RE: FIFTH AND PARK PLACE' BUILDING PARKING
Gene Horbach', owner of the Fifth and Park Place Building,
. has made application to retain the former City' water shop
building located within one of the six parking lots required •
by the subject main building. Due to changes in the parking
regulations to' allow- compact vehicle spaces, the applicant
has been able to obtain sufficient parking space within the
six lot complex for both the primary building and the smaller
shop building.
At the time that the City Council heard this. matter, the
shop building was to be- removed. Now, with the--added spaces •
available from the use of compact spaces, the shop building
is proposed to be retained. This office initially concluded
that modifying the Council' s orginial decision at the administrative
level would be inappropriate. . However, the lots have already
been modified to install compact spaces where all full size
spaces were originally approved.
Therefore, it is our opinion that holding another hearing
- and opening up the same issues again would not be in anyone' s
interest. Do you agree?

Dear Mr. Clemens:
Pursuant to our discussions to leave the former Water Department Building
standing, I am submitting the following information per your request:
1 . Status of all properties owned or leased for Fifth and Park Place
project has remained the same since City Co ncil granted us
special permit.
2. We have now completed parking lay-out and 1 ndscaping of all six
parking lots according to approved plans by the Building Department.
3. Breakdown of leased and owned properties and number of stalls follows.
The land leases are secured for a 35 year period with options to renew.
a. Leased properties:
Lot No. 2 - 50 stalls
Lot No. 3 - 12 stalls
Lot No. 4 - 17 stalls
Alley Strip - 20 stalls
Total 99 stalls
b. Owned properties:
Lot No, 1 - 19 stalls
Lot No, 5 - 62 stalls

The total spaces required for the 500 Building is 27Q and we have provided
281 stalls, which would allow us to allocate 11 stalls to the Water Building.
The Water Building is approximately 1 ,700 square feet and will be primarily
utilized for storage with about 250 to 300 square feet of office space
for our own use.
Based on all of these calculations, it appears we have ample parking to
satisfy both. buildings and hope this will provide you with enough back-
ground information to leave the Water Building intact.

Transportation to landscaping which obstructs vision and creates traffic hazard.
Improvement Councilman Stredicke inquired re Item No. 2 Miscellaneous street

by Councilman Clymer, Acting Public Works Director Houghton noted
relaxation of rules for complete projects previously requiring curbs,

Fifth and Park re parking requirements for Fifth and Park Place Building, recalled ;
Place Building the City Council granted a Special Permit 8/18/80 to meet the off-
Special Permit street parking requirements through five auxiliary parking lots.
re Parking Mr. Henderson called attention to one of the parking lots located
Modification at southwest corner of Pelly and 6th Ave. N (owned by Mr. Horbach)
Requested which is improved by a building formerly leased by the City Water
Dept. for equipment; the lot provides a portion of the required
280 parking spaces required for the Fifth and Park Place Building.
Mr. Henderson requested newly adopted Zone Code amendments be
applied to the parking regulations, allowing reduction of require-
ments, including parking stall size, to prevent necessity to demolish
the existing structure, thereby saving money by continued use.
City Attorney Warren noted parking should have been installed prior
• to this time. Council President Stredicke recalled Special Permit
overturned Examiner's recommendation, that applicant's construction
7i of third floor of Fifth and Park Place Building in lieu of parking
necessitated the Special Permit for parking. City Attorney Warren
noted Code revision prohibited leased parking as used by Mr. Horbach
for the Fifth and Park Place Building. Following further discussion,
it was Moved by Clymer, Second Reed, Council proceed to the next
Agenda item. SUBSTITUTE MOTION BY STREDICKE, SECOND CLYMER, REQUEST
TO MODIFY SPECIAL PERMIT BE DENIED. CARRIED.
CONSENT AGENDA The following items are adopted by one motion which follows the
business matters included:
Traffic Study Letter from Public Works Department requested transfer of funds in
Projects amount of $9,900 to provide matching money for three Traffic Study
projects funded 82.98% by Federal FAUS Grants. Projects: Safety
Planning, Traffic Study; Valley Parkway SW Study and SW 27th Street
Study. Refer to Ways and Means Committee. (See Page 4.)

Fifth & Park Place Building
Dear Mr. Horbach:
The material which the Planning Department received on Thursday,
May 7, is not a complete application concerning modification
of the parking for the Fifth and Park Place Building. Not all
of the involved parking lots are shown in detail and there is
no justification showing that enough parking is provided for
the buildings. It is up to the applicant to bear the burden
of proof to allow modification.
, It appears that you consider the application a request to leave
the former Water Department Building standing on which it is
located on Proposed Lot No. 5. However, it is a complete revi-
sion to the special permit application which you obtained for
auxiliary parking lots to the Fifth and Park Place Building.
To complete the application we will have to know specifically
the square footage of the Fifth and Park Place Building, the
parking lot breakdowns for the six lots including the adjacent
parking to the building for both standard and compact cars to
evaluate whether the compact ratio is met or exceeded, the square
footage of the existing Water Department Building and the
required parking necessary for it. Until that information is
obtained along with the appropriate fees, we will hold this
application.

review and decision:
The building in question is located in the southwest corner of a large lot at Pelly
and Sixth Avenue North and is used for offsite parking for the Fifth and Park
Place Building. At the time of our submission of the parking plan, the building
at Pelly Avenue was to be demolished to create additional parking stalls. The
City Water Department was leasing this building to house equipment for monitoring
the level of different water reservoirs serving Ren on. We acquired this building
at the end of the City's lease and were asked to co tinue Water Department's occupancy
until the lowering of certain reservoir was accomplished. We did accommodate the
City's request and left the building alone, blacktOping only surrounding land.
Eventually the building was vacated and with the acquisition of additional property
and the advent of new parking code, we were able to meet all parking requirements
for both buildings.
We, therefore, rpectfully request your permission to allow the building to stand.
r, We plan to aesthetically improve the appearance of the building and to use it
for our own office and storage facilities. It is a solid structure, which has
been neglected, but with some imagination could become a fine asset in the area.
