REPORT AND DECISION.
APPLICANT: Austin Company FILE NO. SP-046-82
LOCATION: Southwest corner of S.W. 16th Street and Lind Avenue S.W.
SUMMARY OF REQUEST: The applicant seeks approval of a special permit to allow
construction of an earthen mound for the purpose_ of
surcharging underlying compressible soil for the eventual
construction of a building.
SUMMARY OF ACTION:Building & Zoning Department Recommendation: Approval with
conditions.
Hearing Examiner, Decision: Approval with conditions.
BUILDING & ZONING The Building and Zoning Department report was received by the
DEPARTMENT REPORT:Examiner on July 13, 1982.
PUBLIC HEARING: After reviewing the. Building & Zoning Department report,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows:
The hearing was opened on July 20, 1982 at 9:40 a.m. in the Council Chambers of the Renton
Municipal Building. Since the applicant or his representative were not in attendance, the
hearing was continued to August 10, 1982.
CONTINUATION:
The hearing was opened on August 10, 1982 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the staff report and entered the following
exhibits into the record:
Exhibit #1 : Application File containing Building & Zoning
Department report and other pertinent documents
Exhibit #2: Proposed Grading Plan
Exhibit #3: Segment of Zoning Map designating subject
site and vicinity
Discussion regarding the current and finished elevations of the subject site by the
Examiner and Mr. Blaylock indicated a current low elevation of 16.5 feet and a high of
20 feet. Following the surcharge project, the elevation will be approximately 27 feet,
and removal of the surcharge at a later date will return the elevation to its previous
level . Responding to the Examiner's inquiries , Mr. Blaylock stated that the flood
elevation of the valley is approximately 15 feet although completion of the FEMA study
will provide more specific information; and the from 600 to 800 total truck trips will
be required to transport the fill material to the subject site.
The Examiner requested testimony by the applicant. Responding was:

Mr. Grayfer requested that the requirement for installation of a wheel wash for the trucksbedeferreduntildeterminednecessarysincethesurchargeisbeingbuiltaboveground
level and adequate drainage will be provided. The Examiner requested final comments.
Mr. Blaylock advised that the department has no objection to deferral of the wheel wash
requirement since filling on the site has previously occurred which reduces concern
regarding tracking of mud.
Since no further comments were offered, the hearing regarding File No. SP-046-82 was
closed by the Examiner at 9: 17 a.m.

FINDINGS, CONCLUSIONS S DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The applicant, Austin Company, filed a request for a special permit to place surcharge
material on a previously filled and graded site.
2. The application file containing the application, SEPA documentation, the Building
and Zoning Department report, and other pertinent documents was entered into the
record as Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee (ERC) ,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. The subject site is located on the southwest corner of S.W. 16th Street and Lind
Avenue S.W. The site varies in elevation from approximately 16 feet to approximately
20 feet. The site is currently vacant. Little or no vegetation is growing on the
site as a result of earlier grade and fill operations on the site.
8. The applicant proposes preparing the building pad area of the subject site by placing
approximately 10 feet of material on the central portion of the site. The material
will act to compact the underlying soils allowing eventual development. Approximately
15 to 20 thousand cubic yards of material will be used to accomplish this purpose.
This will create a mound of material about 10 feet in height on the site.
9. Approximately 600 to 800 truck trips will be required to bring this amount of fill
material to the subject site.
10. The subject site is located in the Green River Valley and is in a location subject
to flooding. The previous filling on the site brought the elevation of the site to
about 16 feet or greater which was considered. a safe elevation when the fill operation
was approved. The Federal Emergency Management Agency (FEMA) is currently
recalculating the appropriate flood elevation.
11 . The transporting of material by truck generally results in some deposit of materials
along the haul route through the city. The Police Department has requested that the
route be signed, the hours of operation be limited to 6:30 a.m. to 3:00 p.m. Monday
through Friday, that a cash bond be posted to permit city crews to clean the roads
if the applicant fails to do so, that the entry/exit road be paved to allow debris
to be deposited onto the paved surface before the trucks exit the site onto the
public right-of-way and that a wheel wash be installed.
12. Since the mound may be subject to erosion, the Public Works Department wants erosion
control plans submitted subject to its approval and hydroseeding of the mound to
minimize the amount of material subject to erosion.
13. The surcharge is a temporary utilization of material to compact lower levels of soil
and is not used to permanently modify the grade of the site. The Public Works
Department, therefore, has recommended that the permit be limited to two years ,and
that the applicant remove all material from the site at the expiration of that time
limit.
CONCLUSIONS:
1 . The subject fill •and grade appears to serve the public use and interest if conditioned
as indicated below.
The soils on the subject site were artificially placed there and in their present'
state cannot support the loads which development of the subject site would require.
The surcharge will compact the soils, increase the load bearing strength of the site
and permit the applicant to develop the site.
2. The grading and surcharging requires the hauling of large amounts of material onto
and off of the site which can result in debris either being dropped onto the public
right-of-ways or tracked onto the right-of-way by the wheels of haul trucks.

