NA 99111 "I'l IIS AGREEMENT is made this OV day of ScpUneber, 1995 by and between Kinder - Cate Learninr Centers, Inc. a Delaware Corporation (Kinder -Care), and Anton A. Ahhoff and Millie E. Althoff, husband and wife (Althoff). Background Kinder -Care is purchasing a parcel of land, further described as Exhibit "A"" in the County of King, City of Renton, State of Washington from the Althofrs. In connection with their purchase of the property, Althoff wishes to grant i!nd convey a Constriction casement to Kinder -Care un:c. and accross Althoff's property, more particularly described as Exhibit "B" attached hereto.The p-irpose of the easemera is to divert the above ground stream to an undergro,:nd storm drain culvert and to connect the newly created storm drain culvert with the existing cuiv�,: -. said premisis. Oro r.N CONSIDERATION of the sums of one dollar ($1.00) and other bargained for v CV) consideration, and subject to the terms and considerations set forth below,Althoff hereby —' grants Kinder -Care an casement for the purposes ana to the extent provided herein. CO THEREFORE, the parties agree as follows: (l.) Grantor Althoff hereby grants and conveys to Grantee Kinder -Care, its successors and assigns, a perpetual easement, under and accross the land of Grantor, more particularly described as Exhibit "C attached hereto. 2.) Grantee, Kinder -Care will bear the entire cost of constructing said storm drain culvert and connection with existing culvert on easement area, and will hold Grantor Althoff harmless from any and all costs, expenses, claims or demands relating to, arising from or out of the construction of said easement. (3.) The Grantor Althoff shall fully use and enjoy the aforesaid premises, including the right to use the surface of said Construction casement if such use does not interfere with installation and function of said storm drain culvert. Ilowever, the Grantor Althoff shall not erect ouildings or permanent structures over, under or accross the easement area. (4.) This Agreement shall be binding upon and nun with the land and shall inure to the benefit of and be binding upon the owners described above their heirs, successors and assigns, and personal representatives. rAB IN WITNESS whereof, the parties have hereunto set their hands and seal this J f7— day of September, 1985.
