SUBJECT: Principles of Acceptability of a Lot Line Adjustment
Section 4-7-0608, lists 3 principles of acceptability that the Administrator or designee
considers, along with of/ other relevant information; when making a decision on o Lot
Line Adjustment application. Check the appropriate box and give analysis, if necessary:
D Correcting: Adjust lot lines including the elimination of a common lot line in
order to correct property line or setback encroachments;
Staff Analysis:
~ Improving: Create better lot design, or improve access;
Staff Analysis: The proposed lot line adjustment will reconfigure the lot lines
between 5 parcels and remove an existing access tract {Tract A). The proposed
lot line adjustment results in a better lot design for both lots as well as improved
access. All 5 lots would maintain frontage along 114th Avenue SE, new Lot 5
would also have frontage along SE 162"d Street.
~ Conforming: Conform to applicable zoning: see chapter 4-2 RMC, subdivision
and other code requirements pertaining to lot design, building location and
development standards.
Staff Analysis: The proposed lot line adjustment revises the lot lines such that the
new lots would be rectangular in shape and would comply with comply with the
minimum lot size, width, and depth requirements ofthe R-8 zone.

•--• SCHEDULE OF EXCLUSIONS FROM COVERAGE OF THIS GUARANTEE
1. Except to the extent that specific assurances are provided in
Schedule A of this Guarantee, the Company assumes no
liability for loss or damage by reason of the following:
(a) Defects, liens, encumbrances, adverse claims or other
matters against the title, whether or not shown by the
public records.
(b) (1) Taxes or assessments of any taxing authority that
levies taxes or assessments on real property; or, (2)
Proceedings by a public agenc.y which may result in taxes
or assessments, or notices of such proceedings, whether
or not the matters excluded under (1) or (2) are shown
by the records of the taxing authority or by the public
records.
(c) (!) Unpatented mining claims; (2) reservations or
exceptions in patents or in Acts authorizing the issuance
thereof; (3) water rights, claims or title to water,
whether or not the matters excluded under (1), (2) or
(3) are shown by the public records.
2. Notwithstanding any specific assurances which are provided
in Schedule A of this Guarantee, the Company assumes no
liability for loss or damage by reason of the following:
(a) Defects, liens, encumbrances, adverse claims or other matters
affecting the title to any property beyond the lines of the land
expressly described in the description set forth in Schedule (A),
(C) or in Part 2 of this Guarantee, or title to streets, roads,
avenues, lanes, ways or waterways to which such land abuts,
or the right to maintain therein vaults, tunnels, ramps or any
structure or improvements; or any rights or easements therein,
unless such property, rights or easements are expressly and
specifically set forth in said description.
(b) Defects, liens, encumbrances, adverse claims or other matters,
whether or not shown by the public records; (1) which are
created, suffered, assumed or agreed to by one or more of the
Assureds; (2) which result in no loss to the Assured; or (3)
which do not result in the invalidity or potential invalidity of
any judicial or non-judicial proceeding which is within the
scope and purpose of the assurances provided.
(c) The identity of any party shown or referred to in Schedule A.
( d) The validity, legal effect or priority of any matter shown or
referred to in this Guarantee.
GUARANTEE CONDmONS AND STIPULATIONS
1. Definition of Terms.
The following terms when used in the Guarantee mean:
(a) the "Assured": the party or parties named as the
Assured in this Guarantee, or on a supplemental writing
executed by the Company.
(b) "land": the land described or referred to in Schedule
(A)(C) or in Part 2, and improvements affixed thereto
which by law constitute real property. The term "land"
does not include any property beyond the lines of the
area described or referred to in Schedule (A)(C) or in
Part 2, nor any right, title, interest, estate or easement in
abutting streets, roads, avenues, alleys, lanes, ways or
waterways.
(c) "mortgage": mortgage, deed of trust, trust deed, or
other security instrument.
(d) "public records": records established under state
statutes at Date of Guarantee for the purpose of
imparting constructive notice of matters relating to real
property to purchasers for value and without knowledge.
(e) "date": the effective date.
2, Notice of Claim to be Given by Assured Claimant.
An Assured shall notify the Company promptly in writing in
case knowledge shall come to an Assured hereunder of any
claim of title or interest which is adverse to the title to the
estate or interest, as stated herein, and which might cause
loss or damage for which the Company may be liable by
virtue of this Guarantee. If prompt notice shall not be given
to the Company, then all liability of the Company shall
terminate with regard to the matter or matters for which
prompt notice is required; provided, however, that failure to
notify the Company shall in no case prejudice the rights of
any Assured unless the Company shall be prejudiced by the
failure and then only to the extent of the prejudice.
3. No Duty to Defend or Prosecute.
The Company shall have no duty to defend or prosecute any
action or proceeding to which the Assured is a party,
notwithstanding the nature of any allegation in such action or
proceeding.
4. Company's Option to Defend or Prosecute Actions; Duty of
Assured Claimant to Cooperate.
Even though the Company has no duty to defend or prosecute as
set forth in Paragraph 3 above:
(a) The Company shall have the right, at Its sole option and cost,
to institute and prosecute any action or proceeding, interpose
a defense, as limited in (b), or to do any other act which in its
opinion may be necessary or desirable to establish the title to
the estate or interest as stated herein, or to establish the lien
rights of the Assured, or to prevent or reduce loss ·or damage
to the Assured. The Company may take any appropriate action
under the terms of this Guarantee, whether or not it shall be
liable hereunder, and shall not thereby concede liability or
waive any provision of this Guarantee. If the Company shall
exercise its rights under this paragraph, it shall do so diligently.
(b) If the Company elects to exercise its options as stated in
Paragraph 4(a) the Company shall have the right to select
counsel of its choice (subject to the right of such Assured to
object for reasonable cause) to represent the Assured and shall
not be liable for and will not pay the fees of any other counsel,
nor will the Company pay any fees, costs or expenses incurred
by an Assured in the defense of those causes of action which
allege matters not covered by this Guarantee.
(c) Whenever the Company shall have brought an action or
interposed a defense as permitted by the provisions of this
Guarantee, the Company may pursue any litigation to final
determination by a court of competent jurisdiction and
expressly reserves the right, In its sole discretion, to appeal
from an adverse judgment or order.
(d) In all cases where this Guarantee permits the Company to
prosecute or provide for the defense of any action or
proceeding, an Assured shall secure to the Company the right
to so prosecute or provide for the defense of any action or
proceeding, and all appeals therein, and permit the Company
to use, at its option, the name of such Assured for this
purpose. Whenever requested by the Company, an Assured,
at the Company's expense, shall give the Company all

