The fire impact fees are applicable at the rate of $479.28 per single family unit. This fee is paid at time of building permit. Code Related Comments: 1. The fire flow requirement for a single family home is 1,000 gpm minimum for dwellings up to 3,600 square feet (including garage and basements). If the dwelling exceeds 3,600 square feet, a minimum of 1,500 gpm fire flow would be required. A minimum of one fire hydrant is required within 300 feet of the proposed buildings and two hydrants if the fire flow goes up to 1,500 gpm. It appears there is adequate fire flow in this area. A minimum of one new hydrant is required. 2. Fire department apparatus access roadways are required to be a minimum of 20 feet wide fully paved, with 25 feet inside and 45 feet outside turning radius. Fire access roadways shall be constructed to support a 30 ton vehicle with 322 psi point loading. Access is required within 150 feet of all points on the buildings. The following comments are based on the application submittal made to the City of Renton by the applicant. EXISTING CONDITIONS WATER: The site is located in the City of Renton water service area. SEWER: The site is located in the city of Renton sewer service area. STORM: There is existing storm drainage on Lincoln Ave NE. STREETS: Lincoln Ave NE is a residential street with a right of way width of 60 feet. CODE REQUIREMENTS Water 1. The proposed development is within the City's water service area and in the Kennydale 320 hydraulic zone. The static water pressure is about 43 psi at elevation of 220 feet. There is an existing 12 inch water main in Lincoln Ave NE, ending at the intersection with NE 36th Street (see City water project plan no. W 400) that can deliver 2,600 gpm. 2. Provide 8 inch diameter water main near the north property line, from the existing 12 inch main on Lincoln Ave BE and upto the west property line of the subdivision. 3. Installation of a fire hydrant near the connection of the new water main with Lincoln Ave NE. 4. Installation of a 1 inch domestic water service and meter to the new lots. 5. There is an existing 1 inch domestic water meter on Lincoln Avenue which serves the property west of the site, 3623 Lincoln Ave NE. It is assumed that this service currently is located in the proposed 20 feet wide ingress/egress easement. If not, it will have to be located in the easement. 6. The development is subject to payment of a water system development charge (SOC) fee of $3,090.00 (2015 rate) and a water meter installation fee of $3,310.00 92015 rate)for each 1 inch meter. These fees, as well as any related permit fees, are subject to yearly increase, and the fee current at the time of permit issuance will be applicable and collected at permit issuance. The meters will be installed by the City. 7. Civil plans for the water main improvements will be required and must be prepared by a registered professional engineer in the State of Washington. Sanitary Sewer 1. All lots of the short plat will be served by the city of Renton sewer service. 2. The submitted plans show the extension of 8" diameter sewer main on Lincoln Ave NE frontage upto the south property line. A sewer man hole is provided at the end of the sewer main extension. 3. Individual side sewers are required to serve each lot. 4. Service details will be reviewed with the utility construction permit 5. Sanitary Sewer System Development Fee (SOC) is based on the size of the domestic water meters. The current SOC fee for 1" sewer is $2,135.00. This fee is subject to yearly increase, and the fee current at the time of permit issuance will be applicable and collected at permit issuance. Storm 1. A preliminary TIR/ drainage report prepared by Encompass Engineering has been submitted with the land use application. Based on the City's flow control map, this site falls within the Flow Control Standard Forested Site Conditions. The applicant engineer has mentioned in the report that a detention vault is proposed to serve the flow control requirements of the project The report includes that the project will add less than 5,000 square feet of new pollution generation impervious surface and therefore water quality facility is not triggered. However, the calculations were not included. Individual lot storm water BMP's are applicable on the lots. If infiltration trenches are proposed, they should be aligned parallel to the slope. The final drainage report/ TIR and drainage plans submitted during the utility construction permit should be based on the 2009 Surface Water Design Manual Amendment to the 2009 King County Surface Water manual. 2. A geotechnical report prepared by Earth Solutions NW LLC. was submitted by the applicant. The geotech report mentions that infiltration of stormwater is feasible on the site. The report recommends a rate of 0. 13 inches per hour or less to be used in the design of the infiltration facilities. · 3. The site should be graded near the property boundary such that discharge from the subject site does not run off into the adjacent property. Ran: June 30, 2015 Page 3 of 8 ADVISORY NOTES TO APPLICANT LUA 14-001200 The Surface Water System development charge (SDC) fee for storm water is applicable on the project. The 2015 rate for this fee is $1,350 per lot. This fee is subject to yearly increase, and the fee current at the time of permit issuance will be applicable and collected at permit issuance. Transportation 1. Lincoln Street is a residential street with existing ROW width of 60 feet. The project is proposing a 26 feet wide paved street, with 0.5 feet wide curb, 8 feet wide planter, and 5 feet wide sidewalk on the frontage. City standards include a maximum slope of 4H:1V at the back of sidewalk. The project will widen approximately 8 feet of pavement (as per City pavement standards) on the opposite side of the street, retaining wall may be applicable. Minimum separation of 2 feet is required between the face of the wall and the travel paved surface edge. Easements may be applicable for the retaining wall construction. The pavement widening will taper at 13:1 to meet with the existing pavement. 2 feet of ROW dedication is proposed on Lincoln Ave frontage. 2. Lots 1 and 2 are proposed to get direct access from Lincoln Ave NE by means of individual driveways. Driveways shall meet requirements of RMC 4 4 060. Lot 3 is proposed to gain access from Lincoln Ave NE by means of a 20 feet ingress and egress easement. The paved width shall meet City code and meet fire department requirements. 