all street and lane closures, and the plan shall be performed in compliance with the Manual on
Uniform Traffic Control Devices.
• Notify emergency services (253-852-2121) twenty-four (24) hours before any street or lane closures.
• Any lane or street closures not in conformance with the approved traffic control plan and/or without
notification of emergency services may result in receiving a citation for violation of R.C.W. 47.36.200

including all costs of defense and attorney's fees incurred in defending against same, arising from and
related to implementation of the approved traffic control plans including claims arising from towing of
private vehicles and the acts of the Permit Holder's agents and employees.
• The City of Renton shall be entitled, in its reasonable discretion, to settle claims prior to suit or
judgment, and in such event shall indemnify and hold harmless the City for any such claims pa i d,
including the City's reasonable attorney's fees and litigation costs incurred resulting from such claim.
• In the event any claim or suit is brought against City within the scope of this Agreement, Permit Holder
will pay for legal counsel chosen by the City to defend against same. .
• Flagger and sign placement are subject to revision by the City Inspector on site, if needed to address
traffic or pedestrian safety or travel. .

NOTES:
• Work Zone Traffic Control shall be in accordance with the Manual on Uniform Traffic Control Devices (MUTCD)
and shown by sketch or reference to WSDOT.
• The plan must be submitted to the City's PW/Transportation Division for review and/or approval at least three
working days prior to work.
• Approved Temporary Traffic Control Plan must be at the work site during work hours.
• Contractor or entity must call Renton School District (425-204-4455) or any public/private agency to be affected
by a temporary lane or road closure.
• Complete assistance and accommodation shall be provided to all kinds of pedestrian traffic when sidewalk or
walkway is impeded.
• Total rnad clo5ure lasting more than 24 hours is subject to the approval by the City_.c_.o ... ulLau.cnil-____________ _
• Any vehicle, equipment, barricade, or portable tow-away sign used within the work area must display a
company logo or any legally acceptable sign showing the company name, address, and telephone number at a
conspicuous place on the vehicle or equipment.
In the case of Temporary No Parking Zones, all the following apply in addition to previous:
• Contractor must complete form to show limits of Temporary No Parking Zone identifying barricade locations for
vacate parking or curb lane usage.
• Contractor must post notice of dates and time of Temporary No Parking Zone with at leasttwo signs per block
72 hours in advance of effective date and time.
• The cover sheet of this Traffic Control Plan form must be attached to each Temporary No Parking Sign on the
project site.
• Temporary traffic control devices must be removed immediately when work is done or no construction activities
are going on. If deemed abandoned, City crews will remove and store them at the City's maintenance shop
(3555 NE 2'd Street).

