(continued from January 28, 1970) The Chairman described the site approval application and statedthematterhadbeencontinuedtopresenthearinginorderto allow time for the applicant to discuss the application further with the planning staff and also to allow for the appearance before the Commission of the property owner, Mr. John Welch. The Planning Director stated that since the last Commission meeting, the staff has met with the applicant and the property owner. Discussions were held concerning the actual use of the site as well as the site plan itself. The questions essentially ' remain the same--first, is the proposed use permissible in- the M-P zone; and secondly, is the site plan acceptable in the opinion of the Planning Commission. Audience comments were invited. Mr. John Welch, property owner, stated that inasmuch as the property is zoned M-P, he did not think it was necessary for the use to be approved by the Com'- mission. The Chairman replied that some city officials had felt the proposed use was questionable in the Manufacturing Par( zone and the matter had been referred to the Planning Commission to resolve. Normally, the Planning Commission must approve all site plans in M-P zones, but in this case the ques- tion of permissibility of use must also be resolved. Cones-iderable discussion ensued among Commission members, the Plajnning Director and Mr. Welch concerning his proposed use, which in essence would be the remanufacture and sale of heavymachinery. The Chairman made the point that the proposed use lay; on a fine line of being a wrecking yard operation. Mr. Welch stated that he would abide by the fencing, screening and! setback requirements of the zone, and if they were vio- lated, the matter could come under the enforcement arm of the city' s ordinances. The Chairman stated that the City AttorneyhadIbeenconsultedonthematter, and he had informed the Planning Department that the permissibility of the use was not; a legal matter; that it was the prerogative of the Plan- ning Commission to hear all the facts and determine whether or not! a proposed use was or was not allowable in the zone. Discussion followed concerning similar uses in the immediate area of subject property; it being pointed out that the major- ity, of these uses are in the city of Tukwila and not under the control of Renton. The Leber Ink operation to the north is in the ' city of Renton. Zoning was granted prior to the enactment of the M-P ordinance, but the applicant accepted B-P (Business Parking) zoning on that portion of the property fronting WestValleyHighwayuponwhichnostructuresarepermitted. It was Mr. ,Welch' s contention that his proposed use is permitted under the {M-P ordinance under that section which states that permitted use include any use allowable in the L-1 zone together with such machinery and products manufacturing uses as specified in Section 4-713 (a) of the Zoning ordinance. Mr. Leo Scarsella, property owner directly 'south of subject property, stated he would have no objection to the operation provided it were cleaned up. With reference to poor condition of subject prop- erty, the Planning Director stated that in accordance with Commission wishes a letter addressed to W. C. Bogard, District Engineer, Washington State Highway Commission, Department of Highways, dated February 2, 1970, was hand delivered to Mr. Bogard' s office. The letter requested information concerning the State Highway Department' s intentions relative to the re- moval of decrepit houses and litter presently on state right- of-way adjacent subject property. To date, there has been no reply to this letter. Referring back to discussion of Section 4-712 : L-1 (Light Industry) from which the uses permitted in M-P are derived, the Planning Director stated the Commission' s authority to decide permissibility of use is contained in (a) Use Permitted: item (20) , "Other uses which can be reasonably considered simi- lar or related to the uses listed above (items 1 through 19) , upon approval of the Planning Commission. The Chairman stated the M-P section of the Zoning ordinance is a fairly new one and was established in order to control indus- trial development by uses and setbacks, landscaping and screen- ing. The Earlington Industrial Park was cited as an excellent example of this use and the avoidance of unsightly manufacturing uses through application of said controls. At the present time, wrecking yards are permitted only in the H-1 (Heavy Industry) district. Ross stated he felt that to reach a determination of the Com- miSsion' s definition of the use of this property is paramount and the Commission should handle this now, keeping in mind the long term effect the use will have on the city generally and the adjacent properties in particular. ACTION: MOVED BY DENZER, SECONDED BY ROSS, THAT THE PLANNING COMMISSION'S DETERMINATION OF PROPOSED USE WITH REFERENCE TO APPLICATION NO. SA-643-70 IS THAT THE STORAGE, REMANUFACTURE AND SALE OF HEAVY EQUIPMENT IS NOT PERMISSIBLE IN THE MANUFACTURING PARK ZONING