Continued Public Works Director Houghton reported a revised percentage of protests of 43.54% with addition of aforementioned letters, 60% required to terminate the LID. However, he has been advised that owner of the Gateway PUD, representing 19.8% of the total assessment, intends to protest, which will raise the protests to over the required percentage to terminate the LID. Upon inquiry, Mr. Houghton explained improvements by certain property owners are required as conditions of approval of previous land use changes. Responding for the Gateway PUD property owner was Raoul Ramos The Mueller Group, 855-106th Avenue SE, Bellevue, who advised that although certain improvements are required as a result of prior PUD approval , his client is not committed to participate in the LID and plans to protest. CARRIED.j I Planning nd Planning and Development Committee Chairman Rockhill presented a Development report, recommending reversal of the Hearing Examiner's decision Committee to deny Conditional Use request by Renton Plaza Associates, Renton P1 -za File No. CU-025-83, V-026-83, for property located at Talbot Appeal Road S. and S. Puget Drive. The committee found that the Examiner CU-025i83 made an error of law in that the Parking and Loading Ordinance allows a conditional use permit for off-site parking in all zones except for R-1 and R-2; the subject site is classified as R-4. The Committee also felt that the Examiner made an error in finding that the 25% coverage limitation for parking in greenbelts is 'a maximum threshold law rather than a guideline; and due to ! topographical elements on the property, the 35% to 50% lot coverage proposed meets the guidelines of the Comprehensive Plan for greenbelts. 1 Continued In reversing the Hearing Examiner and approving the conditional use permit to allow off-site parking on the adjacent greenbelt areas, the committee recommends imposition of the following conditions: 1 ) The applicant must provide the city with a bond sufficient to cover five years of tax and insurance payments under the parking lease with the bond adjusted to always provide the city with at least five years security' for future lease payments; 2) The applicant must apply for a change in the Comprehensive Plan to meet its guidelines' 1 RENTON CITY COUNCIL Regular Meeting Jul , 11 , 1983 Municipal Building Monl ay, 8:00 p.m. Council Chambers MINUTES CAL TO ORDER Mayor Barbara Y. Referencing the Wells Street Bridge public hearing held on 6/27/83, Councilman Stredicke felt the Council process should have included reading of correspondence into the record. PUB IC HEARING This being the date set and proper notices having been posted Sprngbrook/ and published according to law, Mayor Shinpoch opened the public Alb:•rthal hearing to consider the Springbrook/Alberthal Annexation Annexation consisting of 2.7 acres of city-owned property located along the east side of Talbot Road South approximately 800 feet south of South 192nd Street adjacent to the Springbrook Watershed. Policy Development Director David Clemens outlined the purpose of the acquisition and annexation of the property to ensure protection of one of the city's major water supplies and a key transmission main on Talbot Road South by connecting the subject property to the city boundary. The location of the site was designated on a display map, and it was noted a portion of the Talbot Road right-of-way is included to provide the connection. Continued Mr. Clemens reported the legal description of the proposal incorrectly includes a small , triangular piece of property on the east side of Talbot Road, owned by the adjacent property owner to the west. Upon notification of the error by the owner this date, the island, only several hundred square feet in size and surrounded by city-owned property to be annexed, has been deleted. Alternatives for future action on that property were discussed by Mr. Clemens including purchase by the city, leaving it as it now exists, or selecting a different boundary configuration. Responding to Councilman Stredicke' s inquiries, Mr. Clemens explained the city' s rationale in annexing a county roadway not built to city standards to ensure protection of the water system in the event development of county property occurs; and explained the route of an existing water line which heads north along Talbot Road to S. 43rd Street. Continued William Scholen, 19418 Talbot Road S. , owner of property directly south of the proposal , indicated concern regarding future development of annexed property which may potentially impact his water well located in close proximity to the boundary. Public Works Director Richard Houghton advised- the possibility of fencing the city property although there are no plans for development to his knowledge. Further discussion indicated a G-1 zoning classification will be applied upon annexation which would allow development of one single family residence. Correspondence Stre, l Vacation was read from Public Works Director Houghton reporting that the of Gej