WHENEVER A CONTRACTOR lXjQUESTS PERMISSION TO SUBLET A PART OF ANY CONTRACT AND SUCH CONTRACT COMES
WITHIN THE PROVISIONS OF THE EQUAL OPPORTUNITY REGULATIONS OF THE SECRETARY OF LABOR, REVISED MAY
21, 1968, HE SHALL OBTAIN THIS CERTIFICATION FROM HIS PROPOSE!) SUBCONTRACTOR AND FORWARD IT
TOGETHER WITH SUCH REQUEST. NO SUBCONTRACT WILL BE APPROVED BEFORE FECEIPT OF SUCH CERTIFICATION
FROM THE SUBCONTRA--TOR.
FOR THIS PLRPOSE, CERTIFICATION FORMS MAY BE OBTAINED FROM THE PROJECT ENGINEER ASSIGNED TO THIS
PROJECT.
CONTRACTOR'S FESPONSIBILITY FOR WORK (RE -PLACEMENT SECTION)
THE WORK 94ALL BE UNDER THE CONTRACTOR'S RESPONSIBLE CARE AND CHARGE. THE CONTRACTOR SHALL BEAR
ALL LOSS NO DAMAGE WHATSOEVER AND FROM WHATSOEVER CAUSE, EXCEPT THAT CAUSED SOLELY BY THE ACT OF
THE OWNER WHICH MAY OCCUR ON OR TO THE WORK DUFl:4G THE FULFILLMENT OF THE CONTRACT.
IF ANY SUCH LOSS OR DAMAGE OCCURS, THE CONTRACTOR %AJ-L IMMEDIATELY MAKE COW ANY SUCH LOSS OR
DAMAGE, AND IN THE EVENT OF THE CONTRACTOR REFUSING OR NEGLECTING TO DO SO, THE OWNER MAY, ITSELF
OR By THE 04PLOYMENT OF SOME OTHER PE�-, MAKE GOOD ANY SUCH LOSS OR DAMAGE, AND THE MST AND
EXPENSE OF SO DOING SHALL BE CHARGED TO THE CONTRACTOR.
THE CONTRACTOR ALONE SHALL AT ALL TIMES BE RESPONSIBLE FOR THE SAFETY OF HIS AND HIS
SUBCONTRACTOR'S EMPLOYEES, AND FOR HIS AND HIS SUBCONTRACTOR'S PLANT AND EQUIPMENT AND THE METHOD
OF PROSECUTING THE WORK.
DURING UNFAVORABLE WEATHER AND OTHER CONDITIONS, THE CONTRACTOR SHALL MRSUE ONLY SUCH PORTIONS OF
THE WORK AS SHALL NOT BE DAMAGED THEREBY.
NO PORTION OF THE WORK WHOSE SATISFACTORY QUALITY OR EFFICIENCY WILL BE AFFECTED BY UNFAVORABLE
CONDITIONS SKqLL BE CONSTRUCTED WHILE THESE CONDITIONS EXIST, UNLESS BY SPECIAL MEANS OR
PWZAUTIONS ACCEPTABLE TO THE ENGINEER, THE CONTRACTOR SHALL BE ABLE TO OVERCOW niEM.
.1-07.14 RESPONSIBILITY FOR DAMAGE (ACCITIONAL SECTION)
THE CONTRACTOR SHALL BE RESPONSIBLE FOR CONTROLLING DUST AND MUD WITHIN THE PROJECT LIMITS AND ON
ANY STREET WHICH IS UTILIZED BY HIS EQUIPMENT FOR THE OLORAT10N OF THE PROJECT. THE CONTRACTOR
SMALL BE PREPnRED TO USE WATERING TRUCKS, POWER SWEEPERS, AND OTHER PIECES OF EQUIPMENT AS DEEMED
NECESSARY By THE ENGINEER, TO AVOID CREATING A NUISANCE.
DUST AND MUO CONTROL SHALL BE CONSIDE);tED AS INCIDENTAL TO THE PROJECT, AND NO CD4—'NSTION WILL BE
MADE FOR THIS SECTION.
COW-AINTS OF DUST, MUD OR UNSAFE PRACTICES AND/OR PROPERTY DAMAGE TO PRIVATE O-�ERSHIP WILL BE
TRAN-94ITTED TO THE CONTRACTOR AND PROMPT ACTION IN CORRECTING THEM WILL BE REQUIRED BY THE
CONTRACTOR.
1-07.16 PROTECTION AND RESTORATION OF PROPERTY (REPLACEMENT SECTION)
THE OWNER WILL OeTAIN ALL EASEMENTS AND FRANCHISES REQUIRED FOR THE PROJECT. THE CONTRACTOR SHALL
LIMIT ;lIS CPERATION TO THE AREAS OBTAINED AND SHALL NOT TRESPASS ON PRIVATE PROPERTY.
THE OWNER MAY PROVIDE CERTAIN LANDS, AS IN01CATED IN CONNECTION WITH THE WOW UNDER THE CONTRACT
TOGETHER WITH THE RIGHT OF ACCESS TO SUCH LANDS. THE CONTRACTOR 91ALL NOT L04REASONABLY ENCL44BER
THE PREMISES WITH HIS EQUIPMENT OR MATERIALS.
