I appreciate the consideration that has gone into this from your department. This is our 3rd project of building a new lumber yard, building material, home center facility and in this case, I decided to get involved in all the preparation up to the point of having the architect draw up the final drawings for construction purposes that involved the short plat of the property and the special permits required for my type of use, it has been quite an experience. I started June 1st and stayed with it continuously, until now it looks like we are ready to go ahead with the final plans and construction. In going in today to the planning department to clarify a couple of items, it was pointed out to me, by Roger Blaelock, that I should ask you to clarify under decision, the item number 2 , on the back page, the word perimeter. It is our plan to landscape along the street right away that borders the property on the west, as per approval , and to landscape in the parking lot area as the plans show. This covers the Westerly side of the building site and the Southerly side. On the Easterly side, the existing building is built on the property line and it runs alomst the length of the Easterly side. On the Northerly side, we but up against the railroad right away and the tracks sit 20 to 30 feet above the property. This boundry line will be fenced, of course, for security and is not in the view of the public. This will be one of the main areas that we will be stacking our lumber. SP-058-81 LOCATION: Vicinity of 50 S.W. 7th Street. SUMMARY OF REQUEST: The applicant requests approval of a special permit for an addition to an existing building to be used as a retail and wholesale lumber yard and hardware store. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions Hearing Examiner Decision: Approval with conditions PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on August 6, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the •subject as follows: The hearing was opened on August 11 , 1981 at 9:45 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department preliminary report. Steve Munson, Planning Department, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Map with staff comments Roger Blaylock, Associate Planner, corrected Sections M.3, M.4, and M.5, which reference Sections L.4, L.5, and L.6, respectively, to reference Sections L.5, L.6, and L.7, respectively. He also advised that although the outside storage yard is greater in size than one acre, it constitutes less than 40% of the total square footage; therefore, provisions of the bulk storage ordinance would not apply. The Examiner requested testimony by the applicant. Responding was: Jack Curran P.O. Box 6669 Bellevue, WA 98007 Referencing Police Department recommendations' contained in Section L.7 of the Planning Department report regarding installation of a traffic signal at the intersection of S.W. 7th Street and Hardie Avenue S.W. , Mr. Curran advised the Examiner that upon dedication of Hardie Avenue several months ago, included in the written agreement signed by the Mayor and the Engineering Division was a provision which stated that the applicant would not be required to participate in the cost of the signal since construction on the subject site would not have any bearing on the installation. Mr. Curran requested clarification of an Engineering Division staff comment which recommends dedication of additional right-of-way along S.W. 7th Street for future installation of sidewalks, noting that the northern lot is proposed for development at this time, not the southerly lot abutting S.W. 7th Street. The Examiner agreed that conditions may be imposed on the southerly lot upon development at a later date, but should not be required at this time. Mr. Curran discussed requirements for a screening fence and indicated his intent to provide an eight foot high slatted, diffused fence with provision of landscaping on the exterior; however, he questioned the recommendation to provide landscaping on the inside of the fence, particularly since it would be adjacent to an operational area. He also noted the provision of sidewalks and a retaining wall in addition to the landscaping and fencing. Mr. Blaylock discussed the Planning Department's concern that the lumber could be stacked to a height of SP- -81 Page Two 20 feet, 12 feet above the top of the fence, and to ensure. a screening effect, additional landscaping located inside the fence had been recommended. Mr. Curran clarified the maximum height of stacked lumber in the yard, three slings high, noting that that is the maximum height which fork lift equipment can accommodate. He also clarified that required turning radius will be provided on site to expedite traffic flow and avoid congestion. The Examiner confirmed that all vehicle maneuvering must take place on site in accordance with provisions of the Parking and Loading Ordinance. Responding for the city was: Gary Norris Traffic Engineer Mr. Norris expressed concern with proposed access widths to accommodate large trucks traveling to the back portion of the property. He stated that a 30-foot width is proposed on the northern access, and the driveway to the south is proposed at 40 feet in width. He suggested that it might be preferable to provide the wider driveway on the northern access and the 30-foot width on the south. He also stated that although the applicant had discussed an agreement with the city which holds him harmless from any cost of providing the signal at S.W. 7th Street and Hardie Avenue, funds have not yet been identified for installation of that facility, and because of the high percentage of accidents at that intersection, it remains a concern of the city. Also, the agreement does not state that development would be allowed prior to the signal installation. The Examiner inquired if it was Mr. Norris' opinion that without the signal , this project should not be constructed. Mr. Norris confirmed the statement. The Examiner then reported that he would hold the hearing record open until a copy of the written agreement is received for purposes of clarification. Mr. Curran stated that he has been coordinating the project with city staff for several months, that the agreement had conditioned the dedication of Hardie Avenue on releasing the applicant from participation in the cost of signalization at the aforementioned intersection, that the street remains open at this time, and the proposed project will only generate a maximum of 300 trips per day. I . Responding to the Examiner's inquiry regarding turnaround provisions, Mr. Curran stated that the required radius would be provided on site, and the secondary structure to the west will function as a drive-through lumber loading facility consisting of a roof supported by posts to allow customers to load supplies•• in an area out of the rain. The Examiner stated that the record would remain open to allow receipt of the referenced agreement, and the report would be issued within fourteen days following that submission. Since there were no further comments, the hearing regarding File No. SP-058-81 was closed by the Examiner at 10:05 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a special permit to allow the establishment of a lumber yard and hardware store in a B-1 (Business/Commercial) zone. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . I _ 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The subject property is located in the vicinity of 50 S.W. 7th Street. The site is essentially level and limited amounts of vegetation exist on the cleared site. 7. The applicant proposes constructing a lumber yard and hardware store on the subject site. Pursuant to Section 4-711 (A) (7) , lumber yards may be permitted in a B-1 zone subject to the approval of a special permit and provided further that the yard is screened by an eight (8) foot fence and is locatedmore than 100 feet from a residential district. 8. The site has an existing building of about 20,000 square feet to which the applicant proposes an addition of 14,440 square feet. The proposal will also contain about SP-058-ei Page Three 1 10,320 feet of covered outdoor storage and about 46,400 square feet of uncovered storage. The applicant proposes. providing 78 parking stalls whereas only 72 parking stalls are required. 9. The applicant proposes complying with the requirements to provide a screening fence on the subject site. The Planning Department recommended that landscaping be placed interior to the fence for screening purposes since lumber may be stacked up to twenty feet high. 10. All maneuvering must occur on site and the Traffic Engineer recommended that the northerly proposed driveway be widened and that a specific turnaround be employed for the use of large delivery vehicles. The applicant proposed a 30-foot driveway at the northern access. The Traffic.Engineer indicated that a 40-foot wide driveway would be better in this location. The proposed southern driveway is 40 feet wide. 11 . The current sewer line must be relocated to conform to the revised location of Hardie/ Edwards Avenue. Storm drainage plans must be provided and approved by the Public Works Department. 12. The Fire Department required consultation about stacking height, access for emergency vehicles and information about the type of storage and the configuration of the yard. 13. The Police Department indicated that an intrusion alarm is required because the screening fence blocks the view into the interior of the storage area. 14. Both the Police Department and the Traffic Engineer indicate that the project should ' not be permitted until a traffic signal is installed at the intersection of Hardie/ Edwards Avenue and S.W. 7th Street. No traffic analysis was submitted to substantiate the need for the signal . Hardie/Edwards Avenue was dedicated as a public right-of-way by the applicant at some economic cost though the department indicated that a traffic signal must be installed at the above location, but did not recommend a method for financing same. The developer of the Ea,rlington Woods PUD has agreed to partial participation in the cost of the signal . 15. The site, with the exception of the existing structure, is undeveloped. The Burlington Northern right-of-way is located just north of the site. The Sears Shopping Center is located north of the railroad. A variety of commercial and light industrial uses are situated south and west of the subject site. 16. The predominant zoning category in the area is B-1 , the subject site's classification. Some light industrial zoning (L-1) is located east of the site and manufacturing park (MP) zoning is located west of the site. 17. The Comprehensive Plan designates the area in which the subject property is located as suitable for commercial uses. CONCLUSIONS: + 1 . The special permit to allow the establishment of a combination lumber yard/hardware store in the B-1 zone adjacent to the Sears Shopping Center appears to serve the public use and interest although certain modification of the plans is required so that the impact of the proposal will not adversely affect the public health, safety and welfare. 2. The access to the site is via Hardie/Edwards Avenue, and while the extreme curves in the road have been removed, the site is still located on a curving portion of the roadway and just south of the railroad overpass. Visibility in this location is not the best, and therefore wider driveways which can expedite turning movements are in order. A 40-foot driveway should be installed at all access points for the subject property. 3. The lack of a traffic signal at the intersection of the site's access roadway (Hardie/ Edwards Avenue) and S.W. 7th Street presents an issue of overriding public safety with similar concerns raised by both the Police Department and the Traffic Engineer. • While part of the costs of the signal will be borne by the developer of Earlington Woods, the remainder of the costs is unassigned. The applicant has dedicated the right-of-way at considerable economic cost. The proposed business is not the sole generator of traffic in the area, and therefore the signal costs should not be placed upon the applicant. While the departments with expertise indicated that the signal light should be operating prior to the operation of the proposed use, the applicant should not bear the cost of installing same. SP-058-81 Page Four 4. The issue is one .of .the safety of those using the roadway with increased frequency as the rear access to the Sears Shopping Center from the developing commercial and industrial areas west and south of the intersection, but as indicated above, the subject proposal will not place an undue burden on the existing intersection by its mere operation, and the operation of the business should not be held up until such signal is in place. 