Seng subject roadway, platted in 1904, has never been opened to the Avenuq traveling public, and because it is unnecessary for future use, VAC-0 -83 no easements are required. However, due to development potential of the vacated property, a Class "C" street vacation category requiring a fee should be applied. It was further recommended that Section V of Ordinance No. 3635, street vacation procedures, should be followed, specifically the section requiring abandonment and denial of the petition if the compensation determined by Council has not been paid within 90 days of that decision. Mr. Houghton designated the location of the subject site on a display map, and advised the petition had not been signed by one of the abutting property owners on the southwestern side of Gen Seng Avenue. Contin ed James C. Hanken, 1300 Seattle Tower, Seattle, legal counsel for the petitioners, confirmed that the street has never been used, a fully developed access roadway lies parallel to it, and approval of the street vacation will allow the highest and best use of the property. Responding to Councilman Rockhill ' s inquiry regarding potential problems caused by failure of the owner who has not signed the petition to pay his share of the assessed value, City Attorney Warren explained division of the vacated property to abutting property owners on each side of the road, discussed options available to property owners to negotiate purchase of the vacated land from each other, and indicated right of the City Council to delete any. portion if the owner refuses to pay. Councilman Stredicke supported inclusion of the entire street in the vacation procedure at this time to avoid duplication of effort in the future when other property owners may petition the city. Mayor Shinpoch explained privilege of property owners to choose not to sign the petition. MOVED BY ROCKHILL, SECONDED BY MATHEWS, THE PUBLIC HEARING BE CLOSED. Kaufman Land Use Hearing Examiner SUBJECT: HARRISON APPEAL —METHOD OF SEWERAGE DISPOSAL I have re:i ewed Mr. Harrison's letter of appeal and would like to clarify the matter regarding I.a sewerage issue. The minute s reflect the fact that Mr. Harrison answered an inquiry regarding whether the property as served by a septic tank or sanitary sewer to the effect that he was served by a septic system. The minutes appear to be at variance with the actual tape recording, although t e clarity of the tape at this point may account for the error. The minutes are not a for(gal part of the Exal er's Report and do not reflect the formal decision-making process. While the recommendation Qf this office did not make any affirmative finding regarding this matt r, I myself recorded his response to the question as that he was served by sewersl. S. •ce property served by septic would have to have had the approval of the King County H-alth Department, the implication of the report is that the site is served by sewers. o reference was made to King County approval and one of the issues was whether ti e sewer system had sufficient capacity to handle this new development, not the conseque ces of a septic system. PUBLIC HE RING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 31, 1983, at 9:00 a.m. in the. Council Chambers of the Renton Municipal B lding. Parties wishing to testify were affirmed by the Examiner. Testifying was: Michael Blonski 1908 N.E. 20th Renton, WA 98056 Mr. Blonski indicated his property lies directly east of the applicant's property; there are no survey stak:s set on the proposed development, no brush has been cut from the approxiimate boundary 1 •es, so no set boundaries have been established between his property and the applicants. Mr. Blonski expressed opposition to the proposal for the variance for 26 feet because he •elieves there is aliready an easement into the interior of this section for a street that sorrietin e was initiated for a road and feels a full street, with full curbs and sidewalks, would allow full development of the area at some time in the future. Box 201 Renton, WA 98057 Mr. JohnI so stated he built his home at its present location 28 years ago and exp essed opposition t,) the increase in traffic the road for four houses would create if constructed .n the east side, 1 of s lot.- Further testimony was heard from: Leona Core 1828 N.E. 20th Renton, WA 98057 Mrs. Core dicated her property lies west and downhill from Mr. Harrison's property; she questioned the problem of roald obstruction if four houses use the same roadway for access to and from he proposed development. She indicated this development would change the neighborhoo' completely. Mrs. Core also inquired if Mr. Harrison would subdivide thepropertyandand 'Se the lots, or whether he would construct rental homes on the property. Mrs! Cord stated also that there is a problem with standing water most of the year in this vicinity. Testimony as then heard from: Lola Johnson 1836 N.E. 20th P. 0. Box 201 Renton, WA 98057 Mrs. Johnso indicated if a private road is constructed, three of the proposed