The Bohemian knotweed stands are typically 10 to 15 feet in depth. The knotweed will be removed using a commercial sprayer (Imazapyr) by the contractor, Applied Ecology. This is one of the same contractors and herbicide used by the City in May Creek Trails Park. The applicant is also requesting to remove other (secondary) invasive vegetation, including morning glory, blackberry, buttercup, horsetail, and miscellaneous weeds, such as dandelion, herb-Robert, and bitter cress, etc. The applicant proposes to remove the other invasive species using hand tools and continued quarterly high mowing by Barbee Mill's landscape contractor; however, city staff does not agree that mowing is an appropriate method of controlling the invasives and recommends a condition of approval that no mowing shall be used to control invasives, only hand grubbing and commercial herbicide spray. The proposed vegetation removal is within the 100 foot shoreline buffer for May Creek. The Bohemian knotweed resides on the banks of May Creek. All four forms of knotweed are known to cause erosion of stream and river banks. The applicant is not proposing any vegetation removal at or below the ordinary high water mark. Any disturbances of soil below the ordinary high water mark will be strictly avoided. The applicant proposes to begin work immediately following permit approval. As proposed, the vegetation removal would be accomplished in three phases. The first phase would involve spraying the knotweed with the commercial sprayer. This would take approximately 1 to 2 days. The third phase would involve trimming blackberry to the ground during the next 12 months. The applicant proposes year-to-year maintenance for the next seven years in order to assure destruction and decay of established knotweed stands. In the second and third year, knotweed will be mitigated by a second or third application of Imazapyr for stands greater than 50 stems. Stands fewer than 50 stems shall be controlled through injection of a 4-6% solution of Glyphosate. The applicant has been trained and certified by King County in Glyphosate application. Knotweed roots below ground will be left to decay. Following the first and/or second year of knotweed control, Barbee Mill will begin to address the secondary invasives. The applicant's proposal specifically excludes digging or disturbing the root structure of knotweed. Removal of the secondary invasives may involve minor soil disturbance due to shallow digging with hand tools to remove the roots of morning glory, blackberry, buttercup, horsetail, and others. Following decomposition of the knotweed, the applicant proposes to replant with strawberry, salal and nootka rose. Wheelbarrows, dumpsters, and towed trailers will be used to haul away the major refuse. Minor refuse will be placed in residents' trash bins or recycle bins as appropriate. NW32-24-5 Tracts "A", "B", and "I", as shown on Plat of Barbee Mill as recorded in King County Plats under recording number 20080208000182 May Creek An exemption from a Shoreline Management Substantial Development Permit is hereby Approved with Conditions' on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the following reasons: Renton Municipal Code, Section 4.9.190C.13: Removal or Control of Aquatic Noxious Weeds: The process of removing or controlling an aquatic noxious weed, as defined in RCW 17.26.020, through the use of a herbicide or other treatment methods applicable to weed control that are recommended by a final environmental impact statement published by the Department of Agriculture or the Department of Ecology jointly with other State agencies under chapter 43.21C RCW. The proposed development is: Consistent with the policies of the Shoreline Management Act. Consistent with the guidelines of the Department of Ecology where no Master Program has been finally approved or adopted by the Department. Attachments: Vicinity/Neighborhood Detail Map, Site Plan Page 3 of 3 EXHIBIT 1 Barbee MiIIlnvasives Removal Shoreline Exemption Project Narrative September 6, 2015 Proposed Plants to be removed Primary objective is to remove approximately 500 linear feet of the Class B invasive, Bohemian Knotweed. Stands are typically 10 to 15 feet in depth. Secondary objective is to obtain approval to remove other invasives: particularly morning glory, blackberry, buttercup, horsetail and miscellaneous weeds, such as dandelion, herb-Robert, bitter cress, et cetera. Removal methods are described below. Location of removal in detail See attached charts. All measurements are approximate and subject to change as plants migrate. Equipment Used to Remove The initial equipment used on knotweed will be a commercial sprayer by the contractor, Applied Ecology. This is one of the same contractors and herbicide used by the City in May Creek Trails Park, directly adjacent to the Barbee Mill community. The spray itself will be Imazapyr, or other herbicide as directed by the City of Renton. The equipment used to mitigate the secondary invasives will be hand tools and the continued quarterly high mowing by Barbee's landscape contractor. With the City's permission and direction, a commercial spray may be employed on the deeper thickets of these secondary invasives. We must emphasize, our primary and immediate objective is removal