N This being the date set,the hearing was declared open. Letter from Planning Director "vicksen outlined Planning Commission actions to date, noting applicant’s intent to . -truct a triplex behind existing duplex with proposed access being 9th Pl, North. It was noted the duplex is an existing non-conforming use and the present Comprehensive Plan indicates medium density multi-family use, however a low density multi-family use has been proposed for the Comprehensive Plan now under consideration by the Commission. Audience comment was invited and Mr. Barger, 2820 ~ 8th Place North, pointed out the proposed construction on drawing exhibited on the wall and stated he would like an R-2 if the R-3 is not acceptable. He noted there have been no objections from the residents of the area during the five months the matter has been pending and upon inquiry, advised he did plan to remove the existing duplex.Mr. Stredicke noted 7-1 vote to reject by the Commission.Moved by Bruce, second by Grant to close ‘the hearing.Carried. Shane noted théerewas no objection and that turther delay results in additional increased interest costs to the applicant and moved that the property be zoned R-3. The ™ tion was seconded by Bruce. Discussion ensued regarding Planning Commissfon study and the Comprehensive Plan, it being noted that this is on a fringe area and the Commission had felt that 9th Place North should be the breaking line between the medium and low density multiple use, and that the proposed use is considered to be premature for this area at present. It was pointed out that adjacent and nearby properties have apartment and multiple-residential units at present, also the .duplex neéds Yepair brit could be brought to -eode..On dissenting voided vote, ‘roll eali was taken, The vote resulted as follows: Aye: Garrett, Shane, Grant and Bruce, No: Barei, Maxin, Edwards, Trimm, Delaurenti, Schellert and Morris. The motion lost 7 to 4, Moved by Barei, seconded by Bruce, to grant R-2 zoning, bringing the property into legal and current reflection of use, the petitioner having agreed to amend his appli- cation to R-2. The motion carried. Moved by Garrett, seconded by Grant, to refer the rezone to the Law and Ordinance Committee for the necessary Ordinance, Carried. Mayor Custer submitted a communication he recetved from the City Attorney, with regard to the North Renton Interchange and costs in sum of $1,256.40 which the State has requested be reimburselto it as being the City of Renton's share of the projects and it was passed to the Council President. He submitted another communication regarding proposal for a secondary water supply for the Renton Boeing Plant, received from the Attorney, which item is on the Agenda. COMMUNICATIONS : Letter from Park Director Coulon submitted and recommended for payment, statement in sum of $3,500.00 due Architects, Olson-Richert, Bignold & Co. for services on Phase I development plans for Lake Washington Beach Park. Custer, Mayor Members of the City Council Renton, Washington Re: Lyle L. Barger Appeal Appl. No. R~-433-67, request for rezone from R-1 to R~-3; property located at 2502-04 9th Place N. Gentlemen: The application of Lyle L. Barger for rezone from R-1 to R-3 was presented to the Planning Commission at its public hear- ing meeting of November 22, 1967. The property in question has the following general characteristics: Total Area--app. 10,000 sq. ft. Existing Zoning--R-1l Existing Use--duplex family dwelling Principal Access--9th Pl. N. Proposed Use--multi-family residential Comprehensive Plan--Existing: Medium density multi-family Revised: Low density multi-family On his application for rezoning the applicant indicated that it was his intention to construct a triplex unit behind the ex- isting duplex presently on the property. The proposed access to the apartment units would be from 9th Place N. The area surrounding the applicant's property, with the exception of one duplex, is developed for single family residential use and is, for the most part, a relatively stable neighborhood area. There are, however, existing apartment units in the vicinity on E Street and adjacent to Sunset Blvd. in the existing R-3 zones. Various questions were raised by members of the Planning Commis- sion, and since the applicant was not present to answer these questions, the application was continued to the December public hearing meeting. The applicant was advised by letter that his application had been continued and it was requested that he or his representative be present at the public hearing meeting of December 27, 1967. At the December public hearing meeting, questions were raised as to the suitability of R-3 zoning for the area under study. The Mayor and City Council March 18, 1968 Page 2 Planning Commission, with the permission of the applicant, con- tinued the hearing for 60 