits 5), 27 building number wall signs for the multi-family buildings (Exhibits 6), and 164 parking stall numbers (Exhibit 6). The parking stall numbers are less than 2 square feet in size and are exempt from sign regulations, per RMC 4-4-lOOB.6.r "Small Parking and Traffic Control Signs," as. any parking and traffic control signs 2 square feet or less on private property are not regulated. The individual building number wall signs are needed for addressing of the buildings and idenfitication for emergency services. For the 2 permanent signs already installed along SE 175<h St (Exhibit 7). these 2 signs were not part of the written variance request but will be considered by staff as part of the request {Exhibit 7). There is a separate sign permit application at the Grammacy Apartment complex for 8 permanent decorative flug signs approximately 15 feet in height in the southwest corner of the site along Petrovitsky Rd SW (Exhibit 10). Without the individual building wall signs and parking stall numbers, there are 18 permanent signs requesting approvals at the site between the variance request (10) and decorative flag sign permit (8). In total, the variance request is applic2ble to 8 on-premises identification signs (8 freestanding signs and 2 wall signs on the resident center and leasing office). The 8 permanent decorative flags are being reviewed through a separate sign permit (Exhibit 9). The applicant 1s requesting a variance to allow 10 on-premises freestanding identifying signs which is inore than the allowed 2 per RMC 4-4-lOOE.4.a., including 2 signs already installed on screening fences along SE 175'" St (Exhibit 7). 1\II of the signs are 32 square feet or less. FINDINGS: 1:. ---------------------·~--»--·-,.........,ij Having reviewed the written record in the matter, the City now makes and enters the following: 1, Request: The applicant has requested an administrative variance from RMC 4-4-lOOE.4.a to allow more than 2 permanent identification signs within an apartment complex and also allow proposed freestanding permanent signs to be located closer than 5 feet to any lot line. The applicant is requesting 2 wall signs on the resident center and leasing office and 8 freestanding on-premises identification signs with 0-foot setbacks. 2. Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance request. The applicant's site plan and proposed sign photo simulations are provided as Exhibits 3 and 4. 3. Existing Land Use: The subject parcel is surrounded on all sides by existing residential and non- residential development including Cascade Shopping Center and the Federal Post Office to the north and west, a daycare center to the east, and multi-family residential to the east and west, and SE Petrovitsky Rd to the south. The subject site is a multi-family apartment complex on a 20.36-acre complex with multiple private driveways, and 27 multi-story apartment buildings and resident and leasing service buildings. 4. Zoning: The subject property is within the Residential Multi-Family (RMF) Zone and Urban Design - District B. Topography: The site slopes from north to south downward towards SE Petrovitsky Rd. 6. Lots and Building Size: The subject site is a multi-family apartment complex with approximately 27 multi-story apartment buildings with 380 units on an approximate 20-acre campus with multiple private driveways, a resident center, and a leasing service office. Combined total building area is 352,315 square feet according to King County Assessor Data (Exhibit 11). E. CONSISTENCY WITH VARIANCE CRITERIA: Section 4-9-2508.5 lists 4 criteria that the Plonning Director is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Planning Director shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant contends that practical difficulties exist and that the strict interpretation of the sign regulations for the approximate 20-acre site causes confusion for the public and emergency vehicles that enter the property from the multiple entrance points and half dozen public and private streets that run through the property (Exhibit 6). As part of signage improvements, the applicant is proposing to remove existing non-conforming signs located in the public right-of-way along SE Petruvitsky Rd (Exhibit 10). The code allows for up to 2 on-premises permanent signs per RMC 4-4-lOOE.4.a at an apartment complex in a residential zone. The subject site is not a small apartment complex with one or two buildings but is a large 20-acre campus with 27 multi-story buildings and a wide overhead high voltage utility easement that divides the property east to west. Staff has reviewed the proposed variance request and concurs with the applicant's analysis. The size of the proposed signs meet the standard of 32 square feet in area or less per RMC 4-4- lOOE.4.a. Additionally, all proposed freestanding signs are 6 feet or less in height .JS required per RMC 4-4-lOOE.4.a. The