Bonneville Power Administration will make available approximately $100 million per year to local entities in the Northwest states. ADMINISTRATIVE Mayor Shinpoch reported successful and interesting Suburban Mayor' s REPORT Assoc.. meeting, Renton Host City; speaker Mike Nolt of King County Jail explained it is largest prison facility in the state, even surpassing Walla Walla. NEW BUSINESS Councilman Hughes submitted letter from Renton . Merchants Parking Association stating concern for customer parking in the area of S 3 -d and Wells S 3rd and Wells Ave. because numerous visitors to the Alcoholic Anonymous Office occupy the parking for several blocks. The letter suggested more parking be obtained other than in front of the building or another location obtained for the use of AA meetings with easier access without infringing on merchants ' right to access for their handicapped or aging customers. Councilman Hughes also explained the problem of those parking in the area of only moving the car within the same block upon time expiration. Capt. Bourasa noted this was a parking violation. SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from G to L-1 for future office use. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with restrictive covenants. PLANNIN3 DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on April 22, 1981 . PUBLIC HEARING: After reviewin:: the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 28, 1981 at 9:35 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was -eported that the Hearing Examiner and the applicant had received and reviewed the Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit. #1 : Application File containing Planning Department repu:t and other pertinent documents Exhibit #2: King County Assessor' s Map Referencing Section L.5 of the staff report which discusses the possibility of reopening the plai to review prohibition of access to all but emergency vehicles on Grady Way, the Examiner stated that the plat has already been restricted through prior conditioned approval Mr. Blalock advised that because the plat has not yet been filed, the possibility exists that the city may reopen the plat for review since the department feels that execution of restrictive covenants limiting access to Grady Way should not be required of the rezone. Mr. Blaylock noted that staff comments from other divisions relate to ultimate development of the property, not to the rezone specifically, and have been submitted for informational purposes to the Examiner. The Examiner requested testimony by the applicant. Responding was : LeRoy A. Bowen 301 Lloyd Building Seattle, WA 98101 Mr. Bowen concurred with staff recommendations contained within the report, but requested clarification of comments contained in Section L.5, noting the possibility that upon widening of the roadway it may be inappropriate to restrict access to Grady Way. The Examiner advised that the restriction on Grady Way was imposed as a condition of approval of the short plat, and uncertainty exists regarding the possibility of reopening the plat for review. He did note, however, that Grady Way is an arterial to which access should be controlled and limited according to the code, and a determination must be made regarding whether the plat can be reopened. The Examiner requested further comments. Since there were none, the hearing regarding File No. R-030-81 was closed by the Examiner at 9:50 a.m. 10-81 Page Two FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . The request is for approval of a reclassification of +2.3 acres from G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to L-1 (Light Industry) . 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject property is located between S.W. Grady Way and S.W. 10th Street and between Thomas Avenue S.W. and Lind Avenue S.W. 8. The subject property was annexed into the city by Ordinance No. 1745 in April of 19!;9 and the current zoning was applied at that time. The property was short platted in :o three lots in February of 1981 . One of the adjoining platted lots was rezoned to L-1 in March of 1981 . The applicant has requested similar L-1 zoning on the subject property. 9. The Comprehensive Plan and the Green River Valley Comprehensive Plan indicate that the area in which the subject property is located is suitable for the development of manufacturing park uses. 10. The subject property is about 175 feet deep and about 630 feet wide. The setbacks required by the M-P (Manufacturing Park) zone of 60 feet adjacent to city streets would leave approximately 50 feet of buildable area on the subject property. I1 . The site slopes downward from the south to the north. Scrub brush and blackberries are the principal vegetation on the site. The site is undeveloped but had served as ra lroad right-of-way. 12. The area is in transition from undeveloped and older single family homes to light commercial and office park uses. North of the site is the Earlington Industrial Park. Wet of the site is the proposed Earlington Office and Manufacturing Park. 13. North of the subject site is a large M-P zone. The subject site is in the central portion of its G zone and west is G zoning. South of the site is a B-1 (Business/ Commercial ) zone extending east and west of the subject site and running along the south side of Grady Way from Rainier Avenue South to the Springbrook Creek two blocks west of the site. South of the B-1 zone there are a mixture of zoning types of one and 'two lot sizes. Included in this mix are L-1 (Light Industry) and R-4 (High Density Multifamily) and a multiblock G-6000 (General ; Single Family Residential ; Minimum lot size - 6,000 square feet) zone. 14. New construction just east of the western boundary of the city has occurred on S.W. Grady Way including Cummins Diesel and 0-W Properties. