Thank you for your participation. Please take the opportunity to review the draft Land Use Element and send any comments to me by Tuesday September 3''. We spent the spring working with you one-on-one to gather materials, information, and policies for the Land Use Element. We briefed the Planning Commission on this in May and held a public workshop in June. All of this input was collected to create the draft document that is attached. Once we get your comments, we will make any necessary revisions and present the draft Element to the Planning Commission on September 18th. They are tentatively scheduled to hold a public hearing on October 161h to receive formal public comments, and another round of revisions. After that point, the Land Use Element will be on hold for a few months while the other parts of the Comprehensive Plan are updated. We are also simultaneously updating our critical areas policies, rules, and best available science, which is a required part of our update. There may be additional information and changes that come out of that process. This Element is significantly shorter than our current version. You will notice a different format and style. There are four themes that are covered: regional planning, land use classification, natural environment, and community design. SHORELINE MASTER PROGRAM CRITERA: - A. COMPREHENSIVE PLAN COMPLIANCE AND CONSISTENCY, SHORELINE ELEMENT: The site is located in the Shoreline High-Intensity Overlay District. The objective of the High Intensity Overlay is to provide opportunities for large-scale office and commercial employment centers as well as multi-family residential use and public services. This district provides opportunities for water-dependent and water-oriented uses, while protecting existing ecological functions and restoring ecological functions in areas that have been previously degraded. Development may also provide for public use and/or community use, especially access to and along the water's edge. The proposal is compliant with the following applicable Shoreline policies: Policy SH-2. Aesthetic considerations should be integrated with new development, redevelopment of existing facilities, or for general enhancement of shoreline areas and should include: 1. Identification and preservation of areas with scenic vistas and areas where the shoreline has high aesthetic value as seen from both upland areas, areas across the water, and recreational and other uses on the water. 2. Appropriate regulations and criteria should ensure that development v' provides designs that contribute to the aesthetic enjoyment of the shoreline for a substantial number of people and provide the public with the ability to reach, touch, and enjoy the water's edge and view the water and shoreline. 3. Regulations and criteria for building siting, maximum height, setbacks, screening, architectural controls, sign regulations, designation of view corridors, and other provisions should ensure that development minimizes adverse impacts on views of the water from public property or views enjoyed by a substantial number of residences. Shoreline processes that shall be protected include, but are not limited to, water flow; littoral drift; erosion and accretion; infiltration; ground water recharge and discharge; sediment delivery, transport, and storage; large woody debris recruitment; organic matter input; nutrient and pathogen removal; and stream channel formation/ maintenance. Existing economic uses and activities on the shorelines should be ,/ recognized and economic uses or activities that are water-oriented should be encouraged and supported, ,/ Policy SH-18. General: Shoreline use and development activities shall be designed and operated to allow the public's visual access to the water and shoreline and maintain shoreline scenic and aesthetic qualities that are derived from natural features, such as shoreforms and vegetative cover. Existing views would be maintained. b. View Obstruction and Visual Quality: The following standards and criteria shall apply to developments and uses within the jurisdiction of the Shoreline Master Program: i. View Corridors Required: Where commercial, industrial, multiple use, multi-family and/or multi-lot developments are proposed, primary structures shall provide for view corridors between buildings where views of the shoreline are available from public right-of- way or trails. Screening Required: The standards in RMC 4-4-095 concerning screening of mechanical equipment and outdoor service and storage areas shall apply within shorelines with the additional criteria that the provisions for bringing structures or sites into conformance shall occur for minor alteration or renovation as provided in RMC 4-9-190. 4. Public Access: a. Physical or Visual Access Required for New Development: Physical or visual access to shorelines shall be incorporated in all new development when the development would either generate a demand for one or more forms of such access, would impair existing legal access opportunities or rights, or is required to meet the specific policies and regulations of the Shoreline Master Program. A coordinated program for public access for specified shoreline reaches is established in the Comprehensive Plan, Shoreline Policy SH-31 Table of Public Access Objectives by Reach Element, Policy SH-31 with provisions for public access, including off-site facilities designated in the table Public Access Requirements by Reach in subsection D4f of this Section. General Development Standards: The proposed work is additional enclosed structure under the roof overhang of an existing building on an existing dock and does not change the current conditions of impact to the shoreline environment. Architectural styles for the building will be consistent with the existing building and, by tucking it under the existing eave it's designed in such a way as to minimize the impact on the area and pedestrian level views. No mechanical equipment will be visible. The shoreline is still just as accessible both visually and physically as it is now. Views from paths are not obstructed by this addition. Also, views from the multi-family complex across Lake Washington Blvd N are a little farther north of the existing structures and angled away from the direction of the buildings and so are not impacted. The use is compatible with the other uses in the same area for outdoor eating overlooking Lake Washington. While the addition is within 50' of the effective shoreline, it is attached to the existing building and enclosed under the existing roof overhang so that it doesn't come any closer to the OHWM than currently exists on the building elsewhere. E. USE REGULATIONS: 4. Commercial and Community Services: a. Use Preference and Priorities: New commercial and community services developments are subject to the