The applicant has requested a Critical Areas Exemption for the installation of
Comcast cable conduit within the existing improved right-of-way along the
northern portion of Jones Avenue NE and along NE 43rd Street to Lincoln Avenue
NE. The proposed conduit would pass through a stream buffer, wetland buffer,
and protected slope buffer. In addition, the conduit would be bored under an
existing Type F stream located in a culvert where it crosses NE 43rd Street. No
in-water work is proposed as all work is proposed within the existing improved
right-of-way.

EXEMPTION JUSTIFICATION: RMC 4-3-050C3.e.iii Utilities, Traffic Control, Walkways, Bikeways Within
Existing, Improved Right-of-Way or Easements. Within existing and improved public road rights-of-way or
easements, installation, construction, replacement, operation, overbuilding or alteration of all natural gas,
cable, communication, telephone and electric facilities, lines, pipes, mains, equipment or appurtenances,
traffic control devices, illumination, walkways and bikeways . If activities exceed the existing improved area or
the public right-of-way, this exemption does not apply. Where applicable, restoration of disturbed areas shall
be completed.

FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles if submitted plans are followed and the conditions of
approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are followed
and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance with this
exemption, the site will be revegetated with native vegetation as required as a condition of approval for this
exemption.

An exemption from the Critical Areas Regulations is hereby Approved with
1. Bentonite shall not be used when installing the conduit.
2. Please submit a new complete application for a Franchise Permit. A copy of
this decision shall be included with the application submittal.
3. When the boring is taking place, a City construction inspector shall oversee
the work to ensure there is no leaching of sediment etc. into the stream. Please
contact the appropriate inspector to schedule the inspection.

period (RCW 43.21.C.075(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057, on or before S:00 p.m., on November 19, 2015. RMC 4-8-110 governs appeals to the Hearing
Examiner and additional information regarding the appeal process may be obtained from the Renton City
Clerk's Office, (425) 430-6510.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.

Re: SEFNCO Renton Application, On-Hold Status
Dear Jill,
Thank you for working with Soundview Consultants LLC and SEFNCO (Applicant) on tbis Critical
Areas Exemption and Master Permit Application (LUA15-000718, CAR). The project site is located
at Northeast 43'' Street and Lincoln Avenue in the City of Renton, WA 98056 and spans several tax
parcels but is located entirely witbin the right-of-way (l<ing County Tax Parcel Numbers 334570-
0005, 0055, 0057, and 0059). The proposed project would bore Comcast cable conduit below
Northeast 43"' Street witbin the paved road right-of-way. The purpose of tbis Technical
Memorandum is to provide additional information in response to comments provided by the City of
Renton in a letter dated October 22, 2015. Specifically, tbis technical memorandum addresses R1vfC
4-3-050.J.Z(b).
Previously, a Critical Areas Exemption form was submitted for tbis project under Renton Municipal
Code (fu'v!C) 4-3-050-C(3), wbich exempts new utilities constructed within a road right-of-way from
critical areas regulations pertaining to Type F and Ns streams and their associated buffers. As
specified under R1vfC 4-3-050-F.7.b.i(a), if a road exists between an existing stream or other water
body and the proposed activity, a stream or lake study may be waived by the Administrator.
Northeast 43'" Street is a paved street, wbich interrupts any functional buffer associated with the
Type F ditched stream. Furthermore, the cable conduit will be bored under the existing road and
will not impact any vegetation or functions of the stream or its associated buffer. Based on this
information, a waiver of the stream/lake study was provided by the City, and a Master Application
was accepted for the proposed project.
The City has now reviewed the project Master Application and has requested that Soundview
Consultants LLC address pertinent code tbat was not previously included in the project application
code analysis. The following section is an analysis of R1vfC 4-3-050.J.Z(b), Criteria for Administrative
Approval of Utilities in Stream/Lake or Buffer. Per Rlv!C 4-3-050.J.Z(b), the proposed project will
not impact any fish and "'i.ldlife habitat. All project actions will occur in the road right-of-way where
cable conduit will be bored solely within the footprint of an existing road crossing in compliance

