WASHINGTON 98057 255-8878 1 CLARKRICH, INC. , the City agreed to defer the installation of 2 certain of those improvements, as required by City law, upon 3 condition that a bond be provided to the City of Renton. 4 Such bond was provided to the City by Defendant HERITAGE 5 INSURANCE COMPANY OF AMERICA by means of a document entitled 6 Deferral Performance Bond - Bond No. H 33833 , a copy of which 7 is attached hereto and incorporated by reference as if fully 8 set forth. 9 IV. 10 The bond required that the work to be performed be com- 11 pleted and accepted by the City of Renton on or before 12 March 1, 1985 . That work has not been completed. 13 V. 14 The City has made demands on the bonding company and 15 CLARKRICH, INC. to perform without any results to date. 16 WHEREFORE, the CITY OF RENTON prays for judgment against 17 Defendants as follows: 18 1 . Chairman Clymer P-1 , O-P) advised receipt of a letter from the Planning Commission Ordinance Development Committee, dated March 3, 1983, concerning retail sales in the Office Park zone as a conditional use, and recommending revision of proposed Section 4-720(B) (3) (F) as follows: 1 ) In two 2) story buildings, retail sales may be located only on the first floor and where they do not, in the aggregate, exceed fifty (50) percent of the gross floor area of the building; and 2) In multi- story buildings, three (3) stories or more in height, retail sales space may be located on any floor of the structure and where they do not, in the aggregate, exceed fifty (50) percent of the gross floor area of the building. Continued Councilman Hughes objected to restrictive nature of the provision regarding retail sales in two story buildings. Roger Blaylock, Zoning Administrator, explained intent of the ordinance to allow retail sales in upper floors only as a support to the major office function; otherwise, a commercial zoning designation may be more appropriate if retail sales are the major function of the building. Following lengthy discussion, it was moved by Stredicke, seconded by Reed, Council accept the wording suggested by the Planning Commission as a replacement to proposed Section (3) (F) of the ordinance, with one additional stipulation that retail business in other than ground floor locations be related to office park function. Councilman Stredicke Transfer to questioned whether a construction schedule is currently included in Group W Cable Group W Cable franchise. City Attorney Warren confirmed inclusion of the schedule. MOTION CARRIED. NEW BUSINESS Council President Trim announced an Executive Session following Executive the audience comment portion of the Council agenda to discuss personnel Session matters. Rockhill asked for an approximate date of submittal of Entertainment information regarding other adult entertainment uses from the City Uses Attorney. Mr. Warren advised several ordinances from other jurisdictions will be transmitted to the committee within two to three weeks for review. Agreement Councilman Stredicke asked for status report regarding proposed With Water interlocal agreement with Water District No. 58. Mayor Shinpoch District No. explained alternatives for transferring water system for Ponderosa 58 Estates plat from that water district to City of Renton system, noting discussion with Public Works Department staff and direction from City Council necessary. (See later action.) Signs Posted Responding to Councilman, Stredicke's inquiry regarding enforcement in City of the Sign Code, Mr. Blaylock advised that "for rent" signs posted ! Right-of-Way in city right-of-way are in violation of the ordinance and will be removed. I SB 4196 -Councilman Stredicke discussed Senate Bill 4196, $750 million public Infrastructure works infrastructure bill scheduled for executive action in the Bond Issue Legislature. It was MOVED BY STREDICKE, SECONDED BY MATHEWS, CITY OF RENTON GO ON RECORD IN SUPPORT OF SB 4196. Mayor Shinpoch explained short notice given by A.W.C. of legislative action and lack of I opportunity to poll Council members regarding the matter. Councilman Rockhill questioned source of funds, noting his preference for the II city to sell its own bonds rather than relying on the state for distribution. MOTION CARRIED. HB 235 - Gas Councilman Stredicke also expressed support of House Bill 235, gasoline Tax Package tax package which will include increases in July of 1983 and July of 1984 to be shared by cities on a formula basis. Kay Johnson, Manager, Renton Chamber of Commerce, explained support of the bill by the Chamber only if larger portion proposed for cities having high maintenance costs for heavily traveled state arterials. Councilman Stredicke noted that without the additional gas tax, urban arterial projects will receive no funding at all , and encouraged support of the bill for that reason. It was subsequently moved by Stredicke, seconded by Mathews, that the City of Renton go on record in support of HB 235, d and that the Legislature be notified of the city's concern that the d formula be increased for local municipalities bisected by state 1 arterial roads receiving full traffic impact. The robot, yet unnamed, entertained the audience and officials with the assistance of Camille Radcliffe, Fire Code Inspector, and Ken Walls, Fire Inspector/Investigator, operator of the controls. The robot concluded the presentation by requesting suggestions for an appropriate name be sent to the department. OLD BUSINESS Community Services Committee Chairman Reed presented a report Community concurring in the recommendation of the Parks Department to resolve Services street tree problems in the downtown Central Business District. Committee The recommendation includes removing eight trees in planters on CBD Street 3rd Avenue; pruning four trees in sidewalks on 2nd Avenue which Tree Project are blocking traffic lights; and removing London Plane trees from Rainier to Burnett on 3rd Avenue, which are breaking sidewalks, cracking buildings, clogging sewers and growing into lights and signs, and replacing them with a different variety. The report further recommended the Parks Department continue to work closely with the Downtown Merchants Association and the Community Services Committee on the matter. This energy conservation measure will save of Lighting approximately 63% of the required energy usage per year and will System at be partially funded by a grant from Puget Power whi-ch pays for Gianini 71 .8% of such conversions. The city's share will be paid for out Stadium of the Park Department 1983 budget, and payback on the converstion is estimated at less than three years. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, RCW 43.21C, as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located on the east side of Union Avenue N.E. between N.E. 4th Street and N.E. 6th Street (extended). 6. The subject site is generally level. The site is covered with scrub brush, Alder and Douglas Fir trees. The subject site is vacant. The subject site was annexed into the City in November of 1966 by Ordinance No. 2290. The G-1 classification was applied at that time. The site was reclassified to R-3 by Ordinance No. 3651 in August of last year. The preliminary plat was approved by the City Council in October of 1982. 8. The land use element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial and office park type uses. At this time, the zoning code has not been amended to provide for an office park district. 9. Immediately north of the subject site are four older single-family homes. Immediately south of the subject site are an additional three older single-family homes. A single-family subdivision is located west of the subject site across Union Avenue N.E. There are also vacant properties in the vicinity of the subject site. South of the three single-family homes south of the subject site is a twelve-plex constructed on R-3 property. 10. Applicant has posted a bond to assure the installation of the required improvements pursuant to a deferral granted by the Board of Public Works. 11. The plat design reflects the conditions imposed upon the preliminary plat by the City Council and the ERC. CONCLUSIONS: 1. The plat appears to serve the public use and interest. The plat will allow the development as proposed by the applicant of up to 18 units of multi-family housing which is consistent with the R-3 zoning of the subject site. 2. The plat will create additional multi-family housing opportunities in this area, which is located near a growing commercial node along N.E. 4th Street and Union Avenue N.E. 3. While not immediately adjacent to other multi-family housing, there is similar development to the south, and this will permit an extension of same on the subject site. The applicant is seeking final plat approval for a proposed 9-lot subdivision approved under the McWilliams Preliminary Plat, file PP-031-82. 2. The final plat has been redesigned to reflect the Environmental Review Committee's condition to allow access to the east through the plat. 3. Road and utility plans including storm drainage, sanitary sewers, water supplies, street and pump station plants, have been approved by the City along with a temporary erosion control plan. The Board of Public Works granted a deferral for these plat improvements on February 2, 1983. Proper security was submitted to the City of Renton on February 15, 1983 to cover the cost of the deferred improvements in the amount of 155,000.00. This amount is a reduction from that originally estimated by the Public Works Department on December 6, 1982. 4. The final plat mylar has been revised to include an utility easement along the common property lines of Lots #7 and #8, thus complying with the Condition No. #5 of the Engineering Department comments. Tract. "A" have been eliminated to provide for road access to the east. Therefore, Condition No. #6 of that same comment is no longer applicable. 5. The other departments restate the requirement of compliance with the condition of the Environmental Review Committee, which was to provide access to the east. 6. The mylar has been checked for closure and appropriateness and found to be complete. M. The proposed 18 housing units could add approximately 180 vehicle trips each day to the vicinity road network, based on ITE nationwide average statis- tics . Most of this traffic will likely be coming or going through the Union Avenue/N.E. 4th Street intersection south of the site. For the 21-month period ending in April 1981 , this intersection averaged 2.75 accidents per million vehicles, compared to the state average of 0.9. At this high rate, the statis- tics indicate that the accidents are probably caused by the characteristics of the intersection. In, April 1981 improvements were made at, this intersection in the forms of left-turn signal phasing of the light and the addition of left-turn pockets. In the three months following the installation of these, there were no accidents at this intersection. William E. Popp Associates, in a traffic study for a separate nearby development, noted that most of the accidents prior to the im- provements involved vehicles turning left from 4th onto Union and that the addition of signal phasing and turn pockets caused a "dramatic reduction in accidents. " (Northward PUD Transportation Impact Analysis , March 1982. ) The pm peak hour level of service (LOS) at this intersection in 1981 was "C" . Another traffic concern in the vicinity includes N.E. 4th west of Union to where it becomes N.E. 3rd and then intersects Sunset Boulevard, which provides the pri- mary access to I-405 for the site and its vicinity. East of Duvall Avenue, 4th become SE 128th St. , and this arterial NE 3rd/NE 4th/SE 128th would be the major distributor of the project's expected 180 ADT. The intersection of NE 3rd and Sunset experienced a large number of accidents (21/year) through July 1981 , but for the volume of traffic this number is not critical . In 1981 this intersection operated at LOS "C". The City has proposed to widen NE 4th/NE 3rd from Union to Sunset to a continuous five-lane roadway with a two-way left turn lane. This work would also include resurfacing, curbs , gutters, sidewalks and drainage, and it is scheduled to begin in 1982. Traffic from the proposed project (180 ADT) would have no measurable effect on the operations of these roadways and intersections. 16 (d) Sanitary Sewer The proponent intends to install a lift station to pump sewage under Union Avenue to an existing manhole about 250 feet south of the site. The pro- ponent will construct and maintain this lift station. The proponent will also install a "dry" sewer at his front property line that will later be connected to an anticipated gravity system that will flow from about 1500 feet north of the site south past the site and adjacent properties . When this line is com- pleted through to the south, or at least to a connection at N.E. 4th , the devel- oper will abandon his lift station. Completion of the line depends on develop- ment of other nearby property.
