The parcel to the north (PIO 7224000340) is also zoned CN and has an existing vacant restaurant. No parking and/or infrastructure associated with the temporary use is proposed on parcel 7224000340. The parcel to the south (PIO 7224000330) is vacant and zoned Residential-10 (R-10). Vehicle circulation associated with the temporary use is proposed on parcel 7224000330. Per Footnote 80 of RMC 4-2-080, Zoning Use Table, drive-In/drive-through retail is permitted in the CN zone as an Accessory Use, provided the use is either a) located on the same lot with another building/use; orb) structurally integrated into another building/use; or c) located on its own lot with some amount of indoor customer seating to qualify the drive-through as "accessory" to the eating/drinking establishment. No indoor seating is proposed with this temporary structure. The temporary use will be open 7 days a week, from Sam to 7pm. The proposed temporary structure is approximately 166 square feet. Access to the coffee stand is proposed via an existing curb cut from Park Ave Non the east side of parcel 7224000335, or from the existing alley to the west. The applicant proposes 4 stacking parking spaces. Vehicles that access the temporary coffee stand from Park Ave N will enter the parking lot from the east, execute a U-turn, and approach the coffee stand from the west portion ot' the parcel. The turning movement of the vehicle headlights will temporarily impact nearby residential occupants to the south, within 46 feet of the proposed temporary use. Since the proposed temporary use will increase vehicular traffic flow and light emissions during the early morning hours, staff recommends as a condition of approval that a 5 -6 foot tall temporary fence be installed between parcel 7224000335 and parcel 7224000330 to the south, in order to ensure a visual screening between this temporary use and residential uses to the south. The fence shall be either cedar or vinyl and shall be opaque. In addition, because the purpose of this permit is to provide a temporary location for this existing business while the applicant acquires a permanent location, staff recommends as a condition of approval that the temporary use shall be valid for one year only, with no possible extensions. The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions. *CONDITIONS OF APPROVAL: 1. Ingress to and egress from the proposed temporary use shall be provided via the existing alley and/or the existing curb cut on parcel 7224000335 only. Customers shall not access from the southern parking lot or the southern curb cut (PID 7224000330). Prior to operation, the applicant shall install parking and traffic control signs (two square feet or less) on the property to direct customers to and from the temporary use. 2. However, the planning department is supportive of a rezone for the property. You could choose to request the rezone with associated development or request the rezone without associated development. The rezone with associated development can be done concurrently with the SEPA and site plan review.