3. All electrical, phone, and cable services and lines serving the proposed development must be underground. The construction of these franchise utilities must be inspected and approved by a City of Renton inspector prior to recording the plat. 4. Traffic Impact Fees -The transportation impact fees applicable on new houses at the building permit stage. The fee is based on the applicable fee at the time of building permit application and payment is due at the time of issuance of the building permit. 5. A minimum of 5 feet separation is required between any access and property line. 6. Fixed objects that may be situated in the location of the proposed access must be relocated, after obtaining owner approval. General Comments 1. All construction or service utility permits for drainage and street improvements will require separate plan submittals. All utility plans shall conform to the Renton Drafting Standards. Plans shall be prepared by a licensed Civil Engineer. 2. When utility plans are complete, please submit three (3) copies of the drawings, two (2) copies of the drainage report, permit a lication, an itemized cost of construction estimate, and a lication fee at the counter on the sixth floor. The legal description exhibit should be prepared, stamped, dated and signed by the applicant's surveyor. The surveyor should also prepare the map exhibit. The dedication process requires an updated Plat Certificate dated within 45 days of approval of said dedication. Talk to the Project Manager if there are questions or further information is needed. Consistency with Short Plat Criteria SHORT PLAT REVIEW CRITERIA: Approval of a short plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the plat. The maximum building coverage for lots 5,000 square feet or greater is 35 percent or 2,500 square feet, whichever is greater. Staff Comment: Building height and lot coverage for the new single family residences would be verified at the time of building permit review. Note 1 Landscaping: The City's landscape regulations (RMC 4-4-070) require all short plats to provide a 10-foot landscape strip along all public street frontages. Where there is insufficient right-of-way space or no public frontage, street trees are required in the front yard subject to approval of the Administrator. A minimum of two (2) trees are to be located in the front yard prior to final inspection. Staff Comment: A conceptual landscape pion (Exhibit A.4} was submitted as port of the proposed land use application. The conceptual landscape plan (Exhibit A.4} shows o 10- foot wide landscaped strip along Lincoln Avenue NE and includes o planting detail showing trees, shrubs, and groundcover. The project site is currently vegetated with o total of 35 significant trees (2 fir trees and 35 maple trees) and native undergrowth. The applicant is proposing to retain 12 maple trees on the project site (see further discussion below under Tree Retention). Eight (8) of the retained maple trees would be located within the front yard areas of Lots 1 and 2 and would be incorporated within the required 101oot landscaped strip. A plant list was not included on the conceptual landscape pion for the 10-foot landscaped strip. No trees ore proposed within the front yard area of Lot 3. Staff recommends as o condition of approval that o detailed landscape pion be submitted at the time of Construction Permit application for review and approval by the Current Planning project manager. The detailed landscape pion shall include o plant list and two trees within the front yard area of Lot 3. The 10-foot landscaped strip shall be installed prior to final short plot approval and the front yard trees shall be installed prior to Certificate of Occupancy. ,/ Tree Retention: The City's adopted Tree Retention and Land Clearing Regulations require the retention of 30 percent of trees in a residential development. Staff Comment: There ore o total of 35 significant trees (2 fir trees and 33 maple trees) located on the project site. Of those 7 ore located within the existing private access easement, which results in o total of 28 protected trees remaining on the project site. A total of 12 maple trees ore proposed to be retained. To comply with the Tree Retention requirements, 8 trees are required to be retained or replaced. The proposal to retain 12 trees would comply with this requirement. Stoff recommends as o condition of approval that o final Tree Retention pion in compliance with the City's adopted Tree Retention and Land Clearing Regulations be submitted at the time of Construction Permit application for review and approval by the Current Planning project manager. Critical Areas: A medium landslide hazard area and slopes with a grade between 15 and 25 percent are mapped on the project site. Medium landslide hazard areas are regulated under the City's Critical Areas Regulations (RMC 4-3-050). Staff Comment: A Geotechnical Engineering Study prepared by Earth Solutions NW, LLC, dated August 21, 2014 (Exhibit A. 7) was submitted with the project application. According to the report the landslide and erosion hazard potential on the project site is minimal due to the "relative density of the underlying soil, and the lack of groundwater in the subgrade." The report included recommendations for site preparation and earthwork, foundations, seismic design considerations, critical areas assessment, slab-on-grade floors, retaining walls, drainage, excavations and slopes, utility trench backfill, and pavement sections. Staff recommends as a condition of approval that project construction be required to comply with the recommendations provided in the Geotechnica/ Engineering Study prepared by Earth Solutions NW, LLC, dated August 21, 2014. 3, DESIGN STANDARDS: Residential Design and Open Space Standards (RMC 4-2-115) are applicable in the R-8 zone. The Standards implement policies established in the Land Use and Community Design Elements of the Comprehensive Plan. Compliance with Site Design Standards must be demonstrated prior to approval of the subdivision. Compliance with Residential Design Standards would be verified prior to issuance of building permits. Staff recommends as a condition of approval that the existing access easement serving 3623 Lincoln Avenue NE be amended to provide shared access to Lots 2 and 3. A note requiring the access to Lot 2 to be provided from the shared driveway shall be recorded on the face of the final short plat map. A shared private driveway may be permitted for access up to a maximum of four (4) lots. Up to three (3) of the lots may use the driveway as primary access for emergencies. The private access easement shall be a minimum width of 16 feet with a maximum of 12 feet paved driveway, unless 20 feet is required by the Fire Dept. for