lots will b on a hillside and this will increase! the stOrmwater runoff. She questioned if provisions would be made to Ptak care of this problem. It was poin ed out by Roger Blaylock, Zoning Officer, that the Engineering Department has already required positive drainage to the west across Tracts 293 and 284, which may elude major revisions to the storm drainage system. Mr. Blaylock indicated' the t there was not. IIt was noted positive drainage would have to be provided Out to Jones Road :nd that may require fairly deep culverts. Mrs. Johnso inquired if the domestic water well located below Mr. Harrison's property, which well has bee in use for 80 years, would be affected by the runoff. The Examiner explained that there ar,e codes requiring cornpliance for storm drainage systems. She further stated an unnamed l cr..ek originates at the SE corner of the Blueberry farm and runs down to the corner of Jones & 24t and also comes out in the Gene Coulon Beach Park. The Examin:r assured Mrs. Johnson that there are codes in the city that require storm water to be positivel conveyed to a storm drainage channel; he is not sure what the existing channel system is in hat area. Plans for the proposal have been reviewed by all city departments affected by the impact of thi- development. 5. The s bject property is located at 1832 N.E. 20th Street between Jones Avenue N.E. and Aber.een Avenue N.E. in the Kennydale area of the city. This is a large superblock consi ting of a number of large lots on the block's periphery. There are some interior lots whos: only access to a public street is by private easement. 6. The s bject site was annexed into the city in 1960 by Ordinance 1827 at which time it was auto atically zoned G 7200. A 1982 change in designation resulted in this site being desig ated R-1 (Single Family Residential); Minimum lot size - 7,200 sq. ft.). 7. The su•ject property is al pipestem lot with an approximately 26 foot wide by 80 foot deep accfess driveway onto 20th Street N.E. 10. Imrned ately to the south of the subject site is a single family home which is in separate owners p. The pipestem driveway runs along the east side of this separate property, provid i g access to the subject site and its proposed four lots. The to area on the subject site is located north of this single family home. 11. The o er of this property will be affected by the traffic generated by the additional homes proposed for the subdivision. These owners were concerned about storm drainage proble n s associated with development on the subject site, as well as the traffic and noise. 12. The a -a is primarily developed with single family homes, many of them on large lots approa hing, and in some cases exceeding, two acres in area. 13. In add tion to the single family home immediately south of the site, the owner of the proper y immediately to ithe east of the site raised concerns regarding the traffic, storm drainage and the necessity for a public or private street in the location proposed y the applic.nt. AnIea-ement providing access to the center of the superblock in which the subject ite is locate, already exists to the east of the subject site. 14. The ar-a's drainage problems probably account for the existence of a bog and blueberry farm 1•cated south of the subject site. While not readily apparent in this location, there is a d ainage feature which drains the water from the site to an unnamed creek. This creek -ventually contributes to the stream which flows into and through the Gene Coulon Beach I'ark. 15. A regi,tered well which is located 20 feet west of the subject site still provides domestic water. Modification of I the surface drainage and diversion of surface waters may interf,re with the valuable right to draw water from the well. 16. There ave been riecurring problems with the sewer pump station serving the area in whichtheysu•ject site is located. The station is reported to be at capacity and two existing homes have yet to hook into the system. 17. The a;'plicant proposes the creation of four lots ranging in area from approximately 15,000 sq. ft. to approximately 20,000 sq. ft. The minimum lot size required under the zoning is 7,200 sq. ft. 18. The superblock in which the subject lot is located now contains approximately 40 homes. Under the R-1 zoning of the area, the block could contain up to 125-150 homes. ' Thereareaap'roximately 8 similarly sized and developed superblocks in the immediate areaoftheIsubjectsite. Event al infilling of these blocks could increase the housing stock in this area by appro 41 mately 600 - 800 homes. In ithi- regard, the Fire Department noting the potential for haphazard development, rec'om ended that a general policy is necessary to provide for uniform access, fire flow and of er emergency requirements. 19. Event al construction on the proposed four lots would contribute approximately 10 additional people, approximately 40 additional vehicle trips per day, and increa e the school age population by approximately 1 student. 