days to allow additional time for study in order to determine the most suitable zoning for the over-all area including the applicant's property. After completion of detailed study of the Comprehensive Plan and field trips to the area, the Planning Commission again con- sidered the Barger application at its meeting of February 28, 1968. It was the determination of the Planning Commission that the proposed rezone request to R-3 zoning was premature for the area and that the property, if developed to-R-3 stand- ards, would have some detrimental effects on the adjacent single family residential properties. The Commission was of the opinion that a low density multi-family zoning would be feasible ata future time (approximately three to five years), but that the area should be rezoned on a comprehensive basis rather than parcel-by-parcel. The Commission, therefore, could not recom- mend the rezoning of the applicant's property for R-3 at this time and recommended that the zoning not be changed from the etisting R-l. The Planning Director replied that any future widening would be done within the present right of way. The pending motion to close the hearing carried unanimously. ACTION: Moved by Stredicke, seconded by Mola, that in recognition of the petition of 146 residents of the area and in noting staff comments that this rezoning would have detrimental effects, that the rezone application of Vern Gambriell for R-3 zoning be denied. The motion carried unanimously. The Chairman advised the applicant of his right to appeal the decision of the Planning Commission to the City Council in writing within ten days. FURTHER ACTION: Moved by Stredicke, seconded by Sterling, that the Planning Commis- sion recommend to the City Council that SR-1l zoning is the highest and best use for this property. The Planning Director pointed out that this property is presently platted into single family residential lots of approximately 6900 square feet and as such are buildable lots even under GS-1 zoning; SR-1 calls for a minimum square footage of 7500. Stredicke stated he felt this would indicate to the Council the Commission's feelings about the area. Pending motion carried unanimously. The Chairman declared a brief recess at 9:25 P.M. The meeting was reconvened at 9:35 P.M. All members present at roll call returned to the meeting. 3. BUSINESS CONTINUED FROM PREVIOUS MEETINGS REZONE APPLICATIONS ><(b) BARGER, LYLE L., Appl. No. R-433-67, rezone from R-l to R-3; property located at 2502-04 9th Pl. N. (continued from meetings of | November 22 and December 27, 1967) The Chairman described the rezone application. The Planning Director pointed out the location of the property on the zoning map and described surrounding uses. The applicant has had dis- cussions with the Planning Director regarding the rezone request and has indicated he desires to construct a triplex behind the existing duplex unit. Teegarden stated he has commented on the field trips to the property in question that he feels that this is a substantial single family residential area and that it would be a mistake to rezone the prop- erty. The two duplexes there (one on the applicant's property and one next door) are the only multiples in the immediate area. Denzer stated he felt the Commission should grant R-2 to the appli- cant to legalize his present use of the property. Renton Planning Commission Meeting February 28, 1968 Minutes Page 6 The applicant, Mr. Lyle Barger, spoke on behalf of the rezone ap- plication and stated he would accept R-2 rather than R-3 zoning on the property. Stredicke stated he agreed with Teegarden's thinking on the matter. As there were no further comments, it was moved by Teegarden, seconded by Stredicke, that the hearing be closed. Motion carried unanimously. ACTION: Moved by Teegarden, seconded by Stredicke, that the rezone applica- tion of Lyle Barger for rezone from R-l to R-3 be denied and that the Planning Commission recommend to the City Council that the zoning not be changed from existing R-l. Motion carried; Denzer dissenting. The Chairman advised the applicant of his right to appeal the decision of the Planning Commission to the City Council in writing within ten days. — (c) SINGER, DEAN A., Appl. (continued from meetings of December 27, 1967, January 24 and February 14, 1968) The rezone application was described by the Chairman, and the loca- tion of the property was pointed out by the Planning Director on the zoning map. The Planning Director stated that originally the application was for R-4 zoning, but was later amended by the applicant to R-3. He stated further that for the information of the Commission everything was in order and the department sees no problem at this time. As there were no further comments from the Commission or the audience, it was moved by Denzer, seconded by Stredicke, that the