emergency access. The applicant has requested a variance from the Fire Dept. to reduce the paved width of the driveway from 20 feet to 16 feet. The Fire Dept. has granted this variance subject to the requirement that the future residence constructed on proposed Lot 3 is equipped with a fire sprinkler system. Staff recommends as a condition of approval that a note be recorded on the final short plat map stating that the future residence to be constructed on Lot 3 shall be equipped with a fire sprinkler system. The minimum separation of access from the adjacent property line is 5 feet. The access as shown in the plans shall be modified to provide the 5 feet separation. The separation distance must also be labeled in the plans. Staff recommends as a condition of approval that the short plat plan be revised to provide the required 5-foot separation between the private street and the adjacent property line. The revised short plat plan shall be submitted prior to final plat approval for review and approval by the Plan Review section. Note 1 Streets: Lincoln Avenue NE is classified as a residential street and has an existing right- of-way width of 60 feet. The project is proposing a 26-foot wide paved street, with 0.5- foot wide curb, 8-foot wide planter, and 5-foot wide sidewalk along the project site frontage. City standards include a maximum slope of 4H:1V at the back of sidewalk. The project will widen approximately 8 feet of pavement (as per City pavement standards) on the opposite side ofthe street, a retaining wall may be required. Minimum separation of 2 feet is required between the face of the wall and the travel paved surface edge. Easements may be required for the retaining wall construction. Note 3 Architectural Detailing: If one siding material is used on any side of the dwelling that is two stories or greater in height, a horizontal band that measures at least eight inches (8") is required between the first and second story. Additionally, one of the following is required: 1. Three and one half inch (3 1/2") minimum trim surrounds all windows and details all doors, or 2. A combination of shutters and three and one half inches (3 1/2") minimum trim details all windows, and three and one half inches (3 1/2") minimum trim details all doors. COMPLIANCE WITH SUBDIVISION REGULATIONS: RMC 4-7 Provides review criteria for proposed subdivisions. The proposed project is consistent with the following subdivision regulations if all conditions of approval are complied with: Note 1 Access: Alley access is the preferred street pattern in the R-8 zone, unless the development proposed is a short plat. As the proposed project is a short plat, it is exempt from the alley access requirements. Access to Lots 1 and 2 is proposed via residential driveways off of Lincoln Avenue NE. Access to proposed Lot 3 would be provided via an existing 20-foot wide private access easement (currently serving 3623 Lincoln Avenue NE) located along the northern portion of the subject property. Note 1 Topography and Vegetation: Slopes with grades between 15 and 25 percent and a medium landslide hazard area are mapped on the project site. The existing ground surface generally slopes to the west with an elevation change of approximately 34 feet. A total of 35 significant trees have been identified on the project site and of these trees 12 are proposed to be retained. See previous discussion above under Landscaping, Tree Retention, and Critical Areas. 5. AVAILABILITY AND IMPACT ON PUBLIC SERVICES: ,/ Police: Police staff indicates that there would be minimal impact on police services as a result of the proposed subdivision and sufficient resources exist to furnish services to the proposed development. ,/ Fire: Fire Prevention staff indicates that sufficient resources exist to furnish services to the proposed development. The fire flow requirement for a single family home is 1,000 gpm minimum for dwellings up to 3,600 square feet (including garage and basements). If the dwelling exceeds 3,600 square feet, a minimum of 1,500 gpm fire flow would be required. A minimum of one fire hydrant is required within 300-feet ofthe proposed buildings and two hydrants if the fire flow goes up to 1,500 gpm. It appears there is adequate fire flow in this area. A minimum of one new hydrant is required. Fire department apparatus access roadways are required to be minimum 20-feet wide fully paved, with 25-feet inside and 45-feet outside turning radius. Fire access roadways shall be constructed to support a 30-ton vehicle with 322-psi point loading. Access is required within 150-feet of all points on the buildings. Applicant requested and has been granted a variance to the roadway width from 20 feet to 16 feet with the dwelling on Lot 3 to be equipped with a fire sprinkler system. A Fire Impact Fee for the future houses would be payable at the time of building permit issuance. The current Fire Impact Fee is $495.10. ,/ Schools: The Renton School District has indicated that it can accommodate the impact of additional students expected to come from the proposed project at Hazelwood Elementary School, McKnight Middle School, and Hazen High School. Students attending all schools would be bussed to school from the existing stop located approximately 0.2 miles to the north at the intersection of Lincoln Avenue NE and Monterey Place NE. To walk to this bus stop, students would walk to the north along the existing shoulder along Lincoln Avenue NE. The current Renton School District Impact Fee is $5,541.00. The Renton School Impact Fee would be payable at the time of building permit issuance; the fee in effect at the time of building permit application would be applied to this project. ,/ Parks: A Park Impact Fee would be required for the future houses. The current Park Impact Fee is $1,441.29. The fee in effect at the time of building permit application is applicable to this project and is payable at the time of building permit issuance. Note 3 Stormwater: A preliminary Technical Information Report (TIR) (Exhibit A.6) prepared by Encompass Engineering has been submitted with the land use application. The applicant's engineer has mentioned in the report that a detention vault is proposed to satisfy the flow control requirements for this project. According to the report, the proposed short plat will add less than 5,000 square feet of new pollution generating impervious surface and therefore a water quality facility is not required. However, no calculations were included in the TIR. Individual lot stormwater BM P's are applicable on the new lots. If infiltration trenches are proposed, they should be aligned