The applicant is requesting a variance from RMC 8-7-2 (Noise Regulations, Maximum
Environmental Noise Levels) in order to conduct construction work at night in areas with
residential uses . Geotechnical exploration is needed to aid WSDOT's design build
contractor in the design of the 1-405/SR-167 Direct Connector Project. Six supplemental
boring locations are proposed and all lie within the paved areas of the states' highway.
Only one boring will require night time work. Borings 2, 3, 4, 5 and 6 will proceed as
daytime work. The work time frame proposed is February thru April of 2016 for 2 non-
consecutive nights. The night time work shall be achieved between 10:00 PM and 4:30
AM . The contractor would like to begin work the week of February 15, 2016 . The
equipment to be used will include a drill rig, passenger van and a support vehicle. The
drilling operation generates approximately 88 dBA of noise with some brief elevated
spikes when the drill is penetrating resistant soil layers .

I D. FINDINGS OF FACT (FOF}:
1. The Planning Division of the City of Renton accepted the above master application for review on
February 8, 2016 and determined the application complete on February 8, 2016. The Administrator of
Community and Economic Development Department will waive the public comment period of 14 days
for this specific variance request.
2. The project site is located at 1-405/SR-167 -Vicinity of Shattuck Ave S. & S. 14th Street
3. The project site is currently developed with asphalt (roadway prism) in the state right-of-way.
4. Access to the site would be provided via road access and may require a lane closure.
5. The applicant is proposing to begin construction on February 15, 2016 and end on April 30, 2016.
6. Per RMC 8-7-8, the applicant notified the two residences living within a 300 ft. radius of soil boring #1
on February 8, 2016. Any complaints within the Renton city limits shall be summarized and reported to
the City's project manager, Vicki Grover, VGrover@rentonwa.gov within 5 days of the complaint. Staff
recommends the applicant comply with this requirement as a condition of approval.
Variance Analysis: The decision maker, in passing upon an application for a variance, shall consider all technical
evaluations, all relevant factors and standards specified in other sections of this Chapter, and in addition
thereto shall consider the following, none of which is mandatory for the granting of the variance:

a. That the applicant suffers practical difficulties and unnecessary hardship and the variance
is necessary because of special circumstances applicable to the applicant's property or
project, and that the strict application of this Chapter will deprive the subject property
.,,-owner or applicant of rights and privileges enjoyed by others .
Sta[[ Comment: Conducting the work at night will limit disruption to the transport of people
goods and services. WSDOT has indicted that safety for drivers and construction workers
improves when work is conducted at night. Permitted noise levels would be exceeded during
construction, in the area where the work is occurring.
b . That the granting of the variance will not be materially detrimental to the public health, .,,-welfare or safety, or unduly injurious to the property or improvements in the vicinity of
the location for which this variance is sought.

Staff Comment: Noise impacts would occur during nighttime hours and would be perceptible at
times during construction. However, the noise would occur during 2 non-consecutive nights over
the course of approximately 2.5 months. The improvements to the roadway would ultimately
increase public health, safety and welfare. Therefore, staff believes that the noise impacts would
be of a limited duration and intensity, and would not be materially detrimental to the public
health, welfare, or safety. Property and/or improvements in the area would not be unduly
damaged as the work would be limited to the public right-of-way, and the noise generated would
not damage property or improvements.
c. That the approval is a minimum variance that will accomplish the desired purpose.
Staff Comment: Staff believes that the request is the minimum needed to accomplish the
necessary investigation for the design of the Direct Connector Project.
d. That the variance contains such conditions deemed to be necessary to limit the impact of
the variance on the residence or property owners impacted by the variance. The variance
approval may be subject to conditions including, but not limited to, the following:
a. Implementation of a noise monitoring program;
b. Maximum noise levels;
c. Limitation on types of equipment and use of particular equipment;
d. Limitation on back-up beepers for equipment;
e. Required use of noise shields or barriers;
f. Restrictions to specific times and days;
g. Specific requirements for documentation of compliance with the noise variance
conditions;
h. Specific requirements for notification to nearby residents;
i. Required cash security to pay for inspection services to verify compliance;
j. Required access to the project by the City to verify compliance with the noise
variance conditions;
k. Specific program to allow for temporary hotel vouchers to effected residents;
I. Requirements for written verification that all workers understand the noise
variance conditions for the project; and
m. Provision allowing the City to immediately revoke the variance approval if the
variance conditions are violated.
Staff Comment: Staff believes that the request is the minimum needed to accomplish the
necessary investigation for the design of the Direct Connector Project.
e. The importance of the services provided by the facility creating the noise and the other
impacts caused to the public safety, health and welfare balanced against the harm to be

I E. CONCLUSIONS
1. The subject site is located on the south side of 1-405 within state right-of-way, adjacent to Shattuck Ave
Sand S 141h Street and between the north bound and south bound lanes.
2. The requested variance meets the seven criteria to be considered in making a decision on a variance
request as specified in RMC 8-7-8 if all conditions of approval are met. The analysis of the proposal
according to variance criteria is found in the body of the Staff Report.
i F. DECISION:
The 1-405/SR-167 Direct Connector Supplemental Borings Project Noise Variance, File No. LUA16-000095, as
depicted in Exhibit 1, is approved and is subject to the following conditions:
1. Any complaints within the Renton city limits will be summarized and reported to the City's project
manager, Vicki Grover, VGrover@rentonwa.gov within 5 days of the complaint.

