No. R-471-68 Rezone from G and G-6000 to R-3; property located on Lake Washington Blvd. between S.E. 9lst Pl. and S.E. 9lst St. (Kennydale area) Gentlemen: The rezone request of M, Cayford and A. Huseland as noted above was considered by the Planning Commission at its public hearing meeting of June 26, 1968, The property in question has the following gen- eral characteristics: Total Area--29,700 sq. ft. * Existing Zoning--G and G-6000 Existing Use--single family residential Principal Access--Lake Washington Blvd., S.E. 9lst St., S.E. 9ist: Pl. Proposed Use--multi-~family residential Comprehensive Plan--low to medium density multi-family residential on existing Plan; single family residential on revised Plan The area in question has been under study by the Planning Commis- sion on various occasions during the formulation of the revised Comprehensive Plan. Mr. Huseland has also submitted several let- ters to the Commission regarding his proposed use in relationship to the Comprehensive Plan. The Planning Commission, in the course of its study of the area, has conducted field trips to review the land in question and to review the area on a comprehensive basis. Considerable discussion also has taken place regarding feasibility of multiple use adjacent to Lake Washington Boulevard. Consider- able time has also been given to the matter of sewers in the area and the impact of multiple use on the adjacent single family resi- dential areas. During the course of discussion at the Planning Commission public’ hearing, the feasibility of a lesser multiple zoning was dis- cussed, The applicant, Mr. Huseland, indicated however that any Mayor and City Council July 12, 1968 : Page 2 lesser zoning was not acceptable to him and would not be considered, The Planning Commission upon completion of its discussion with the applicant and the opponents voted to deny the rezone request for the following reasons: 1. The request is not in agreement with the intent of the Comprehensive Plan. 2. Sewers are not now presently available, 3. Such rezone would have a very definite detrimental effect on adjacent properties, At the Planning Commission Administrative meeting of July 10, 1968 the matter of the Cayford-Huseland rezone denial appeal was dis- cussed in view of communicating to the City Council the basis for ‘the Planning Commission decision. The Commission at this time — voted to recommend to the City Council that the highest and best use for the property in question would be that allowed under the R-2 zone, It was the feeling of the majority of the Commission “members that the R-2 zone would allow the Commission adequate | controls to alleviate some of the problems and the detrimental effects on the adjacent properties. Honorable Mayor Custer: I wish to make a protest regarding Richard Stredicke's and Dayle E, Garrison's action as members of the Planning Commission at their open meeting on June 26th and also their action at a City Council meeting earlier when the new comprehensive plan was discussed. Mr. Stredicke and Mr. Garrison did everything possible to influence the other members of the Planning Commission with Mr. Stredicke's facts of questionable validity and Mr. Garrison's straying from Robert's Rules of Order to reject the R3 zoning of the Lawrence and Huseland property in Kennydale. Several members of the Planning Commission spoke in favor of the rezoning. Mr. Stredicke made a motion to reject the R3 zoning first on the Huseland, Cayford property and later on the Lawrence property for the following reasons: 1. Not in agreement with the intent o Comprehensive plan . Answer. We are at this time dealing with the present comprehensive plan, which is multi family, medium density or R 3 zoning. 2. Sewers not presently availabe. Answer. They will be availabe shortly on the Huselan/Cayford property and the buyer of the Lawrence property acknowledges that he cannot obtain a building permit until sewers are availdhbée. A covenant to this effect could be attached to the R3 zonine, I am spelling this out even though sewers are not an issue in rezoning. 3. Such zoning would be detrimental to the area. Answer. Thereare businesses and apartments in the direct vicinity of the Huseland Cayford property and across the street from the Lawrence property there is a gas station and on the opposite corner there is business zoned property. There is also a three story avartment building just beyond the gas station. These two business areas in Kennydale should be treated as any other business corner in the city of Renton. A three‘story building would enhance the area and not in ant} way be detrimental. It would upgrade the business area there and provide a buffer between the business and residential area. There were no complaints from the audience regarding the Lawrence property except lack of sewers. The property is bounded by S. E. 9th on the north, 1chth SE. on the east, a fifteen foot alley on the south and a private residence on the west. The purchascr of the Lawrence property agrees to provide for a shrub or fence