Project Description: The Johns Creek Bridge site is approximately 24,000 square feet and is located west of
the Lake Washington Blvd and Houser Way Intersection in Renton, Washington at the south entry to Gene
Coulon Park and the Southport Mixed-Use Development. The crossing is located within Section 8 of Township
23 North and Range 05 East of the Willamette Meridian. No wetlands were identified at the project site and the
ordinary high water mark (OHWM) of Johns Creek was surveyed and incorporated into the site plans.
The current use of the specific site for the Bridge is for pedestrian and vehicular access to the Southport
Mixed-Use Development and Puget Sound Energy yard. Current stream flow beneath the road is
accomplished by three 60-inch pipe culverts while the stream channel itself is dominated by invasive
Himalayan blackberry. Improvements are needed as a result of the limited length of the existing culverts which
limit the road width.
The proposed project includes widening of the access road which will improve traffic flow entering and exiting
the site and be able to accommodate anticipated traffic flow for the future expansion of the Southport Mixed-
Use Development. Prior to closing the road, cofferdams will be installed on the upstream and downstream
ends of the proposed crossing and a creek bypass system will be established. After the road is closed, the
existing culverts will be removed and the new culvert subgrade will be excavated to remove near surface
organic material. Demolition of the area will include the existing asphalt driveway along with a few smaller
coniferous trees. Total trees removed includes six, 2" caliper and two, 6" caliper evergreens. After demolition
of surface improvements, subgrade elevation will be re-established with quarry spalls and the new culvert
segments will be placed and backfilled. Total excavation will be approximately 1,450 cu.yds. The banks will
be restored with native habitat plantings and new asphalt road paving along with a continuous sidewalk and
crosswalk that will provide a link from both Gene Coulon Park and the Southport Development to Lake
Washington Blvd.
Project cost for the bridge improvements will be approximately $500,000 with total project cost of
approximately $1.7 million for all associated pavement, utility, and stream restoration. Further information for
the Bridge improvements including but not limited to roadway improvements, bridge design, tree inventory,
stream study, mitigation plan, habitat data, and geotechnical report have been submitted to the City of Renton
Building Department under permit numbers B16002140 and U16002823. In addition, the Project has received
Hydraulic Project Approval (HPA) from the Washington Department of Fish and Wildlife and is currently
seeking Army Corp of Engineer approval due to work being performed within the ordinary high water mark.
EXHIBIT 2
Project Schedule: The project :,chedule includes a short duration closu. -of the entrance and exit of the
Southport development followed by a shortened duration of an alternating lane traffic configuration. Total
project duration would be eleven weeks. During the proposed short duration closure, the general contractor
would be able to excavate, install, backfill and temporarily surface the proposed culvert. Twenty-four hour
traffic control management will be provided to assist individuals entering or exiting the Southport Development.
Once the temporary surfacing has been installed over the culvert, an alternating lane traffic configuration would
be utilized for approximately 8 weeks, working Monday through Friday, to complete the remaining scope of the
project.
Date and Time Sought for Variance: Time of construction would be from 10 pm on Thursday through 11 :59
pm on Sunday for the short duration closure only. Specific dates for the closure are being coordinated with the
City of Renton Parks Department since there will be transportation impacts with the south entrance and south
parking lot of Gene Coulon Park. The entry to the Park will remain open but residents for the Bristol Apartment
Buildings located within the Southport Development will access the site via the south fire access road that joins
Southport with the Gene Coulon South parking lot. Current plans for the Thursday to Sunday closure are for
September 9-11 -to be confirmed with the City of Renton Parks Department prior to publication notice for the
Public Hearing.

Reasoning for Variance and Mitigation Measures: A 24 hour roadway closure will be utilized in an effort to
reduce construction impacts to the surrounding area and expedite construction. The short duration shutdown
will reduce the overall duration o, construction by approximately 8 weeks u .. lizing the expedited schedule. In
order to complete the construction within the timeframe allowed, Thursday evening through Sunday evening,
construction must occur outside the hours of 1 O:OOPM -7:00AM. The following mitigation and alternative
measures are proposed:
• Trucks receiving demo ACP and PCCP will be lined with soil to minimize impact noise. dBa reduction is
variable depending on the size of the ACP or PCCP being loaded and the height of which the material
is dropped.
• Light plants and small generators will be encased. The dBa volumes shown above represent the
expected dB a under this condition.
• When equipment is not being operated it will not be left on idle and will be shut down. dBa reduction will
be 100% when equipment is not operational.
• For the Puget Sound Energy yard access, alternative transportation measures for transformer transport
and driveway access have been reviewed and will be finalized with PSE. In addition, PSE will be
compensated for charges associated with the closure.
• For the Bristol at Southport, resident concessions will be offered. Concessions offered will be
commensurate with proximity to the construction site as a percentage of rent paid for the month of
September.

Variance Request Justification
In an effort to reduce construction impacts to the surrounding area and expedite construction, a noise variance
is requested for work outside of the City of Renton standard construction working hours of 7:00 am to 10:00 pm
weekdays and 9:00 am to 10:00 pm weekends for the Johns Creek Bridge installation. The applicant is
requesting the variance due to unnecessary hardship that would be incurred for the surrounding residents,
park visitors, Puget Sound Energy access, and construction traffic due to increased traffic control that would be
necessary with sustained lane closures to complete the bridge installation in multiple phases over the course of
an extended schedule. The granting of the variance will not be detrimental to adjacent properties nor shall the
approval of the variance grant a special privilege. The approval of the requested variance would be the
minimum variance that will accomplish the desired purpose.
By allowing continuous work over approximately a seventy-two hour road closure Thursday evening to Sunday
evening, the construction schedule would be decreased by approximately eight weeks. There are many
advantages of completing the culvert install operations over the course of a short duration closure in addition to
the justification of issues presented above. They include:
• Shortened construction schedule. Total Project construction would be 11 weeks as opposed to 18
weeks.
• Reduced stream bypass of John's Creek. A stream bypass duration of 2 weeks as opposed to 9 weeks
is included in the short duration closure schedule. The reduced stream bypass duration reduces the risk
of encountering a significant rain event and/or bypass failure.
• Reduced differential settlement. Due to the yielding subgrade conditions, continuous construction is
preferred to minimize the effect of settlement by joining precast culvert pieces at the same time versus
over the course of a multi-week phased construction with varying subgrade conditions.
• Reduced traffic impacts. Reduction in traffic control to accommodate access for the South Gene
Coulon Park entry, the Puget Sound Energy yard adjacent to the construction site, and Bristol
Apartment residents.

