Dear Bob:
Coral Construction's minority Business Enterprise form is now
acceptable.
With respect to their performance bond, that is clearly unacceptable.
If you would compare the bond with the suggested City bond form you
will note the differences. Fireman's Fund performance bond guarantees
only that the contractor will fulfill each and every of the covenants,
conditions and requirements of the contract. our standard bond form
also requires the contractor to pay laborers, mechanics, subcontractors
and materialmen and suppliers to the principal or subcontractors and
that they hold the City of Renton harmless from any loss or damage
to any person or property by reason of carelessness or negligence on
the part of the principal or any subcontractor. Our bond further
requires them to indemnify and hold the City harmless from any
darnages or expense by reason of failure of performance or from defects
appearing or developing in the material or workmanship within a period
of one year after acceptance.
Our bond form closely parallels the requirement of State law. Their
bond form does not. They must provide us either with a more complete
bond form or sign the City bond form. I will t approve their bond
form as it presently exists. Z7`