20. The tr•nd, if continued on this block, would increase the population by approximately 300, the vehicle trips by approximately 1,200 trips per day, and increase the scho 1 age popula ion by approximately 30 students. There remain after the close of the public hearing, too many unanswered que tions regarding the impacts ofl the proposed plat and eventual development upon the general area, E.nd particularly upon neighboring property. There also remains the precedent seting value of approving) this request and its affects upon similar properties in the a ea. 3. The potential adverse affects upon the domestic well were unanswered. The adverse health affects of the pump station overload and failure cannot be discounted, an two more existing homes are entitled to hook up to the system. 4. The applicant failed to demonstrate what affects the development of his parcel ould have upon storm drainage. The resultant storm waters in the area enter into and ha e an impact upon the stream flowing through the Coulon Beach Park. The consequen s of either increased or decreased flow were not discussed. 5. The policy concerns raised by the Fire Department are applicable to not only the subject superblock, but to the other large blocks in the Kennydale area. While the zoning would permit the proposed development at the proposed intensity, the nee4 for adequate public services must be addressed prior to the approval of addi donal development. As Mrs. Johnson stated in her testimony and letter, the consequenc s of inadequate sewer capacity must be addressed, if it is inadequate, before the sit ation results in a situation similar to that along Sunset Blvd. 6. If, we decided to add on, we can build five feet from our property line east and,we t. Our house then would be five feet from that traffic. There - e seven private driveways, over 100 feet long on N.E. 20th between Aberdeen Ian. Jones, that have been here before we were annexed into the city. Four of those 'se en driveways go back over 300 feet from the street. 211 of those drive- ways are 'Ito single residences. We doubt if any neighbors have too much of a problem i I with the ,pe.ple who use those driveways. The normal amount of traffic is expected. Some lof those driveways have turn-arounds at the ends. It is still a little ' inconvenien to get in and out sometimes. If there were four houses along their driveways;, 't would be a great deal more inconvenient! We don't know anybody who would like - of those driveways to go to four houses instead of one. There is the fact of the traffic restriction on a 26 foot road! There will always be, so,eone backing out to let someone else in or out, that happens now with just one hou-el If it was ever going to be any different, I'm sure it would have been in the ast ten years Mr. Harrison has rented out his property. 26 feet ounds like a fair size road, but that kind of road usually ends in a one lane 'acc SS and there is no guarantee that it will be maintained! Even if iveways or parking were made for'each of the four lots, there is I still visito's, company or trades people who will park on or in the private road. It would just be more convenient for them! So that happens if there' is an emergency to get in or out? It actually would be worse than eing on a party line telephone when there is a fire. At least on a party line your tell the person, there is an emergency, but what if you had to get out of a car and to a house to ask to have a vehicle removed? In addition, a request for waiver of off-site improvements along N.E. 20th Street has been requested. 2. The proposal is generally consistent with the Comprehensive Plan designation of Single Family Residential and zoning classification of R-1, Residential. 3'The request is the first proposal to allow development of an interior lot in one of the old superblocks of C. D. Hillman Lake Washington Garden of Eden tracts. This superblock, comprised of almost forty (40) acres, has only forty 40) houses located within it. Considering a loss of approximately 30% for public streets, the area could potentially have as many as one hundred and fifty (150) dwelling units under the R-1 zoning. Neighboring blocks have undergone some redevelopment within the last ten years with the plats of the Stolenmeyer Addition to the north, Azalyea Lane to the east, and High Gate to the south. At the present time, development has occurred along the peripherial streets and is to the point of limiting access to the interior of the block. The applicant's request to utilize a private street does not specifically comply with the criterial that limits access to only four (4) lots. Even though the applicant has only applied for a four (4) lot short plat, his own property potentially could be divided into six (6) lots under the present zoning standards. In addition, Tract 273 to the north of the subject site and the parcel of 272 immediately to the east of the subject site could be subdivided. A temporary hammerhead could be utilized on the subject site similar to the one that was utilized in the plat for Union 600. The applicant does not suffer undue hardship to allow the utilization of a private street. In addition, it would be materially detrimental to adjacent properties and the subsequent redevelopment of the neighborhood. 