Project Description: The Johns Creek Bridge site is approximately 24,000 square feet and is located west of
the Lake Washington Blvd and Houser Way Intersection in Renton, Washington at the south entry to Gene
Coulon Park and the Southport Mixed-Use Development. The crossing is located within Section 8 of Township
23 North and Range 05 East of the Willamette Meridian. No wetlands were identified at the project site and the
ordinary high water mark (OHWM) of Johns Creek was surveyed and incorporated into the site plans.
The current use of the specific site for the Bridge is for pedestrian and vehicular access to the Southport
Mixed-Use Development and Puget Sound Energy yard. Current stream flow beneath the road is
accomplished by three 60-inch pipe culverts while the stream channel itself is dominated by invasive
Himalayan blackberry. Improvements are needed as a result of the limited length of the existing culverts which
limit the road width.
The proposed project includes widening of the access road which will improve traffic flow entering and exiting
the site and be able to accommodate anticipated traffic flow for the future expansion of the Southport Mixed-
Use Development. Prior to closing the road, cofferdams will be installed on the upstream and downstream
ends of the proposed crossing and a creek bypass system will be established. After the road is closed, the
existing culverts will be removed and the new culvert subgrade will be excavated to remove near surface
organic material. Demolition of the area will include the existing asphalt driveway along with a few smaller
coniferous trees. Total trees removed includes six, 2" caliper and two, 6" caliper evergreens. After demolition
of surface improvements, subgrade elevation will be re-established with quarry spalls and the new culvert
segments will be placed and backfilled. Total excavation will be approximately 1,450 cu.yds. The banks will
be restored with native habitat plantings and new asphalt road paving along with a continuous sidewalk and
crosswalk that will provide a link from both Gene Coulon Park and the Southport Development to Lake
Washington Blvd.
Project cost for the bridge improvements will be approximately $500,000 with total project cost of
approximately $1.7 million for all associated pavement, utility, and stream restoration. Further information for
the Bridge improvements including but not limited to roadway improvements, bridge design, tree inventory,
stream study, mitigation plan, habitat data, and geotechnical report have been submitted to the City of Renton
Building Department under permit numbers B16002140 and U16002823. In addition, the Project has received
Hydraulic Project Approval (HPA) from the Washington Department of Fish and Wildlife and is currently
seeking Army Corp of Engineer approval due to work being performed within the ordinary high water mark.
Project Schedule: The proj schedule includes a short duration cl re of the entrance and exit of the
Southport development followed by a shortened duration of an alternating lane traffic configuration. Total
project duration would be eleven weeks. During the proposed short duration closure, the general contractor
would be able to excavate, install, backfill and temporarily surface the proposed culvert. Twenty-four hour
traffic control management will be provided to assist individuals entering or exiting the Southport Development.
Once the temporary surfacing has been installed over the culvert, an alternating lane traffic configuration would
be utilized for approximately 8 weeks, working Monday through Friday, to complete the remaining scope of the
project.
Date and Time Sought for Variance: Time of construction would be from 10 pm on Thursday through 11 :59
pm on Sunday for the short duration closure only. Specific dates for the closure are being coordinated with the
City of Renton Parks Department since there will be transportation impacts with the south entrance and south
parking lot of Gene Coulon Park. The entry to the Park will remain open but residents for the Bristol Apartment
Buildings located within the Southport Development will access the site via the south fire access road that joins
Southport with the Gene Coulon South parking lot. Current plans for the Thursday to Sunday closure are for
September 9-11 -to be confirmed with the City of Renton Parks Department prior to publication notice for the
Public Hearing.

