Renton School District is requesting a Critical Areas Exemption for renovation of
the Lindbergh High School Pool Building, located at 16426 128th Ave SE, as part
of building permit number B14003817. The area to the south of the existing
building contains a small identified Category 3 wetland described in the
Wetland Delineation and Fish and Wildlife Habitat Report as a "Palustrine
emergent, seasonally flooded system" with "low biologic functions due to its
size, seasonal shallow water, and a single plant community." The wetland is
approximately 9,000 square feet and located south of the pool building and has
a portion of a brick wall and catch basins within the wetland. The wetland
extends off to the south. Per Renton Municipal Code, Section 4-3-050M6c, the
Category 3 wetland has a standard buffer zone width of 25 feet. The project
consists of a gut and remodel of interior areas of the existing Lindbergh Pool
Building to improve the functionality and accessibility of these spaces. The
project includes several structural upgrades, and all new mechanical, electrical
and communication systems to greatly improve functionality, safety, and
efficiency. Exterior improvements include siding replacement on the south face
of the building, a completely new roof assembly and cleaning, repairing and

Category 3 Wetland
EXEMPTION JUSTIFICATION: 4-3-050.C.5.g. Maintenance and Construction -Existing Uses and Facilities:
i. Remodeling, Replacing, Removing Existing Structures, Facilities, and Improvements: Remodeling, restoring,
replacing or removing structures, facilities and other improvements in existence on the date this section
becomes effective and that do not meet the setback or buffer requirements ofthis section provided the work
complies with the criteria in RMC 4-10-090.
FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section
4-3-050C. 5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or
regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles if submitted plans are followed and the conditions
of approval ofthis exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are
followed and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance
with this exemption, the site will be re-vegetated with native vegetation as required as a condition of
approval for this exemption.
DECISION: An exemption from the Critical Areas Regulations is hereby Approved with Conditions*.
CONDITIONS:
1. Any native vegetation, located outside the work/access area, that is damaged or disturbed during
maintenance activities shall be restored and/or replanted immediately following the pool building
renovation.

APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA

98057, on or before 5:00 p.m., ft'l September 08, 2014. RMC 4-8-110 "overns appeals to the Hearing
Examiner and additional inforr on regarding the appeal process ma1 obtained from the Renton City
Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

We are requesting that the City approve a Critical Areas Exemption pursuant to RMC 4-3-
050C5gL
Project Description:
In general the projects consists of a gut and remodel of interior areas of the existing
Lindbergh Pool Building to improve the functionality and accessibility of these spaces. The
project includes several structural upgrades, and all new mechanical, electrical and
communication systems to greatly improve functionality, safety, and efficiency.
Exterior improvements include siding replacement on the south face of the building, a
completely new roof assembly and cleaning, repairing and adding a protective coating to
existing the masonry walls. Also included are some minor site improvements for an improved
accessible route to the main entry, a new natatorium mechanical unit and a new fire water
line to support a new fire sprinkler system. All site improvements combined total less than
1,620 SF and are all located outside of Critical Area Buffers and will not adversely impact
existing critical areas.
The exterior wood siding on the building's south wall is at the end of its life and the condition
is such that it cannot be repaired. New insulation will be installed along with a new air/water
barrier and metal siding. The condition of the existing exterior masonry is in pretty good
condition with a few areas needing repair. The brick will be cleaned and an anti-graffiti
coating will be provided. A few areas need minor repair and salvaged bricks shall be used in
the repair.
Critical Area Exemption:
The area to the south of the existing building contains a small identified Category 3 wetland
described as a "Palustrine emergent, seasonally flooded system" with low biologic function
and a single plant community. The wetland is located south of the pool building and has a
portion of a brick wall and catch basins within the wetland. The wetland extends off to the
south. This Wetland is identified as 'Wetland A' in the attached Wetland Report and can be

