The two permit applications are approved, subject to conditions. Testimony Matthew Herrera, Senior Planner, summarized the proposal. He noted that references in the staff report that the subject property is 25 acres in size is incorrect. The property is 66 acres. The portion of the property subject to the application is 12 acres. In response to examiner questions, Mr. Herrera responded that the soil at the site would not be used to replenish soil required by a consent decree for the project site and that the sole purpose of the soil pile is storage. The applicant isn't ready at this point to move the soil off the property. Once modified as proposed and conditioned, the configuration of the soil will not be changed. Exhibit 17 Exhibit 18 Exhibit 19 Procedural: February 21, 2017 Staff Report Staff power point COR maps on City's website FINDINGS OFF ACT I. Applicant. Paccar Inc. 2. Hearing. A hearing was held on the subject applications on February 21, 2017 at 11 :00 am in the City of Renton Council Chambers. Substantive: 3. Project Description. The applicant is requesting a Special Grade and Fill Permit and Site Plan approval to retain approximately 139,000 cubic yards of soil on the 66-acre Paccar property located at 1400 N. 4th Street. The existing stockpile is currently located on the southwest portion of the subject property near the Garden Ave. N. and N. 4th St. frontages. The stockpile is the remnant of preload and surcharge material that was used for soil compaction related to the recently constructed Paccar Parts and Distribution Center (PDC) on the southwest portion of the site. The soil was moved to its current location in 2015 and stabilized. The PDC building permit approved locating the preload and surcharge materials in its current location for a period of 5-years and then the applicant would be required to take action. No building construction or access improvements are proposed with the applicant's request. 4. Adequacy of Infrastructure/Public Services. The project will be served by adequate infrastructure and public services. Since the proposal is limited to a stabilized pile of soil with no occupancy, no infrastructure or public services is necessary. The drainage facilities for the site will not be changed as a result of the proposal and no changes are necessary as determined by City staff. 5. Adverse Impacts. As conditioned, there are no significant adverse impacts associated with the project. Specific issues related to impacts are discussed below. A. Critical Areas. The proposal is consistent with the City's Critical Areas Regulations and, therefore, all impacts are adequately addressed and there are no significant adverse impacts to critical areas. Critical areas at the site are limited to Wellhead Protection Zone 2 and High Seismic Area The applicant has provided fill source statements (Exhibit 6) certified by a professional engineer that the preload soil stockpile materials were obtained from sites that were not on the Hazardous Site SITE PLAN AND SPECIAL CLEAR AND GRADE PERMIT 2 , 2 3 4 5 6 7 8 9 IO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 List for Model Toxic Control Act or National Priority List for Federal "Superfund" List and the soils are native to the fill source site. The applicant's updated geotechnical memorandum (Exhibit 6) states the existing preload soil stockpile does not require compaction testing as it is non- structural. The report further states the track walking that occurred on the soil during its placement provided adequate compaction for its stockpile purpose. The report recommends the newly exposed slopes be revegetated as soon as possible to minimize the risk of erosion and sedimentation runoff and all potentially exposed soils be managed and capped with a minimum one-foot clean soil cap layer. The conditions of approval require compliance with the recommendations of the geotechnical report. B. Aesthetics. As conditioned, the project site is adequately screened from view and will not create any significant adverse aesthetic impacts. There is a six-foot tall chain link fence with barb wire around the perimeter of the project site. City staff has visited the site and determined the fence is in good condition. The stockpile is setback from the Garden Ave. N. property line approximately 25-feet. Setbacks from N. 4th St. are approximately 40-feel. The City has not received any complaints on the existing stockpile during this application process. City staff has worked with the applicant to modify the existing slope along Garden Ave N and regrade the slope to between 4-5 foot horizontal run per I-foot of vertical rise within 50-feet of the property line and to provide additional tree planting along the stockpile's south and west perimeter. The area between the fence and the stockpile is vegetated with a mix of mature evergreen trees such as Douglas Fir and W cstem Red Cedar and recently planted evergreen trees and shrubs. There are gaps along the Garden Ave. N. frontage where vegetation is sparse or the newly planted vegetation appears to be unhealthy. The applicant has submitted a revised landscaping plan (Exhibit 5) that provides I 03 new Western Red Cedar trees to be planted on the existing perimeter adjacent to N. 4th St. and the proposed modified slope along Garden Ave. N. A condition of approval requires the applicant to submit an irrigation plan for the newly planted trees. Another condition requires the applicant's Landscape Architect to provide an assessment of the existing perimeter landscaping with regard to health and vigor and prepare and implement a plan to return any unhealthy plants to healthy status or replace those shrubs and/or trees that are dead, diseased, or near death. A surety device will be required for the newly planted and any replanted vegetation to guarantee plant survival for a period of5-years. C. Noise and Dust. The proposal will not create any significant adverse noise or dust impacts. Staff determined that the amount of soil cuts and fills on the site are typical of a development project and therefore code based requirements for noise and dust control limitations should be appropriate. The applicant will be required to implement any additional dust and wheel wash procedures as identified in a hazardous waste consent decree applicable to the project site and/or company policy document for those areas containing contaminated soil that will be disturbed as part of the slope regrade. A condition of approval requires the applicant to submit a Construction Mitigation Plan that identifies the construction dates, hours of construction, vehicle routes, measures to minimize dust, erosion, mud, and noise. The mitigation plan will also identify all specific special procedures as required by the consent decree and company policy document to handle, store, and/or remove contaminated soils. The Construction Mitigation Plan shall be submitted to the Current Planning Project Manager for review and approval prior to grading license approval. Adequate provision is made for ensuring that the proposal doesn ·t create any significant adverse drainage impacts. The preload soil stockpile was graded to drain to existing catch basins and conveyance pipes that were on the site prior to grading. The applicant's landscape plan (Exhibit 5) identifies erosion control planting (hydroseed) for the regraded areas along the Garden Ave. N. frontage. The updated Geotechnical Memorandum recommends the exposed soil on the newly graded slopes be revegetated as soon as possible following regrading to minimize risk of erosion and sedimentation runoff. A condition of approval requires the applicant to comply with all recommendations of the Geotechnical Memorandum. E. Views. The existing preload soil stockpile does not block view corridors to shorelines or Mt. Rainier. F. Compatibilitv/Size and location of the activity. As conditioned, the proposal is fully compatible with surrounding uses. Since the soil stockpile will be largely screened from view and has no other adverse impacts associated with it, it is difficult to conceive of any use to which the proposal would be incompatible. In any event, the surrounding uses are relatively intense and there are no apparent compatibility issues. The Renton School District Bus Barn and Boeing office with surface parking is located across Garden Ave. N. to the west. Zoning to the west is UC and IL. To the south of the project are multi-family duplexes and single-family residential is located across N. 4th St. to the south. Zoning to the south is R-10. The Paccar campus with Kenworth Truck Plant and the new PDC building is located to the north and east, respectively. Conclusions of Law 1. Authority. RMC 4-9-080(F)(2) provides that the hearing examiner is responsible for granting special permits for fill and grade and the permit is classified is a Type III review by RMC 4-8-0SO(G). Site plan review is classified as a Type II permit by RMC 4-8-0SO(G). Both of the aforementioned permits have been consolidated. RMC 4-8-080(C)(2) requires consolidated permits to each be processed under "the highest-number procedure". The special permit has the highest numbered review procedures, so both permits must be processed as Type Ill applications. As Type lII applications, RMC 4-8-0SO(G) grants the Examiner with the authority to hold a hearing and issue a final decision on them, subject to closed record appeal to the City Council. 2. Zoning/Comprehensive Plan Designations. The subject property is zoned Heavy Industrial (IH). The comprehensive plan land use designation is Employment Area (EA). 3. Review Criteria. Pursuant to RMC 4-9-200.B, Site Plan Review is required for development in the Employment Area land use designation when it is not exempt from Environmental (SEPA) review. Site plan review criteria are governed by RMC 4-9-200(E). The special grade and fill permit was required as a condition for approval for the original placement of the soil. The condition required a special grade and fill permit to retain the soil if it remained on the property for more than five years. SITE PLAN AND SPECIAL CLEAR AND GRADE PERMIT 4 • I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 The criteria for special grade and fill permits is governed by RMC 4-9-080(F)( 4 ). All applicable criteria are quoted below in italics and applied through corresponding conclusions of law. Site Plan RMC 4-9-200(E)(3): Criteria: The Administrator or designee must find a proposed project to be in compliance with the following: a. Compliance and Consistency: Conformance with plans. policies, regulations and approvals, including: i. Comprehensive Plan: The Comprehensive Plan, its elements, goals, objectives, and policies, especially those of the applicable land use designation; the Community Design Element; and any applicable adopted Neighborhood Plan: ii. Applicable land use regulations; iii. Relevant Planned Action Ordinance and Development Agreements; and iv. Design Regulation,: Intent and guidelines of the design regulations located in R.MC 4-3-100. 