REPORT AND DECISION.
APPLICANT: CITY OF RENTON DEPARTMENT OF PUBLIC WORKS
FILE NO. SA-013-84
LOCATION: Located in the extreme north corner of Liberty Park, south
of Bronson Way North, and west of Houser Way North.
SUMMARY O REQUEST: Applicant seeks site plan approval to allow the
reconstruction of a municipal water supply well in a P-1
zoned district.

PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a public h aring
on the subject as follows:
The hearing was opened on February 28, 1984, at 11:05 a.m. in the Council Chambers of the
Renton Municipal Building.j Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1: Yellow file containing the application, staff
report, and other documents pertaining to
posting and publication.
Exhibit #2: Site plan for the proposed site.
Roger Blaylock, Zoning Administrator, presented the staff report. He noted the applicant is
seeking site plan approval to allow the reconstruction of a municipal water supply well in1 a P-1
zoned district in Liberty Park. Further, the site plan does not show the access roadway from
Bronson Way which will have to be constructed for servicing the well. Mr. Blaylock then drew
said roadway on the site plan map.

Mr. Blaylock indicated this proposal was to update the existing city services; the existing well
has been in use for many; years, but there now exists a problem with the well vault. It is
creating unsafe working Cortiditions for the city employees and there is a potential foil some
contamination in the backflow. He noted further that the structure would be tucked in On the
existing founldation and basically will not disturb the natural vegetation on site except for someofthelawnareatoallow ;construction of the new access driveway to supply chemicals and for
maintenance of the facility.
Mr. Blaylock noted staff recommends approval of the request.

Bob Bergstrom, Engineering Supervisor, commented that Well #3 was the original replacement
for the well!in Jones Park; that it was built underground and there has been a problem with it
filling up with water seepage; and that permission has been received from the Park Board to
build the new above-ground facility.
The Examiner called for fu 1ther testimony. There being none, the hearing was closed at 11:15
a.m. The Examiner noted his decision would be issued within 14 days.

FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the following:
FINDINGS:
1. The applicant, City of Renton, Department of Public Works, filed a request for approval
of a site plan to reconstruct a municipal water well.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building & Zoning Department Report, and other pertinent
documents, was entered into the record as Exhibit 4t 1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of
Non-Significance has been issued for the subject proposal by the Environmental Review
Committee (ERC), responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this developmerlt.

6. The subject site is located in the northeast corner of Liberty Park near the intersection of
Bronson Way N. and Houser Way N.
7. The site is part ofj the original City of Renton and has been classified P-1 (Public) since
1953 when the zoning code was originally adopted.
8. The Comprehensive Plan designates the area in which the subject site is located as
suitable for recreational uses.
9. The development of any facilities in the P-1 zone, including municipally sponsored
facilities, requires site plan review.
10. The plan for the well was approved by the Park Board, but the road, which will be paved
with asphalt, was not part of the plan which that Board reviewed. Therefore, Park Board
review will be required for the road.
11. The original well is located underground as a result of earlier Park Board conditions, but
such undergrounding has led to flooding and safety problems, necessitating redesign and
reconstruction of the facility.
12. The property involved will be approximately 200 square feet without the roadway access.
13. Existing park vegetation will screen the facility from view and the facility will be located
away from recreational sports fields.
CONCLUSIONS:
1. The subject proposal appears to serve the public use and interest. The current facility is
unsafe from both a maintenance and water supply aspect. Not only does periodic flooding
hamper repair activities, but drowning and electrocution are potential hazards of
maintenance.
2. Backflow during flooding could also introduce contaminants into the water supply,
endangering the public health. The new facility would be above ground level and flooding
problems would be eliminated.
3. The landscaping of the building and its location would permit the structure to
unobtrusively blend in with the existing park. The location also prevents the structure
from interfering with recreational opportunities in the park.
4. The Park Board apparently has not had an opportunity to review the entire plan, including
the road, and this office does not have overriding authority in matters relating to parks.
The approval of the Park Board will be required as a condition of approval.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed
in writing on or before March 22, 1984. Any aggrieved person feeling that the decision of the
Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearing may
make a written request for review by the Examiner within fourteen (14) days from the date of
the Examiner's decision. This request shall set forth the specific errors relied upon by such
appellant, and the Examiner may, after review of the record, take further action as he deems
proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other
specified requirements. Copies of this ordinance are available for inspection or purchase in the
Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-orb-one)
communications may occur, concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision-maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members bf the
City Council
All communications concerning the the proposal must be made in public. This permits all
interested parties to know;the contents of the communication and would allow them to openly
rebut the evidence. Any I violation of this .doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

The subject site is part of the original city site and'ha's'been zoned P-1. Public Use,
since' 1'953, with the adoption of the first zoning code.
D. PHYSICAL BACKGROUND:
1. Topography: The subject site is level.
2. Soils: Urban Land (Ur). This soil has been modified by disturbance of the
natural layers with additions of fill material several feet thick to
accommodate large industrial and housing installations. The erosion hazard is
slight,to moderate. No capability or woodland classification.

3. Vegetation: The subject site is covered by grass and a small stand of cedar

The subject property is surrounded by the Liberty Park grounds and commercial

L. DEPARTMENT ANALYSIS:
1. The applicant, the City of Renton Public Works Department, is requesting
site plan approval to allow the reconstruction of municipal Well #3 located in
the northeast corner of Liberty Park.
2. The proposal 'generally complies with the Recreational designation for
Liberty Park on the Comprehensive Plan.
3. The proposal is to replace the existing underground well house with an
above-the-ground structure. In the 1960's, when the existing structure was
constructed, it! was considered a very advanced design. It has now been
determined that there exists both a safety hazard for general operation and a
potential public ;health problem. The existing facility has only one access
Which could be blocked if a water pipe broke, thus trapping an individual
within the plant. In addition, the water supply could be more easily
contaminated by a backflow because the facility is at a grade with the
existing watermains.

4. The above ground structure will be built on the existing foundations of the
present well vault. The service drive may have to be constructed from
Bronson Way 1Jdrth located to the northwest of the subject building for
access.
5. The building will be tucked in behind the existing park vegetation. Only a
minor amount ofl trimming of trees is anticipated during construction. This
vegetation provides a very effective screen of the building. The Parks
Department advises that, because property is still under the control of the
Parks Board, final approval of the design must also be approved by the Parks
and Recreation Department, specifically in relationship to landscaping, and
access.

6. The proposed building will not interfere with any of the existing recreational
activities conducted in Liberty Park. The northeast corner is actually a
s 6 rplus area that is beyond the limits of the existing baseball fields and
recreational facilities to the south of the proposed building.
7. The Police Department advises that an intrusion alarm should be included in
the building. The new telemetering system, which will be installed with well
construction, includes an intrusion alarm and an emergency cutoff in case of
contamination. I
8. The Land Use !Hearing Examiner has recently denied an adjacent land use
application by Texaco because ,of the potential hazards upon the water
obtained by the City from this specific Well No. 3. The well, as showned in
the well log, obtains water from elevations approximately 35 to 70 feet
underground.
M. DEPARTMENTAL RECOMMENDATION:
Based !upon the above analysis, it is recommended that the site plan approval
request, SA-013-84, be approved.