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 3014 which provides in part that : a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or R• -81 Page Three c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the reclassification of the subject property. 2. The property is in an area which is no longer suitable for residential development which would be permissible under the existing G zoning. The M-P zoning which would be strictly compatible with the Comprehensive Plan designation of the area would be impractical since the combined setbacks of 120 feet would eliminate about three/ quarters of the buildable site area. 3. The property is located north of I-405, a heavily used interstate highway and just north of Grady Way, a major city arterial . It is adjacent to property which has recently been rezoned to L-1 and is in an area which is undergoing transition to office and light industrial uses. Under these circumstances, the site should be more appropriately zoned to allow compatible development. The L-1 proposed by the applicant would be appropriate for the subject site. 4. L-1 zoning permits uses which are z 'so permitted in an M-P zone and L-1 would be conpatible with the Comprehensive Plan designation. There have been other reclassifications to B-1 and L-1 in areas designated Manufacturin Park. The Dahlby rezone, R-044-80, the Olga Lewis rezone, R-080-80, Duane Wells/ Puget Power rezone, R-101 -80, and Atlantic Services (zoned to B-1 property designated for light industry) all shared the characteristic that ii their location and given the size, shape or nearby zoning, the designated use was determined to be inappropriate when the property was specifically analyzed. M-P zoning pursuant to the Comprehensive Plan should be reserved for larger sites (Page 7, Renton Urban Area Report) where the provisions of the code requiring extensive setback and landscaping can be ac:ommodated. 5. In this location and with the other zoning in the surrounding area, L-1 zoning would provide a transition betwee the M-P ?oning north of the subject site and the large B-1 zoning south of the site across Grady Way. The L-1 would be compatible with nearby zoning and permits many of the uses allowed in the M-P zone and would afford tha applicant a reasonable zoning category. At the same time, the goals and objectives of the Comprehensive Plan which would require landscaping and screening in M-P zones should be accommodated by the provision of landscaping along the street right-of-ways and between properties (Page 8, Renton Urban Area Comprehensive Plan) . The landscapinc_, requirements of the M-P zone will not impose an unreasonable burden on the subject site and will provide an attractive place in which to work and conduct business Renton Urban Area Comprehensive Plan, Page 8; Land Use Report , Page 18) . RECOMMENDATION: The City Council should approve a rezone from G to L-1 subject to execution of restrictive covenaits to require provision of a 10-foot landscape buffer adjacent to S.W. 10th Street and S.W. Although not directly in conformance with the Compre- hensive Plan designation of Manufacturing Park for the subject site, the proposed office use and rezone to L-1 can be considered consistent with existing land uses and zoning for the surrounding properties. (Section 4-3014-c (b) ) 2. The subject property was generally considered in the adoptions of the Comprehensive Plan in 1965 and the Green River Valley Comprehensive Plan in 1976. Planning Department records do not indicate that an area-wide zoning review of this site has been undertaken. These facts would appear to sub- stantiate Section 4-3014-c (a) . Previous rezones in the vicinity include Vehicle Test Technology, Inc. (R-004-81 ) and the Dahlby rezone (R-044-80) . Both of these were reclassified to L-1 with the former also being part of the Bowen Short Plat 138-80. 4. The Engineering Division advises that appropriate storm water installation will be required across the subject site. Off-site improvements must be installed along S.W. Grady Way and S.W. 10th Street as per the Hearing Examiner requirements of Short Plat 138-80. 5. As part of the Bowen Short Plat, the Hearing Examiner required that restrictive covenants be filed and executed prohibiting all but emergency access to S.W. Grady Way. As a discussion of this rezone, the question has been raised by staff whether access for every use should be limited. The possibility exists that the City may request reopening to plat. Therefore, the rezone should not be restricted. 6. The Utilities Engineering Division indicates that the proposed use would be subject to approved utility plans in a possible water main extension. Payment of development fees , latecomer ' s fees and special assessment district fees, if any, will also be required. 7. A pre-construction conference with the Fire Marshall will be necessary and the proposed development is subject to all provisions of the Uniform Fire Code. 8. Security measures including proper placement of outside lighting , security locks, and an intrusion alarm system are recommended by the Police Department. Consult for details. 9. In R-004-81 the Hearing Examiner required execution of restrictive covenants to include a 10-feet land- scape buffer adjacent to S.W. 10th Street and S.W. Grady Way. As part of the same short plat, this requirement should also apply to the applicants rezone request. M.