hearing be closed. Motion carried unanimously. ACTION: Moved by Stredicke, seconded by Denzer, that the Planning Commis- sion recommend approval of the rezone application of Dean Singer for R-3 zoning and forward to the City Council for action as it agrees with the Comprehensive Plan. Motion carried unanimously. (d) BEANBLOSSOM, F. AND ROE, E., Appl. No. R-438-68, rezone from R-2 to R-4; property located SE corner Wells Ave. N. and N. 4th St. (continued from meeting of January 24, 1968) The Chairman described the rezone application. The Planning Director pointed out the location of the property on the zoning map and indicated proposed use is in conformance with the existing and revised Comprehensive Plans. Some discussion was held concern- ing alley access. The Planning Director advised that access is subject to review when the building permit is appiied for and plans go through the Planning and Traffic Engineering Departments where parking and access are checked. As there were no further comments, it was moved by Stredicke, seconded by Denzer, that the hearing be closed. Motion carried unanimously. RENTON PLANNING COMMISSION PUBLIC HEARING MEETING FEBRUARY 28, 1968 AGENDA ROLL CALL APPROVAL OF MINUTES, MEETING FEBRUARY 14, 1968 BUSINESS CONTINUED FROM PREVIOUS MEETINGS: SPECIAL PERMIT APPLICATION (a) Butko, George C., Appl. Existing Zoning--R-2 Existing Use--undeveloped Principal Access--Earlington St. and 4th Ave. W. Proposed Use--multi-family residential Comprehensive Plan--multi-family residential, low density Staff Comments: The staff has. met with Mr. Butko and his designer on several occasions to discuss and review proposed plans. Proposed plan as revised will present some ingress-egress problems, with particular reference to the proposed parking area. Proposed plan still leaves something to be desired in terms of making it compatible with surrounding single family neighborhood. REZONE APPLICATIONS Y%(b) Barger, Lyle L., Appl. No. R-433-67, rezone from R-1 to R-3; property located at 2502-04 9th Pl. N. (continued from meetings of November 22 and December 27, 1967) Total Area--app. 10,000 sq. ft. Existing Zoning--R-] Existing Use--duplex family dwellings Principal Access--9th Pl. N. Proposed Use--multi-family residential Comprehensive Plan--multi-family residential Staff Comments: Proposed rezone to R-3 would extend multiple zoning into a presently single family residential area. The two existing duplex structures on Mr. Barger's and adjoining property are presently non-conforming uses but would be conforming if the area were an R-2 zone. The neighborhood area at the present time appears to be relatively stable and for the most part well-maintained, and a rezone to multiple use would tend to have some detrimental effects. Commission Comments: The rezone request to R-3 is considered premature at this time. Recommend denial. (c) Singer, Dean A., Appl. BUSINESS CONTINUED FROM MEETING OF NOVEMBER 22, 1967 REZONE APPLICATION He a) Barger, Lyle L., Appl. No. R-433-67, rezone from R-1l to R-3; property located at 2502-04 9th Pl. N. The Chairman described the rezone application and indicated that it had been continued from the meeting of November 22, 1967. The Plan- ning Director pointed out the location of the property on the zoning map and stated it was presently the site of a duplex dwelling which would probably have to be removed before additional units could be constructed; that the existing duplex was a non-conforming use in an R-l area. Slides of the property in question were shown. The applicant, Mr. Lyle L. Barger of 2820 - 8th Pl. N., spoke on behalf of the rezone application, stating there were other apart- ments in the area and that access to his property was good. Discussion ensued regarding possible removal of existing structures, setbacks required from existing structures. The Chairman indicated the prime consideration of the Commission was to determine the best zoning for the property; that once zoning was granted, other City ordinances would control development of the property relative to setbacks, land coverage, etc. Teegarden stated the property was located in an area of nice single family homes, and in his opinion it would be a mistake to allow an apartment to be developed there. Brower stated he felt the whole area was suitable for apartments, but not just a single piece. Renton Planning Commission Meeting December 27, 1967 Minutes Page 2 ACTION: Moved by Racanello that the Commission delay this application for 60 days to allow additional time for further study of the area in order to determine the most suitable zoning for the property. Brower stated he would second this motion if the applicant was agreeable to the delay. Mr. Barger indicated he was in agreement with the proposed delay of his application; therefore, Brower's second was effective. ; Serene carried, with Teegarden dissenting. 