Motion carried unanimously. ACTION: Moved by Stredicke, seconded by Denzer,.that the Eugene M. Richards application for L-l1 zoning be approved and forwarded to the City Council as it agrees with the Comprehensive Plan. Motion carried unanimously. P (c) COOK, WALTER L., Appl. No. R=-426-67, rezone from G-6000 to L~l; property located on 89th Ave. S, between FAI 405 and S. 153rd St. (continued) The Chairman described the rezone application and stated that the applicant has voluntarily filed restrictive covenants on this property. The Planning Director stated that copies of the declaration of restrictive covenants filed by the applicant on the property have been furnished for review; such covenants are in compliance with previous discussions with the applicant. The plan at this time shows the proposed development of the entire parcel of land under consideration rather than the smaller section previously submitted by the applicant. The applicant has presented a plan for two pro- posed buildings with setbacks as indicated of ten and twenty feet and landscaping strips. The parking plan exceeds ordinance require- ments. The Planning Director stated further he felt the covenants comply with the desires of the Commission for this area. As there were no comments from the audience, it was moved by Denzer,. seconded by Racanello, that the hearing be closed. Motion carried unanimously. Stredicke inquired as to why this applicant was. allowed a ten foot setback in one area when another applicant in the vicinity was re- quired to set back twenty feet. Discussion followed concerning differences between the two properties with reference to location, proposed use, proximity to the freeway, and the fact that the applicant's ten foot setback is along the interior lot line, rendering it less critical than if it abutted public right of way, as the property directly south of the applicant's property is presently zoned L-l, ACTION: Moved by Racanello, seconded by Denzer, that the Walter L. Cook. The letter stated the 20-foot setback from adjacent property as suggested by the Plan- ning Commission was unreasonable in view of the shape and size of the property and building location. The applicant felt a ten-foot setback requirement would be reasonable and adequate. The letter stated further that the applicant felt a 4-foot high fence to pro- tect landscaping would be adequate rather than a 6-foot high fence as requested by the Planning Commission for storage area. It was noted that Mr. Cook's original application for rezone en- compassed a larger area than now under consideration. The Planning Director stated that while this application was officially continued to the meeting of April 24, 1968, it was the prerogative of the Commission to reopen the hearing and take action on the matter at this time, if they so desire. Mr. Cook spoke on behalf of the rezone request. The Chairman stated that in considering any parcel of land, he felt the Commission members should look at adjoining property as well. First, let me say that all properties cannot be fully developed by exactly the same rules. Such items as terrain, soil conditions, lot configuration, and economic feasibility should also be considered, as well as property location. fo agree with a 20 foot setback from adjacent property is unreasonable, in view of the shape and size of the property and building location. A 20 foot setback would reduce the area.of the proposed building to two-thirds that showm. Reducing the size of the building would not only make the cost per unit of floor area much higher, but would greatly reduce the usefulness of the building. Relocation of the building is not possible in view of the future development of the balance of the property fronting on 29th Avenue South. It is imperative that 91st Avenue South provide an exit/entrance to the entire area described in the original rezone application. Therefore, a 10 foot setback to me, represents a reasonable and adequate setback, and makes a 20 foot setback requirement arbitrary. The existing ownerships in the vicinity of this property, however, are for the most part somewhat small and will present some problems for development to M-P standards. The L-l zone, on the other hand, does not require setbacks or screening and such zoning would not be fully in accord with the proposed development as presently being undertaken by the Austin Company and Seattle Lumber. Three possible alternatives are suggested: (1) rezone the area to L-1l incorporating restrictive covenants to attain desired bufilding setbacks, landscaping, etc; (2) rezone to M-P with a recommenda- tion to the Board of Adjustment that a variance be granted with reference to the proposed construction of a building to the rear property line of the existing residence; (3) initiate immediate study of the area in question with the possibility that a dif- ferent type of industrial zone be developed, possibly L-2, which would incorporate some of the desired standards of the M-P district but not be as restrictive as the M-P zone. The following persons spoke in opposition to the rezone stating they wished the area to remain single family residential: Mr. Curt Agren, 8223 - 104th Ave. S.E.; Mrs. Paul Kullama, 10453 S.E. 84th St.; and Mr. Russell Carlson, 10445 S.E. 84th St. Mr. Don Gouge, attorney representing the applicant, spoke on behalf of the rezone, citing the fact that the property had been zoned multiple in the county, the suitability of the property for multi- family residential development, and pointing out that access from Lake Washington Boulevard would be developed which would eliminate the nuisance to adjacent residents of traffic over the 20' ease- ment now serving the property. There being no further comments, it was moved by Stredicke, seconded by Denzer, that the hearing be closed. Motion carried unanimously. ACTION: It was moved by Denzer, seconded by Racanello, that the Planning Commission grant the rezone application of Ditler Berg for R-3 zoning and forward this recommendation to the City Council for approval.