4. The proposal is consistent with the comprehensive plan as outlined in Finding No. 20 of the staff report. The proposal is consistent with the zoning code as outlined in Finding No. 22b of the staff report. No design standards apply as the proposal is not in a design district. No planned action ordinance or development agreement applies. RMC 4-9-200(E)(3)(b ): Off-Site Impacts: Mitigation of impacts to surrounding properties and uses, including: i. Structures: Restricting over scale structures and overconcentration of development on a particular portion of the site; ii. Circulation: Providing desirable transitions and linkages between uses, streets, walkways and adjacent properties; iii. Loading and Storage Areas: Locating, designing and screening storage areas, utilities, rooftop equipment, loading areas, and refuse and recyclables to minimize views.from surrounding properties; iv. Views: Recognizing the public benefit and desirability of maintaining visual accessibility to attractive natural features; SITE PLAN AND SPECIAL CLEAR AND GRADE PERMIT 5 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 v. Landscaping: Using landscaping to provide transitions between development and surrounding properties to reduce noise and glare, maintain privacy, and generally enhance the appearance of the project; and vi. Lighting: Designing and/or placing exterior lighting and glazing in order to avoid excessive brightness or glare to adjacent properties and streets. 5. All off-site impacts have been addressed in Finding of Fact No. 5. As conditioned and as determined in Finding of Fact No. 5, the proposal will not create any significant off-site impacts. The criterion is met. RMC 4-9-200(E)(3)(c): On-Site Impacts: Mitigation of impacts to the site, including: i. Structure Placement: Provisions for privacy and noise reduction by building placement, spacing and orientation; ii. Structure Scale: Consideration of the scale of proposed structures in relation to natural characteristics, views and vistas, site amenities, sunlight, prevailing windf, and pedestrian and vehicle needs; iii. Natural Features: Protection of"the natural landscape by retaining existing vegetation and soils, using topography to reduce undue cutting and filling, and limiting impervious surfaces; and iv. Landscaping: Use of landscaping to soften the appearance of parking areas, to provide shade and privacy where needed, to define and enhance open spaces, and generally to enhance the appearance of the project. Landscaping also includes the design and protection of planting areas so that they are less susceptible to damage from vehicles or pedestrian movements. 6. The criterion is met. Most requirements do not apply, as there are no buildings or other improvements at the stockpile site. All existing vegetation is proposed to be retained and a condition of approval requires the applicant to revitalize areas that may be in decline. No impervious areas are proposed with the application. Existing and new landscaping planted between the property fence and soil stockpile softens the effects of the grade change from the street. A majority of the landscaping are evergreen varieties that will provide screening year-round. New frontage improvements along Garden Ave N. also incorporated several of the site's existing mature evergreen trees, which provide a tree lined sidewalk along the portions of the frontage. Planting areas are located behind a 6-foot tall chain link fence and therefore not be susceptible to damage. The two permit applications are approved, subject to conditions. Testimony Matthew Herrera, Senior Planner, summarized the proposal. He noted that references in the staff report that the subject property is 25 acres in size is incorrect. The property is 66 acres. The portion of the property subject to the application is 12 acres. In response to examiner questions, Mr. Herrera responded that the soil at the site would not be used to replenish soil required by a consent decree for the project site and that the sole purpose of the soil pile is storage. The applicant isn't ready at this point to move the soil off the property. Once modified as proposed and conditioned, the configuration of the soil will not be changed. A hearing was held on the subject applications on February 21, 2017 at 11:00 am in the City of Renton Council Chambers. Substantive: 3. Project Description. The applicant is requesting a Special Grade and Fill Permit and Site Plan approval to retain approximately 139,000 cubic yards of soil on the 66-acre Paccar property located at 1400 N. 4th Street. The existing stockpile is currently located on the southwest portion of the subject property near the Garden Ave. N. and N. 4th St. frontages. The stockpile is the remnant of preload and surcharge material that was used for soil compaction related to the recently constructed Paccar Parts and Distribution Center (PDC) on the southwest portion of the site. The soil was moved to its current location in 2015 and stabilized. The PDC building permit approved locating the pre load and surcharge materials in its current location for a period of 5-years and then the applicant would be required to take action. No building construction or access improvements are proposed with the applicant's request. 4. Adequacy of Infrastructure/Public Services. The project will be served by adequate infrastructure and public services. Since the proposal is limited to a stabilized pile of soil with no occupancy, no infrastructure or public services is necessary. The drainage facilities for the site will not be changed as a result of the proposal and no changes are necessary as determined by City staff. 5. Adverse Impacts. As conditioned, there are no significant adverse impacts associated with the project. Specific issues related to impacts are discussed below. A. Critical Areas. The proposal is consistent with the City's Critical Areas Regulations and, therefore, all impacts are adequately addressed and there are no significant adverse impacts to critical areas. The applicant's updated geotechnical memorandum (Exhibit 6) states the existing preload soil stockpile does not require compaction testing as it is non- structural. The report further states the track walking that occurred on the soil during its placement provided adequate compaction for its stockpile purpose. The report recommends the newly exposed slopes be revegetated as soon as possible to minimize the risk of erosion and sedimentation runoff and all potentially exposed soils be managed and capped with a minimum one-foot clean soil cap layer. The conditions of approval require compliance with the recommendations of the geotechnical report. B. Aesthetics. As conditioned, the project site is adequately screened from view and will not create any significant adverse aesthetic impacts. There is a six-foot tall chain link fence with barb wire around the perimeter of the project site. City staff has visited the site and determined the fence is in good condition. The stockpile is setback from the Garden Ave. N. property line approximately 25-feet. Setbacks from N. 4th St. are approximately 40-feet. The City has not received any complaints on the existing stockpile during this application process. City staff has worked with the applicant to modify the existing slope along Garden Ave N and regrade the slope to between 4-5 foot horizontal run per I-foot of vertical rise within 50-feet of the property line and to provide additional tree planting along the stockpile's south and west perimeter. The area between the fence and the stockpile is vegetated with a mix of mature evergreen trees such as Douglas Fir and Western Red Cedar and recently planted evergreen trees and shrubs. There are gaps along the Garden Ave. N. frontage where vegetation is sparse or the newly planted vegetation appears to be unhealthy. The applicant has submitted a revised landscaping plan (Exhibit 5) that provides I 03 new Western Red Cedar trees to be planted on the existing perimeter adjacent to N. 4th St. and the proposed modified slope along Garden Ave. N. A condition of approval requires the applicant to submit an irrigation plan for the newly planted trees. Another condition requires the applicant's Landscape Architect to provide an assessment of the existing perimeter landscaping with regard to health and vigor and prepare and implement a plan to return any unhealthy plants to healthy status or replace those shrubs and/or trees that are dead, diseased, or near death. A surety device will be required for the newly planted and any replanted vegetation to guarantee plant survival for a period of 5-years. C. Noise and Dust. The proposal will not create any significant adverse noise or dust impacts. Staff determined that the amount of soil cuts and fills on the site are typical of a development project and therefore code based requirements for noise and dust control limitations should be appropriate. The applicant will be required to implement any additional dust and wheel wash procedures as identified in a hazardous waste consent decree applicable to the project site and/or company policy document for those areas containing mntaminated soil that will be disturbed as part of the slope regrade. A condition of approval requires the applicant to submit a Construction Mitigation Plan that identifies the construction dates, hours of construction, vehicle routes, measures to minimize dust, erosion, mud, and noise. The mitigation plan wi II also identify all specific special procedures as required by the consent decree and company policy document to handle, store, and/or remove contaminated soils. The Construction