4. The applicant has also requested a variance from the thirty (30) foot width requirement for a private street. If the private street variance is not granted, then the variance for width is moot. The applicant does comply with the justification for granting a variance to width. Principally, the property under control of the applicant is limited to twenty-six (26) feet and widening of this right-of-way would make the existing residence fronting on N.E. 20th Street non-conforming with respect to sideyard setback in the R-1 zone. The applicant does suffer an undue hardship that is not his own making as a result of the shape of his piece of property and the location of the adjacent residence. The granting of the variance would not be materially detrimental to the public welfare because the public generally does not utilize the full width rights-of-way required by the subdivision ordinance. In addition, it would not constitute a special privledge and is the minimum variance that could be allowed. Half streets can be placed on as little as twenty-five (25) feet of right-of-way. 5. Other department comments are attached for the Examiner's and public review. In general, the Building Division, Public Works Department and Fire Department question the advisability of utilizing a private access in this project. They see the potential for more lots accessing onto this easement without consideration of the total development plan for the forty (40) acre superblock. The Policy Development Department does not agree. The Public Works Department also advises that all public improvements will need approved plans and profiles, and that positive drainage off-site will be required between Tracts 293 and 284. The improvement of the applicants frontage of twenty-six (26) feet on N.E. 20th Street should not be waived. It appears that this is the first lot of the superblock to be redeveloped. Further redevelopment of the lots would allow an upgrading of the general area. M. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the short plat request, Short Plat-014-83 and variance, V-016-83, be approved subject to the following conditions: 1. Dedication of area designated on short plat map for private street for a public half street with construction per Public Works Department's standards. 2. Extension of the dedication thirty (30) feet in width to the northern property line. 3. The hamnerhead turnaround would be considered temporary in nature and should show so on the short plat. However, after a more de ailed review, the proposal may be the only solution available given the current lot config ration in the vicinity. The following items must be taken into consideration: I l. Tract 272 of the original C.D. Hillman's Plat has been divided east and west with the subject property being 152' wide and the remainder to the east being 100' wide. 2. The applicants has physical access to only N.E. 20th across a 26-foot wide pipestem area. The subject property located at 1832 N.E. 20th is not a part of the plat and is not in the applicant's ownership. 1 13. Tract 273 to the north has also been subdivided, leaving approximately 350' of land-locked property ownership immediately adjacent and north of this plat. Full com•liance with the Subdivision Ordinance would appear to require a public street with a mi imum width of 56' to serve Tracts 2-72 and. 273. However, such a public street would lal ost certainly exceed the 500-foot maximum length provided in the Subdivision Ordinanc Due to the existing platting of the tracts to the north, west, and east, there does not appear to be a feasible northerly access to an existing public street, which would alleviate his condition. 1 If a publi street with a minimum width of 50 feet is required, this property owner would need to I,edicate and construct the westerly 30 feet of that improvement, with the remainin: 20 feet being eliminated from the 100- width- parcel immediately to the east. However, after a more de ailed review, the proposal may be the only solution available given the current lot configu ation in the vicinity. The following items must be taken into consideration: Tract 272 of the original C.D. Hillman's Plat has been divided east and west with the subject property being 152' wide and the remainder to the east being 100' wide. 2. The applicant has physical access to only N.E. 20th across a 26-foot wide pipestem area. The subject property located at 1832 N.E. 20th is not a part of the plat and is not in the applicant's ownership. 