Therefore, the applicant will have to pave the one hundred feet of exit road
immediately adjacent to the public right-of-way; limit operations to hours between
6:30 a.m. and 3:00 p.m. when city crews can either observe,. the operations or clean
the streets if necessary, and to hours which will not interfere with peak hour
traffic; and post a cash bond to permit the city to clean the streets if the
applicant does not do so.
3. The applicant and the city agreed that a wheel wash may be necessary, but that the
paving of. the exit road may accomplish the purpose and that a wheel wash will only
be required if the paving is not successful in eliminating the problem.
4. The creation of .the 10-foot high mound could increase erosion problems on the site,
and therefore the applicant will have to submit an erosion control plan to the
Department of Public Works. The applicant will also have to hydroseed the site
upon completion of the surcharge deposit or before the rainy season, not later than
November 1 , 1982.
5. The surcharge is only temporary to permit the compaction of the underlying soils,
and therefore the material cannot be used to increase the elevation of the subject
site. To permanently leave the material would change the flood water storage
capacity of the site. Therefore, the applicant will have to remove all the
material from the site within two years of the issuance of the first annual
license. In the event the applicant does not remove th.e material , the city should
have the means to accomplish this end. Therefore, the applicant will have to post
a bond in an amount to be determined by the Department of Public Works to permit
the city to remove the 15 to 20 thousand cubic yards of material if the applicant
does not remove it at the end of the two year period.
DECISION:
The special permit to permit surcharge material to be placed upon the site is approved
subject to the following conditions:
1 . The permit shall be issued for not longer than two years.
2. All surcharge material shall be removed from the subject site by the time the
second annual license expires.
3. The applicant shall post a bond or other security to permit the city to remove the
surcharge material if the applicant fails to do so. The amount of the security
shall be subject to the determination of the Public Works Department.
4. A cash bond of $2,000 shall be posted prior to the issuance of each annual license.
5. The hours of operation shall be limited to between 6:30 a.m. and 3:00 p.m. Monday
through Friday.
6. The 100 feet of access road immediately adjacent to the public right-of-way shall
be paved.
7. The route shall be signed and approved by the Department of Public Works and the
Police Department.
8. The applicant shall keep the public right-of-way clear from all debris generated
by the operation.

9. An erosion control plan shall be approved by the Public Works Department.
10. The surcharge material shall be hydroseeded after the completion of the mound or
by November 1 , 1982, whichever is earlier.

2. Soils : Puget Silty Clay Loam (Pu) . Permeability
is slow. The seasonal high water table is at or
near the surface. The available water capacity
is high. Runoff is slow to ponded and the erosion
hazard is slight. Stream overflow is a severe
hazard. This soil is used for row crops and pasture.
Urban Land (Ur) is soil that has been modified
by distrubance of the natural layers with additions
of fill material several feet thick to accommodate
large industrial and housing installations. The
erosion hazard is slight to moderate.
3. Vegetation: Little or no vegetation remains on
the subject site.
4. Wildlife: The existing vegetation would not provide
any significant habitat for wildlife.
5. Water: No surface water was observed on the subject
site (July 9, 1982) .
6. Land Use: The subject site contains no structures
but is being utilizes as a temporary parking lot.
To the north is an old lumber yard and some older
single family residences . The. properties'\ to the
east and south remain undeveloped (except fot the
existing Austin Co. facilities) while the Group
Health Co-operative warehous is on the west.

L. . DEPARTMENT ANALYSIS:
1 . Proposal generally complies with the Comprehensive
Plan designation of Manufacturing Park and zoning
classification of H-1 , Heavy Industrial for the
subject site.
2. The proposal is to mound the central portion of
Lot No. 2 of Valley Office Industrial Park with
earth approximately 12 feet in height to surcharge
and stabilize the potential building pad of the
lot. Specific plans are not known at this time
and will require site plan approval in the future.
Approximately 15 to 20 thousand cubic yards of .
material will need to be utilized for the surcharge.
3. The primary issue of any fill in the Green River
Valley is flood storage capacity. In 1977 , the
City of Renton allowed the site to be filled to
an approximate elevation of 16 plus feet. That
original fill was envisioned to flood proof the
subject site. The request now to surcharge the
site is solely for stabilization purposes. The
application may be complicated in that the exact
flood elevation is unknown, but has generally been
accepted as 16 feet for this area.
The Environmental Review Committee has considered
the flood issue and has basically resolved that
it is presently above the anticipated 100 year
flood level.

4. Primary staff concerns related to any fill operation
focus on 1 ) traffic, 2) clean-up, and 3) storm
drainage.
It should be remembered that surcharging a subject
site is a temporary fill operation intended to
compact the existing soil structure. A special
permit to fill and grade for surcharge, therefore,
should be limited to a period so that the issue
doesn' t become overlooked at the time of building
permit and the mound is just gradually pushed out
and leveled on the site. The surcharge must actually
be removed from the. site.
5. The Police Department advises that hauling should
be only from 6 : 30 a.m. to 3 : 00 p.m. , Monday though
Friday. The Police force does not have sufficient
personnel to monitor filling operations on Saturday
or Sunday. They also advise that a $5, 000 cash
bond should be posted. Recently, the City has
been accepting a smaller cash bond to accompany
the annual grading license to that it is evaluated
on an annual basis. To assure daily clean-up of
the area, the Police Department also suggests that
a wheel washing rack be installed so that trucks
do not track onto the roadway and that the first
100 feet of the haul road off of S.W. 16th Street
be paved. Both Traffic Engineering and the Police
Department will have to approve the haul routes
based upon the contractor hired.

Based upon the above analysis, it is recommended that
the request for fill and grade, file No. SP-046-82,
be approved subject to the following conditions :
1 . The surcharge shall be removed within two (2) years
after the issuance of the first annual grading
license.
2. Limitation of hours to 6 : 30 a.m. to 3 : 00 p.m. ,
Monday through Friday.
3. Posting of a $2, 000 cash bond for street clean-up
to accompany the annual grading license and be
reviewed and extended by the Building Official.
4. Pavement of the first 100 feet of the haul road
from S.W. 16th Street.
5. Installation of wheel wash for the trucks . .
6. Temporary erosion control plan shall be approved -
by the Public Works Department.
7. The mound shall be hydroseeded upon completion