Mitigation Plan shall be submitted to the Current Planning Project Manager for review and approval prior to grading license approval. Adequate provision is made for ensuring that the proposal doesn't create any significant adverse drainage impacts. The preload soil stockpile was graded to drain to existing catch basins and conveyance pipes that were on the site prior to grading. The applicant's landscape plan (Exhibit 5) identifies erosion control planting (hydroseed) for the regraded areas along the Garden Ave. N. frontage. The updated Geotechnical Memorandum recommends the exposed soil on the newly graded slopes be revegetated as soon as possible following regrading to minimize risk of erosion and sedimentation runoff. A condition of approval requires the applicant to comply with all recommendations of the Geotechnical Memorandum. E. Views. The existing preload soil stockpile does not block view corridors to shorelines or Mt. Rainier. F. Compatibility/Size and location of the activity. As conditioned, the proposal is fully compatible with surrounding uses. Since the soil stockpile will be largely screened from view and has no other adverse impacts associated with it, it is difficult to conceive of any use to which the proposal would be incompatible. In any event, the surrounding uses are relatively intense and there are no apparent compatibility issues. The Renton School District Bus Barn and Boeing office with surface parking is located across Garden Ave. N. to the west. Zoning to the west is UC and IL. To the south of the project are multi-family duplexes and single-family residential is located across N. 4th St. to the south. Zoning to the south is R-10. The Paccar campus with Kenworth Truck Plant and the new PDC building is located to the north and east, respectively. Conclusions of Law I. Authority. RMC 4-9-080(F)(2) provides that the hearing examiner is responsible for granting special permits for fill and grade and the permit is classified is a Type III review by RMC 4-8-0SO(G). Site plan review is classified as a Type II permit by RMC 4-8-0SO(G). Both of the aforementioned permits have been consolidated. RMC 4-8-080(C)(2) requires consolidated permits to each be processed under "the highest-number procedure". The special permit has the highest numbered review procedures, so both permits must be processed as Type III applications. As Type III applications, RMC 4-8-0SO(G) grants the Examiner with the authority to hold a hearing and issue a final decision on them, subject to closed record appeal to the City Council. 2. Zoning/Comprehensive Plan Designations. The subject property is zoned Heavy Industrial (IH). The comprehensive plan land use designation is Employment Area {EA). 3. Review Criteria. Pursuant to RMC 4-9-200.B, Site Plan Review is required for development in the Employment Area land use designation when it is not exempt from Environmental (SEPA) review. Site plan review criteria are governed by RMC 4-9-200(E). The special grade and fill permit was required as a condition for approval for the original placement of the soil. The condition required a special grade and fill permit to retain the soil if it remained on the property for more than five years. Structure Placement: Provisions for privacy and noise reduction by building placement, spacing and orientation; ii. Natural Features: Protection of the natural land~cape by retaining existing vegetation and soils, using topography to reduce undue cutting and filling, and limiting impervious surfaces; and iv. Landscaping: U,·e of landscaping to soften the appearance of parking areas, to provide shade and privacy where needed, to define and enhance open spaces, and generally to enhance the appearance of the project. Most requirements do not apply, as there are no buildings or other improvements at the stockpile site. All existing vegetation is proposed to be retained and a condition of approval requires the applicant to revitalize areas that may be in decline. No impervious areas are proposed with the application. Existing and new landscaping planted between the property fence and soil stockpile softens the effects of the grade change from the street. A majority of the landscaping are evergreen varieties that will provide screening year-round. New frontage improvements along Garden Ave N. also incorporated several of the site's existing mature evergreen trees, which provide a tree lined sidewalk along the portions of the frontage. Planting areas are located behind a 6-foot tall chain link fence and therefore not be susceptible to damage. The two permit applications are approved, subject to conditions. Testimony Matthew Herrera, Senior Planner, summarized the proposal. He noted that references in the staff report that the subject property is 25 acres in size is incorrect. The property is 66 acres. The portion of the property subject to the application is 12 acres. In response to examiner questions, Mr. Herrera responded that the soil at the site would not be used to replenish soil required by a consent decree for the project site and that the sole purpose of the soil pile is storage. The applicant isn't ready at this point to move the soil off the property. Once modified as proposed and conditioned, the configuration of the soil will not be changed. A hearing was held on the subject applications on February 21, 2017 at 11 :00 am in the City of Renton Council Chambers. Substantive: 3. Project Description. The applicant is requesting a Special Grade and Fill Permit and Site Plan approval to retain approximately 139,000 cubic yards of soil on the 66-acre Paccar property located at 1400 N. 4th Street. The existing stockpile is currently located on the southwest portion of the subject property near the Garden Ave. N. and N. 4th St. frontages. The stockpile is the remnant of preload and surcharge material that was used for soil compaction related to the recently constructed Paccar Parts and Distribution Center (PDC) on the southwest portion of the site. The soil was moved to its current location in 2015 and stabilized. The PDC building permit approved locating the pre load and surcharge materials in its current location for a period of 5-years and then the applicant would be required to take action. No building construction or access improvements are proposed with the applicant's request. 4. Adequacy of Infrastructure/Public Services. The project will be served by adequate infrastructure and public services. Since the proposal is limited to a stabilized pile of soil with no occupancy, no infrastructure or public services is necessary. The drainage facilities for the site will not be changed as a result of the proposal and no changes are necessary as determined by City staff. 5. Adverse Impacts. As conditioned, there are no significant adverse impacts associated with the project. Specific issues related to impacts are discussed below. A. Critical Areas. The proposal is consistent with the City's Critical Areas Regulations and, therefore, all impacts are adequately addressed and there are no significant adverse impacts to critical areas. Critical areas at the site are limited to Wellhead Protection Zone 2 and High Seismic Area The applicant has provided fill source statements (Exhibit 6) certified by a professional engineer that the preload soil stockpile materials were obtained from sites that were not on the Hazardous Site SITE PLAN AND SPECIAL CLEAR AND GRADE PERMIT 2 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 List for Model Toxic Control Act or National Priority List for Federal "Superfund·' List and the soils are native to the fill source site. The applicant's updated geotcchnical memorandum (Exhibit 6) states the existing preload soil stockpile does not require compaction testing as it is non- structural. The report further stales the track walking that occurred on the soil during its placement provided adequate compaction for its stockpile purpose. The report recommends the newly exposed slopes be revegetated as soon as possible to minimize the risk of erosion and sedimentation runoff and all potentially exposed soils be managed and capped with a minimum one-foot clean soil cap layer. The conditions of approval require compliance with the recommendations of the geotechnical report. B. Aesthetics. As conditioned, the project site is adequately screened from view and will not create any significant adverse aesthetic impacts. There is a six-foot tall chain link fence with barb wire around the perimeter of the project site. City staff has visited the site and deterrnined the fence is in good condition. The stockpile is setback from the Garden Ave. N. property line approximately 25-feet. Setbacks from N. 4th St. are approximately 40-feet. The City has not received any complaints on the existing stockpile during this application process. City staff has worked with the applicant to modify the existing slope along Garden Ave N and regrade the slope to between 4-5 foot horizontal run per I-foot of vertical rise within 50-feet of the property line and to provide additional tree planting along the stockpile· s south and west perimeter. The area between the fence and the stockpile is vegetated with a mix of mature evergreen trees such as Douglas Fir and W cstcm Red Cedar and recently planted evergreen trees and shrubs. There are gaps along the Garden Ave. N. frontage where vegetation is sparse or the newly planted vegetation appears to be unhealthy. The applicant has submitted a revised landscaping plan (Exhibit 5) that provides 103 new Western Red Cedar trees to be planted on the existing perimeter adjacent to N. 4th St. and the proposed modified slope along Garden Ave. N. A condition of approval requires the applicant to submit an irrigation plan for the newly planted trees. Another condition requires the applicant's Landscape Architect to provide an assessment of the existing perimeter landscaping with regard to health and vigor and prepare and implement a plan to return any unhealthy plants to healthy status or replace those shrubs and/or trees that are dead, diseased, or near death. A surety device will be required for the newly planted and any replanted vegetation to guarantee plant survival for a period of 5-years. C. Noise and Dust. The proposal will not create any significant adverse noise or dust impacts. Staff deterrnined that the