screening between the Lawrence properhy and the private residence on the weste This too, covld be a, covenant attached to the R3 zoning. The purenen er is interested’ R3 zoning -Floyd and Della Lawrence are'nt getting any younger and if they are to enjoy the proceeds from their ppoverty it must be now when TI have a sale on ite The same is true of the Huselands. After Mr. Stredicke made the motion_to reject the rezoning a Uisedand property, a member of the Blanni tic Commission told M a) a <) edicke’ that two of the reasons he gave were untrue. Mr. Garrison immediately called for a vote. It certainly was'nt clear to me if it passed or not and I have excellent hearing and I was sitting in the front row.The same menber of the Planning Commission asked for a roll call vote but Mr. Garrison told him it was too late to ask for a roll call vote although it was immediately after the vote. Mr. Garrison said that the rezoning’ was rejected anyway as he was going to vote against the rezonirg I believe Mr. Garrison strayed from Roberts Rules of order by not allowing a roll call vote and as Chairman of the Planning Commission he votes if bv ballot but not after the count starts and in all cases where his vote would change the result. The result here was unclear and he should not have voted vnless it was a tie.Mr. Stredicke made the same motion on the Lawrence powperty and it too was rejected for the same reasons. It appeared to me that Mr. Stredicke and Mr. Garrison showed that either they had no knowledge of what was best for the area or the property owrers or they could'nt care less or that they were acting in a prejudicial manner. The decision i believe was capricious, arbitrary, unreasonable and as I will prove discrimitory. On the Holcomb property on Sunset Blv. between 132nd SE and 1388. E. the Planning Commission granted R3 zoning although they covld have rejected it for two of the same reasons and correctly so,that they used on the Huseland Cayford and the “lawrence ppoperty. On the present comprehensive plan it is not multi family, medium densitywhich the Kennydale property is. Also three story buildings could be detrimental to the area. The Holcomb speaker wants R3 zoning although he said he was going to build one and two story buildings. He also said he covld put many more apartments on the property with R3 zoning. He had a picture of a one and two story building. How binding is a picture after he receives the R3 zoning? My next protest regarding Mr. Stredicke and Mr. Garrison was their action at the RentaN City Council meeting recently when the council was discussing the new comprehensive plan. The Chairman called for a vote on the green belt near the Barbee mill in Kennydale. I heard and saw Mr. Stredicke and Mr. Garrison both vote on the issue along with the councilmen. In fact because of this a roll call vote was asked and permission granted as some one in the audience was heard to vote. They were not identified but I am sure they knew who they were. It seemed to me that Mr. Stredicke and Mr. Garrison were behaving in a very immature and irresponsible manner as the council was voting on a legislative matter. Some of the members of the Planning Commission were thoughtful and working in the best interest of the Renton area. Some I thought acted in a high handed manner typical of some of the black cuttain countries. If it was'nt for the Real Estate business, the Investers, and the Builders, Renton would be a ghost town. As Lord Samuel said, and I quote,''Nothing is so dangerous as wrong headed efficiency.''! It is long past due all over the United States that we have fair dealings in zoning and all other matters for all of the people. - Thank you for bearing with me so long but I just could'nt stand idly by and see total disregard for some people and their a lal te Tose PArne Pe TOroek i sores va ws 2 Approved @ Sincerely yours, ; : fe ‘ Pa c ‘ we = ge ee rl % al wehbe” YE bree - 1 £ Xie ye Rn e & he pel , oe ' : 2 SITS Lauvsverce ANeS AugeLanr? , /7 \ VINA. D. Hillmans Lake washington Garden of Eden, bivis- on # Ls (9140 Lake Washington Blvd., Renton, wash.) We are making this application under the existing land use as per Renton City Ordinance which permits multiple housing in this area, Applicant owner (Huseland) ef Lots 7 & & would remind you that when this property was in the county, it w as zoned B-l, We were verbally assured by city officials that zoning would not be taken from property own- ers when annexed and on that basis, Huselands actively worked for annex- ation, It was further, later stated by city officials, that heretofore, zoning has not been taken away from those who had it in the county. fThere- fore, we are not asking for special favors, but for a portion of zoning authorized in the county. What the undersigned want, and are asking for (4-3), is the same as has been granted to adjacent property owners to the south, that is The Kennydale Market, the former Kennydale Post Office Property and the appartments south of and ae Je EE the Kennydale Market. There is also