3. Tract 273 to the north has also been subdivided, leaving approximately 350' of land-locked property ownership immediately adjacent and north of this plat. Full comp'fiance with the Subdivision Ordinance would appear to require a public street with a mil imum width of 50' to serve Tracts 272 and 273. However, such a public street would al ost certainly exceed the 500-foot maximum length provided in the Subdivision Ordinanc-. Due to the existing platting of the tracts to the north, west, and east, there does not 'pear to be a feasible northerly access to an existing public street, which would alleviate his condition. If a publi street with a minimum width of 50 feet is required, this property owner would need to edicate and construct_ the westerly 30 feet of that improvement, with the remairun 20 feet being eliminated from the 100 width parcel immediately to the east. Severing hat additional 201 feet from the 100-foot width would make the parcel to the east extra mely difficult to develop. I i Art Fred J. The burden was upon the applicant to demonstrate that the request was justified and would not adversely affect the public health, safety and welfare. 2. There remain after the close of the public hearing, too many unanswered questions regard g the impacts of the proposed plat and eventual development upon the general area, nd particularly upon neighboring property. There also remains the precedent settin value of approving this request and its affects upon similar properties in the area. I 3. The p tential adverse affects upon the domestic well were unanswered. The adverse health affects of the pump station overload and failure cannot be discounted, and two more existing homes are entitled to hook up to the system. I 4. The a plicant failed to demonstrate what affects the development of his parcel ,would have on storm drainage. The resultant storm waters in the area enter into and have an impac upon the stream flowing through the Coulon Beach Park. The consequencs of either ' creased or decreased flow were not discussed. 5. The p licy concerns raised by the Fire Department are applicable to not only the subject superb ock, but to the other large blocks in the Kennydale area. There will be a storm water run-off, both from the houses and the road. Would there be provisions made to take care of that run-off? There is a registered wbil about 20 feet west of Mr. Harrison's property, below the hill where new lots would be. That well has been in use for about 80 years. Wou] 1d that well be affected by storm water run-off? There i a problem now getting the water out of this little valley. The only place the water can go is on somebody else's property that already has a problem. One time ir. Harrison did put in a culvert under an adjoining driveway, but all that happen d was the water was transferred from his side of the road to the other side. There is already a tremendous amount of undergroQnd and surface water through this little valley. If an improved road is put in, is there any guarantee that no neighbors will suffer from storm water run-off going onto their property??? We were told that the pump lift station was near it's capacity now, and there Five is still two existing houses ,to hook up. Would that lift station take six more houses? My home address 1836 N.E. 20th and my mailing address is P.O. Box 201 Renton, Wa. 98057. My wife and I built our house ourselves 28 years ago at the present address. We realize our lot is a bottleneck to the property behind us. It's one thing to have a single residence driveway along side of our property, but we can not be happy with a road for four houses put in against the east side of our lot! That is four times the traffic that uses the road now. Which you can figure is approx- imately eight vehicles, at two per houselhold. That traffic would be 20 feet from i our house. If, we decided to add on, we can build five feet from our property line east and west. Our house then would be five feet from that traffic. There ar seven private driveways, over 100 feet long on N.E. 20th between Aberdeen and Jones, that have been here before we were annexed into the city. Four of those seven driveways go back over 300 feet from the street. 211 of those drive- ways are to single residences. We doubt if any neighbors have too much of a problem with the peo le who use those driveways. The normal amount of traffic is expected. Some of hose driveways have turn-arounds at the ends. It is still a little inconvenient to get in and out sometimes. If there were four houses along their driveways, it would be a great deal more inconvenient! We don't know anybody who would like any of those driveways to go to four houses instead of one. There is the fact of the 'traffic restriction on a 26 foot road! There will always be so.eone backing out to let someone else in or out, that happens now with just one hou e! If it was ever going to be any different, I'm sure it would have been in the last ten years ILr. Harrison has rented out his property. 