amount of soil cuts and fills on the site are typical of a development project and therefore code based requirements for noise and dust control limitations should be appropriate. The applicant will be required to implement any additional dust and wheel wash procedures as identified in a hazardous waste consent decree applicable to the project site and/or company policy document for those areas containing contaminated soil that will be disturbed as part of the slope regrade. A condition of approval requires the applicant to submit a Construction Mitigation Plan that identifies the construction dates, hours of construction, vehicle routes, measures to minimize dust, erosion, mud, and noise. The mitigation plan will also identify all specific special procedures as required by the consent decree and company policy document to handle, store, and/or remove contaminated soils. Adequate provision is made for ensuring that the proposal doesn't create any significant adverse drainage impacts. The preload soil stockpile was graded to drain to existing catch basins and conveyance pipes that were on the site prior to grading. The applicant's landscape plan (Exhibit 5) identifies erosion control planting (hydroseed) for the regraded areas along the Garden Ave. N. frontage. The updated Geotechnical Memorandum recommends the exposed soil on the newly graded slopes be revegetated as soon as possible following regrading to minimize risk of erosion and sedimentation runoff. A condition of approval requires the applicant to comply with all recommendations of the Geotechnical Memorandum. E. Views. The existing preload soil stockpile does not block view corridors to shorelines or Mt. Rainier. F. Compatibility/Size and location of the activitv. As conditioned, the proposal is fully compatible with surrounding uses. Since the soil stockpile will be largely screened from view and has no other adverse impacts associated with it, it is difficult to conceive of any use to which the proposal would be incompatible. In any event, the surrounding uses are relatively intense and there are no apparent compatibility issues. The Renton School District Bus Barn and Boeing office with surface parking is located across Garden Ave. N. to the west. Zoning to the west is UC and IL. To the south of the project are multi-family duplexes and single-family residential is located across N. 4th St. to the south. Zoning to the south is R-10. The Paccar campus with Kenworth Truck Plant and the new PDC building is located to the north and east, respectively. Conclusions of Law I. Authority. RMC 4-9-080(F)(2) provides that the hearing examiner is responsible for granting special permits for fill and grade and the permit is classified is a Type III review by RMC 4-8-0SO(G). Site plan review is classified as a Type II permit by RMC 4-8-0SO(G). Both of the aforementioned permits have been consolidated. RMC 4-8-080(C)(2) requires consolidated permits to each be processed under "the highest-number procedure". The special permit has the highest numbered review procedures, so both permits must be processed as Type III applications. As Type III applications, RMC 4-8-0SO(G) grants the Examiner with the authority to hold a hearing and issue a final decision on them, subject to closed record appeal to the City Council. 2. Zoning/Comprehensive Plan Designations. The subject property is zoned Heavy Industrial (IH). The comprehensive plan land use designation is Employment Area (EA). 3. Review Criteria. Pursuant to RMC 4-9-200.B, Site Plan Review is required for development in the Employment Area land use designation when it is not exempt from Environmental (SEPA) review. Site plan review criteria are governed by RMC 4-9-200(E). The special grade and fill permit was required as a condition for approval for the original placement of the soil. The condition required a special grade and fill permit to retain the soil if it remained on the property for more than five years. All applicable criteria are quoted below in italics and applied through corresponding conclusions of law. Site Plan RMC 4-9-200(E)(3): Criteria: The Administrator or designee must find a proposed project to be in compliance with the following: a. Compliance and Consistency: Conformance with plans, policies, regulations and approvals, including: i. Comprehensive Plan: The Comprehensive Plan, its elements, goals, objectives, and policies, especially those of the applicable land use designation; the Community Design Element; and any applicable adopted Neighborhood Plan; ii. Applicable land use regulations; iii. Relevant Planned Action Ordinance and Development Agreements; and iv. Design Regulations: Intent and guidelines of the design regulations located in RMC 4-3-100. 4. The proposal is consistent with the comprehensive plan as outlined in Finding No. 20 of the staff report. The proposal is consistent with the zoning code as outlined in Finding No. 22b of the staff report. No design standards apply as the proposal is not in a design district. No planned action ordinance or development agreement applies. RMC 4-9-200(E)(3)(b ): Off-Site Impacts: Mitigation of impacts to surrounding properties and uses, including: i. Structures: Restricting oversea le structures and overconcentration of development on a particular portion of the site; ii. Circulation: Providing desirable transitions and linkages between uses, streets, walkways and adjacent properties; iii. Loading and Storage Areas: Locating, designing and screening storage areas, utilities, rooftop equipment, loading areas, and refuse and recyclables to minimize views from surrounding properties; iv. Lighting: Designing and/or placing exterior lighting and glazing in order to avoid excessive brightness or glare to adjacent properties and streets. 5. All off-site impacts have been addressed in Finding of Fact No. 5. As conditioned and as determined in Finding of Fact No. 5, the proposal will not create any significant off-site impacts. The criterion is met. RMC 4-9-200(E)(3)(c): On-Site Impacts: Mitigation of impacts to the site, including: i. Structure Placement: Provisions for privacy and noise reduction by building placement, spacing and orientation; ii. Structure Scale: Consideration of the scale of proposed structures in relation to natural characteristics, views and vistas, site amenities, sunlight, prevailing winds, and pedestrian and vehicle needs; iii. Natural Features: Protection of the natural landscape by retaining existing vegetation and soils, using topography to reduce undue cutting and filling, and limiting impervious surfaces; and iv. Landscaping: Use of landscaping to soften the appearance ofparking areas, to provide shade and privacy where needed, to define and enhance open spaces, and generally to enhance the appearance of the project. Landscaping also includes the design and protection of planting areas so that they are less susceptible to damage from vehicles or pedestrian movements. 6. The criterion is met. Most requirements do not apply, as there are no buildings or other improvements at the stockpile site. All existing vegetation is proposed to be retained and a condition of approval requires the applicant to revitalize areas that may be in decline. No impervious areas are proposed with the application. Existing and new landscaping planted between the property fence and soil stockpile softens the effects of the grade change from the street. A majority of the landscaping are evergreen varieties that will provide screening year-round. New frontage improvements along Garden Ave N. also incorporated several of the site's existing mature evergreen trees, which provide a tree lined sidewalk along the portions of the frontage. Planting areas are located behind a 6-foot tall chain link fence and therefore not be susceptible to damage. RMC 4-9-200(E)(3)(d):Access and Circulation: Safe and efficient access and circulation for oil users, including: SITE PLAN AND SPECIAL CLEAR AND GRADE PERMIT 6 2 3 4 5 6 7 8 9 10 I I 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 i. Location and Consolidation: Providing access points on side streets or frontage streets rather than directly onto arterial streets and consolidation of ingress and egress points on the site and, when feasible, with adjacent properties; ii. Internal Circulation: Promoting safety and efficiency of the internal circulation system, including the location, design and dimensions of vehicular and pedestrian access points, drives, parking, turnarounds, walkways, bike ways, and emergency access ways; iii. Loading and Delivery: Separating loading and delivery areas from parking and pedestrian areas; iv. Transit and Bicycles: Providing transit, carpools and bicycle facilities and access; and v. Pedestrians: Providing safe and attractive pedestrian connections between parking areas, buildings, public sidewalks and adjacent properties. 7. The criterion is met and is mostly inapplicable. The proposal is not accessed by and does not interfere with any pedestrian or vehicular circulation and no connections to pedestrian or vehicular improvements are necessary. There arc no loading areas. RMC 4-9-200(E)(3)(e): Open Space: Incorporating open spaces to serve as distinctive project focal points and to provide adequate areas for passive and active recreation by the occupants/users of the site. 8. No open space is required for this use RMC 4-9-200(E)(3)(f): Views and Public Access: When possible, providing view corridors to shorelines and Mt. Rainier, and incorporating public access to shorelines. 9. There are no view corridors to shorelines or Mt. Rainier affected by the proposal. RMC 4-9-200(E)(3)(g): Natural Systems: Arranging project elements to protect existing natural systems where applicable. 