freestanding signs are located as close as zero setback along Petrovitsky rather than 5 feet minimum distance because there is approximately 25 feet of undeveloped right- of-way between the back of sidewalk and property line. If the strict code were applied, only 2 on- premises signs would be allowed on the 20-acre site that has approximately 6 public and private streets. At 2 on-premises identification signs, this maximum of two signs would not provide needed wayfinding for the public ;ind emergency needs. All signs would help provide clarity and wayfinding in close proximity of sidewalks and vehicles traveling through the large site. It is anticipated that the proposed signs would reduce confusion in the large apartment complex site and clarity between boundaries with other multi-family residential developments bordering the site on either side. b. The applicant also states that the signs are of high quality and will be beneficial to the public in both convenience and improved property values. Staff has reviewed the proposed variance request and concurs with the applicant's analysis, The granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and rnne in which the subject property is situated. The proposal would remove non-conforming signs that are currently in the public right-of-way along SE Petrovitsky Rd. The subject proposal would allow the removal of the existing signs within the public right-of-way and improve wayfinding. Granting of the variance for more than 2 signs on the site would allow for improved directional signage within the site along the public and private streets and drives. The granting of the variance to allow signs along lot lines to be closer than the 5-foot setback (zero foot setbacks) is not anticipated to cause any negative impacts to neighboring property owners and/or the public. The proposed replacement sings would be outside of the vision clearance areas at entrances (Exhibit 4) and would be moved outside of the public right-of-way. The reduced setback from 5 feet to O feet allows the signs to be between 24 and 27 feet from the back of the sidewalk. The proposed location of the signs at a 0-foot setback increases visibility from the public right-of-way without being located in the right-of-way. The result of the proposed sign package would improve the non-conforming situation and move the complex's freestanding signs closer to conformance. Therefore, staff recommends that the requests for 8 on-premises freestanding identifying signs be allowed and that the signs be allowed up to zero setback along lot lines and public rights-of-way. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: rhe applicant contends that the approval of the variance requests would improve directions throughout the large site for both the public and emergency services. Due to the large site having multiple entry points, and having multiple public and private streets bisecting the campus, there is a need for improved signage throughout the site. The site needs more than the 2 permanent signs allowed through City code. All proposed signs are identified in Exhibits 4-9. The signs would be for locating the leasing and resident centers, apartment buildings, parking stalls, and identification of the complex with contact information. Staff has reviewed the applicant's justifications and concurs that the approval of the variance for more than 2 permanent signs and one of the permanent signs to be less than 5-feet from the property lines would improve wayfinding through the site for residents, the public, and emergency services. In addition, the wanting of this variance would not constitute a grant of special privilege, as the sign package would bring the site closer to conformance with Renton Municipal Code than it is today. d. That the approval as determined by the Planning Director is a minimum variance that will accomplish the desired purpose: The applicant is proposing to reduce the signs on Petrovitsky by one, to ultimately have 3 on- premises freestanding identifying signs along Petrovitsky and 5 along the internal public road SE 175'h St. There are two private streets connecting to Petrovitsky, where there are two freestanding signs near each entry and one primary site sign in the middle of the two streets. Staff has reviewed the proposed variance request and concurs with the applicant's analysis, that the request for 8 new signs and associated reduced setbacks is the minimum variance necessary to effectively facilitate way finding on the site for both residences, visitors, and emergency services. Although not part of the variance request, the apartment complex ownership has applied for decorative flags in the southwest portion of the site. The decorative flags would be allowed by RMC 4-4-lOOE.4.a.i "Decorative Flags". There are previously installed cement footings near the decorative flag proposal within the right-of-way. Therefore, to