The applicant shall provide a notarized original abatement agreement form, as provided by the City. The agreement assures the temporary use will ultimately be removed as required by the terms of the permit. The applicant shall also provide an original signed Release and Indemnification Agreement. Both agreements shall be provided to the Current Planning Project Manager prior to building permit approval. 2. Only five single family building permits shall be issued for Canyon Terrace subdivision prior to recording of the final plat, regardless of what the underlying lots allow. 3. We assume/hope the 5 homes would be built on the same tier as where the "sales office" is located, or if they are not currently planned for that tier, we would request that they are built there. This temporary road was meant to be for "Emergency Vehicles" and we would hope that will not be allowed for all the construction vehicles needed for the construction of the first 5 houses, or the total 72. We have had to endure extreme waits to get out of our cul-de-sac (today we counted 13 cars coming from lower SE 192"' and then 1 coming from the other direction before we could exit our road and wonder what it's going to be like when there are 72 homes, with probably at least 144 cars possibly using SE 192"') noise and vibration almost daily from the heavy equipment and would hope that this part will soon be over. Due to the vibration, we have new cracks in our ceiling and walls of our home and are experiencing ground settling in our back yard that has only started since the construction and we will need to repair the yard and repair and repaint our home interior when this heavy equipment is done. Also, we are wondering what kind of home will be built on lot #14, adjacent to our home since the lot does not appear to be similar to the other lots. We were assured the homes in front of our homes on the 121" Place cul-de-sac were going to be built in such a way that only the top floor would be all that we will see. Actually we were told they would be "tri-levels" but to us, they look like they will be day- light basement homes. Lot #'14 is currently much higher than the other lots around it. The Plat of Canyon Terrace is a 14.45 acres in size. The site is located at South of SE 188'" Street and east of 120'" Avenue SE Renton, Washington. The proposal is to construct 4 model homes on Lots 2, 9, 25, 68 & 69 of the project. • Land use permits for the proposed project. 1. Tier 2 Temporary Use Permit 2. Building Permits • Zoning designation af the site and adjacent properties. The following is the designation for the site: City of Renton: R-4 Residential (Canyon Terrace project is vested to the 2004 R-4 development standards and the Urban Residential Comprehensive Plan Designation of King County). The following is the zoning designation and characteristics: North: Existing single-family residential (R-6 zone) East: Existing single-family residential (R-4 zone) South: Existing single-family residential (SR-6 Kent, WA) West: Soo's Creek Trail (King County Parks) • Current use of the site and existing improvements. The site is currently under construction with new roadways, storm and utility improvements in accordance with the approved construction plans. Special site features (i.e., wetlands, water bodies, steep slopes). The project does not contain wetlands. The project is located adjacent to Bonneville Power Easement containing wetland areas. The easement is approximately 250' wide and abuts the project boundary. Big Soo's Creek, a Type F water is located to the east of the easement, approximately 350' feet from the project limits. The projects easterly boundary directly connects to Soo's Creek Regional Trail system has easy access to the parks in the valley adjacent east. • Statement addressing soil type and drainage conditions. The Geologic Map of King County by Derek B. Booth, Kathy A. Troost & Aaron P. Wisher (2007), maps the site as Vashon Till (Qvt). The geologic engineering report prepared for the site are general consistent with the publish maps of this area. The engineering report included test pits that were completed on site and provided construction recommendations for foundations, drainage, utilities and pavement. • Proposed Use of Property and scope of the proposed development. The Plat of Canyon Terrace is currently under construction for 72 single-family detached residences with tracts for storm-water, open space and joint-use tracts. The specific proposal under this application is to allow construction of five (5) model homes on Lots 2, 9 25, 68 & 69. • For plats indicate the proposed number, net density and range of sizes (new lot area} of new lots. The Plat of Canyon Terrace has been designed to utilize standard front load single-family homes totaling 72 lots each averaging 4,000 square feet. The model home size is between 2,300 to 3200 square feet. Access to the model home lots will be provided from 1241" Ave SE that will be completed as part of the Canyon Terrace site construction. • Access The main entrance on 124'" avenue SE provides access to the model home lots and provide access the overall project. • Proposed oft-site improvements (i.e. Install of Sidewalks, fire hydrants, sewer main, etc.}. The project will construct a portion of 124'" avenue SE roadway including curb/gutter/sidewalk improvements along the property frontage including curb/gutter/sidewalk. A new centrally located storm water facility will be at the natural discharge location proposed along the central portion of this eastern edge of the development and/or to the existing conveyance along the north side of SE 192"• Street. An additional storm drainage detention and treatment for the portion of roadway that cannot be captured by onsite vault may occur within 124'" Ave SE or SE 192"• Street right-of-way. Storm lines, water lines and sewer lines will be installed in association with the Canyon Terrace development. • Total estimated construction cast and estimated fair market value of the proposed project. 2 The estimated construction (hard and soft costs) will range from $62,000 per lot or approximately $4,460,000 total. The estimated finished lot value is estimated to range from $385,000 to $435,000 per lot. • Estimated quantities and type af material if any fill or excavation is propased. The majority of the earthwork required for construction of the five (5) model homes is 25 cubic yards. • Number, type and size of any trees to be removed. All the existing trees other than the trees contained within Native Growth Protection Area and buffer have been removed from the site as part of the roadway, utility and earthwork construction. Trees and additional landscaping will be installed per the approved landscaping plans. No trees will be removed for construction of the proposed model homes. • Explanation of any land to be dedicated to the City. As part of the final plat process the proposed public roads within the project will be dedicated to the city as well as 200' along 124th Street SE • Any proposed job shacks, sale trailer and proposed model homes. Big Soo's Creek, a WAC 222-16-030 type F water is located approximately 350' feet from the project limits. Lots 68 and 69 are located closest and directly north of the Native Growth Protection Area or NGPA Tract located on the central eastern portion of the Canyon Terrace project. Lots 2, 9 and 25 are 200' or more south of the NGPA Tract area. • An explanation of the proposed access/roadway construction, temporary erosion control, utilities, street and lot addressing. Construction of 124th Street SE road improvements, including sewer, water, storm, power, etc. Temporary erosion controls measures are currently in place and being maintained as part of the project construction. 3 • Proposed security devices for removal of model homes if plat is not recorded. Recitals Summit Homes of Washington, its Operating Manager, Bryan White, Manager The Owners own real property in the City legally described in Exhibit A, attached. The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some risk in building the model homes. In consideration of the inherent risks associated with the construction of buildings in advance of the recording of the plat, the City requires the owner to execute an indemnification agreement prior to any model home construction activities. Agreement The parties agree to the following: 1. The City authorizes the Owners to do the work as described in the Temporary Use Permit Application No. once building permits have been obtained. 2. The owners assume the risk that the model home(s) must be removed or reconfigured and therefore release and discharge the City and its representatives from all known and unknown losses, claims, damages or causes of actions which the owners have or may have relating to buildings or structures authorized by the Temporary Use Permit. 3. As a condition of granting Owner permission to construct model homes, Owner agrees to indemnify, defend and hold the City of Renton Harmless from any claims or liens that may be exerted against the property as a result of construction of model homes and use of the unrecorded plat of Summit Frenchies, LLC 4. Owners understand and acknowledge that, should the model home construction not comply with the proposed lot configuration of the final plat, no variances to development standards for either the lots or the homes may be granted as such a situation would be considered a "self-induced hardship". 5.