reasonable aid in any action or proceeding, securing
evidence, obtaining witnesses, prosecuting or defending
the action or lawful act which In the opinion of the
Company may be necessary or desirable to establish the
title to the estate or interest as stated herein, or to
establish the lien rights of the Assured. If the Company
is prejudiced by the failure of the Assured to furnish the
required cooperation, the Company's obligations to the
Assured under the Guarantee shall terminate.
5. Proof of Loss or Damage.
In addition to and after the notices required under Section 2
of these Conditions and Stipulations have been provided to
the Company, a proof of loss or damage signed and sworn to
by the Assured shall be furnished to the Company within
ninety (90) days after the Assured shall ascertain the facts
giving rise to the loss or damage. The proof of loss or
damage shall describe the matters covered by this Guarantee
which constitute the basis of loss or damage and shall state,
to the extent possible, the basis of calculating the amount of
the loss or damage. If the Company is prejudiced by the
failure of the f'Ssured to provide the required proof of loss or
damage, the Company's obligation to such assured under the
Guarantee shall terminate. In addition, the Assured may
reasonably be required to submit to examination under oath
by any authorized representative of the Company and shall
produce for examination, inspection and copying, at such
reasonable times and places as may be designated by any
authorized representative of the Company, all records, books,
ledgers, checks, correspondence and memoranda, whether
bearing a date before or after Date of Guarantee, which
reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the Company,
the Assured shall grant its permission, in writing, for any
authorized representative of the Company to examine, inspect
and copy all records, books, ledgers, checks, correspondence
and memoranda in the custody or control of a third party,
which reasonably pertain to the loss or damage. All
information designated as confidential by the Assured
provided to the Company pursuant to this Section shall not be
disclosed to others unless, in the reasonable judgment of the
Company, it is necessary in the administration of the claim.
Failure of the Assured to submit for examination under oath,
produce other reasonably requested information or grant
permission to secure reasonably necessary Information from
third parties as required in the above paragraph, unless
prohibited by law or governmental regulation, shall terminate
any liability of the Company under this Guarantee to the
Assured for that claim.
6. Options to Pay or Otherwise Settle Claims:
Termination of Liability.
In case of a claim under this Guarantee, the Company shall
have the following additional options:
(a) To Pay or Tender Payment of the Amount of Liability or
to Purchase the Indebtedness.
The Company shall have the opfion to pay or settle or
compromise for or in the name of the Assured any claim
which could result in loss to the Assured within the
coverage of this Guarantee, or to pay the full amount of
this Guarantee or, if this Guarantee is issued for the
benefit of a holder of a mortgage or a lienholder, the
Company shall have the option to purchase the
indebtedness secured by said mortgage or said lien for the
amount owing thereon, together with any costs, reasonable
attorneys' fees and expenses incurred by the Assured claimant
which were authorized by the Company up to the time of
purchase.
Such purchase, payment or tender of payment of the full
amount of the Guarantee shall terminate all liability of the
Company hereunder. In the event after notice of claim has
been given to the Company by the Assured the Company
offers to purchase said indebtedness, the owner of such
indebtedness shall transfer and assign said indebtedness,
together with any collateral security, to the Company upon
payment of the purchase price.
Upon the exercise by the Company of the option provided for
in Paragraph (a) the Company's obligation to the Assured
under this Guarantee for the claimed loss or damage, other
than to make the payment required in that paragraph, shall
terminate, including any obligation to continue the defense or
prosecution of any litigation for which the Company has
exercised its options under Paragraph 4, and the Guarantee
shall be surrendered to the Company for cancellation.
(b) To Pay or otherwise Settle With Parties other Than the
Assured or With the Assured Claimant.
To pay or otherwise settle with other parties for or in the name
of an Assured claimant any claim assured against under this
Guarantee, together with any costs, attorneys' fees and
expenses incurred by the Assured claimant which were
authorized by the Company up to the time of payment and
which the Company is obligated to pay. ·-· · ·
Upon the exercise by the Company of the option provided for
in Paragraph (b) the Company's obligation to the Assured
under this Guarantee for the claimed loss or damage, other
than to make the payment required in that paragraph, shall
terminate, including any obligation to continue the defense or
prosection of any litigation for which the Company has
exercised its options under Paragraph 4.
7. Determination and Extent of Liability.
This Guarantee Is a contract of Indemnity against actual monetary
loss or damage sustained or incurred by the Assured claimant who
has suffered loss or damage by reason of reliance upon the
assurances set forth in this Guarantee and only to the extent herein
described, and subject to the Exclusions From Coverage of This
Guarantee.
The liability of the Company under this Guarantee to the Assured
shall not exceed the least of:
(a) the amount of liability stated in Schedule A or in Part 2;
(b) the amount of the unpaid principal indebtedness secured by
the mortgage of an Assured mortgagee, as limited or provided
under Section 6 of these Conditions and Stipulations or as
reduced under Section 9 of these Conditions and Stipulations,
at the time the loss or damage assured against by this
Guarantee occurs, together with interest thereon; or
(c) the difference between the value of the estate or interest
covered hereby as stated herein and the value of the estate or
interest subject to any defect, lien or encumbrance assured
against by this Guarantee.
8, Limitation of Llabllity.
(a) If the Company establishes the title, or removes the alleged
defect, lien or encumbrance, or cures any other matter assured
against by this Guarantee in a reasonably diligent manner by

