DESCRIPTION: The applicant is requesting a Tier 2 Temporary Use Permit to
retain two existing Single-family residences on parcel number
3343901403 until such time as the construction of a new residence
is completed on Lot 1 of the Stewart Short Plat (LUA08-099,
SHPL-A). The residential dwelling unit located closest to the
southern property line on Lot 2 would then be demolished when
the new residence is constructed. The subject property is within
the Residential - 8 dwelling unit per acre (R-8) zone which allows
only one detached single-family home per lot. The Stewart Short
Plat is currently being processed to determine its adequacy for
recording.
Analysis: A temporary use permit (LUA08-115, TP) was issued for
this use on November 14, 2008; subsequently, that temporary use
permit expired on November 14,2010. The Stewart Short Plat
(LUA08-099, SHPL-A) is currently being processed for recording.
The applicant would like to continue the use on the subject
property until such time as a house is constructed on Lot 1.
Two single-family residences currently exist on one single-family
lot on the subject property. This condition would not change if the
temporary use permit request is approved. However, when a
house is constructed on Proposed Lot 1, one of the houses on
Proposed Lot 2 would be removed and consistency with the R-8
zone would be achieved.

Staff believes that it is reasonable to grant this temporary use
permit for a period of two years. Such time frame would give the
applicant or his successor in interest two construction seasons to
construct a new house on Proposed Lot lor adequate time to
apply for a Conditional Use Permit for an accessory dwelling unit
for the southerly residence on Lot 2. The only other option to
retain the additional house would require that a conditional use is
obtained/granted for an accessory dwelling unit.
Staff supports the applicant's request with two conditions: that
two single-family residences are allowed to remain on Lot 2 of the
Stewart Short Plat during the term of this temporary use permit;
and that the temporary use permit expires two years from the date
of issuance (September 21, 2015), or at such time as a building
permit has been issued for construction of a new single-family
house on Lot 1 ofthe Stewart Short Plat (LUA08-099, SHPL-A), or at
such time as a Conditional Use Permit for an accessory dwelling
unit on lot 2 has been applied for and approved, whichever comes
first.
The Temporary Use Permit is hereby Approved with Conditions * and subject to the following
conditions.
*CONDITIONS OF APPROVAL:
1. Two single-family residences are allowed to remain on Lot 2 of the Stewart Short Plat
(LUA08-099, SHPL-A) during the term of this temporary use permit.
2. This temporary use permit shall expire two years from the date of issuance (September
21,2015)' or at such time as a building permit has been issued for construction of a new
single-family house on Lot 1 of the Stewart Short Plat (LUA08-099, SHPL-A), or at such time
as a Conditional Use Permit for an accessory dwelling unit on Lot 2 has been applied for and
approved, whichever comes first.

RECONSIDERATION; Within 14 days ofthe decision date, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not redily discoverable prior to the original decision is found or if he finds
there was misrepresentation or fact. After review of the Reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no
furtherextension of the appeal period. Any person wishing to take further action must file a
formal appeal within the 14-day appeal time frame.
APPEALS; Appeals of the permt issuance must be filed in writing on or before 5:00 p.m. on
October 03, 2013. Appeals must be filed in writing together with the required fee with
Hearing Examiner c/o City Clerk, City of Renton, 1055 S Grady Wy, Renton, WA, 98057.
Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-110.
Additional information regarding the appeal process may be obtained from the Renton City
Clerk's Office, 425-430-6510.
EXPIRATION; A Temporary Use Permit is valid for up to one year from the effective date of
the permit, unless the Community & Economic Development Administrator or designee
establishes a shorter time frame or an applicant can request that a permit be valid beyond
the one year expiration, for up to five years at the time of application or prior to permit
expiration.
EXTENSIONS; Extension requests do not require additional fees and shall be requested in
writing prior to permit expiration to the Department of Community & Economic Development
Administrator.

Dear Development Services Staff:
This letter outlines the application for the Stewart Temporary Use Permit at 2125 & 2129
NE 28th ST. Renton W A. The proposal is to allow use of an existing residence on one lot
pending construction of a new house on the newly platted lot # I in the Stewart Short Plat.
A temporary permit was granted in 2008 but has expired at this time, however the short
plat has not expired and the final has been submitted for recording. The temporary permit
was to allow two residences on one of the lots until a house was constructed on the other.
The idea was to keep the two houses for up to two years after the short plat was recorded.
Since the temporary permit has expired the owner has no time to use the temporary
permit and build the new house while keeping the second unit.
The current zoning of the site and surrounding area is R-8. An Abatement Agreement is
attached.
The existing parcel is 15,180 square feet in size. One additional lot will be created with
the short plat. The lots will be more than the minimum of 5000 square feet. The proposed
density is 5.7 units per acre. (See density worksheet with short plat submittal). The
property fronts on NW 28th ST. Access for lots I and 2 will be off ofNE 28th ST. There
are no curbs, gutters and sidewalks on NE 28th ST abuttinl this parcel. An 8" water main
is located in NE 28 th ST. Fire hydrants are located NE 28 ST within 300 feet of the lots
1 and 2. A new water service will need to be installed for lot 2. An 8" sewer main is
located in NE 28th ST. and will to serve the plat. Storm water from the driveway paving
and roofs of the new houses will be infiltrated on site. (See drainage plan with short plat
submittal).