parallel to the slope. The final drainage report (TIR) submitted during the utility construction permit should mention that the drainage report is based on the City of Renton's Amendments to the 2009 king County Surface Water Drainage Manual. The wording of the Section 1.2.3 Core Requirement #3 : Flow Control can be reworded to mention that pavement is removed in certain locations and pavement is added at other portions in the Public ROW. All the six Special Requirements and all eight Core Requirements should be mentioned in the final drainage report. A Geotechnical Engineering Study (Exhibit A.7) prepared by Earth Solutions NW, LLC was submitted with the project application. The study mentions that infiltration of stormwater on the project site is feasible. The report recommends a rate of 0.13 inches per hour or less to be used in the design of the infiltration facilities. The site should be graded near the property boundary such that discharge from the subject site does not run off onto the adjacent property. Staff recommends as a condition of approval that grading plans be submitted at the time of Utility Construction Permit application which show grading near the property boundary to prevent stormwater discharge from flowing onto the adjacent property. These grading plans shall be subject to the review and approval of the City's Plan Review Section. Surface water system development fee is $1,350.00 per new lot. Fees are payable prior to issuance ofthe construction permit. Note 3 Water Service: The site is located in the City of Renton water service area and in the Kennydale 320 hydraulic zone. The static water pressure is about 43 psi at elevation of 220 feet. There is an existing 12 inch water main in Lincoln Avenue NE, ending at the intersection with NE 361h Street (see City water project plan no. 400) than can deliver 2,600 gpm. The project is required to provide an 8 inch diameter water main near the north property line from the existing 12 inch main in Lincoln Ave NE and up to the west property line of the subdivision. A fire hydrant shall be installed near the connection of the new water main to Lincoln Ave NE. Separate domestic water meters, minimum 1-inch, are required to serve each single family lot. There is an existing 1 inch domestic water meter on Lincoln Ave NE which serves the property to the west of the project site, 3623 Lincoln Ave NE. It is assumed that this service currently is located in the existing 20-foot wide ingress/egress easement. If not, it will have to be relocated within the easement. The development is subject to payment of a water system development charge (SDC) fee of $3,090.00 and a water meter installation fee of $3,310.00 for each 1 inch meter. The submitted generalized utility plans (Exhibit A.5) show the extension of an 8 inch diameter sewer main on Lincoln Ave NE up to the south property line. A sewer manhole is shown at the end of the sewer main extension. Individual side sewers are required to serve each lot. System development fee (SDC) for sewer is based on the size of the new domestic water to serve the houses on each lot. The current Sewer SDC fee for a 1-inch meter install is $2,135.00. These fees are collected at the time a construction permit is issued and the rate prevalent at time of construction permit will be applicable. Note3 Transportation: See previous discussion above under Access and Streets. A Transportation Impact Fee for the new houses would be payable at the time of building permit issuance; the fee in effect at the time of building permit application would be applied to this project. The current Transportation Impact Fee is $2,214.44. H. FINDINGS: Having reviewed the written record in the matter, the City now enters the following: 1. Request: The applicant is requesting approval of a 3-lot short plat on a 24,374 square foot site. The project would have a net density of 6.25 dwelling units per acre. 2. Application: The subject property is located at 36XX Lincoln Avenue NE, tax parcel 3345700235. 3. Comprehensive Plan: The subject property is designated as Residential Single Family (RSF) in the Comprehensive Plan. The proposed project would satisfy the objectives and policies of the Land Use, Community Design, and Environmental Elements of the Comprehensive Plan, if all conditions are complied with. 4. Zoning: The proposed project site is zoned Residential -8 dwelling units per net acre (R-8). The project as proposed would satisfy the R-8 standards and regulations, if all conditions are complied with. 5. Subdivision Regulations: The project as proposed would satisfy the requirements of RMC 4-7, Subdivision Regulations if all conditions are complied with. 6. Existing land Uses: The subject property is currently vacant. 7. Setbacks: Building setbacks for the future houses on the new lots would be verified at the time of building permit review. 8. Public Utilities: Water, sewer, and storm drainage would be provided by the City of Renton. 11. Schools: The Renton School District has indicated that adequate school facilities are available at Hazelwood Elementary, McKnight Middle, and Hazen High Schools. A Renton School District Impact Fee would be assessed at the time of building permit application and would be payable at the time of building permit issuance. 12, Safe Routes to Schools: Renton School District bus service is available to all schools; there is a safe walking route to the bus stop located at Lincoln Avenue NE and Monterey Place NE. 13. Topography/Critical Areas: Slopes with grades between 15 and 25 percent and a medium landslide hazard area are mapped on the project site. The existing ground surface generally slopes to the west with an elevation change of approximately 34 feet. I. CONCLUSIONS: 1. The subject site is located in the Residential Single Family Comprehensive Plan designation and complies with the goals and policies established with this designation. 2. The subject site is located in the Residential -8 dwelling units per acre (R-8) zoning designation and complies with the zoning and development standards established with this designation provided the applicant complies with City Code and conditions of approval. 3. The proposed 3-lot short plat complies with the subdivision regulations as established by City Code and state law provided all advisory notes and conditions are complied with. 4. The proposed 3-lot short plat complies with the street standards as established by City Code, provided the project complies with all advisory notes and conditions of approval contained herein. 