any method, including litigation and the completion of
any appeals therefrom, It shall have fully performed its
obligations with respect to that matter and shall not be
liable for any loss or damage caused thereby.
(b) In the event of any litigation by the Company or with the
Company's consent, the Company shall have no liability
for loss or damage until there has been a final
determination by a court of competent jurisdiction, and
disposition of all appeals therefrom, adverse to the title,
as stated herein. ·
(c) Toe Company shall not be liable for loss or damage to
any Assured for liability voluntarily assumed by the
Assured in settling any claim or suit without the prior
written consent of the Company.
9. Reduction of Liability or Termination of Liability.
All payments under this Guarantee, except payments made
for costs, attorneys' fees and expenses pursuant to Paragraph
4 shall reduce the amount of liability pro tanto.
10. Payment of Loss.
(a) No payment shall be made without producing this
Guarantee for endorsement of the payment unless the
Guarantee has been lost or destroyed, in which case
proof of loss or destruction shall be furnished to the
satisfaction of the Company.
(b) When liability and the extent of loss or damage has been
definitely fixed in accordance with these Conditions and
Stipulations, the loss or damage shall be payable within
thirty (30) days thereafter.
11. Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and paid a claim
under this Guarantee, all right of subrogation shall vest in the
Company unaffected by any act of the Assured claimant.
The Company shall be subrogated to and be entitled to all
rights and remedies which the Assured would have had
against any person or property in respect to the claim had
this Guarantee not been issued. If requested by the
Company, the Assured shall transfer to the Company all rights
and remedies against any person or property necessary in
order to perfect this right of subrogation. Toe Assured shall
permit the Company to sue, compromise or settle In the name
of the Assured and to use the name of the Assured in any
transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the
loss of the Assured the Company shall be subrogated to all
rights and remedies of the Assured after the Assured shall
have recovered its principal, interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the Company or the
Assured may demand arbitration pursuant to the Title Insurance
Arbitration Rules of the American Land Title Association. Arbitrable
matters may include, but are not limited to, any controversy or
claim between the Company and the Assured artsing out of or
relating to this Guarantee, any service of the Company In
connection with its issuance or the breach of a Guarantee provision
or other obligation. All arbitrable matters when the Amount of
Liability is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Assured. All arbitrable matters when the
amount of liability is in excess of $2,000,000 shall be arbitrated only
when agreed to by both the Company and the Assured. Toe Rules
in effect at Date of Guarantee shall be binding upon the parties.
The award may include attorneys' fees only if the laws of the state
in which the land is located permits a court to award attorneys' fees
to a prevailing party. Judgment upon the award rendered by the
Arbitrator(s) may be entered in any court having jurisdiction
thereof.
Toe law of the situs of the land shall apply to an arbitration under
the Title Insurance Arbitration Rules.
A copy of the Rules may be obtained from the Company upon
recuest.
13. Liability Limited to This Guarantee; Guarantee Entire
Contract.
(a) This Guarantee together with all endorsements, if any,
attached hereto by the Company is the entire Guarantee and
contract between the Assured and the Company. In
interpreting any provision of this Guarantee, this Guarantee
shall be construed as a whole.
(b) Any claim of loss or damage, whether or not based on
negligence, or any action asserting such claim, shall be
restricted to this Guarantee.
(c) No amendment of or endorsement to this Guarantee can be
made except by a writing endorsed hereon or attached hereto
signed by either the President, a Vice President, the Secretary,
an Assistant Secretary, or validating officer or authorized
signatory of the Company.
14. Notices, Where Sent.
All notices required to be given the Company and any statement In
writing required to be furnished the Company shall include the
number of this Guarantee and shall be addressed to the Company