remove the non-conforming flag footings in the right-of-way, staff recommends that all sign footings in the right-of-way along the border of the complex be removed by the applicant, prior to installation of any sign approved through this application. At minimum, grass shall be added where removal of the footings occurs. F. CONCLUSIONS: 1. The subject site is located on the north side of SE Petrovitsky Rd, at 3750E Valley Road, within the Residential Multi-Family (RMF) Zone and Design District B. 2. The sign regulations of RMC 4-4-lOOE.4.a limit permanent signs to 2 on-premises identifying signs not over 32 square feet in Mea on the face, where freestanding signs shall not have a height greater than 6 feet and shall not be located closer than 5 feet to any lot line. rhe applicant requests that a total of 8 permanent freestanding identifying signs be allowed, be as close as zero setback from property lines, and allow three 6-foot tall fence sections with signs near the intersection of SE l75'h 120'" Ln SE. All are proposed on-premises identifying signs are less than 32 square feet in size and 6-feet or less in height. 3. The requested vari;ince meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4-9-250B.5. The analysis of the proposal according to variance criteria is found in the body of the Staff Report as long as the existing four freestanding signs in the Petrovitsky right-of-way are removed and as long as the pipe and concrete footings for pole signs in the Petrovitsky right-of-way art:' rt:'moved prior to installation of any new signs approved through this variance. 1 G. DECISION: rhe Administrative Variance for the Grammacy Apartments Sign Variance, File No. LUAlS-000281, is approved subject to the following conditions: l. The applicant shall remove the four existing permanent freestanding signs within the SE Petrovitsky Rd right-of-way and add landscaping to replace the location of the existing signs with landscaping similar to what exists. A landscape plan showing landscaping for the new signs and the restoration landscaping for the removed sites shall be submitted to the Current Planning Project Manager for review and approval prior to sign permit issuance. The applicant shall remove all sign footings that were installed in rights-of-way along the complex's boundaries and be replaced by grass or landscaping prior to installation of any signs proposed through this request. This includes the existing four freestanding signs and footings for flags within the SE Petrovitsky Rd right-of-way. 3. The three sections of fencing just west of the intersection of 175th St and the 120'1, Terrace SE must not be located within the public right-of-way, or the applicant shall be required to remove the fencing and place them outside of the public right-of-way. A sign permit shall be provided to the City of Renton for review and approval that identifies the location of the signs out of the right-of- way. 4. The variance approval does not qualify as a sign permit approval, and the applicant must submit for separate sign permits for the different sign types being installed at the site. The applicant is also proposing to remove 4 non-conforming permanent freestanding signs in the public right-of-way along Petrovistky Rd SW (Exhibit 10). The apartment complex site is bounded by SE Petrovitsky Rd to the south and Cascade Shopping center to the north and is located in the Residential Multi-Family Zone and the Design District 'B' overlay (Exhibit 3). The approximate 20-acre site is a combination of two properties: PIO 2823059024 and PIO 2823059026 (Exhibit 2 and Exhibit 11). Multiple public and private streets provide access to the 27 building complex with 378 apartment units, access to parking, the leasing office, and the resident center. The two public streets that provide access to the site are SE Petrovitsky Rd and SE 1751h St. The three private streets that provide access throughout the site are 119th Pl SE, 1201h Ln SE, and 12o'h Ter SE. Overhead high-voltage electric towers divide the site east to west. The applicant is requesting that: a) more than 2 on-premises identifying signs be allowed, and b) that proposed freestanding signs be allowed closer than 5 feet from lot lines. Both requests require a variance from RMC 4-4-lOOE.4.a. For apartment complexes, the Renton Municipal Code (RMC) allows up to 2 on-premises identifying signs of not over 32 square feet in area on one face, and that any freestanding signs shall not have a height greater than 6 feet above any established grade, and a freestanding sign shall be no closer than 5 feet to any lot line per RMC 4-4-lOOE.4.a. The applicant has identified 199 signs in the variance submittal. With 2 permanent freestanding signs that were already installed without a permit along SE 175th St, this is a total of 201 permanent signs. These are 8 freestanding signs along streets (Exhibits 4 and 7), 2 wall