another store at the corner of S.H. 91st Pl. and 100th Ave. S.E. and a railroad is across the Blvd., and our request is within keeping of the surrounding area which for years has comprised the "Business Center” in the community known as Kennydale. Also K-3 will serve as a buffer between business and residential areas. Applicant ewner of Lot 4 (Cayford) of the upper east corner, agrees no buildings should be placed on this lot and will gladly accept whatever zoning will permit parking on said lot. (4) Rezoning to R-3, allewing apartments on this preperty will def- initely upgrade the vicinity tremendously, as at present it is underdev eloped and unimproved except for a couple of cabins which would be removed, In the motion (at Planning Commission) to reject this application, a principal objection was, "Sewers are not now available." nasmuch as this property is within the boundary of LID # 258 and the City Council had already awarded to king Construction Company, a contract to install sewers in LID # 258, we do not feel this is a proper objection, it is understood and agreed all construction would be made accord- ing to city codes and building requirements and with principal access and parking to be from &.E. 9lst Pl. and S.E. 9lst Et., by the existing 12! platted alley and Lot 4 on the Hast, thus avoiding traffic problems en Lake washington Bivd. CAYFORD and AM BE, iUSfLaND Honorable Mayor, Members of Council, Members of Planning Commission, City of Renton Gentlemen: We, the undersigned, wish to appeal the decision of the Renton Planning Commission of June 26, 1968, when said commission rejected the following request: Gayford, M. and Huseland, A: Application No. R 47168; rezone from G and Ge6000 to R33; Property located on Lake Washington Blvd., be= tween S.5. 9lst Pl. and S.E. 91st St., legally described as Lots 4,5,6, 7 and 8, Block 4, C. D. Hillmans Lake Washington Garden of Eden, Divise ion # 1. (9140 Lake Washington Blvd., Renten, Wash.) We are making this application under the existing land use as per Renton City Ordinance which permits multiple housing in this area, Applicant owner (Huseland) of Lots 7 & 8 would remind you that when this property was in the county, it w as zoned Bel, We were verbally assured by city officials that zoning would not be taken from property owne ers when annexed and on that basis, Huselands actively worked for annexe ation, It was further, later stated by city officials, that heretofore, zoning has not been taken away from those who had it in the county. There» fore, we are not asking for special favors, but for a portion of zoning authorized in the county. | What the undersigned want, and are asking for (R-3), is the same as has been granted to adjacent property owners to the south, that is; The Kennydale Market, the former Kennydale Post Office Property and the appartments south of and adjoining the Kennydale Market. There is also another store at the corner of S.E, 91st Pl. and lOOth Ave. S.m, and a railroad is across the Blvd., and our request 1s within keeping of the . surrounding area which for years has comprised the "Business Center" in the community known as Kennydale, Also R»3 will serve as a buffer between business and residential areas. Applicant owner of Lot 4% (Cayford) of the upper east corner, agrees no buildings should be placed on this lot and will gladly accept whatever zoning will permit parking on said lot. (4) Rezoning to Re3, allowing apartments on this property will def- initely upgrade the vicinity tremendously, as at present it is underdeve eloped and unimproved except for a couple of cabins which would be removed, In the motion (at Planning Commission) to reject this application, a principal objection was, "Sewers are not now available," Inasmuch as this property is within the boundary of LID # 258 and the City Council had already awarded to King Construction Company, a contract to install sewers in LID # 258, we do not feel this is a proper objection. It is understood and agreed all construction would be made accords ing to city codes and building requirements and with principal access and parking to be from S.E. 91st Pl. and S.E. 91st St., by the existing 12! platted alley and Lot 4 on the East, thus avoiding traffic problems on Lake Washington Blvd, We respectfully request that the Renton Council grant Re3 Zoning on the property herein described. le tice oc Ct AOD CX “(Mo He. Renton, Washington oN Renton Planning Commission Meeting June 26, 1968 Minutes Page 5 Stredicke stated that under R-3 zoning there is nothing legally the Commission can do to enforce screening to protect adjacent single family homes. He asked the applicant if he would consent to R-3 zoning with adequate legal protection for the single family areas to the north as to height of not more than two stories. The appli- cant stated he would post bond to this effect or execute restrictive covenants, whichever the Commission desired. As there were no further comments from Commissioners or the audience, it was moved by Stredicke, seconded by Ross, that the