DISTRICT. On the question, Poff stated that while he is in favor of reduc- ing, the amount of objectionable sights and noises that go with this type of land use, that when the Commission talks in terms ofgood planning one of the main definitions is a certain con- tinuity of land use in this area. In his opinion, in this case the' property owner is a victim of circumstances beyond his con- trol in that when he first acquired the property his proposed wrecking yard use was permitted in the L-1 district. This use was repealed and transferred to the H-1 district before he could put his plans into effect. Poff stated further that he is for good planning., but he did not think it was fair to make one man the[ victim of historical circumstances; hence' he was opposed to the] motion. It was noted by the Planning Director that prior to rezoning to M-P, the area in question was zoned G allowing residential uses only. PENDING MOTION. TO DENY PERMISSIBILITY OF PROPOSED USE. 'Welch Renton Planning Commission Meeting January 28, 1970 Minutes - Page 5 Discussion ensued concerning the feasibility of the new construc- tion as requested by the applicant, and the Planning Director stated he felt it would 'be desirable to have the plan checked by the Fire Department with reference to access for emergency vehicles due to the close proximity of the new building to the existing one. The Chairman stated he felt the hearing should be continued for two weeks to allow the planning staff time to check with the Fire Department and also give the applicant an opportunity to submit more detailed drawings of his proposed construction. ACTION: MOVED BY MOLA, SECONDED BY ROSS, THAT THE SPECIAL PERMIT APPLI- CATION OF LYLE BARGER BE CONTINUED TO THE ADMINISTRATIVE MEETING OF FEBRUARY 11 , 1970. MOTION CARRIED. No. SA-641-70; site approval for warehouse, offices and service shop in M-P zone; property located on southwest corner of SW 7th St. and Powell Ave. SW in Earlington Industrial Park The Chairman described the application; the Planning Director pointed out location of the property on the zoning map. The Planning Director stated the plan as presented does conform to the setback and parking requirements; however, the landscaping plan is not satisfactory in that the plantings shown are too sparse for the area to be covered. The Planning Director recom- mended that the Commission approve the site plan subject to re- submittal of the landscape plan and approval thereof by the Plan- ning Department. Audience comments in favor of the application were invited. Mr. Douglas Mulvanney, architect, appeared on behalf of the applicant. He stated he would be willing to revise the land- scape plan in accordance with the wishes of the Planning Com- mission and the Planning Director. The Chairman described the site approval application. The Plan- ning Director pointed out property location on the zoning map. Slides of the property were shown. The Planning Director stated the question before the Commission is two-fold; first, is the proposed use allowable in the M-P zone with reference to Sec- tion 4-712 (a) (20) ; and second, does the site plan as presented meet the approval of the Planning Commission as required under the M-P zone. The applicant' s proposed use of heavy equipment Renton Planning Commission Meeting January 28, 1970 Minutes Page 6 repair and storage would appear to be allowed only in the H-1 zone, and this question will be resolved by the Planning Com- mission: Mr. Mike Willard, 13844 SE 171st Street, the applicant, spoke on behalf of the application. He stated there have been consider- ablel problems concerning filling the property and he realized that' the development looks poor at the present time. The State Highway Department has purchased twenty feet of width fronting the property for the realignment of the West Valley Highway,and Mr. Willard stated he has just received permission from the State Highway Department to remove the unsightly old houses on the property. Considerable discussion followed among Commission members, the Planning Director and Mr. Willard concerning his use of the property. It was determined that Mr. John Welch is the actual owner of the property, is paying for the fill and improvements, will construct the proposed building; Mr. Willard is leasing the property from Mr. Welch and had been requested to appear for him. It was agreed by Commission members that it would be desirable for Mr. Welch to appear before the Commission in support of the application. I Mr. Leo Scarsella, property owner adjacent directly south of subject property, was present in the audience and was concerned overHthe proposed use and the poor appearance of the develop- ment. He stated he was in the construction business himself and certainly not opposed to anyone in the construction industry, but that applicant's use of the property was a detriment to the area., The Chairman stated the Commission would, in the course of the hearings, determine whether or not the use was permittedand. allowable in the M-P zone.