signs for the leasing office and resident center (Exhibits 5), 27 building number wall signs for the multi-family buildings (Exhibits 6), and 164 parking stall numbers (Exhibit 6). The parking stall numbers are less than 2 square feet in size and are exempt from sign regulations, per RMC 4-4-1008.6.r "Small Parking and Traffic Control Signs," as any parking and traffic control signs 2 square feet or less on private property are not regulated. The individual building number wall signs are needed for addressing of the buildings and idenfitication for emergency services. For the 2 permanent signs already installed along SE 175th St (Exhibit 7), these 2 signs were not part of the written variance request but will be considered by staff as part of the request (Exhibit 7). There is a separate sign permit application at the Grammacy Apartment complex for 8 permanent decorative flag signs approximately 15 feet in height in the southwest corner of the site along Petrovitsky Rd SW (Exhibit 10). Lots and Building Size: The subject site is a multi-family apartment complex with approximately 27 multi-story apartment buildings with 380 units on an approximate 20-acre campus with multiple private driveways, a resident center, and a leasing service office. Combined total building area is 352,315 square feet according to King County Assessor Data (Exhibit 11). I E. CONSISTENCY WITH VARIANCE CRITERIA: Section 4-9-2508.5 lists 4 criteria that the Planning Director is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the fallowing: The Planning Director shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant contends that practical difficulties exist and that the strict interpretation of the sign regulations for the approximate 20-acre site causes confusion for the public and emergency vehicles that enter the property from the multiple entrance points and half dozen public and private streets that run through the property (Exhibit 6). As part of signage improvements, the applicant is proposing to remove existing non-conforming signs located in the public right-of-way along SE Petrovitsky Rd (Exhibit 10). The code allows for up to 2 on-premises permanent signs per RMC 4-4-lOOE.4.a at an apartment complex in a residential zone. The subject site is not a small apartment complex with one or two buildings but is a large 20-acre campus with 27 multi-story buildings and a wide overhead high voltage utility easement that divides the property east to west. Staff has reviewed the proposed variance request and concurs with the applicant's analysis. The size of the proposed signs meet the standard of 32 square feet in area or less per RMC 4-4- lOOE.4.a. Additionally, all proposed freestanding signs are 6 feet or less in height as required per RMC 4-4-lOOE.4.a. The freestanding signs are located as close as zero setback along Petrovitsky rather than 5 feet minimum distance because there is approximately 25 feet of undeveloped right- of-way between the back of sidewalk and property line. If the strict code were applied, only 2 on- premises signs would be allowed on the 20-acre site that has approximately 6 public and private streets. At 2 on-premises identification signs, this maximum of two signs would not provide needed wayfinding for the public and emergency needs. All signs would help provide clarity and wayfinding in close proximity of sidewalks and vehicles traveling through the large site. It is anticipated that the proposed signs would reduce confusion in the large apartment complex site and clarity between boundaries with other multi-family residential developments bordering the site on either side. b. The applicant also states that the signs are of high quality and will be beneficial to the public in both convenience and improved property values. Staff has reviewed the proposed variance request and concurs with the applicant's analysis. The granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is situated. The proposal would remove non-conforming signs that are currently in the public right-of-way along SE Petrovitsky Rd. The subject proposal would allow the removal of the existing signs within the public right-of-way and improve wayfinding. Granting of the variance for more than 2 signs on the site would allow for improved directional signage within the site along the public and private streets and drives. The granting of the variance to allow signs along lot lines to be closer than the 5-foot setback (zero foot setbacks) is not anticipated to cause any negative impacts to neighboring property owners and/or the public. The proposed replacement sings would be outside of the vision clearance areas at entrances (Exhibit 4) and would be moved outside of the public right-of-way. The reduced setback from 5 feet to O feet allows the signs to be between 24 and 27 feet from the back of the sidewalk. The proposed location of the signs at a 0-foot setback increases visibility from the public right-of-way without being located in the right-of-way. The result of the proposed sign package would improve the non-conforming situation and move the complex's freestanding signs closer to conformance. Therefore, staff recommends that the requests for 8 on-premises freestanding identifying signs be allowed and that the signs be allowed up to zero setback along lot lines and public rights-of-way. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that the approval of the variance requests would improve directions throughout the large site for both the public and emergency services. Due to the large site having multiple entry points, and having multiple public and private streets bisecting the campus, there is a need for improved signage throughout the site. The site needs more than the 2 permanent signs allowed through City code. All proposed signs are identified in Exhibits 4-9. The signs would be for locating the leasing and resident centers, apartment buildings, parking stalls, and identification of the complex with contact information. Staff has reviewed the applicant's justifications and concurs that the approval of the variance for more than 2 permanent signs and one of the permanent signs to be less than 5-feet from the property lines would improve wayfinding through the site for residents, the public, and emergency services. In addition, the granting of this variance would not constitute a grant of special privilege, as the sign package would bring the site closer to conformance with Renton Municipal Code than it is today. d. That the approval as determined by the Planning Director is a minimum variance that will accomplish the desired purpose: The applicant is proposing to reduce the signs on Petrovitsky by one, to ultimately have 3 on- premises freestanding identifying signs along Petrovitsky and 5 along the internal public road SE 17S'h St. There are two private streets connecting to Petrovitsky, where there are two freestanding signs near each entry and one primary site sign in the middle of the two streets. Staff has reviewed the proposed variance request and concurs with the applicant's analysis, that the request for 8 new signs and associated reduced setbacks is the minimum variance necessary to effectively facilitate way finding on the site for both residences, visitors, and emergency services. Although not part of the variance request, the apartment complex ownership has applied for decorative flags in the southwest portion of the site. The decorative flags would be allowed by RMC 4-4-lOOE.4.a.i "Decorative Flags". There are previously installed cement footings near the decorative flag proposal within the right-of-way. Therefore, to remove the non-conforming flag footings in the right-of-way, staff recommends that all sign footings in the right-of-way along the border of the complex be removed by the applicant, prior to installation of any sign approved through this application. At minimum, grass shall be added where removal of the footings occurs. I F. CONCLUSIONS: 1. The subject site is located on the north side of SE Petrovitsky Rd, at 3750E Valley Road, within the Residential Multi-Family (RMF) Zone and Design District B. 2. The sign regulations of RMC 4-4-lOOE.4.a limit permanent signs to 2 on-premises identifying signs not over 32 square feet in area on the face, where freestanding signs shall not have a height greater than 6 feet and shall not be located closer than 5 feet to any lot line. The applicant requests that a total of 8 permanent freestanding identifying signs be allowed, be as close as zero setback from property lines, and allow three 6-foot tall fence sections with signs near the intersection of SE 175th 120'h Ln SE. All are proposed on-premises identifying signs are less than 32 square feet in size and 6-feet or less in height. 3. The requested variance meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4-9-2506.5. The analysis of the proposal according to variance criteria is found in the body of the Staff Report as long as the existing four freestanding signs in the Petrovitsky right-of-way are removed and as long as the pipe and concrete footings for pole signs in the Petrovitsky right-of-way are removed prior to installation of any new signs approved through this variance. I G. DECISION: The Administrative Variance for the Grammacy Apartments Sign Variance, File No. LUAlS-000281, is approved subject to the following conditions: 1. The applicant shall remove the four existing permanent freestanding signs within the SE Petrovitsky Rd right-of-way and add landscaping to replace the location of the existing signs with landscaping similar to what exists. A landscape plan showing landscaping for the new signs and the restoration landscaping for the removed sites shall be submitted to the Current Planning Project Manager for review and approval prior to sign permit issuance.