with R.lvIC 4-3-050.J.2.b.ii.(c). In addition, the proposed conduit does not cross any location where a
stream bed occurs. However, the proposed conduit does cross a culverted portion of the stream
where the conduit turns from Jones Avenue Northeast onto Northeast 43'd Street. The utility
installation will not increase or decrease the natural rate of channel migration as the utility is being
bored under the existing road right-of-way outside the channel. Seasonal work windows are not
applicable to the proposed project as no in-water work is required. Finally, no compensatory
mitigation is necessary as no direct impacts to the stream feature or its buffer are proposed.

Dear Ms. Santiago:
The Planning Division of the City of Renton accepted the above master application for
review on October 1, 2015. Upon further review, additional information is required to
process the application. The City's Critical Areas Regulations provide specific criteria
under RMC 4-3-0SOJ2b for utility crossings in streams/lakes or buffer area, see below:
b. Criteria for Administrative Approval of Utilities in Stream/Lake or Buffer: New utility
lines and facilities may be permitted to cross water bodies in accordance with an
approved stream/lake study, if they comply with the following criteria:
i. Fish and wildlife habitat areas shall be avoided to the maximum extent possible; and
ii. The utility is designed consistent with one or more of the following methods:
(a} Installation shall be accomplished by boring beneath the scour depth and hyporheic
zone of the water body and channel migration zone; or
(b} The utilities shall cross at an angle greater than sixty (60} degrees to the centerline of
the channel in streams or perpendicular to the channel centerline; or
(c} Crossings shall be contained within the footprint of an existing road or utility
crossing; and
iii. New utility routes shall avoid paralleling the stream or following a down-valley course
near the channel; and
iv. The utility installation shall not increase or decrease the natural rate of shore
migration or channel migration; and
v. Seasonal work windows are determined and made a condition of approval; and

vi. Mitigation criteria of subsection L of this Section are met.

To City of Renton Planning Division Staff,
This Technical Memorandum provides a project narrative and brief code analysis for the SEFNCO
Renton project. The intent of this document is to demonstrate project compliance with critical areas
exemptions outlined in Renton Municipal Code (Rl\IC) 4-3-050, and State Environmental Policy Act
(SEPA) exemptions outlined in fu\,fC 4-9-070.H and WAC 197-11-800. The subject property is
located at Northeast 43"' Street and Lincoln Avenue in the City of Renton, WA 98056 and spans
several tax parcels (King County Tax Parcel Numbers 334570-0005, 0055, 0057, and 0059).
Currently parcel number 3345700059 houses the Korean Antioch Presbyterian Church at 1701
Northeast 43'' Street. Tax parcel 3345700057 is a single family residential property spanning 0.89
acres at 4343 Lincoln Avenue Northeast. Parcel 3345700005 is a single family residential property
spanning 3.64 acres at 4348 Lincoln Avenue Northeast. Parcel 3345700055 is a 2.63 acre vacant,
commercial lot.
This project proposes to place cable conduit under an existing paved road, Northeast 43'" Street,
within the right-of-way. The road and proposed project area are within the vicinity of a potential
stream buffer, potential wetland buffer, and potential steep slope buffer. In addition, the conduit is
proposed to cross the stream in one piped location within the City of Renton.
Surrounding critical areas include an unnamed Type F ditched stream which runs through parcels
3345700055, and 3345700005, as well as the boundary between 3345700055 and 3345700059. The
City of Renton COR Maps identify potential wetland habitat on parcels 33457-00055, 00057, and
00059. Potential regulated slopes and landslide hazard are identified on parcels 334570-00055,
00057, and 00005.
Project actions include; tying conduit cable in at existing Comcast node (RN25 C Leg) located
northeast of the corner of Northeast 43'' Street and Lincoln Avenue, and placing a 1 / 4 inch, 25 foot
riser with cable at this location; starting at Jones Avenue, boring north 335 feet and placing '/, inch
conduit with cable underneath the existing public road right-of-way; at the comer of Jones Avenue