hearing be closed. Motion carried unanimously. ACTION: MOVED BY STREDICKE, SECONDED BY DENZER, THAT THE APPLICATION OF EDWARD A. HOLCOMB FOR REZONE FROM G-7200 TO R-3 BE GRANTED AND FORWARDED TO THE CITY COUNCIL FOR APPROVAL AS IT AGREES WITH THE COMPREHENSIVE PLAN. MOTION CARRIED UNANIMOUSLY. The Chairman declared a brief recess at 9:50 P.M. The meeting was reconvened at 10:00 P.M. All Commission members previously noted were present. ok (e) CAYFORD, M. AND HUSELAND, A., Appl. No. R-471-68; rezone from G and G-6000 to R-3; property located on Lake Washington Blvd. between S.E. 9Ist Pl. and S.E. 91st St. The Chairman described the rezone application and stated that inasmuch as the Commission had visited the property several times and were familiar with it, they would dispense with showing of slides. Comments from the audience were invited. Mrs. Graham Bell, 9827 S.E. 91st Place, asked what the applicants intended to do with the property. She was advised that the zoning requested would permit construction of apartment buildings. She stated she was opposed to the rezone as such construction would block her view of Lake Washington. Mr. Amos Huseland, 10410 - 116th Ave. S.E., one of the applicants, spoke on behalf of the rezone request. He stated he owned two of the lots under consideration; that while in the county these two lots were zoned for business, and such zoning was lost when the property was annexed to Renton. Mr. Huseland stated an apartment development would upgrade the area and be more desirable than the modest rental dwellings now existing on the property. Upon inquiry, Mr. Huseland stated the property was annexed to the City early in 1960, but as sewers were not available, he did not request rezone prior to this time. It is his understanding that sewers will be available soon. Mr. M. Cayford, 16640 N.E. 85th, Redmond, applicant, also spoke on behalf of the rezone request. Mr. Jim Fawcett, 9003 - 100th Ave. S.E. stated he was opposed to the rezone as he did not want a three story apartment house in close proximity to his home. He stated he realized a single family home could be built to a height of 35 feet, just 5 feet less than an R-3 apartment house, but he said a single family home would not block the view like an apartment house could. Renton Planning Commission Meeting June 26, 1968 Minutes Page 6 Mr. Huseland stated he would be willing to leave the area above the alley as single family or perhaps utilize this area for parking purposes. Stredicke stated that granting this rezone request would be opening the door for multiple use in this area, and he felt the Commission had already reviewed this area many times and felt it was suitable for single family rather than for multiple use. Ross stated he felt that granting this high a density on the prop- erty would subject the adjacent property owners to the east to possible depreciation of their properties. He stated further that perhaps the applicants would be willing to accept R-2 zoning on the property which would permit the Commission to exercise some control over its development as well as limit the height of buildings which most of the people in the audience seemed to object most to. Mr. Huseland stated he would not amend his application to R-2; that he felt the best use of the property was R-3 inasmuch as he had busi- ness use in the county for many years. As there were no further comments, it was moved by Stredicke, seconded by Ross, that the hearing be closed. Motion carried unani- mously. ACTION: MOVED BY STREDICKE, SECONDED BY ROSS, THAT THE REZONE REQUEST OF CAYFORD-HUSELAND FOR R-3 ZONING BE DENIED FOR THE FOLLOWING REASONS: (1) THE REQUEST IS NOT IN AGREEMENT WITH THE INTENT OF THE COMPRE- HENSIVE PLAN; (2) SEWERS ARE NOT NOW PRESENTLY AVAILABLE; AND (3) SUCH REZONE WOULD HAVE A VERY DEFINITE DETRIMENTAL EFFECT ON AD- JACENT PROPERTY. Racanello stated he did not agree with the motion; that he felt the property was suitable for R-3 use. Ross stated he felt the Comprehensive Plan indicated low density multiple use for the property, not the medium density applied for; that R-2 would allow the applicant reasonable use of the property, but the applicant had refused to consider R-2. THE PENDING MOTION TO DENY THE REZONE REQUEST CARRIED; DENZER AND RACANELLO DISSENTING. The Chairman advised the applicant of his right to appeal the decision of the Planning Commission in writing to the City Council within ten days. (£) LAWRENCE, F. E., Appl. No. R-472-68; rezone from G-6000 to R-3; property located on SW corner S.E. 94th St. and 104th Ave. S.E. The Chairman described the rezone application. The Planning Director pointed out the location of the property on the zoning map. Slides of the property were shown. Comments from the audience were invited. Mrs. Josephine Peterson, 1458 Hillcrest Lane, representing the applicant, spoke on behalf of the rezone request. She presented a contract purchase agreement to the Commission which read that the owner would not develop the property for multiple use until sewers were available.