5. The fence should be set back from the property line and landscaping should be installed between the fence and property line to soften the effects of the fence on city right-of-way (Comprehensive Plan, Policy 3.C. 1 . and 4) . 6. The lumber yard will not unduly harm neighboring properties, and as conditioned will not prove detrimental to the public welfare. Neighboring properties are a mix of commercial and industrial uses and will not be impaired by the establishment of the lumber yard in this location. DECISION: The special permit is approved subject to the, following: I . All access driveways be not less than 40 feet wide. 2. I tried to speak personally on the matter at the hearing but felt that part of what I tried to say may or may not have been fully understood or absorbed by the hearing ccomittee. This letter should clarify my thoughts. 1. The building department, according to the papers I received, has approved the special permit signed by Mr. Hansen. 2. The engineering division has approved subject to 3 conditions. I can't read the signature, these 3 conditions are all being met. The work is under way according to the city approved plans. 3. The traffic division has been approved by Gary Norris subject to the following conditions. A. The road way alienment was designed by the city engineering, it was found to be substandard for safety, this has been realiened and is being constructed under approved city plan. B. Regarding the maneuvering of trucks on public right away. We have no intention of building our facility so that this would be required. All truck maneuvering will be on our own property. C. Verbally at the meeting, if I understood him right,-Mr. Norris of the traffic division, suggested that the permit for construction be held up'regarding development of the proposed property until funds were found to pay for installation of a proposed stop light at the 7th and Edwards St. Before'.this property was purchased for development and before the Edwards St. property was given to the city, I entered into an agreement with the city, Mr. Edwards, CHG. Co. and myself that the light would be installed at the cost of others than myself and it would not create a delay in our Fred Kaufnan Page 2 August 12, 1981 construction plans. This was a combination of a verbal and a written agreement during April, May and June. This should satisfy this proposed problem. 4. The engineering department approved subject to 4 conditions. A. We will correct if we build over the sewer line. B. City is asking for a 5 foot easment, I just found out today what they are referring to. They have run part of this new sewer on my property rather than city property, this is the main sewer line, that I understood would be out in the street as normal. I would plan on getting together with the city and taking care of this. The city will have to provide the paper work and filing necessary to achieve this. C. The 5 foot right of way that the city wants of my property on 7th doesn't effect this project. I would plan on handling the same as above if we can get this all worked out. D. On-sight storm water retention system will be revised to meet city requirements when plans go through for building the apartments. 5. The fire department has approved with the conditions. I have met with the fire people and understand these requirements will be met. 6. Utility department. A. This has been covered previously it will be taken care of. 7. Police department. A. We use the Alarmex system for burglary in all our facilities. This should cover all there concerns. 8. Police department. A. The 10 foot drive way that the police department object to, is actually 40 foot. Placement of these 2 driveways, one 40 foot and one 30 foot are not completely decided upon. The 10 foot was a mis print on the plan. B. The traffic signal was covered previously in this letter. Probably the key thing that has not been fully decided upon at this time is the request that along the Westerly side of the storage area we put a planting 5 foot wide inside the fence area. I talked today with Roger Blaelock at the planning department regarding this request by them. The Fred Kaufnan Page 3 August 12, 1981 new road that we are putting in will have a 7 foot wide strip infront of the fence and a 5 foot wide side walk running along side the fence. This area will have to be planted and will make the whole area very attractive. Next to the sidewalk there will be a wall roughly 4 to 5 feet high on top of that wall an 8 foot screen fence. This should give all the screening that any one should feel necessary and it would moot the code requirements. Inside the yard area we will provide protection bumpers for the fende in order to help keep a continual good looking fence screen exposure. Another planting inside this fence would create an unrealistic expense and would create a hardship in working in the area. I would request that this condition be dropped. For what I can find on the paperwork I have this last condition planting area was a verbal suggestion entered into the meeting and was not a written request by the planning department. After explaining my feelings to Mr. Blaelock I believe he felt it was probably not a necessary condition. Thank you for your considerations in this matter. Basically what it says is that if Mr. Curran and Mr. Edwards would donate the right-of-way for Hardie Ave. SW from SW 7th to the railroad tracks once and for all (after twenty years of some very unfriendly negotiations) solve the problem of the right-of-way, we would not require any additional participation from them on the signal at SW 7th and Hardie. Their participation would be the donation of the right-of-way, some very expensive property I might add. 2. We have initiated a program to find the finances for the signal at 7th and Hardie in-house. It appears that we may be able to do this; how- ever, as you know we have no absolute funding other than a commitment of 25% from CHG. There are others who have been requested to participate but they are not signed, sealed and delivered. 3. I do not believe that there is enough additional traffic that would be generated from Mr. Curran' s operation that would make a severe impact on the intersection at this time; therefore I do not believe we should stop him from continuing with his project. The most severe problem is going to come from the completion of CHG' s project. I hope this will help you make a decision.