Northeast and Northeast 43'" Street, placing a 17x30 inch vault in the landscape; boring 640 feet east
towards Lincoln Avenue Northeast and boring 50 feet across Lincoln Avenue to continue to bore
7 5 feet northeast to a Puget Sound Energy pole. The proposed project will include best management
practices (BMPs) and no in-water work or substantial site grading actions are proposed.
Code Analysis
As outlined in Rl\fC 4-3-050.C.3 and the associated Exempt Activities Permitted within Critical Areas and
Associated Buffers table (shown below), new utilities under e.ii and e.iii of the table, are exempt from
regulations associated with geologic hazard areas, Type F streams, and wetlands. As described in
Rl\fC-4-3-050.C.3 Exempt Activities Permitted within Critical Areas and Associated Buffers table, superscript
14, normal and routine maintenance of utilities within public roads right-of-way, streets or new trails
are exempt from regulations associated with geologic hazard areas, Type F streams, and wetlands.
Pursuant to Rl\IC-4-050.C.3 superscript 15, within existing public road right-of-way or easements,
installation of utilities is exempt from regulations associated with geologic hazard areas, Type F
streams, and wetlands. Therefore, while impacts within critical areas buffers usually require
assessment reports and mitigation plans, the proposed project is exempt from these requirements. It
should be noted that the project will still require a construction permit per Rl\1C 4-9-170.

RMC 4-3-050-F.7.a applies to Critical Areas in general. As specified under R..c\1C 4-3-050-F.7.a, if
the proposal is not likely to significantly impact the critical habitat an applicant may request to waive
the reporting requirement. Northeast 43'<l Street is a paved street which interrupts any functional
buffer associated with the adjacent ditched stream, potential wetlands and/ or potential steep slopes.
Furthermore, the cable conduit will be bored under the existing road and will not impact any
vegetation or functions of the critical areas or associated buffer. This application request that the
City of Renton waive the Habitat Assessment Report requirement in compliance with the code
outlined below.
RMC 4-3-050-F.7.b applies to streams. As specified under Rl\fC 4-3-050-F.7.b.i(a), if a road exists
between an existing stream or other water body and the proposed activity, a stream or lake study

may be waived b y the Administrator. Northeas t 43"' Street is a pave d street, which interrupts an y
functi onal buffer associated with the Type F ditched stream. Furthermore, the cable conduit will be
bored under the existing road and will not impact any vege tation or functions of the stream or its
associated buffer. Therefore, the proposed project should n o t require a Habitat Assessment Report
for the associated s tream buffer. However, a habitat as sessment report can be provided upon
reques t, but is unnecess ary as the project only proposes work under an existing road within the
ri g ht-of-way. l·utthermore, only minor vegetation impacts will occur within the right-of-way where
the va u lt and cable riser connections are proposed. These grassy areas will be temporarily disturbed,
but immediatel y re see ded after completion of propose d work. In addition, th ese areas are already
su bject to re g ular disturbance from right-of-way maintenance.
RMC 4-3-0 50 -F.7 .c appli es to wetlands. Per RMC 4-3-050-l'.7.c , a wetland assessment ma y be
waived b y the Administrator when an existing road acts as a barrier between the wetland and
proposed project. Northeast 43 '" Street is a paved, existing roadway that disrupts the functional
buffer associated with the wetland located on parcels adjacent to the proposed project area. The
project will b o re cable conduit underneath this road and thus, will not impact any vegetation or
functi ons of the wetland or its associated buffer. 1\ wetland assessment report for the proposed
project should b e waived under these conditions.
As specified under RJ'v(C 4-3 -050.C.3.e.ii (table above), proposed utili ty lines within geologic hazard
areas arc exempt from regu lations pertaining to critical area s and associated buffers. While, a
geotcchnical assessment may be prepared for the proposed project, it d oes not seem necessary given
that the proposed cable conduit will be bored underneath an existing, paved road and thus , will not
impact identified steep slopes on adjacent parcels or their associated buffers.