final submittal. The type size used for the. land record number should be smaller than that used for the land use act)on number.
Make specific note that ties to the City's Survey control Network are pursuant to the underlying MShort Plar otherwise show said
ties on this subdivision.
The legal description is not complete as Lots 5 & 8 should include an equal and undivided interest in Tract 'A' of the under lying
"Short Plat." All of the lots at issue also include and equal and undivided interest is Tracts 'C' and 'E' which should be included in
the legal description as well. The reference to Parcel C as an easement is meaningless and uninterpretable.
The issue of the tracts begs the question regarding the signatories of the lot line adjustment as there are three other lot owners,
who are not a part of the lot line adjustment, with interests in the Tract 'C' and 'E'. These tracts should be shown on the lot line
adjustment but noted as not a part of the lot line adjustment; together with a note to the effect that the lot line adjustment does not
change the ownership interests in said tracts held by the other lots that not a part of the LLA
There is an easement to Soos Creek Water and Sewer District over Tract 'A' under King County Rec. No. 20080630001458 that is
not shown or mentioned on the lot line adjustment.
The underlying short plat also grants Puget Sound Energy a 5' easement adjoining all "private drives" which also includes Tract 'A'
which is not shown on the Lu\.
The lot addresses will be provided by the city as soon as possible. Note said addresses on the drawing.
Change the title of the declaration block on the drawing to "OWNERS' DECLARATION".