10. As determined in Finding of Fact No. 5, the natural systems at the site (i.e. critical areas) will not be adversely affected by the proposal. RMC 4-9-200(E)(3)(h): Services and Infrastructure: Making available public services and facilities to accommodate the proposed use. 11. The project is served by adequate services and facilities as determined in Finding of Fact No. 4. LUAOG-139,ECF; LUAlG-000620,SA-H,SP Paccar Parts Distribution Building Proposal/ Purpose of Addendum: The original SEPA threshold determination for the Paccar Parts Distribution Buildings was issued on December 18, 2006. The original application included a proposal for the construction of a new 255,000 square foot parts distribution center with 5,000 square feet of office space. The Environmental Review Committee Staff Report, project description and the application materials did not explicitly disclose the site's regrading of the retained 139,000 cubic yards of pre-load surcharge soils. The intended purpose of this SEPA Addendum is to disclose the proposed regrade of the site's existing surcharge soils from the current 2:1 slope along the Garden Ave N. frontage to a 4:1 slope with new tree and erosion control planting. New trees are also proposed along the N. 4th St. frontage. The proposed regrading of the slope will require approximately 2,700 cubic yards of soil to be cut from the slope and relocated to an interior location on the existing graded pad. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on December 18, 2006, the Environmental Review Committee issued a Determination of Non-Significance -Mitigated (DNS-M) for the Paccar Parts Distribution Building. The DNS-M included five mitigation measures related to geotechnical recommendations, drainage and erosion control, truck traffic and mitigation fees. A 14-day appeal period commenced on December 18, 2006 and ended on January 5, 2007. An appeal was received on January 5, 2007 from the project proponents, requesting amending the mitigation measure that limited the hours of operation for truck traffic. The decision of the ERC was affirmed by the Hearing Examiner on March 19, 2007, resulting in no changes to the Addendum to Environmenta, ($EPA) Review Page 2 of 3 January 30, 2017 original DNS-M. As such, truck traffic would remain limited to the hours of 7:00 am to 10:00 pm. An Addendum to the original SEPA determination was issued on August 26, 2013 to clarify that an existing 28,500 square foot building was to be demolished as part of the project as part of site development for the distribution center. A second Addendum to the SEPA determination was issued June 15, 2015, to disclose the intended relocation and retention of 139,000 cubic yards of pre-load surcharge fill to the western portion of the site. It has been determined that the environmental impacts of the proposal were adequately addressed under the analysis of significant impacts contained within the previously adopted DNS-M. Based on WAC 197-11-600(4) c, the addendum process may be used if analysis or information is added that does not substantially change the analysis of significant impacts and alternatives in the existing environmental document. The regrading of the site's retained pre-load surcharge materials and new landscaping would not change the analysis or impacts in the State Environmental Policy Act (SEPA) Review. Please note however that this year, Ecology is due to review 5 years of groundwater monitoring data to determine if the site clean-up is performing as planned. The environmental requirements for redevelopment of the property may change as a result of this review. Costs for compliance with these requirements must be charged to the redevelopment project budget. 1. Both soil and groundwater may be contaminated and thus grading, excavation or trenching of soil below the minimum 12 " structural cap must be conducted by a contractor that is trained and conducts the work in accordance with WAC 296-62-300, Hazardous Waste Operations and Emergency Response. A Health and Safety Plan will be needed. See attached Heath and Safety Requirements applicable to any work performed below the level of the structural cap. 2. Soils greater than 12" in depth must be assumed to be contaminated. If the site soil is visibly clean and can be re-used on-site it must be stockpiled in a manner that prevents dust and stormwater contact including plastic sheeting underneath, and a cover each evening and during weather conditions that may result in dust or stormwater impacts. Berms should be used to avoid excessive stormwater contact with potentially contaminated soil. Erosion, stormwater and dust control plans will be needed. If the potentially contaminated but visibly clean soil is not re-used on-site, the soil stockpiles must be sampled with a 5-point composite sample for each individual stockpile or for each 500 cubic yards within a single stockpile, whichever is more, and tested for proper disposal. Soil stockpiles should be segregated in a manner that prevents contamination of clean soil and minimizes disposal costs. CED must pre-approve the disposal site(s). Copies of all test results, shipping papers and the final disposal site must be provided to CED. Off-site disposal of more than 200 cubic yards of potentially contaminated soil in any 3 month period must be pre-approved by CED and Ecology. 3. If visibly contaminated soil, debris or groundwater is encountered, CED should be notified immediately. With approval from CED, proceed with Hot Spot Removal Action (HSRA) for visibly contaminated soil as detailed in Item 15. Removed groundwater should be stored in a portable Baker tank. Visibly contaminated debris must be stockpiled on plastic and covered each evening or if weather conditions are such that wind or stormwater could contact and mobilize any contaminated soil that is adhering to the debris. Backfilling is allowable with either clean imported fill or visibly clean site soils. However, unless testing is performed to confirm that the visibly clean site soils meet MTCA clean-up levels, the site soil backfill must be covered with a minimum 12 " of clean imported backfill even under buildings or paved areas. Where the structural cap is disturbed it must be repaired or replaced to a minimum depth of 12 ", even under buildings or paved areas. 5. Excavations and trenches that may require future access for maintenance or repairs such as stormdrains or utility trenches must be lined with a geotextile as a marker and backfilled with clean imported fill. 6. Avoid collecting excessive stormwater in trenches and excavations with berms and other surface water diversions. 7. Contact CED if free-product or a sheen is visible in any encountered groundwater. With verbal approval from CED, collect the free-product or sheen with absorbent materials and properly dispose. 8. Potentially impacted soils and groundwater must not be stored south of the Aquifer Protection Zone. See attached Figure 2. 9. The dust control plan must include dust control measures such as water spaying for all operations that could generate dust. No visible dust is allowed. 10. A soil erosion plan is required to prevent erosion due to stormwater runoff or run-on from excavations, stockpiles, graded areas or other exposed site soils. Measures such as berms, straw bails, plastic covers and other means must be taken to control soil erosion. 11. Measures must be taken to protect site groundwater monitoring wells. CED must be notified of any well damage. The contractor shall be required to properly abandon and replace to meet or exceed original conditions. any damaged wells. 12. Site access shall be limited. No access will be allowed to the other parts of the PDS Superfund site. Any damage to the structural cap will be the responsibility of the contractor. If the existing access gate and road are damaged or removed the contractor will be asked to replace to meet existing conditions or better. 13. Site equipment that contacts potentially contaminated soil must be washed prior to leaving the site. Wash water must be collected for proper disposal. 14. Sales tax exemptions apply to remediation projects in Washington State under some circumstances. The contractor should be asked to apply for any application sales tax exemptions if remediation efforts such as disposal of contaminated soil or groundwater are required. The contractor may need a copy of the Consent Decree in applying for sales tax exemptions. PACCAR will make copies of the Consent Decree available upon request. May 5, 2003 Page 3 15. Confirmational soil samples must be taken from the bottom and sidewalls of the excavation as shown in Figure 1. Hot spots will be sampled on a 10 foot grid. One four point composite sample will be taken for each 800 square foot excavated bottom. One four point composite sample will also be taken for each 40 linear feet of side wall per layer of strata. Subsamples will be collected at midpoints of the strata. If the composite samples exceed a HSAL then excavation will continue until confirmational samples are below HSAL. However, excavations will not be continued vertically below an underlying protective silt layer. Pending disposal all soils exceeding HSAL must be stored in bermed, lined and covered stockpiles such that wind or stormwater will not contact and mobilize the contaminated soil. Berms should be used to prevent excessive contact of stormwater runoff with contaminated soil stockpiles. Soil stockpiles should be segregated in a manner that prevents contamination of clean soil and minimizes disposal costs. For disposal purposes, a 5 point composite sample will be taken for every 500 cubic yards of stockpiled soil. CED must pre-approve disposal sites. Copies of the shipping papers (manifests) test results, and disposal location must be provided to CED. Pre-approval from CED and Ecology is required for off-site disposal of greater than 200 cubic yards in any three-month period. The fill placed in this portion of the site consists of relocated preload fill material from the original PDC building pad. Hart Crowser monitored the preload fill placement and removal process during construction. The updated recommendations in this memorandum should only be used in conjunction with the general recommendations of our geotechnical engineering design study dated September 25, 2014, and subsequent supplemental recommendations provided by Hart Crowser. This memorandum is for the exclusive use of PACCAR, Barghausen Engineers, and their consultants for specific application to the subject project and site. We completed this memorandum in accordance with geotechnical practices generally accepted for work of a similar nature done in the same timeframe, in the same or similar localities, and under similar conditions. No other warranty, express or implied, is made. SW Fill Placement Recommendations The fill placed in the SW portion of the site is considered non-structural (i.e. not intended to