following: iii. Water-Enjoyment Uses: Water-enjoyment commercial and community service uses shall not be approved if they displace existing water-dependent or water-related uses or if they occupy space designated for water-dependent or water-related use identified in a substantial development permit or other approval. Prior to approval of water-enjoyment uses, review of the design, layout, and operation of the use shall confirm that the use facilitates public access to the shoreline as, or the use provides for, aesthetic enjoyment of the shoreline for a substantial number of people as a primary characteristic of the use. The ground floor of the use must be ordinarily open to the general public and the shoreline- oriented space within the project must be devoted to the specific aspects of the use that foster shoreline enjoyment. On Lake Washington, allowed water-enjoyment commercial uses shall be evaluated in terms of whether the use facilitates a State-wide interest, including increasing public access and public recreational opportunities in the shoreline. d. Scenic and Aesthetic Qualities: All new or expanded commercial and community services developments shall take into consideration the scenic and aesthetic qualities of the shoreline and compatibility with adjacent uses as provided in subsection 03 of this Section, Use Compatibility Ivar's Outdoor Grill Expansion Code Compliance June 2013 Page 5 of7 and Aesthetic Effects and subsection D5 of this Section, Building and Development Location - Shoreline Orientation. Response to E. Use Regulations: This addition will not be replacing existing water-dependent or water-related uses. With the addition of tables around the building, this will encourage the enjoyment of the shoreline. State of WA Shoreline Policy Per City of Renton Municipal Code 4-9-190 8.7. c. For projects located on Lake Washington the criteria in RCW 90.58 020 regarding shorelines of statewide significance and relevant policies and regulations of the Shoreline Master Program shall also be adhered to. RCW 90.58.020 LEGISLATIVE FINDINGS -STATE POLICY ENUNCIATED -USE PREFERENCE. The legislature finds that the shorelines of the state are among the most valuable and fragile of its natural resources and that there is great concern throughout the state relating to their utilization, protection, restoration, and preservation. In addition it finds that ever increasing pressures of additional uses are being placed on the shorelines necessitating increased coordination in the management and development of the shorelines of the state. The legislature further finds that much of the shorelines of the state and the uplands adjacent thereto are in private ownership; that unrestricted construction on the privately owned or publicly owned shorelines of the state is not in the best public interest; and therefore, coordinated planning is necessary in order to protect the public interest associated with the shorelines of the state while, at the same time, recognizing and protecting private property rights consistent with the public interest. There is, therefore, a clear and urgent demand for a planned, rational, and concerted effort, jointly performed by federal, state, and local governments, to prevent the inherent harm in an uncoordinated and piecemeal development of the state's shorelines. It is the policy of the state to provide for the management of the shorelines of the state by planning for and fostering all reasonable and appropriate uses. This policy is designed to insure the development of these shorelines in a manner which, while allowing for limited reduction of rights of the public in the navigable waters, will promote and enhance the public interest. This policy contemplates protecting against adverse effects to the public health, the land and its vegetation and wildlife, and the waters of the state and their aquatic life, while protecting generally public rights of navigation and corollary rights incidental thereto. The legislature declares that the interest of all of the people shall be paramount in the management of shorelines of statewide significance. The department, in adopting guidelines for shorelines of statewide significance, and local government, in developing master programs for shorelines of statewide significance, shall give preference to uses in the following order of preference which: (1) Recognize and protect the statewide interest over local interest; (2) Preserve the natural character of the shoreline; (3) Result in long term over short term benefit; (4) Protect the resources and ecology of the shoreline; Ivar's Outdoor Grill Expansion Code Compliance June 2013 Page 6 of 7 (5) Increase public access to publicly owned areas of the shorelines; (6) Increase recreational opportunities for the public in the shoreline; (7) Provide for any other element as defined in RCW 90.58.100 deemed appropriate or necessary. In the implementation of this policy the public's opportunity to enjoy the physical and aesthetic qualities of natural shorelines of the state shall be preserved to the greatest extent feasible consistent with the overall best interest of the state and the people generally. To this end uses shall be preferred which are consistent with control of pollution and prevention of damage to the natural environment, or are unique to or dependent upon use of the state's shoreline. Alterations of the natural condition of the shorelines of the state, in those limited instances when authorized, shall be given priority for single-family residences and their appurtenant structures, ports, shoreline recreational uses including but not limited to parks, marinas, piers, and other improvements facilitating public access to shorelines of the state, industrial and commercial developments which are particularly dependent on their location on or use of the shorelines of the state and other development that will provide an opportunity for substantial numbers of the people to enjoy the shorelines of the state. Alterations of the natural condition of the shorelines and shorelands of the state shall be recognized by the department. Shorelines and shorelands of the state shall be appropriately classified and these classifications shall be revised when circumstances warrant regardless of whether the change in circumstances occurs through man-made causes or natural causes. Any areas resulting from alterations of the natural condition of the shorelines and shore lands of the state no longer meeting the definition of "shorelines of the state" shall not be subject to the provisions of chapter 90.58 RCW. Permitted uses in the shorelines of the state shall be designed and conducted in a manner to minimize, insofar as practical, any resultant damage to the ecology and environment of the shoreline area and any interference with the public's use of the water.