found on pages 4-5, Appendix C-Survey and Appendix D-Plant Indicator Data Forms. The
City of Renton Municipal Code 4-3-050 requires a buffer for this wetland that effectively
limited the available locations for the new Air Handling Unit. Per RMC 4-3-050M6c, a
Category 3 standard buffer shall be 25 feet. This new Air Handling Unit will be located as far
as practical outside of the buffer area approximately 75 feet away from the identified wetland
boundary.
The only activities taking place within the buffer are exempt activities consisting of
remodeling and repairs to the existing building in accordance with RMC 4-3-050C5gi which
exempts Maintenance and Construction on Existing Uses and Facilities:
Remodeling, Replacing, Removing Existing Structures, Facilities, and
Improvements: Remodeling, restoring, replacing or removing structures,
facilities and other improvements in existence on the date this section
becomes effective and that do not meet the setback or buffer requirements of
this section provided the work complies with the criteria in RMC 4-10-090
(legally nonconforming structure).
The remodeling and repairs to the existing facilities within this area consists of Siding
replacement and minor masonry restoration/repairs.
As required, during the repair and remodeling of this structure, best management practices
will be utilized to avoid potential impact to critical areas. For Masonry Cleaning Activities, all
landscape plants and soils will be protected from contact of any cleaning solutions. Any
grass damaged during the work will be replanted. Please refer to attached existing
photograph showing the south wall cladded with wood siding that is to receive new metal
siding and the south 4' high brick wall that will receive minor masonry restoration/repairs.
We request a Critical Areas Exemption given that the work taking place is either outside the
buffer area or allowable and exempt within the buffer/wetland area. Please respond with any
questions and/or comments in regards to our exemption request.

The exterior wood siding on the building's south wall is at the end of its life and the condition
is such that it cannot be repaired. New insulation will be installed along with a new air/water
barrier and metal siding. The condition of the existing exterior masonry is in pretty good
condition with a few areas needing repair. The brick will be cleaned and an anti-graffiti
coating will be provided. A few areas need minor repair and salvaged bricks shall be used in
the repair.
Critical Area Exemption:
The area to the south of the existing building contains a small identified Category 3 wetland
described as a "Palustrine emergent, seasonally flooded system" with low biologic function
and a single plant community. The wetland is located south of the pool building and has a
portion of a brick wall and catch basins within the wetland. The wetland extends off to the
south. This Wetland is identified as 'Wetland A' in the attached Wetland Report and can be

found on pages 4-5, Appendix C-Survey and Appendix D-Plant Indicator Data Forms. The
City of Renton Municipal Code 4-3-050 requires a buffer for this wetland that effectively
limited the available locations for the new Air Handling Unit. Per RMC 4-3-050M6c, a
Category 3 standard buffer shall be 25 feet. This new Air Handling Unit will be located as far
as practical outside of the buffer area approximately 75 feet away from the identified wetland
boundary.
The only activities taking place within the buffer are exempt activities consisting of
remodeling and repairs to the existing building in accordance with RMC 4-3-050C5gi which
exempts Maintenance and Construction on EXisting Uses and Facilities:
Remodeling, Replacing, Removing Existing Structures, Facilities, and
Improvements: Remodeling, restoring, replacing or removing structures,
facilities and other improvements in existence on the date this section
becomes effective and that do not meet the setback or buffer requirements of
this section provided the work complies with the criteria in RMC 4-10-090
(legally nonconforming structure).
The remodeling and repairs to the existing facilities within this area consists of siding
replacement and minor masonry restoration/repairs.
As required, during the repair and remodeling of this structure, best management practices
will be utilized to avoid potential impact to critical areas. For Masonry Cleaning Activities, all
landscape plants and soils will be protected from contact of any cleaning solutions. Any
grass damaged during the work will be replanted. Please refer to attached existing
photograph showing the south wall cladded with wood siding that is to receive new metal
siding and the south 4' high brick wall that will receive minor masonry restoration/repairs.
We request a Critical Areas Exemption given that the work taking place is either outside the
buffer area or allowable and exempt within the buffer/wetland area. Please respond with any

PURPOSE: To allow certain activities to intrude into a critical area or required buffer subject to the City
providing a letter of exemption of any listed conditions or requirements.
FREE CONSULTATION MEETING: Prior to submitting an application, the applicant should informally
discuss the proposed development with the Planning Division. The Planning Division will provide
assistance and detailed information on the City's requirements and standards. Applicants may also take
this opportunity to request the waiver of the City's typical application submittal requirements, which
may not be applicable to the specific proposal. For further information on this meeting, see the

COMPLETE APPLICATION REQUIRED: In order to accept your application, each of the numbered items
must be submitted at the same time. If you have received a prior written waiver of a submittal item(s)
during a pre-application meeting, please provide the waiver form in lieu of any submittal item not
provided. All plans and attachments must be folded to a size not exceeding gy; by 11 inches.

property's lot lines, lot lines of surrounding properties, boundaries of the City of Renton (if
applicable), north arrow (oriented to the top of the plan sheet), graphic scale used for the