26 feet sounds like a fair size road, but that kind of road usually ends in a one lane acc ss and there is no guarantee that it will be maintained! Even if iveways or parking were made for'each of the four lots, there is still visitofs, company or trades people who will park on or in the private road.' L. DEPARTMENT ANALYSIS; 1. The applicant is seeking short plat approval to allow the development of four 4) single family residential lots along with a variance request to allow a private street and a variance request to allow a reduction in the private street width from thirty (30) feet to twenty-six (26) feet for a distance of eighty (80) feet at the southern end of the proposed private street. In addition, a request for waiver of off-site improvements along N.E. 20th Street has been requested. 2. The proposal is generally consistent with the Comprehensive Plan designation of Single Family Residential and zoning classification of R-1, Residential. 3. The request is the first proposal to allow development of an interior lot in one of the old superblocks of C. D. Hillman Lake Washington Garden of Eden tracts. This superblock, comprised of almost forty (40) acres, has only forty 40) houses located within it. Considering a loss of approximately 30% for public streets, the area could potentially have as many as one hundred and fifty (150) dwelling units under the R-1 zoning. Neighboring blocks have undergone some redevelopment within the last ten years with the plats of the Stolenmeyer Addition to the north, Azalyea Lane to the east, and High Gate to the south. At the present time, development has occurred along the peripherial streets and is to the point of limiting access to the interior of the block. The applicant's request to utilize a private street does not specifically comply with the criterial that limits access to only four (4) lots. Even though the applicant has only applied for a four (4) lot short plat, his own property potentially could be divided into six (6) lots under the present zoning standards. In addition, Tract 273 to the north of the subject site and the parcel of 272 immediately to the east of the subject site could be subdivided. A temporary hammerhead could be utilized on the subject site similar to the one that was utilized in the plat for Union 600. The applicant does not suffer undue hardship to allow the utilization of a private street. In addition, it would be materially detrimental to adjacent properties and the subsequent redevelopment of the neighborhood. 4 The applicant has also requested a variance from the thirty (30) foot width requirement for a private street. If the private street variance is not granted, then the variance for width is moot. The applicant does comply with the justification for granting a variance to width. Principally, the property under control of the applicant is limited to twenty-six (26) feet and widehing of this right-of-way would make the existing residence fronting on N.E. 20th Street non-conforming with respect to sideyard setback in the R-1 zone. The applicant does suffer an undue hardship that is not his own making as a result of the shape of his piece of property and the location of the adjacent residence. The granting of the variance would not be materially detrimental to the public welfare because the public generally does not utilize the full width rights-of-way required by the subdivision ordinance. In addition, it would not constitute a special privledge and is the minimum variance that could be allowed. Half streets can be placed on as little as twenty-five (25) feet of right-of-way. 5. Other department comments are attached for the Examiner's and public review. In general, the Building Division, Public Works Department and Fire Department question the advisability of utilizing a private access in this project. They see the potential for more lots accessing onto this easement without consideration of the total development plan for the forty (40) acre superblock. The Policy Development Department does not agree. The Public Works Department also advises that all public improvements will need approved plans and profiles, and that positive drainage off-site will be required between Tracts 293 and 284. The improvement of the applicants frontage of twenty-six (26) feet on N.E. 20th Street should not be waived. It appears that this is the first lot of the superblock to be redeveloped. Further redevelopment of the lots would allow an upgrading of the general area. M. 11 DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the short plat request, Short Plat-014-83 and variance, V-016-83, be approved subject to the following conditions: 1. Dedication of area designated on short plat map for private street for a public half street with construction per Public Works Department's standards. 2.Extension of the dedication thirty (30) feet in width to the northern property line. 3. The hammerhead turnaround would be considered temporary in nature and should show so on the short plat. However, after a more, de ailed review, the proposal may be the only solution available given the current lot config ration in the vicinity. The following items must be taken into consideration: 1. Tract 272 of the original C.D. Hillman's Plat has been divided east and west with the subject property being 152' wide and the remainder to the east being 100' wide. I 2. The applicant ,has physical access to only N.E. 20th across a 26-foot wide pipestem area., The subject property located at 1832 N.E. 20th is not a part of the plat and is not in the applicant's ownership. 