1. The fire impact fees are applicable at the rate of $479.28 per single family unit. This fee is paid at time of building pennit
issuance. Credit would be granted for the one existing home to be removed.
Code Related Comments:
1. The fire flow requirement for a single family home is 1,000 gpm minimum for dwellings up to 3,600 square feet (including
garage and basements). If the dwelling exceeds 3,600 square feet, a minimum of 1,500 gpm fire flow would be required. A
minimum of one fire hydrant is required within 300-feet of the proposed buildings and two hydrants if the fire flow goes up to
1,500 gpm. There are two existing hydrants within 300-feet of the proposed plat and these hydrants are up to current code. A

Lund Lot Line Adjustment
The project is located in south Renton which includes 5 parcels with
addresses of 16216, 16217, 16221, 16227, 16223 -1141h Avenue SE
Renton, WA 98055
HCH Lund LLC is requesting the lot line adjustments so that there are 5 -
-50 foot wide lots instead of the present smaller lots that are coming
off of a private driveway. With the new configuration all of the lots will
have frontage on city streets.
The new configuration is able to take place as the house that was on
the present lot 2 with the address of 16217-1141
h AVE SE was
demolished. Also the private tract will no longer be in existence after
the lot line adjustment takes place. All other lots are vacant and now all
5 lots have no structures on them.
There is no need for any change in the storm pond and there will
actually be less impervious surface when finished.
There are no steep slopes or wetlands on the property.
There are no requests for any code modifications.

1. The fire flow requirement for a single family home is 1,000 gpm
minimum for dwellings up to 3,600 square feet (including garage and
basements). If the dwelling exceeds 3,600 square feet, a minimum of
1,500 gpm fire flow would be required. A minimum of one fire hydrant
is required within 300-feet of the proposed buildings and two hydrants
if the fire flow goes up to 1,500 gpm. There are two existing hydrants
within 300-feet of the proposed plat and these hydrants are up to
current code. A water availability certificate is required from Soos Creek
Water and Sewer District.
2. The fire impact fees are applicable at the rate of $479.28 per single
family unit. This fee is paid at time of building permit issuance. Credit
would be granted for the one existing home to be removed.

I have completed a preliminary review for the above-referenced proposal. The following comments are
based on the pre-application submittal made to the City of Renton by the applicant.
Water
Water Service provider will be Soos Creek Water and Sewer District. A water availability certificate will
be required to be submitted to the City.
Sanitary Sewer
Sewer Service will be provided by Soos Creek Water and Sewer District. A sewer availability certificate
will be required to be submitted to the City.
Storm Drainage
1. There are drainage improvements fronting the site in 114'h Ave SE.
2. A drainage plan and drainage report will be required with the site plan application. The report shall
comply with the 2009 King County Surface Water Manual and the 2009 City of Renton Amendments to
the KCSWM, Chapters 1 and 2. All core and any special requirements shall be contained in the report.
Based on the City's flow control map, this site falls within the Flow Control Duration Standard, Forested
Conditions. The drainage report will need to follow the area specific flow control requirements under
Core Requirement #3.
3. A geotechnical report for the site is required. Information on the water table and soil permeability,
withTecommendations of appropriate flow control BMP options with typical designs for the site from
the geotechnical engineer, shall be submitted with the application.

4. Surface Water System Development fee is $1,012 new per lot. This is payable prior to issuance of the
construction permit. Credit is given for the existing home.
5. A Construction Stormwater Permit from Department of Ecology is required if clearing and grading of
the site exceeds one acre.
Transportation/Street
1. Existing right-of-way width in 114th Ave SE is 60 feet. This street has been identified as a residential
access street. To meet the City's new complete street standards, street improvements including 26 feet
of paving, curb and gutter, 8-foot planter strip, 5-foot sidewalk, and storm drainage improvements are
required to be constructed in the right-of-way fronting the site per City code 4-6-060. However, since
street improvements, including rolled curb, sidewalk and drainage, were constructed under the original
Lund Short Plat in King County in 2007, the applicant is encouraged to request a modification requesting
a waiver of the City's complete street standards, allowing the existing street improvement to remain.
2. Current traffic mitigation fees are $717.75 per new single-family lcit. Credit will be given to the
existing home. These fees are payable prior to recording of the plat. A fee increase is anticipated in
2014.
3. Street lighting is not required.
General Comments
1. All construction utility permits for drainage and street improvements will require separate plan
submittals. All utility plans shall conform to the Renton Drafting Standards. Plans shall be prepared by a
licensed Civil Engineer.
2. When the utility plans are complete, please submit three (3) copies of the drawings, two (2) copies of
the drainage report, permit application, an itemized cost of construction estimate, and· application fee at
the counter on the sixth floor.
3. All water, sewer, and storm BMPs are required to be provide to each new lot prior to recording of the
short plat.