4. NEW BUSINESS REZONE APPLICATIONS (a) Singer, Dean A., Appl. No. R-434-67, rezone from R-2 to R-4; property located on H St. between llth and 12th Aves. N. The rezone application was described by the Chairman; the Planning Director pointed out the location of the property on the zoning map. Slides of the property were shown. Teegarden stated in his opinion R-3 was the best zoning for the property and that he would be interested in knowing if the appli- cant planned to remove the existing duplexes before developing the proposed apartment complex. Teegarden stated further he felt the existing structures should be removed prior to other construction. Brower indicated his agreement with Teegarden's opinions on the matter. Mr. Dean Singer, 1915 Monterey Drive, the applicant, stated his plans for development of the property include the removal of the existing duplexes. He displayed a sketch of the proposed devel- opment. Racanello stated he felt this matter should be continued for 30 days in order to consider the matter of removal of existing structures, and so moved. Stredicke stated that before any action is taken, it should be decided whether or not the Commission is discussing R-3 or R-4 zoning. Some discussion followed concerning the number of units that could be built under R-3 and R-4 zoning and how many units could be constructed between the existing duplexes if they were not removed. The Chairman asked the applicant if he would be willing to accept R-3 zoning. Mr. Singer replied that his studies concerning ground use and costs had been predicated on R-4 zoning; that R-3 zoning would limit his development to about 25 units and could be economically unfeasible. Stredicke stated the Commission has been granting R-3 in the area; that he was opposed to R-4 zoning for this property but would be willing to go along with R-3 zoning and would second Racanello's motion for continuance to allow for the preparation of restrictive covenants covering the removal of existing structures. Racanello stated he felt the area was ideal for R-4 zoning. Forgaard asked if other property owners in the area were present in the audience. Mr. Jerome Stephenson, 11430 S.E; 112th st., expressed concern about the parking for apartments in the area, particularly in 4. Motion carried unanimously. ACTION: Moved by Racanello, seconded by Denzer, that the Planning Commission approve the final plat of Powell's First Addition to the City of Renton and forward it to the City Council for action. Motion carried unanimously. REZONE APPLICATIONS (b) Welch, John T., Appl. No. R-432-67, rezone from G to M-P and H-1; property located east of West Valley Highway between extension of S. 174th and 175th Sts. The Chairman described the rezone application. Slides of the property were shown. The Planning Director stated that this appli- cation is similar to the Richards rezone inasmuch as the designation of the Comprehensive Plan in this area is subject to interpretation. On the existing Comprehensive Plan the area is shown as non-manu- facturing. The area to the north is in Tukwila and is zoned for industry. The Planning Director suggested the Commission consider the over-all area in view of the type of zoning best suited for development of the area. Teegarden noted that the applicant is asking for H-1l zoning on a portion of the property which would be in conflict with the Com- prehensive Plan; therefore, the Commission could not grant the H-1l zoning applied for. Comments from the audience were invited. Mr. Robert Kellies, 505 Madison Avenue, Seattle, attorney for the applicant, spoke on be- half of the rezone request, pointing out the industrial use adjacent to the applicant's property. The Commission discussed with Mr. Kellies the uses allowed under M-P, the setbacks required, and the fact that the Comprehensive Plan does not indicate H-1l in this area. After consultation with his client, Mr. Kellies stated the applicant wished to amend his application to M-P, thereby deleting the H-1l portion of the application. The Commission indicated they would accept the amended application. As there were no further comments, it was moved by Racanello, seconded by Denzer, that the hearing be closed. Motion carried unanimously. ACTION: Moved by Teegarden, seconded by Racanello, that the property of John T. Welch be rezoned to M-P in accordance with his amended application as this would agree with the Comprehensive Plan. Brower asked if the Planning staff had any comments on this. The Planning Director replied that he felt that by going to M-P zoning, the Commission is establishing the pattern for future rezones in the area. The pending motion carried unanimously. ok (c) Barger, Lyle L., Appl. No. R-433-67, rezone from R-l to R-3; property located at 2502-04 9th Pl. N. The final plat, as pro- posed, remains