5. Slopes with grades between 15 and 25 percent and a medium landslide hazard area are mapped on the project site. The proposed 3-lot short plat complies with the critical areas regulations as established by City Code provided the applicant complies with the conditions of approval. 6. If the dwelling exceeds 3,600 square feet, a minimum of 1,500 gpm fire flow would be required. A minimum of one fire hydrant is required within 300-feet of the proposed buildings and two hydrants ifthe fire flow goes up to 1,500 gpm. It appears there is adequate fire flow in this area. A minimum of one new hydrant is required. 2. The fire impact fees are applicable at the rate of $479.28 per single family unit. This fee is paid at time of building permit. 3. Fire department apparatus access roadways are required to be a minimum of 20- feet wide fully paved, with 25-feet inside and 45-feet outside turning radius. I have completed a preliminary review for the above-referenced proposal. The following comments are based on the pre-application submittal made to the City of Renton by the applicant. WATER 1. The proposed development is within the City's water service area and is in the Kennydale 320-hydraulic zone. There is an existing 12-inch water main (see City water project plan no. W-0400) within Lincoln Ave NE. The 12-inch water main can deliver a maximum flow rate of 2,700 gallons per minute. The static water pressure is about 55 psi at ground elevation 192, which is roughly the center of the property. There is an existing 1-inch domestic water meter on Lincoln Avenue which serves the property west of the site, 3623 Lincoln Ave NE. It is assumed this service currently is located in the proposed 20-foot wide ingress/egress easement. If not, it will have to be located in the easement. 2. Additional water main improvements will be required to provide for water service to the new plat to include but not be limited to: a. Installation of an 8-inch water main connecting to the existing 12 inch water main in Lincoln Ave NE and extending to the west property line. Installation of a fire hydrant on the new 8 inch line at the intersection of Lincoln Ave NE and the ingress/egress easement (see conceptual layout). b. Installation of 1-inch minimum domestic water services and meters to the new lots. If the new structures are to have fire sprinkler systems, the sprinkler designer will determine service sizes. Project subject to payment of applicable water system development charge (SOC) fee and water meter installation fees for the new lots. Civil plans for the water main improvements will be required and must be prepared by a registered professional engineer in the State of Washington. SANITARY SEWER 1. The site is located in the City of Renton sewer service area. 2. The project can get sewer service by: a. Each lot can be served by individual side sewers from the sewer main. 6. The development is subject to a wastewater system development charge (SOC) fee. SOC fee for sewer is based on the size of the new domestic water to serve the new home on each lot. The sewer fee for a %-inch or 1-inch meter install is $1,812.00 (2013 rate) or $2033.00 (2014 rate). SURFACE WATER 1. A drainage report complying with the City adopted 2009 King County Surface Water Manual and City Amendments will be required. Based on the City's flow control map, the site falls within the Flow Control Duration Standard (Forested Site Conditions). The site is located in the moderate landslide hazard area. Refer to Figure 1.1.2.A-Flow chart for determining the type of drainage review required in the City of Renton 2009 Surface Water Design Manual Amendment. Storm drainage improvements on 1S6'h Ave SE may be applicable. Stormwater BMPs applicable to the individual lots must be provided. The drainage report must account for all the improvements provided by the project. Storrnwater improvements based on the drainage report study will be required to be provided by the developer. ,(2. Payment of the transportation impact fee is applicable on the single family houses at the time of building permit issuance. The current transportation impact fee rate is $717.75 per single family house. The impact fee for this type of land use will increase on January 1, 2014, to $1,430.72 per single family house. The transportation impact fee that is current at the time of building permit application will be levied, payable at issuance of building permit. 2. Lincoln Ave NE is a residential street with an available right of way (ROW) width of 60 feet. RMC 4-6-060 includes a 53-feet ROW width for a residential street. Therefore the available ROW width meets requirements. RMC 4-6-060 also includes two 10-feet wide paved travel lanes, 6-feet wide on street paved parking lane on one side of the street, storm drainage, gutter, 0.50-foot wide curbs, 8-feet wide landscaped planters, and 5-feet wide sidewalks on both sides of the street for a residential street. The required half street frontage improvements will be required to be provided by the developer. 3. Internal access is proposed by a 26-feet wide private access Tract (which includes an existing 20-feet access and utility easement). RMC 4-6-060 mentions a 20-feet wide paved road within a 26-feet wide access easement is mentioned as the requirement for a private road. Lot 2 and Lot 4 are proposed to gain access from the private road by means of a shared driveway in a 20-feet wide private access easement. RMC 4-6-060 includes a minimum 16-feet wide access easement with a maximum paved width of 12 feet for a shared driveway. The proposed access easement width meets the requirements for access easement width for shared driveways. 4. Street lighting is not required to be provided by residential development of maximum 4 lots. 5. All utilities serving the site are required to be undergrounded. 6. Maximum width of single family driveways for two car garage is 16 feet. Refer to RMC 4-4-080 regarding driveway regulations. 7. A minimum separation of 5 feet is required between access and the property line. 8. Informational comment-traffic safety guidelines include a minimum spacing of 20 feet between driveways. GENERAL COMMENTS 1. All construction or service utility permits for drainage and street improvements will require separate plan submittals. All utility plans shall conform to the Renton Drafting Standards. Plans shall be prepared by a licensed Civil Engineer. 2. When utility plans are complete, please submit three (3) copies of the drawings, two (2) copies of the drainage report, the permit application, an itemized cost of construction estimate, and application fee at the counter on the sixth floor. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for $50.00 plus tax, from the Finance Division on the first floor of City Hall or online at www.rentonwa.gov Project Proposal: The subject property is located on the west side of Lincoln Ave NE on a vacant parcel 3345700235. The project site totals 24,374 SF in area; and is zoned Residential-8 (R-8) du/ac. The proposal is to subdivide the existing parcel into 4 lots for the future construction of single family residences. Access to site is proposed via a 20-foot access tract in combination with a shared driveway. The access tract would extend from Lincoln Ave NE. The site is located within an erosion hazard area, moderate landslide hazard area and contains sensitive slopes. Current Use: The site is currently vacant. Zoning/Density Requirements: The subject property is zoned Residential -8 dwelling units per acre (R-8). The density range allowed in the R-8 zone is a minimum of 4.0 to a maximum of 8.0 dwelling units per acre (du/ac). The area of public and private streets and critical areas would be deducted from the gross site area to determine the "net" site area prior to calculating density. Based on the provided design there appears to be approximately 4,144 SF of access easements and a lot line adjustment eliminating 1,776 SF from the south property line; resulting in 5,920 SF of area deducted. Following the deduction of 5,920 square feet the net area for development would be 18,454 SF. Using the net square footage and the proposal of 4 lots arrives at a net density of approximately 9.52 du/ac (4 lots/ 0.42 acres= 9.52 du/ac), which is not within the density range permitted in the R-8 zone. Minimum Lot Size, Width and Depth -The minimum lot size permitted in the R-8 is 4,500 square feet for parcels greater than 1 acre in size and 5,000 square feet for lots 1 acre or less in size. The total Jot area of the subject site is less than 1 acre; therefore a minimum Jot size of 5,000 square feet is applicable to the proposed project. A minimum lot width of 50 feet for interior lots and 60 feet for corner lots, as well as a minimum lot depth of 65 feet, is also required. The proposal appears to comply with the lot size, width and depth requirements of the zone. Building Standards -The R-8 zone allows a maximum building coverage of 35% of the lot area or 2,500 square feet, whichever is greater for lots over 5,000 square feet in size and a maximum impervious surface 75%. Building height is restricted to 30 feet from existing grade. Detached accessory structures must remain below a height of 15 feet. The gross floor area must be less than that of the primary structure. Accessory structures are also included in building lot coverage calculations. The proposal's compliance with the building standards would be verified ot the time of building permit review for the new residences to be located on all lots. Building Design Standards -All single family residences would be subject to the Residential Design Standards outlined in RMC 4-2-115. The proposal's compliance with the residential design standards would be verified at the time of building permit review for the new residences to be located on all lots. Please take not of the following standards One of the following is required: • Lot width variation of 10 feet (10') minimum of one per four (4) abutting street-fronting lots, or • Minimum of four (4) lot sizes (minimum of four hundred (400) gross square feet size difference) for at least every four (4) abutting street fronting lots, or • A front yard setback variation of at least five feet (5') minimum for at least every four (4) abutting street fronting lots. Setbacks -Setbacks are the minimum required distance between the building footprint and the property line and any private access easement. The required setbacks in the R-8 zone are 15 feet in front for the primary structure and 20 feet in front for the attached garage, 20 feet in the rear, 5 feet on interior side yards, and 15 feet on side yards along streets (including access easements) for the primary structure and 20 feet on side yards along streets (including access easements) for the attached garage. The setbacks for the new residences would be reviewed at the time of building permit. Access/Parking: Access to site appears to be proposed via a 20-foot access tract in combination with a shared driveway. The access tract would extend from Lincoln Ave NE. Alley: Alley access is the preferred access pattern in the R-8 zoning classification. However, an Administrative Code Interpretation (Cl-41) requires the decision maker to evaluate the practicality of alleys within a development when the development is a short plat with densities between 6.01 du/ac and 8 du/ac. New development in areas without existing alleys shall utilize alley access on interior lots. If it can be demonstrated through an evaluation that the use of alley(s) is not feasible practical, the use of alleys may not be required. Any or all of the following factors may apply and should be considered in evaluating whether the use of alleys is not practical: a. Size: the new development is a short plat. b. Topography: the topography of the site proposed for development is not conducive for an alley configuration. c. Environmental Impacts: the use of alleys would have more of a negative impact on the environment than a street pattern without alleys. Driveways: The maximum driveway slopes cannot exceed 15%, provided that driveways exceeding 8% are to provide slotted drains at the lower end of the driveway. If the grade exceeds 15%, a variance is required. Landscaping -Except for critical areas, all portions of the development area not covered by structures, required parking, access, circulation or service areas, must be landscaped with native, drought-resistant vegetative cover. The development standards require that all pervious areas within the property boundaries be landscaped. The minimum on-site landscape width required along street frontages is 10 feet. Please refer to landscape regulations (RMC 4-4-070) for further general and specific landscape requirements (enclosed). Significant Tree Retention: If significant trees (greater than 6-inch caliper) are proposed to be removed a tree inventory and a tree retention plan along with a tree retention worksheet shall be provided with the formal land use application. The tree retention plan must show preservation of at least 30 percent of significant trees, and indicate how proposed building footprints would be sited to accommodate preservation of significant trees that would be retained. If the trees cannot be retained, subject to review and approval, they may be replaced with minimum 2 inch caliper trees at