General: We have completed a preliminary review of the pre-application for the above-
referenced development proposal. The following comments on development and permitting
issues are based on the pre-application submittals made to the City of Renton by the applicant
and the codes in effect on the date of review. The applicant is cautioned that information
contained in this summary may be subject to modification and/or concurrence by official
decision-makers (e.g., Hearing Examiner, Community & Economic Development Administrator,
Public Works Administrator, Planning Director, Development Services Director, and City
Council). Review comments may also need to be revised based on site planning and other
design changes required by City staff or made by the applicant. The applicant is encouraged to
review all applicable sections of the Renton Municipal Code. The Development Regulations are
available for purchase for $SO.OD plus tax, from the Finance Division on the first floor of City Hall
or online at www.rentonwa.gov
Project Proposal: The subject property is located on the west side of 1141h Ave SE just south of
SE 162"' St at 16217 1141h Ave SE. The proposal is to adjust the lots lines between S existing
parcels and one tract (Tract A) in order to absolve Tract A and create uniform lots. The lots were
recorded as part of the Lund Short Plat (L04S0037) recorded on September 19, 2007.
Additionally the applicant is requesting to subdivide proposed Lot 5 ·into two lots. The subject
property totals 40,531 square feet in area, and is zoned Residential-8 dwelling units per net acre
(R-8). Access to the site would be gained via proposed driveways from 1141h Ave SE and SE 162"'
St. There appear to_be sensitive slopes located on site.
Current Use: The site is currently contains a single family residence proposed for demolition.
Zoning/Density Requirements: The subject property is located within the R-8 zoning
designation. The density range allowed in the R-8 zone is a minimum of 4.0 to a maximum of
8.0 dwelling units per acre (du/ac). The area located within the proposed access easement
would be deducted from the gross site area to determine the "net" site area prior to calculating
density. With a 40,531 square foot site area, the proposal would arrive at a gross density of 6.45
dwelling units per acre (6 units/ 0.93 acre = 6.45 du/ac) which is within the density range of the
zoning classification. The applicant would be required to demonstrate compliance with the net
density requirements of the zone at the time of formal application.
Legal Requirements: The applicant has purchased Lots 1, 2, 3, 5 and 8 of the Lund Short Plat
(L04S0037). While the applicant is able to reconfigure the five lots through a lot line
adjustment the subdivision would not be possible unless there is consent from all existing

property owners in the Lund Short Plat (L04S0037). The applicant is unable to change the 1/s"'
interest by lots 4, 6 and 7 to a 1/9th interest without their consent. The removal of Tract A is
possible because Lots 5 and 8 ore the only lots who have an interest in the Tract and ore both
owned by the applicant and part of the LLA.
Development Standards: The project would be subject to .RMC 4-2-llOA, "Development
Standards for Single Family Zoning Designations" effective at the time of complete application
(noted as "R-8 standards" herein).
Minimum Lot Size. Width and Depth -The minimum lot size permitted in the R-8 is 4,500 square
feet for parcels greater than 1 acre in size and 5,000 square feet for Jots 1 acre or less in size.
The total lot area of the subject site is less than 1 acre; therefore a minimum lot size of 5,000
square feet is applicable to the proposed project. A minimum lot width of SO feet for interior
Jots and 60 feet for corner lots, as well as a minimum lot depth of 65 feet, is also required. The
proposal appears to comply with the lot standards of the zone.
Building Standards -R-8 zone allows a maximum building coverage of 35% of the Jot area or
2,500 square feet, whichever is greater for lots over 5,000 square feet in size. BuHding height is
restricted to 30 feet from existing grade. Detached accessory structures must remain below a
height of 15 feet. The gross floor area must be Jess than that of the primary structure.
Accessory structures are also included in building lot coverage calculations. The proposal's
compliance with the building standards would be verified at the time of building permit review
for the new residences to be located on all lots.
Setbacks-Setbacks are the minimum required distance between the building footprint and the
property line and any private access easement. The required setbacks in the R-8 zone are 15
feet in front for the primary structure and 20 feet in front for the attached garage, 20 feet in the
rear, 5 feet on interior side yards, and _15 feet on side yards along streets (including access
easements) for the primary structure and 20 feet on side yards along streets (including access
easements) for the attached garage. The setbacks for the new residences would be reviewed at
the time of building permit. Proposed lots 5 and 6 would be required to be oriented to SE
16:l!'•_ St. As a result front yard setbacks would also be assessed from SE 16:l!'d St.
Building Design Standards -All single family residences would be subject to the Residential
Design Standards outlined in RMC 4-2-115. The proposal's compliance with the residential
design standards · would be verified at the time of building permit review for the new
residences to be located on all lots. Please take not of the fa/lawing standards
One of the following is required:
• Lot width variation of 10 feet (10') minimum of one per four (4) abutting street-fronting
lots, or
• Minimum of four (4) Jot sizes (minimum of four hundred _(400) gross square feet size
difference) for at least every four (4) ab~tting street fronting Jots, or
• A front yard setback variation of at least five feet (S') minimum for at least every four (4)
abutting street fronting lots.
Access/Parking: Access to the proposed Jots would be provided via private driveways extended
from 114th Ave SE and SE 162"' St.

