Comments from the audience were invited. Mr. Gunnar Ostlund, the applicant, spoke on behalf of the rezone application. Stredicke stated he would like to see the applicant get together with the Planning Department to work out the development of the property incorporating the setback requirements previously set by the Commission in the area. He asked the applicant if he would have any objections to this and if continuing the matter for 30 days would work a hardship on him. Mr. Ostlund replied he had no objections. There were no comments from the Commission or from the audience. Moved by Denzer, seconded by Stredicke, that the hearing be closed. Motion carried unanimously. Renton Planning Commission Meeting May 8, 1968 Minutes Page 3 The Commission generally felt, after discussion of this matter, that it was unwise policy to disrupt the normal procedures of rezone applications for the convenience of one applicant since the delay was the result of his failure to submit the application by the dead- line date for the April Planning Commission public hearing. Action by the Council would, at best, save the applicant only two weeks in time. Forgaard noted that should SR-1l be granted, that the applicant would lack 500 square feet of having another building site on the property, and he believed the applicant's plot plan submitted with his rezone application did not indicate the true location of the proposed house but that the house would be set well over, possibly to accommodate another building site which might be acquired by a variance request. Commissioners were interested in this point and felt it would be well to check this out on the field trip. ACTION: Moved by Ross, seconded by Racanello, that the Planning Commission follow the normal procedure on this rezone application of Manio Phillips. Mola stated he felt the Planning Commission could come under unfavorable criticism by allowing normal procedures to be by- passed; that some people had indicated to him they believed the Planning Commission would be showing favoritism toward this ap- plicant. The pending motion carried unanimously. The Chairman stated he would suggest that the Commission communi- cate with the City Council indicating that it was the unanimous feeling of the Planning Commission that due to the circumstances the usual procedures should not be by-passed; that the Planning Department has published and posted this application for hearing on May 22, 1968; that other publications and postings for a hear- ing on May 20, 1968 would tend to confuse interested persons; not to mention the possible legal aspects of this case. (b) MANIO PHILLIPS REQUEST This matter was discussed earlier during this meeting. (c) COMPREHENSIVE PLAN REVIEW WITH CITY COUNCIL The Planning Director stated the City Council after the second public hearing on proposed revisions to the Comprehensive Plan on May 7, 1968, requested a joint meeting with the Planning Com- mission on May 28, 1968, 8:00 P.M. in the Council Chamber to review these revisions. The Chairman asked if this would be a public meeting. The Director replied that there were some persons in the audience who indicated they would attend such a joint session. It was the feeling of the Commissioners that they would be pleased to meet with the Council to iron out any problems; but inasmuch as some of the Commission's decisions were over a year old, it would be difficult to pursue these matters at a public meeting with the probability of defending each item with interested property owners. The Commission felt these matters should be ironed out in work session. It was decided to defer decision on this matter until the return of the Planning Commission Chairman and the other two absent Com- missioners. (d) LEGAL DECISION: Supreme Court, State of Washington, Re: Com- prehensive Plan and Zoning Ordinance and Adoption Thereof (Shelton v. City of Bellevue) The publication issued by the Bureau of Governmental Research and Services, University of Washington, on the above-named subject was furnished each Commissioner for his information. The Court indicated that if a comprehensive municipal plan is promulgated and adopted by a municipality, strict compliance with pertinent statutory procedural provisions relating to such adoption is not a prerequisite to the validity of subsequent and resultant zoning ordinances. Further, the formal, written articulation and adoption of a comprehensive municipal plan as a distinct entity, separate and apart and distinguished from comprehensive zoning regulations, is not a condition precedent to the enactment of a valid zoning regulation implementing such a comprehensive plan. (d) SITE PLAN REVIEW This matter was covered earlier during this meeting.