unchanged from the preliminary. The plat meets the requirements of the city's Subdivision Ordinance. REZONE APPLICATIONS (b) Welch, John T., Appl. No. R-432-67, rezone from G to M-P and H-l; property located east of West Valley Highway between extension of S. 174th and 175th Sts. Total Area--app. 3-1/2 ac. Existing Zoning--G Existing Use--undeveloped and agricultural Principal Access--West Valley Highway Proposed Use--M-P and H-1l Comprehensive Plan--non-manufacturing; possible L-l or M-P Staff Comments: The basic question to be decided by the Planning Commission is initially that of determining the type of zoning desirable for the area as defined between the railroad right of way, the West Valley Highway, the Tukwila city limits and S. 180th St. The Leber Ink operation is presently zoned H-1 with the prop- erty adjacent to the West Valley Highway zoned B-P (business parking). This property as presently developed would not comply with M-P zoning, but could conceivably be brought up to standard and brought into reasonable compliance. The proposed use of the property in question as stated in the present application is for material storage, auto transmission and carburetor rebuilding and manufacturing and the sale of new and used auto parts. This use as stated could conceivably be allowed under a B-1l, L-1l or H-1l zone. The storage of non-operating motor vehicles and similar uses or a wrecking yard would require H-1l zoning as outlined under the present H-1 district. all (c) Barger, Lyle L., Appl. No. R-433-67, rezone from R-l to R-3; property located at 2502-04 9th Pl. N. | Total Area--app. 10,000 sq. ft. Existing Zoning--R-1l Existing Use--duplex Principal Access--9th Pl. N. Proposed Use--multi-family residential Comprehensive Plan--multi-family residential Staff Comments: The proposed rezone request is to allow the proposed construction of a triplex behind the existing duplex. The apart- ment as proposed is somewhat questionable in terms of yard require- ments and setbacks. Existing Comprehensive Plan shows the aréa as low to medium density multiple use. The new proposed Plan as revised by the Planning Commission shows the area as low density multiple use. At the present time, the area in the vicinity of the applicant's property is for the most part a relatively stable single family resi- dential area. The rezone to R-3, in the opinion of the staff, would in all probability, have some detrimental effects on the adjacent properties. A rezone to R-2, however, would tend to legalize a pres- ent non-conforming use and would be in accord with the proposed Comprehensive Plan. November 30 , 1967 Mr. Lyle lL. Barger 2820 8th Place N. The Planning Director stated that work had been done and the matter would be brought up later during the meeting under Administrative Matters. REZONE APPLICATIONS (b) Welch, John T., Appl. No. R-432-67, rezone from G to M-P and H-l; property located east of West Valley Highway between extension of S. 174th and 175th Sts. (southerly of Cello Bag and Leber Ink) The Chairman described the rezone application. The Planning Director stated that the applicant's use (auto wrecking yard) requires H-1l zoning, but in order to accomplish setback, fencing and landscaping to set the standard for future development in the area, the applicant was willing to accept M-P zoning on a portion of the property or restrictive covenants with H-1 zoning. (c) Barger, Lyle L., Appl. No. R-433-67, rezone from R-1 to R-3; property located at 2502-04 9th Pl. N. The Chairman described the rezone application. The Planning Director pointed out the location of the property on the zoning map and stated the applicant had been advised of the problems of multiple development on the land in question, but had filed an application anyway. The existing duplex on the property is a non-conforming use, but the Comprehensive Plan indicates multi- | family residential for this area. PLANNING COMMISSION FIELD TRIP: ACT ION¢ Moved by Stredicke, seconded by Denzer, that the Planning Commis- sion consider the above items at a field trip to be set for Novem- ber 18, 1967; commissioners to meet at the Park Avenue Restaurant at 8:30 A.M. Dalpay requesting a six-month extension of the approval of the preliminary plat of Honey Dew Estates Div. 3. Stredicke said he felt applicants should state their reasons for requesting extensions. Racanello and Brower said they agreed with Stredicke on this matter. The Planning Director stated that the staff had been notifying plattors of the expiration dates of their preliminary plats and in the future would ask that reasons for the requests be stated in their letters asking for extensions. ACTION: Moved by Racanello, seconded by Denzer, that the Commission grant a six-month extension of the approval of the preliminary plat of Honey Dew Estates Div. 3. Motion carried unanimously.