support buildings, paved roads, or other surface structures). As such, geotechnical field observation or compaction testing was not required during placement. It is our opinion that track-walking the fill -.. PACCAR November 29, 2016 17946-02 Page 2 material with construction equipment during placement has provided adequate compaction for the intended purpose. We are not aware of any current plans to redevelop this portion of the site. If site development is considered for this portion of the site in the future, the building pad will be reevaluated for potential building support by the geotechnical engineer at that time. We understand that the current 2H:1 V (Horizontal :Vertical) fill slopes along Garden Avenue will be flattened to 4H:1 Vas part of the current regrading effort. This will improve long-term stability of this portion of the fill. We recommend that the exposed soil along the new slopes be revegetated as soon as possible following regrading, to minimize the risk of erosion and sedimentation runoff. The proposed regrading along the west edge of the SW fill area (Garden Avenue side) may expose previously placed and covered contaminated soil. Such potentially exposed contaminated soil should be managed (relocated if necessary) and capped by a minimum 1-foot thick clean soil cap layer, according to the existing contaminated soil handling protocols for the site. On-site Infiltration Potential Because of the fine-grained nature of the near-surface soils and presence of contaminated soils (below protective clean soil cap), the site is not considered suitable for on-site stormwater infiltration. Fill Source Statements The material placed in the SW fill area consists of previously imported preload fill used for the PDC building construction. In the absence of an approved soil engineering report, these provisions may be waived for minor fills not intended to support structures. For minor fills or waste areas, humps, hollows or water pockets shall be graded smooth with acceptable slopes. 2. Fill Location: Fill slopes shall not be constructed: a. On natural slopes steeper than two-and-one-half horizontal to one vertical (2.5: 1) that are fifteen feet (15') or greater in height (except in conjunction with a modification granted per RMC 4-9-250D1 for filling against the toe of a natural rock wall -see RMC 43-060N2a(ii)(2)); or b. Where the fill slopes toes out within twelve feet (12') horizontally of the top of existing or planned cut slopes that are fifteen feet (15') or greater in height and steeper than two-and-one-half horizontal to one vertical (2.5: 1 ). Preparation of Ground: The ground surface shall be prepared to receive fill by removing vegetation, noncomplying fill, topsoil and other unsuitable materials as determined by the soil engineer, and where the slopes are five to one (5:1) or steeper, by benching into sound bedrock or other competent material. 4. Fill Material: Fill materials shall have no more than minor amounts of organic substances and shall have no rock or similar irreducible material with a maximum dimension greater than eight inches (8"). Fill material shall meet the following requirements: a. Construction, Demolition, and Land Clearing Waste Prohibited: Fill material shall be free of construction, demolition, and land clearing waste except that this requirement does not preclude the use of recycled concrete rubble per Washington State Department of Transportation Standard Specifications for Road, Bridge, and Municipal Construction. b. Sampling and Analysis Procedures: The professional engineer or person under the professional engineer's supervision who samples earth materials to be used as imported fill, oversees analysis, and prepares the source statement required by subsections L4c and L4d of this Section shall follow procedures specified in WAC 173-340-820 and 173-340-830 of the Model Toxics Control Act Cleanup Regulation and "Guidance on Sampling and Data Analysis Methods" published by the Department of Ecology for earth materials potentially contaminated with hazardous materials other than petroleum. Procedures specified in "Guidance for Remediation of Petroleum Contaminated Soils" published by the Department of Ecology shall be followed for earth materials potentially contaminated with petroleum. h. Permittee Subject to Required Actions after Illegal Placement of Imported Fill. A permittee who stockpiles or grades imported fill at the site without Department review and acceptance of the source statement required by subsections L4c and L4d of this Section or who stockpiles or grades fill at the site that does not meet the fill quality requirements of subsections L4a and L4b of this Section is subject to measures specified by the Department to reduce risk of contamination of the site due to illegal placement of fill. Department Authority to Conduct Independent Sampling and Analysis: The Department shall have the authority to enter on to private property to conduct independent sampling and analysis of fill. If the Department determines that fill does not meet fill quality standards of subsections L4a and L4b of this Section, then it may require the permittee to accomplish any or all of the measures listed in part h. of this subsection at his or her own expense. j. Department Authority to Implement Removal and Remediation Measures: The Department or its authorized agents shall have the authority to implement measures listed in subsection L4h of this Section if the permittee fails to accomplish such measures in a timely manner. Minimum Compaction: All fills shall be compacted to a minimum of ninety five percent (95%) of maximum density as determined by American Public Works Association (APWA) specifications. Field density shall be determined in accordance with APWA standards. 6. Maximum Slope: The slope of fill surfaces shall be no steeper than is safe for the intended use. Except in conjunction with a modification granted per RMC 4-9-25001 for one of the circumstances listed in RMC 4-3-050N2a(ii) (Geologic Hazards - Modifications), fill operations associated with a plat, short plat, subdivision or dedication, or other permitted land development activity which would result in the creation of permanent slopes forty percent (40%) or greater which are fifteen feet (15') in height, i.e., protected slopes, shall not be approved. Permittee Subject to Required Actions after Illegal Placement of Imported Fill. A permittee who stockpiles or grades imported fill at the site without Department review and acceptance of the source statement required by subsections L4c and L4d of this Section or who stockpiles or grades fill at the site that does not meet the fill quality requirements of subsections L4a and L4b of this Section is subject to measures specified by the Department to reduce risk of contamination of the site due to illegal placement of fill. Department Authority to Conduct Independent Sampling and Analysis: The Department shall have the authority to enter on to private property to conduct independent sampling and analysis of fill. If the Department determines that fill does not meet fill quality standards of subsections L4a and L4b of this Section, then it may require the permittee to accomplish any or all of the measures listed in part h. of this subsection at his or her own expense. j. Department Authority to Implement Removal and Remediation Measures: The Department or its authorized agents shall have the authority to implement measures listed in subsection L4h of this Section if the permittee fails to accomplish such measures in a timely manner. Minimum Compaction: All fills shall be compacted to a minimum of ninety five percent (95%) of maximum density as determined by American Public Works Association (APWA) specifications. FILLS: Renton Municipal Code 4-4-060 Grading, Excavation, and Mining Regulations 1. Applicability and Exemptions: Unless otherwise recommended in the approved soil engineering report, fills shall conform to the provisions of this Section. In the absence of an approved soil engineering report, these provisions may be waived for minor fills not intended to support structures. For minor fills or waste areas, humps, hollows or water pockets shall be graded smooth with acceptable slopes. 2. Fill Location: Fill slopes shall not be constructed: a. On natural slopes steeper than two-and-one-half horizontal to one vertical (2.5: 1) that are fifteen feet (15') or greater in height (except in conjunction with a modification granted per RMC 4-9-25001 for filling against the toe of a natural rock wall -see RMC 43-060N2a(ii)(2)); or b. Where the fill slopes toes out within twelve feet (12') horizontally of the top of existing or planned cut slopes that are fifteen feet (15') or greater in height and steeper than two-and-one-half horizontal to one vertical (2.5: 1 ). Preparation of Ground: The ground surface shall be prepared to receive fill by removing vegetation, noncomplying fill, topsoil and other unsuitable materials as determined by the soil engineer, and where the slopes are five to one (5:1) or steeper, by benching into sound bedrock or other competent material. 