Motion carried unanimously. ACTION: Moved by Stredicke, seconded by Denzer, that the Eugene M. Richards application for L-1l zoning be approved and forwarded to the City Council as it agrees with the Comprehensive Plan. Motion carried unanimously. (c) COOK, WALTER L., Appi. No. R-426~-67, rezone from G-6000 to L~L; property located on 89th Ave. 5S. between FAI 405 and S. 153rd St. (continued) The Chairman described the rezone application and stated that the applicant has voluntarily filed restrictive covenants on this property. The Planning Director stated that copies of the declaration of restrictive covenants filed by the applicant on the property have been furnished for review; such covenants are in compliance with previous discussions with the applicant. The plan at this time shows the proposed development of the entire parcel of land under consideration rather than the smaller section previously submitted by the applicant. The applicant has presented a plan for two pro- posed buildings with setbacks as indicated of ten and twenty feet and landscaping strips. The parking plan exceeds ordinance require- ments. The Planning Director stated further he felt the covenants comply with the desires of the Commission for this area. As there were no comments from the audience, it was moved by Denzer, seconded by Racanello, that the hearing be closed. Motion carried unanimousiy. Stredicke inquired as to why this applicant was allowed a ten foot setback in one area when another applicant in the vicinity was re~ quired to set back twenty feet. Discussion followed concerning differences between the two properties with reference to location, proposed use, proximity to the freeway, and the fact that the applicant's ten foot setback is along the interior lot line, rendering it less critical than if it abutted public right of way, as the property directly south of the applicant's property is presently zoned L-l. ACTION: Moved by Racanello, seconded by Denzer, that the Walter L. Cook property be rezoned from G-6000 to L-1 with restrictive covenants as it agrees with the Comprehensive Plan. (continued) The Chairman described the rezone application. The Planning Director stated this application was continued to this hearing at the request of the applicant and described its location and surrounding uses. There are some existing single family homes in the area in good condition, well maintained, and some concern was felt regarding the effect of multiple use nearby on these single family residences. The Commission had asked the applicant to consider the possibility of an apartment development by special permit in the existing R-2 Renton Planning Commission Meeting April 24, 1968 Minutes Page 3 4, zone to allow the Commission some control over the development. However, no word has been received from the applicant in this re- gard. The staff endeavored to contact the applicant's representa- tive, Mr. Chapin, by phone to remind him of the hearing, but he was unavailable. A message was left with Mr. Chapin's secretary. Comments from the audience were invited. There were none. The applicant or her representative were apparently not present. As there were no further comments from the audience or the Commission, it was moved by Denzer, seconded by Stredicke, that the hearing be closed. Motion carried unanimously. Mr. Pain stated the Commission could grant approval of the use with other City Ordinances taking over in the matter of setbacks, parking, etc. The Planning Director stated the development of the property as pro- posed would involve the granting of certain variances for setbacks and parking, but he felt this was a matter for the Board of Adjust- ment; the Planning Commission being concerned only with the proposed use. While the Planning Commission could act on the variances, it was his opinion this was primarily the concern of the Board of Adjustment. However, as screening is not an ordinance requirement in this zone, screening requirements should be spelled out in the approval of the special permit. Mr. John Dobson, 231 Williams Ave. S., spoke on behalf of the special permit application. As there were no further comments, it was moved by Ross, seconded by Denzer, that the hearing be closed. Mr. Richard Chapin, 225 - 108th Avenue, Bellevue, acting for the applicant, showed additional slides of the area and spoke on behalf of the rezone application, stating the property meets all the re- quirements for multiple zoning. Teegarden and Stredicke were concerned with the effect multiple development might have on the adjacent single family residences. Discussion followed regarding possible development of the property under the existing R-2 zoning. Mr. Chapin was not certain what sort of development the applicant had in mind for the property, so could not say whether it could be accomplished under present R-2. He re- quested that the hearing be continued for thirty days so that he could consult with his client on the matter. The adjacent properties are presently developed for single family and duplex purposes with a church further to the south and a nursing home on the north side of S. 133rd St. The property in question is presently zoned R-2 and apartments could be constructed by special permit. It is recommended that the Commission consider the rezoning of the over-all area rather than the one parcel. Commission Comments: The proposed rezone of the applicant's property to R-3 would have some detrimental effects on adjacent properties.