Reasoning for Variance and Mitigation Measures: A 24 hour roadway closure will be utilized in an effort to
reduce construction impacts to the surrounding area and expedite construction. The short duration shutdown
will reduce the overall durati< 'construction by approximately 8 we utilizing the expedited schedule. In
order to complete the construction within the timeframe allowed, Thursday evening through Sunday evening,
construction must occur outside the hours of 1 O:OOPM -7:00AM. The following mitigation and alternative
measures are proposed:
• Trucks receiving demo ACP and PCCP will be lined with soil to minimize impact noise. dBa reduction is
variable depending on the size of the ACP or PCCP being loaded and the height of which the material
is dropped.
• Light plants and small generators will be encased. The dBa volumes shown above represent the
expected dBa under this condition.
• When equipment is not being operated it will not be left on idle and will be shut down. dBa reduction will
be 100% when equipment is not operational.
• For the Puget Sound Energy yard access, alternative transportation measures for transformer transport
and driveway access have been reviewed and will be finalized with PSE. In addition, PSE will be
compensated for charges associated with the closure.
• For the Bristol at Southport, resident concessions will be offered. Concessions offered will be
commensurate with proximity to the construction site as a percentage of rent paid for the month of
September.

Variance Request Justification

In an effort to reduce construction impacts to the surrounding area and expedite construction, a noise variance
is requested for work outside of the City of Renton standard construction working hours of 7:00 am to 10:00 pm
weekdays and 9:00 am to 10:00 pm weekends for the Johns Creek Bridge installation. The applicant is
requesting the variance due to unnecessary hardship that would be incurred for the surrounding residents,
park visitors, Puget Sound Energy access, and construction traffic due to increased traffic control that would be
necessary with sustained lane closures to complete the bridge installation in multiple phases over the course of
an extended schedule. The granting of the variance will not be detrimental to adjacent properties nor shall the
approval of the variance grant a special privilege. The approval of the requested variance would be the
minimum variance that will accomplish the desired purpose.
By allowing continuous work over approximately a seventy-two hour road closure Thursday evening to Sunday
evening, the construction schedule would be decreased by approximately eight weeks. There are many
advantages of completing the culvert install operations over the course of a short duration closure in addition to
the justification of issues presented above. They include:
• Shortened construction schedule. Total Project construction would be 11 weeks as opposed to 18
weeks.
• Reduced stream bypass of John's Creek. A stream bypass duration of 2 weeks as opposed to 9 weeks
is included in the short duration closure schedule. The reduced stream bypass duration reduces the risk
of encountering a significant rain event and/or bypass failure.
• Reduced differential settlement. Due to the yielding subgrade conditions, continuous construction is
preferred to minimize the effect of settlement by joining precast culvert pieces at the same time versus
over the course of a multi-week phased construction with varying subgrade conditions.
• Reduced traffic impacts. Reduction in traffic control to accommodate access for the South Gene
Coulon Park entry, the Puget Sound Energy yard adjacent to the construction site, and Bristol
Apartment residents.

1. The term "mortgage" when used herein shall include deed of trust, trust deed, or other security
instrument.
2. If the proposed Insured has or acquires actual knowledge of a defect, lien, encumbrance,
adverse claim or other matter affecting the estate or interest or mortgage thereon covered by
this Commitment, other than those shown in Schedule B hereof, and shall fail to disclose such
knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act or reliance hereon to the extent the Company is prejudiced by
failure to so disclose such knowledge. If the proposed Insured shall disclosure such knowledge
to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien,

3. Liability of the Company under this Commitment shall be only to the named proposed Insured
and such parties included under the definition of Insured in the form of Policy or Policies
committed for, and only for actual loss incurred in reliance hereon in undertaking in good faith
(a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B,
or (c) to acquire or create the estate or interest or mortgage thereon covered by this
Commitment. In no event shall such liability exceed the amount stated in Schedule A for the
Policy or Policies committed for and such liability is subject to the Insuring provisions, exclusion