1 3. Tract 273 to the north has also been subdivided, leaving approximately 350' of land-locked!property ownership immediately adjacent and north of this plat. i Full compliance with the Sub diOrdinancewouldappeartorequireapublicstreet with a mini um width of 50' to serve Tracts 272 and 273. However, such a public street would almo certainly exceed the 500-foot maximum length provided in the Subdivision Ordinance. Due to the existing platting of the tracts to the north, west, and east, there does not ap ear to be a feasible northerly access to an existing public street, which would alleviate this condition. If a public stIreet with a minimum width of 50 feet is required, this property owner would need to dedicate and construct the westerly 30 feet of that improvement, with the remaining 20 feet being eliminated from the 100 width parcel immediately to the east. Severing that additional 20 feet from. the 100-foot width would make the parcel to the east extremely difficult to develop. I Fred J. In order to meet the requirements of the provision of not more than four lots having potential access to a private street, the short plat should be approved with three lots. 2 The City of Renton should be granted a 1-foot reserve strip along the east property line to eliminate access to this private roadway from the parcel to the east at such time as it develops. 3. The Variance request for the use of a private roadway should be granted subject .to a revision of the hammerhead to a size consistent with the requirements of the Fire Department for adequate turnaround. 4. The private street should be developed with a minimum 20-foot of paving width with the exception of the cul-de-sac to be consistent with condition 3. 5. The Waiver request should be denied and the matter referred to the Board of Public Works for consideration of the deferral. Clemens, Policy Development Director RE: HARRISON SHORT PLAT APPLICATIONS 014-83, V-015-83, V-016-83, W-017-83 Upon initial review of the , Harrison Short Plat, the proposal appears to be wholly inconsistent with appropriate isections of the City's subdivision provisions. However, after a more 'detailed review, the Proposal may be the only solution available given the current lot configuration in the vicinity. The following items must be taken into consideration: 1. Tract 272 of the original C.D. Hillman's Plat has been divided east and west with the subject property being 152' wide and the remainder to the east being 100' wide. 2; The applicant has physical access to only N.E. 20th across a 26-foot wide pipestem area. 1 The subject property located at 1832 N.E. 20th is not a part of the plat and is not in the applicant's ownership. 3J Tract 273 to the north has also been subdivided, leaving approximately 350' of land-locked property ownership immediately adjacent and north of this plat. Full compliance with the Subdivision Ordinance would appear to require a public street with a minirium width of 50' to serve Tracts 272 and 273. However, such a public street would almost certainly exceed the 500-foot maximum length provided in the Subdivision Ordinance. ue to the existing platting of the tracts to the north, west, and east, there does not app ar to be a feasible northerly access to an existing public street, which would alleviate this condition. If a public street with a minimum width of 50 feet is required, this property owner would need to ded!cate and construct the westerly 30 feet of that improvement, with the remaining 20 feet being eliminated from the 100 width parcel immediately to the east. Severing 'that additional 20 feet from the 100-foot width would make the parcel to the east extremely difficult to develop. Fred J. Kaufman, Hearing Examiner March 16, 1983 Page 2 RECOMMENDATION: Given the current platted condition of the properties surrounding the subject application, the short plat should be approved as follows: 1. In order to meet the requirements of the provision of not more than four lots having potential access to a private street, the short plat should be approved with three lots. 2. The City of Renton should be granted a 1-foot reserve strip along the east property line!to eliminate access to this private roadway from the parcel to the east at such time as it develops. 3. The Variance request for the use of a private roadway should be granted subject to a revision of the hammerhead to a size consistent with the requirements of the Fire Department for adequate turnaround. 4. The private street should be developed with a minimum 20-foot of paving width with the exception of the cul-de-sac to be consistent with condition 3. 5. The Waiver request should be denied and the matter referred to the Board of Public Works for consideration of the deferral.