of Bohemian Knotweed. Wheelbarrows, dumpsters, and towed trailers will be used to haul away the major refuse. Minor refuse will be placed in residents' trash bins or recycle bins, as appropriate. Stream and Approximate Setbacks As we understand it the intent of Washington State's Forests and Fish Law is: to protect "Trees and vegetation along streams providing critical shade and habitat for Washington's fish and wildlife." (taken from Washington Forests Protection Association) We trust that we all share this intent in common. The shoreline buffer for May Creek is 100 feet. The proposed invasive vegetation removal will be located within the shoreline buffer. Regarding the existing setback, our Bohemian Knotweed resides on the banks of May Creek. All four forms of Knotweed are known to cause erosion of stream and river banks, which is a significant reason why we are seeking to carefully remove it. It is our plan to refrain from any mitigation efforts at or below May Creek's ordinary high water mark. Time Frame for Initial Work The initial work has three phases. The first two will focus on the primary objective, Knotweed. The timing of the first phase is critical: that knotweed be sprayed prior ta entering into dormancy, currently estimated as no later than the end of September 2015. The contractor will require 1 to 2 days to perform the initial spraying. The second phase will comprise cleaning up the downed Knotweed, after the above ground stalks have fully died, currently estimated as late winter through early spring of 2016. No effort will be expended on Knotweed below ground level. As a third, minor phase, it is possible that some effort will be expended trimming blackberry to the ground during the next 12 months. Estimated Time Frame for year-to-year Maintenance Studies by organizations such as the Nature Conservancy have shown that three to seven years are required to assure destruction and decay of established knotweed stands. In the second and perhaps third year, knotweed will be mitigated by a second or third application of Imazapyr, if necessary. "If necessary" applies to stands greater than 50 stems. If stands of 50 or fewer stems remain, and are accessible, they will be controlled through injection of a 4-6% solution of Glyphosate. The preparer of this narrative has been trained and certified by King County in Glyphosate application. Removal of roots/rhizomes is both very difficult and unwise, as they extend to 7 feet vertically and up to 23 feet horizontally from the stem. Once sprayed and the Imazapyr migrates to the roots/rhizomes, thereby killing the entire plant, what is below ground is best left to decay in situ. As I understand it, that would be at least two years, likely longer. It is both impractical and inappropriate to consider replacement plantings until the Knotweed rhizomes have decayed. Following the first and/or second year of Knotweed control, and as budget and manpower are available, Barbee will begin to address the above noted secondary invasives. Proposed Measures to Prevent Erosion Our plan specifically excludes digging or disturbing the root structure of Knotweed. It is also important to note that we plan to avoid disturbing any soil below the ordinary high water mark on May Creek. Eventual implementation of the removal of secondary invasives may involve minor soil disturbance due to shallow digging with hand tools to remove the roots of morning glory, blackberry, buttercup, horsetail and others. This portion of the project has not yet been addressed by the Barbee Mill HOA; we are simply seeking permission to add secondary invasives to the primary project: removing knotweed. In that capacity, we again will avoid disturbing below the ordinary high water mark. New Plantings The area between our Barbee homes and May Creek had been planted by the builder, Connor Homes, in accordance with plans established at the time of construction. Those plants included natives Nootka rose, ground strawberry, salal, and trees such as red and yellow twig dogwood and vine maple. It is our plan, follOWing decomposition ofthe Knotweed, to replant primarily with strawberry, salal and occasional Nootka rose. Plenty of native trees abound along the border of May Creek; in our estimation, no further trees need to be added. Other Matters In order to protect our own expenditures of effort and funding, the City is respectfully requested to assure Barbee that no City obligations of stewardship of the lands addressed herein are being abrogated or otherwise reassigned to the Barbee Mill HOA. In a similar vein, the City is also respectfully requested to advise of any funding from local, state or federal programs that may be made available to assist us in this program. Stands are typically 10 to 15 feet in depth. Secondary objective is to obtain approval to remove other invasives: particularly morning glory, blackberry, buttercup, horsetail and miscellaneous weeds, such as dandelion, herb-Robert, bitter cress, et cetera. Removal methods are described below. Location of removal in detail See attached charts. All measurements are approximate and subject to change as plants migrate. Equipment Used to Remove The initial equipment used on knotweed will be a commercial sprayer by the contractor, Applied Ecology. This is one