Alley: Alley access is the preferred access pattern. The proposal would be required to be
revised in order to include alley access or the applicant would be required to demonstrate why
alleys are not possible.
Each lot is requi;ed to accommodate off street parking for a minimum of two vehicles
Driveways: The maximum driveway slopes cannot exceed 15%, provided that driveways
exceeding 8% are to provide. slotted drains at the lower end of the driveway. If the grade ·
exceeds 15%, a variance is required.
Landscaping -Except for critical areas, all portions of the development area not covered by
structures, required parking, access, circulation or service areas, must be landscaped with
native, drought-resistant vegetative cover. The development standards require that all pervious
areas within the property boundaries be landscaped. The minimum on-site landscape width
required along street frontages is 10 feet.
Please refer to landscape regulations (RMC 4-4-070) for further general and specific landscape
requirements (enclosed). A conceptual landscape plan shall be submitted at the time of Short
Plat application.
Significant Tree Retention: If significant trees (greater than 6-inch caliper) are proposed to be
removed a tree inventory and a tree retention plan along with a tree retention worksheet shall
be provided with the formal land use application. The tree retention plan must show
preservation of at least 30 percent of significant trees, and indicate how proposed building
footprints would be sited to accommodate preservation of significant trees that would be
retained. If the trees cannot be retained, they may be replaced with minimum 2 inch caliper
trees at a ratio of six to one.
Critical Areas: There appear to be no critical areas on site however the site contains sensitive
slopes and the applicant would be required to provide a Geotechnical Report at the time of
short plat application. It is the applicant's responsibility to ascertain whether additional critical
areas are present on the site. If so, the proposal would need to be revised accordingly.
Environmental Review Subdivision of land into nine or fewer lots or tracts is exempt from
Washington State Environmental Policy Act {SEPA) review, unless critical areas are known to be
on or near the site. The proposal would be exempt from Environmental Review per WAC 197-
11-800.
Permit Requirements:
The proposed would require a Lot Line Adjustment and an Administrative Short Plat Approval.
All land use permits would be processed within an estimated time frame of 6-8 weeks. The
Short Plat Review application fee is $1,400 and the Lot Line Adjustment application fee is $450.
A 3% technology fee would also be assessed at the time of land use application. Detailed
information regarding the land use application submittal is provided in the attached handouts.
Fees: In In addition to the applicable building and construction fees, the following impact fees
would be required prior to the issuance of building permits:
• A Fire Mitigation fee of $479.28 per new single family residence; and

ASSESSMENT
This project site is located west of 1141h Avenue SE and south of SE 162"d Street. The
proposal is to adjust the lot lines between 5 existing parcels and one tract (Tract A) in order to
dissolve Tract A and create 5 uniform lots. The property is zoned R-8.
The project will not increase the lot count or impervious surface coverage of the site, and in fact
will slightly decrease the imperviousness, due to the removal of Tract A, which is almost entirely
paved. The existing topography includes a drainage divide that can be maintained with the new
lot layout proposed by this BLA. A drainage plan is included as Sheet 3.1, showing a revised
storm drainage layout to maintain this existing condition. Therefore, since the project does not
alter the existing plan for runoff, the existing detention will be more than sufficient.
The attached BLA Documents show the proposed lot line revisions and the final lot
configuration for this BLA. The attached Engineering Evaluation Sheets show the topographic
information for the site, the proposed water and sewer utilities (Generalized Utilities), and the
proposed drainage plan.
There are no critical areas in the BLA portion of the site; however, the north portion of the site
contains slopes that approach 40%; however, they are not more than 10 feet tall, so they are
not expected to significantly impact future development.