4. Fill Material: Fill materials shall have no more than minor amounts of organic substances and shall have no rock or similar irreducible material with a maximum dimension greater than eight inches (8"). Fill material shall meet the following requirements: a. Construction, Demolition, and Land Clearing Waste Prohibited: Fill material shall be free of construction, demolition, and land clearing waste except that this requirement does not preclude the use of recycled concrete rubble per Washington State Department of Transportation Standard Specifications for Road, Bridge, and Municipal Construction. b. Cleanliness of Fill Material: Fill material shall not contain concentrations of contaminants that exceed cleanup standards for soil specified in WAC 173-340- 740, Model Toxics Control Act, regardless of whether all or part of the contamination is due to natural background levels at the fill source site. For project sites located in Zone 1 of the Aquifer Protection Area, fill material shall not contain detectable concentrations of petroleum per the definition of Class 1 Soils contained in Table Vin "Guidance for Remediation of Petroleum Contaminated Soils" published by the Department of Ecology. Where the detection limit (lower limit at which a chemical can be detected by a specified laboratory procedure) for a particular soil contaminant exceeds the cleanup standard for soil specified in WAC 173-340-740, then the detection limit shall be the standard for fill material quality. Detection limits shall be a published by the Department of Ecology in the current version of "TABLE II: SOIL, Method Detection Limits, Practical Quantitation Limits, and Comparison of Method B Values" or other source of information accepted by the Department if the Ecology publication does not address the contaminant. Special Requirement for Projects Located in Zone 1 of the Aquifer Protection Area and Which Will Involve Placement of More than Fifty (50) Cubic Yards of Imported Fill: A source statement certified by a professional engineer licensed in the State of Washington shall be provided to the Department and shall be reviewed and accepted by the Department prior to stockpiling or grading imported fill at the project site. The source statement, as defined in RMC 4-8- 120D19, shall be required for each source location from which imported fill will be obtained. (Amd. Ord. 4851, 8-7-2000) d. Special Requirement for Projects Located in Zone 2 of the Aquifer Protection Area and Which Will Involve Placement of more than One Hundred (100) Cubic Yards of Imported Fill: The source statement described in RMC 4-8-120D19 is required for each source location from which imported fill will be obtained. Abbreviated Source Statement for Aquifer Protection Area: The Department may accept a source statement, as defined in RMC 4-8-120D19, that does not include results of sampling and analysis of imported fill if it determines that adequate information is provided indicating that the source location is free of contamination. In addition to the information otherwise required by subsection as defined in RMC 4-8-120D19, such information may include, but is not limited to: i. Results of field testing of earth materials to be imported to the site with instruments capable of detecting the presence of contaminants; and ii. Source Statement Not Required for Imported Fill Obtained from Washington State Department of Transportation Approved Source: The source statement defined in RMC 4-8-120D19 is not required for those projects located in the aquifer protection area if contractual documents confirm that imported fill will be obtained from a Washington State Department of Transportation approved source. Sampling and Analysis Procedures: The professional engineer or person under the professional engineer's supervision who samples earth materials to be used as imported fill, oversees analysis, and prepares the source statement required by subsections L4c and L4d of this Section shall follow procedures specified in WAC 173-340-820 and 173-340-830 of the Model Toxics Control Act Cleanup Regulation and "Guidance on Sampling and Data Analysis Methods" published by the Department of Ecology for earth materials potentially contaminated with hazardous materials other than petroleum. Procedures specified in "Guidance for Remediation of Petroleum Contaminated Soils" published by the Department of Ecology shall be followed for earth materials potentially contaminated with petroleum. h. Permittee Subject to Required Actions after Illegal Placement of Imported Fill. A permittee who stockpiles or grades imported fill at the site without Department review and acceptance of the source statement required by subsections L4c and L4d of this Section or who stockpiles or grades fill at the site that does not meet the fill quality requirements of subsections L4a and L4b of this Section is subject to measures specified by the Department to reduce risk of contamination of the site due to illegal placement of fill. Provide the Department with a source statement meeting the requirements of subsection L4c of this Section within a time-period specified by the Department; 2. Immediately cover fill with a waterproof cover; 3. Immediately remove fill; 4. Installation of monitoring wells and monitoring of ground water quality; 5. Remediation of contamination of the site caused by the illegal placement of fill according to a schedule specified by the Department and in accordance with cleanup standards for soil and groundwater described in the Model Toxics Control Act Cleanup Regulation, Chapter 173-340. i. Department Authority to Conduct Independent Sampling and Analysis: The Department shall have the authority to enter on to private property to conduct independent sampling and analysis of fill. If the Department determines that fill does not meet fill quality standards of subsections L4a and L4b of this Section, then it may require the permittee to accomplish any or all of the measures listed in part h. of this subsection at his or her own expense. j. Department Authority to Implement Removal and Remediation Measures: The Department or its authorized agents shall have the authority to implement measures listed in subsection L4h of this Section if the permittee fails to accomplish such measures in a timely manner. The permittee shall be responsible for any costs incurred by the Department or its authorized agents in the conduct of such activities. (Amd. Ord. 4740, 7-19-1999) 5. Minimum Compaction: All fills shall be compacted to a minimum of ninety five percent (95%) of maximum density as determined by American Public Works Association (APWA) specifications. Field density shall be determined in accordance with APWA standards. 6. Maximum Slope: The slope of fill surfaces shall be no steeper than is safe for the intended use. Except in conjunction with a modification granted per RMC 4-9-25001 for one of the circumstances listed in RMC 4-3-050N2a(ii) (Geologic Hazards - Modifications), fill operations associated with a plat, short plat, subdivision or dedication, or other permitted land development activity which would result in the creation of permanent slopes forty percent (40%) or greater which are fifteen feet (15') in height, i.e., protected slopes, shall not be approved. I ~I Rev:08/2015 PACCAR PARTS DISTRIBUTION CENTER PRE-LOAD GRADE AND FILL Project Narrative This site is part of the Renton Parts Distribution Center. A building was constructed in the southern portion of the PACCAR plant site at the northwest corner of the intersection of Houser Way North and North 4th Street. As part of this project, a large quantity of preload material was required for the building. After the building pad settlement was completed, a portion of the preload material was removed from the building site and placed on the large open area to the west, at the northeast corner of North 4th Street and Garden Avenue North. The 139,000 cubic yards of material has already been placed and stabilized with seeding. This work was approved as part of the Temporary Sedimentation and Erosion Control Plans for the project, as well as the amended SEPA MONS issued June 15, 2015. The area where the fill has been placed is approximately 12.1 acres. In order for the existing fill to remain, it has been stated that a Fill and Grade Permit and a Site Plan Review is required. The zoning of the existing site is Heavy Industrial. There is property zoned Urban Center to the northwest, Light Industrial to the west, Residential (R-10) to the south and southwest, and Commercial Arterial to the southeast. All of the adjacent properties are separated by a City street. The current use of the subject site is vacant land. The site has been graded with the excess preload material from the newly constructed building to the east. There are some existing catch basins and conveyance pipes that were existing on site prior to the grading that remain and a newly constructed water line extension, but there are no other improvements in the graded area. There are currently mature trees, shrubs and a chain-link fence along both Garden Avenue North and North 4th Street that provide screening between the street and the pad. The grades on the site are approximately 6 feet to 10 feet higher than the surrounding streets. The perimeter slopes are graded at 2: 1. There is an existing storm pond at the northeast corner of the graded site. The soil consists of clean soil that was imported to the site. The site has been graded to drain to some existing catch basins and conveyance pipes that were on the site prior to grading. For now the land is to remain vacant. There are no current plans to develop this portion of the PACCAR campus. The existing fill is proposed to remain on site until that area is developed by the land owner in the future. The date of any future development is indeterminate at this time. The purpose of the fill is to consolidate the underlying soils so that extensive preload may be avoided on any potential future development. Site access is from an existing driveway and concrete pad that was previously designated Factory Avenue. Improvements were made to North 4th Street and Garden Avenue North with the recently completed building project; no further off-site improvements are warranted. No improvements are proposed for the site. The current King County appraised land value for the full 66-acre parcel is $34.5 million. So for the approximately 12. 1 acre site, the appraised land value is approximately $6.3 million. This site has been graded and stabilized with vegetation so no further site work is proposed, including landscaping, tree removal, job trailers or any other site modifications. The proposal for this site is for the existing fill already placed on the site to remain. The Site Plan Review criteria do not apply to this site as there is no proposed building, parking, or pedestrian amenities needed or proposed. The Environmental Review Committee Staff Report, project description and the application materials did not explicitly disclose the site pre-load amount and distribution of the 139,000 cubic yards of pre-load surcharge soils. The intended purpose of the subject SEPA Addendum is to disclose the intended retention and grading of 139,000 cubic yards of fill on the site. Based on the information submitted by the applicant on June 8, 2015; the location of the distribution building pre-load surcharge soils would be relocated from the new building vicinity in the southeast corner of the Paccar complex to the western portion of the site. The graded soils would be hydro seeded. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on December 18, 2006, the Environmental Review Committee issued a Determination of Non-Significance -Mitigated (DNS-M) for the Paccar Parts Distribution Building. The DNS-M included five mitigation measures related to geotechnical recommendations, drainage and erosion control, truck traffic and mitigation fees. A 14-day appeal period commenced on December 18, 2006 and ended on January S, 2007. An appeal was received on January S, 2007 from the project proponents, requesting amending the mitigation measure that limited the hours of operation for truck traffic. The decision of the ERC was affirmed by the Hearing Examiner on March 19, 2007, resulting in no changes to the Addendum to EnvironmeP•al (SEPA) Review Page2of3 June 12, 2015 original DNS-M. As such, truck traffic would remain limited to the hours of 7:00 am to 10:00 pm. An Addendum to the original SEPA determination was issued on August 26, 2013 to clarify that an existing 28,500 square foot building was to be demolished as part of the project as part of site development for the distribution center. It has been determined that the environmental impacts of the proposal were adequately addressed under the analysis of significant impacts contained within the previously adopted DNS-M. Based on WAC 197-11-600(4) c, the addendum process may be used if analysis or information is added that does not substantially change the analysis of significant impacts and alternatives in the existing environmental document. The retention of the pre-load surcharge materials for the distribution facility to the western area of the site, along with proposed mitigation, would not change the analysis or impacts in the State Environmental Policy Act (SEPA) Review. FILLS: Renton Municipal Code 4-4-060 Grading, Excavation, and Mining Regulations 1. Applicability and Exemptions: Unless otherwise recommended in the approved soil engineering report, fills shall conform to the provisions of this Section. In the absence of an approved soil engineering report, these provisions may be waived for minor fills not intended to support structures. For minor fills or waste areas, humps, hollows or water pockets shall be graded smooth with acceptable slopes. 2. Fill Location: Fill slopes shall not be constructed: a. On natural slopes steeper than two-and-one-half horizontal to one vertical (2.5:1) that are fifteen feet (15') or greater in height (except in conjunction with a modification granted per RMC 4-9-250D1 for filling against the toe of a natural rock wall -see RMC 43-060N2a(ii)(2)); or b. Where the fill slopes toes out within twelve feet (12') horizontally of the top of existing or planned cut slopes that are fifteen feet (15') or greater in height and steeper than two-and-one-half horizontal to one vertical (2.5: 1 ). (Amd. Ord. 4835, 3-27-2000; Ord. 4851, 8-7-2000) 3. Preparation of Ground: The ground surface shall be prepared to receive fill by removing vegetation, noncomplying fill, topsoil and other unsuitable materials as determined by the soil engineer, and where the slopes are five to one (5: 1) or steeper, by benching into sound bedrock or other competent material. 4. Fill Material: Fill materials shall have no more than minor amounts of organic substances and shall have no rock or similar irreducible material with a maximum dimension greater than eight inches (8"). Fill material shall meet the following requirements: a. Construction, Demolition, and Land Clearing Waste Prohibited: Fill material shall be free of construction, demolition, and land clearing waste except that this requirement does not preclude the use of recycled concrete rubble per Washington State Department of Transportation Standard Specifications for Road, Bridge, and Municipal Construction. b. Cleanliness of Fill Material: Fill material shall not contain concentrations of contaminants that exceed cleanup standards for soil specified in WAC 173-340- 740, Model Toxics Control Act, regardless of whether all or part of the contamination is due to natural background levels at the fill source site. For project sites located in Zone 1 of the Aquifer Protection Area, fill material shall not contain detectable concentrations of petroleum per the definition of Class 1 Soils contained in Table Vin "Guidance for Remediation of Petroleum Contaminated Soils" published by the Department of Ecology. Where the detection limit (lower limit at which a chemical can be detected by a specified laboratory procedure) for a particular soil contaminant exceeds the cleanup standard for soil specified in WAC 173-340-740, then the detection limit shall be the standard for fill material quality. Detection limits shall be a published by the Department of Ecology in the current version of "TABLE II: SOIL, Method Detection Limits, Practical Quantitation Limits, and Comparison of Method B Values" or other source of information accepted by the Department if the Ecology publication does not address the contaminant. Special Requirement for Projects Located in Zone 1 of the Aquifer Protection Area and Which Will Involve Placement of More than Fifty (50) Cubic Yards of Imported Fill: A source statement certified by a professional engineer licensed in the State of Washington shall be provided to the Department and shall be reviewed and accepted by the Department prior to stockpiling or grading imported fill at the project site. The source statement, as defined in RMC 4-8- 120019, shall be required for each source location from which imported fill will be obtained. (Amd. Ord. 4851, 8-7-2000) d. Special Requirement for Projects Located in Zone 2 of the Aquifer Protection Area and Which Will Involve Placement of more than One Hundred (100) Cubic Yards of Imported Fill: The source statement described in RMC 4-8-120019 is required for each source location from which imported fill will be obtained. Abbreviated Source Statement for Aquifer Protection Area: The Department may accept a source statement, as defined in RMC 4-8-120019, that does not include results of sampling and analysis of imported fill if it determines that adequate information is provided indicating that the source location is free of contamination. In addition to the information otherwise required by subsection as defined in RMC 4-8-120019, such information may include, but is not limited to: i. Results of field testing of earth materials to be imported to the site with instruments capable of detecting the presence of contaminants; and ii. Source Statement Not Required for Imported Fill Obtained from Washington State Department of Transportation Approved Source: The source statement defined in RMC 4-8-120019 is not required for those projects located in the aquifer protection area if contractual documents confirm that imported fill will be obtained from a Washington State Department of Transportation approved source. Sampling and Analysis Procedures: The professional engineer or person under the professional engineer's supervision who samples earth materials to be used as imported fill, oversees analysis, and prepares the source statement required by subsections L4c and L4d of this Section shall follow procedures specified in WAC 173-340-820 and 173-340-830 of the Model Toxics Control Act Cleanup Regulation and "Guidance on Sampling and Data Analysis Methods" published by the Department of Ecology for earth materials potentially contaminated with hazardous materials other than petroleum. Procedures specified in "Guidance for Remediation of Petroleum Contaminated Soils" published by the Department of Ecology shall be followed for earth materials potentially contaminated with petroleum. h. Permittee Subject to Required Actions after Illegal Placement of Imported Fill. A permittee who stockpiles or grades imported fill at the site without Department review and acceptance of the source statement required by subsections L4c and L4d of this Section or who stockpiles or grades fill at the site that does not meet the fill quality requirements of subsections L4a and L4b of this Section is subject to measures specified by the Department to reduce risk of contamination of the site due to illegal placement of fill. Provide the Department with a source statement meeting the requirements of subsection L4c of this Section within a time-period specified by the Department; 2. Remediation of contamination of the site caused by the illegal placement of fill according to a schedule specified by the Department and in accordance with cleanup standards for soil and groundwater described in the Model Toxics Control Act Cleanup Regulation, Chapter 173-340. i. Department Authority to Conduct Independent Sampling and Analysis: The Department shall have the authority to enter on to private property to conduct independent sampling and analysis of fill. If the Department determines that fill does not meet fill quality standards of subsections L4a and L4b of this Section, then it may require the permittee to accomplish any or all of the measures listed in part h. of this subsection at his or her own expense. j. Department Authority to Implement Removal and Remediation Measures: The Department or its authorized agents shall have the authority to implement measures listed in subsection L4h of this Section if the permittee fails to accomplish such measures in a timely manner. The permittee shall be responsible for any costs incurred by the Department or its authorized agents in the conduct of such activities. (Amd. Ord. 4740, 7-19-1999) 5. Minimum Compaction: All fills shall be compacted to a minimum of ninety five percent (95%) of maximum density as determined by American Public Works Association (APWA) specifications. Field density shall be determined in accordance with APWA standards. 6. Maximum Slope: The slope of fill surfaces shall be no steeper than is safe for the intended use. Except in conjunction with a modification granted per RMC 4-9-250D1 for one of the circumstances listed in RMC 4-3-050N2a(ii) (Geologic Hazards - Modifications), fill operations associated with a plat, short plat, subdivision or dedication, or other penmitted land development activity which would result in the creation of penmanent slopes forty percent (40%) or greater which are fifteen feet (15') in height, i.e., protected slopes, shall not be approved.