Hello Vicki,
We really appreciate your help to expedite this approval to help us meet our very tight schedule. Late yesterday we delivered the fee payment, a completed
master application, and notified the two residences within 300' of the drilling location.
As noted in the Notice of Nighttime Work flyer, WSDOT anticipates performing this work the night of Monday, February 15, 2016. Work is anticipated to be
complete by 5 a.m. on Tuesday, February 16, 2016. This work may require an additional night during the week of February 15th.
Should we expect to receive a written administrative approval from the City?

Linda,
I have spoken with Chip Vincent, CED Director, and he has agreed that we can proceed under "emergency" administrative approval for this noise variance and
waive the public comment period. This puts the City in an unfavorable position but we can work with WSDOT to meet their schedule. However, in the future
we would like to request that more notice be given for these types of construction activities within the City of Renton.

Thank you for the quick follow up. This change will impose a considerable hardship upon WSDOT and its contract proposal process because the work is already
scheduled.

We understand that boreholes B2, B3, B4 & BS are exempt from the variance process because of their location, and we've moved B6 has moved off of the
pavement where it can now be done as daytime work.
This leaves borehole Bl where only approximately two residences, within 300 feet, remain after WSDOT's property acquisitions along S 14th Street. The
commercial properties north of 1-405 are about 375' away from the bore hole. Additionally, the 88 dBA generated by the drill rig generates little more noise
than a heavy truck (80-85 decibels).
Our project manager, Lisa Hodgson and I would like to schedule a meeting with the City early Monday to discuss options of how we can resolve this issue and
maintain our project schedule.
WSDOT has reduced the number and locations of bore holes to every extent possible to mitigate night time noise within the City.
Please respond as soon as you can to help us resolve this request.

Per RMC Chapter 7, 8-7-8 Variances & Appeal: Variance requests for two (2) days or less in duration, the variance decision shall be made by the Administrator
{Chip Vincent) following the public notice process.
The fee for the administrative variances is $1,200.00 plus a 3% technology fee for a total of $1,236.00.
WSDOT shall conduct the mailings for bore holes Bl & B6; this will be for a 300 ft. radius and shall target all residential properties. Bore holes B2, B3, B4 & BS
are exempt from the variance process because the 300 ft. radius does not include residential properties. The public notice shall be forwarded to the City for
review and approval. The public notice shall be mailed out to the residential properties affected, 7 days prior to the start of the soil borings.

WSDOT 1-405/SR 167 Direct Connector Project -Supplemental Borings
Project Narrative:
The Washington State Department of Transportation (WSDOT) is proposing to conduct soil
investigations in 6 locations in and around the 1-405/SR 167 interchange.
The proposed work is expected to take one to two days and occur in mid-February, and includes one or
two overnight shifts. A small drill rig will be deployed which will cause minimal ground disturbance in
each drilling location. Four of the six locations are grassy or otherwise vegetated roadside areas.
Disturbed ground in these areas will be covered with wood straw mulch or another erosion control BMP.
The remaining two locations involve drilling through roadway surfaces. These areas will be permanently
stabilized at the completion of drilling. All of the work occurs on WSDOT right of way, and no sensitive
areas will be disturbed as a result.
The work within the roadway will involve the temporary closure of one travel lane and traffic control will
be in place throughout this work.
Plan sheets depicting the boring locations are attached. Also attached is a flyer, which WSDOT will
distribute to affected residents prior to the commencement of work.

NOTICE OF NIGHTIIME WORK
The Washington State Department of Transportation (WSDOT) will be conducting nighttime construction work on
February 15, 2016. The work will allow WSDOT crews to perform soil investigation a long the SR 167 a nd I-405 corridor.
In o rd e r to perform soil investigation along the SR 167 and 1-405 corridor, WSDOT anticipates dril ling in one location
that may impact noi se levels at nearby residences. That boring location is s hown on the map be low. WSDOT anticipates
performing this work the night of Monday, February 15, 2016. Work is anticipated to be complete by 5 a .m. on Tuesday,
February 16, 2016 . This work may require an additional ni ght durin g the week of February 15th .
Work will occur in side the I -405 right of way. Construction equipment used during thi s time will include, but is not
limited to, generators, light plants , drilling rigs and trucks. Nearby residents can expect similar noi se levels to the existing
I-405 and SR 167 background traffic noi se with some hi g her than normal peak noi se levels while the drilling equipment is
in use.
Why work at night?
Crews will work at night to finish the boring quickl y and minimize daytime impacts to thi s key commute and freight
route.