of the same contractors and herbicide used by the City in May Creek Trails Park, directly adjacent to the Barbee Mill community. The spray itself will be Imazapyr, or other herbicide as directed by the City of Renton. The equipment used to mitigate the secondary invasives will be hand tools and the continued quarterly high mowing by Barbee's landscape contractor. With the City's permission and direction, a commercial spray may be employed on the deeper thickets of these secondary invasives. We must emphasize, our primary and immediate objective is removal of Bohemian Knotweed. Wheelbarrows, dumpsters, and towed trailers will be used to haul away the major refuse. Minor refuse will be placed in residents' trash bins or recycle bins, as appropriate. Stream and Approximate Setbacks As we understand it the intent of Washington State's Forests and Fish Law is: to protect "Trees and vegetation along streams providing critical shade and habitat for Washington's fish and wildlife." (taken from Washington Forests Protection Association) We trust that we all share this intent in common. The shoreline buffer for May Creek is 100 feet. The proposed invasive vegetation removal will be located within the shoreline buffer. Regarding the existing setback, our Bohemian Knotweed resides on the banks of May Creek. All four forms of Knotweed are known to cause erosion of stream and river banks, which is a significant reason why we are seeking to carefully remove it. It is our plan to refrain from any mitigation efforts at or below May Creek's ordinary high water mark. Time frame for Initial Work The initial work has three phases. The first two will focus on the primary objective, Knotweed. The timing of the first phase is critical: that knotweed be sprayed prior to entering into dormancy, currently estimated as no later than the end of September 2015. The contractor will require 1 to 2 days to perform the initial spraying. The second phase will comprise cleaning up the downed Knotweed, after the above ground stalks have fully died, currently estimated as late winter through early spring of 2016. No effort will be expended on Knotweed below ground level. As a third, minor phase, it is possible that some effort will be expended trimming blackberry to the ground during the next 12 months. Estimated Time Frame for year-to-year Maintenance Studies by organizations such as the Nature Conservancy have shown that three to seven years are required to assure destruction and decay of established knotweed stands. In the second and perhaps third year, knotweed will be mitigated by a second or third application of Imazapyr, if necessary. "If necessary" applies to stands greater than SO stems. If stands of 50 or fewer stems remain, and are accessible, they will be controlled through injection of a 4-6% solution of Glyphosate. The pre parer of this narrative has been trained and certified by King County in Glyphosate application. Removal of roots/rhizomes is both very difficult and unwise, as they extend to 7 feet vertically and up to 23 feet horizontally from the stem. Once sprayed and the Imazapyr migrates to the roots/rhizomes, thereby killing the entire plant, what is below ground is best left to decay in situ. As I understand it, that would be at least two years, likely longer. It is both impractical and inappropriate to consider replacement plantings until the Knotweed rhizomes have decayed. Following the first and/or second year of Knotweed control, and as budget and manpower are available, Barbee will begin to address the above noted secondary invasives. Proposed Measures to Prevent Erosion Our plan specifically excludes digging or disturbing the root structure of Knotweed. It is also important to note that we plan to avoid disturbing any soil below the ordinary high water mark on May Creek. Eventual implementation of the removal of secondary invasives may involve minor soil disturbance due to shallow digging with hand tools to remove the roots of morning glory, blackberry, buttercup, horsetail and others. This portion of the project has not yet been addressed by the Barbee Mill HOA; we are simply seeking permission to add secondary invasives to the primary project: removing knotweed. In that capacity, we again will avoid disturbing below the ordinary high water mark. New Plantings The area between our Barbee homes and May Creek had been planted by the builder, Connor Homes, in accordance with plans established at the time of construction. Those plants included natives Nootka rose, ground strawberry, salal, and trees such as red and yellow twig dogwood and vine maple. It is our plan, following decomposition of the Knotweed, to replant primarily with strawberry, salal and occasional Nootka rose. Plenty of native trees abound along the border of May Creek; in our estimation, no further trees need to be added. Other Matters In order to protect our own expenditures of effort and funding, the City is respectfully requested to assure Barbee that no City obligations of stewardship of the lands addressed herein are being abrogated or otherwise reassigned to the Barbee Mill HOA. In a similar vein, the City is also respectfully requested to advise of any funding from local, state or federal programs that may be made available to assist us in this program.