a ratio of six to one. Critical Areas: The subject site contains steep slopes, erosion hazards and moderate landslide hazards which are all Geological Hazards therefore, a geotechnicol study shall be provided by a qualified professional. The study shall demonstrate that the proposal will not increase the threat of the geological hazard to adjacent properties beyond the pre-development conditions, the proposal will not adversely impact other critical areas, and the development can be safely accommodated on the site. In addition, the study shall assess soil conditions and detail construction measures to assure building stability. Environmental Review: Short plats are exempt from Environmental (SEPA) Review unless critical areas are found to exist on the subject property. Permit Requirements: The proposed subdivision would require a Preliminary Short Plat Approval. All land use permits would be processed within an estimated time frame of 6-8 weeks. The Preliminary Short Plat Review application fee is $1,400. A 3% technology fee would also be assessed at the time of land use application. GUARANTEE CONDmONS AND STIPULATIONS 1. Definition of Terms. The following terms when used in the Guarantee mean: (a) the "Assured": the party or parties named as the Assured in this Guarantee, or an a supplemental writing executed by the Company. (b) "land": the land described or referred to in Schedule (A)(C) or in Part 2, and improvements affixed tllereto which by law constitute real property. The term "land" does not include any property beyond the lines of the area described or referred to in Schedule (A)(C) or in Part 2, nor any right, title, interest, estate or easement in abutting streets, roads, avenues, alleys, lanes, ways or waterways. (c) "mortgage": mortgage, deed of trust, trust deed, or other security instrument. (d) "public records": records established under state statutes at Date of Guarantee for the purpose of imparting constructive notice of matters relating to real property to purchasers for value and without knowledge. (e) "date": the effective date. 2. Notice of Claim to be Given by Assured Oaimant. An Assured shall notify the Campany promptly in writing in case knowledge shall come to an Assured hereunder of any claim of title or interest which is adverse to the title to the estate or interest, as stated herein, and which might cause loss or damage for which the Company may be liable by virtue of this Guarantee. If prompt notice shall not be given to the Company, then all liability of tile Company shall terminate with regard to the matter or matters for which prompt notice is required; provided, however, that failure to notify the Company shall in no case prejudice the rights of any Assured unless the Company shall be prejudiced by the failure and then only to the extent of the prejudice. 3. No Duty to Defend or Prosecute. The Company shall have no duty to defend or prosecute any action or proceeding to which the Assured is a party, notwithstanding the nature of any allegation in such action or proceeding. ' ---------------------···-------------- 4. Company's Option to Defend or Prosecute Actions; Duty of Assured Claimant to Cooperate. Even though the Company has no duty to defend or prosecute as set forth in Paragraph 3 above: (a) The Company shall have the right, at its sole option and cost, to institute and prosecute any action or proceeding, interpose a defense, as limited in (b), or to do any other act which in its opinion may be necessary or desirable to establish the title to the estate or interest as stated herein, or to establish the lien rights of the Assured, or to prevent or reduce loss or damage to the Assured. The Company may take any appropriate action under the terms of this Guarantee, whether or not it shall be liable hereunder, and shall not thereby concede liability or waive any provision of this Guarantee. If the Company shall exercise its rights under this paragraph, it shall do so diligently. (b) If the Company elects to exercise its options as stated in Paragraph 4(a) the Company shall have the right to select counsel of its choice (subject to the right of such Assured to object for reasonable cause) to represent the Assured and shall not be liable for and will not pay the fees of any other counsel, nor will the Company pay any fees, costs or expenses incurred by an Assured in the defense of those causes of action which allege matters not covered by this Guarantee. (c) Whenever the Company shall have brought an acbon or interposed a defense as permitted by the provisions of this Guarantee, the Company may pursue any litigation to final determination by a court of competent jurisdiction and expressly reserves the right, in its sole discretion, to appeal from an adverse judgment or order. (d) In all cases where this Guarantee permits the Company to prosecute or provide for the defense of any action or proceeding, an Assured shall secure to the Company the right to so prosecute or provide for the defense of any action or proceeding, and all appeals therein, and permit the Company to use, at its option, the name of such Assured for this purpose. If the Company is prejudiced by the failure of the Assured to furnish the required cooperation, the Company's obligations to the Assured under the Guarantee shall terminate. 5. Proof of Loss or Damage. In addition to and after the notices required under Section 2 of these Conditions and Stipulations have been provided to the Company, a proof of loss or damage signed and sworn to by the Assured shall be furnished to the Company within ninety (90) days after the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe the matters covered by this Guarantee which constitute the basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. If the Company is prejudiced by the failure of the Assured to provide the required proof of loss or damage, the Company's obligation to such assured under the Guarantee shall terminate. In addition, the Assured may reasonably be required to submit to examination under oath by any authorized representative of the Company and shall produce for examination, inspection and copying, at such reasonable times and places as may be designated by any authorized representative of the Company, all records, books, ledgers, checks, correspondence and memoranda, whether bearing a date before or after Date of Guarantee, which reasonably pertain to the loss or damage. Further, lf requested by any authorized representative of the Company, the Assured shall grant its permission, in writing, for any authorized representative of the Company to examine, inspect and copy all records, books, ledgers, checks, correspondence and memoranda in the custody or control of a third party, which reasonably pertain to the loss or damage. All information designated as confidential by the Assured provided to the Company pursuant to this Section shall not be disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the administration of the daim. Failure of the Assured to submit for examination under oath, produce other reasonably requested information or grant permission to secure reasonably necessary information from third parties as required in the above paragraph, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this Guarantee to the Assured for that claim. 6. Options to Pay or Otherwise Settle Claims: Termination of Liability. In case of a claim under this Guarantee, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Liability or to Purchase the Indebtedness. The Company shall have the option to pay or settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder, the Company shall have the option to purchase the indebtedness secured by said mortgage or said lien for the amount owing thereon, together with any costs, reasonable attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Such purchase, payment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness, the owner of such indebtedness shall transfer and assign said indebtedness, together with any collateral security, to the Company upon payment of the purchase price. Upon the exercise by the Company of the option provided for in Paragraph (a) the Company's obligation to the Assured under this Guarantee for the claimed loss or damage, other than to make the payment required in that paragraph, shall terminate, including any obligation to continue the defense or prosecution of any litigation for which the Company has exercised its options under Paragraph 4, and the Guarantee shall be surrendered to the Company for cancellation. (b) To Pay or Otherwise Settle With Parties Other Than the Assured or With the Assured Claimant. To pay or otherwise settle with other parties for or in the name of an Assured claimant any claim assured against under this Guarantee, together with any costs, attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of payment and which the Company is obligated to pay. Upon the exercise by the Company of the option provided for in Paragraph (b) the Company's obligation to the Assured under this Guarantee for the claimed loss or damage, other than to make the payment required in that paragraph, shall terminate, including any obligation to continue the defense or prosection of any litigation for which the Company has exercised its options under Paragraph 4. 7. Determination and E-nt of Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described, and subject to the Exclusions From Coverage of This Guarantee. The liability of the Company under this Guarantee ta the Assured shall not exceed the least of: (a) the amount of liability stated in Schedule A or in Part 2; (b) the amount of the unpaid principal indebtedness secured by the mortgage of an Assured mortgagee, as limited or provided under Section 6 of these Conditions and Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the time the loss or damage assured against by this Guarantee occurs, together with interest thereon; or (c) the difference between the value of the estate or interest covered hereby as stated herein and the value of the estate or interest subject to any defect, lien or encumbrance assured against by this Guarantee. 8. Limitation of Liability. (b) In the event of any litigation by the Company or with the Company's consent, the Company shall have no liability for loss or damage until there has been a final determination by a court of competent jurisdiction, and disposition of all appeals therefrom, adverse to the title, as stated herein. (c) The Company shall not be liable for loss or damage to any Assured for liability voluntarily assumed by the Assured in settling any claim or suit without the prior written consent of the Company. 9. Reduction of Liability or Termination of Liability. All payments under this Guarantee, except payments made for costs, attorneys' fees and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto. 10. Payment of Loss. (a) No payment shall be made wfthout producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. (b) When liability and the extent of loss or damage has been definitely fixed in accordance with these Conditions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. 11. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a daim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured claimant. The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to the claim had this Guarantee not been issued. If requested by the Company, the Assured shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect this right of subrogation. The Assured shall permit the Company to sue, compromise or settle in the name of the Assured and to use the name of the Assured in any transaction or litigation involving these rights or remedies. If a payment on account of a claim does not fully cover the loss of the Assured the Company shall be subrogated to all rights and remedies of the Assured after the Assured shall have recovered its principal, interest, and costs of collection. 12. Arbitration. Unless prohibited by applicable law, either the Company or the Assured may demand arbitration pursuant to the Title Insurance Arbitration Rules of the American Land Title Association. Arbitrable matters may include, but are not limited to, any controversy or claim between the Company and the Assured arising out of or relating to this Guarantee, any service of the Company in connection with its issuance or the breach of a Guarantee provision or other obligation. All arbitrable matters when the Amount of Uabilfty is $2,000,000 or less shall be arbitrated at the option of either the Company or the Assured. All arbitrable matters when the amount of liability is in excess of $2,000,000 shall be arbitrated only when agreed to by both the Company and the Assured. The Rules in effect at Date of Guarantee shall be binding upon the parties. The award may include attorneys' fees only if the laws of the state in which the land is located permits a court to award attorneys' fees to a prevailing party. Judgment upon the award rendered by the Arbitratar(s) may be entered in any court having jurisdiction thereof. The law of the situs of the land shall apply to an arbitration under the Title Insurance Arbitration Rules. A copy of the Rules may be obtained from the Company upon request. 13.
