Stewart and his wife Lois Stewart are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: See attached legal description) WHEREAS, the owners of said described property, hereinafter "the property," desire to impose the following restrictive covenants running with the land as to use, present and future, of the property; NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns, as follows: DEVELOPMENT LIMITATION Development on the subject site shall be limited to only those commercial uses enumerated in the B-1 provisions of the Zoning Code, City of Renton, thereby prohibiting any and all residential development of the subject property. DURATION These covenants shall run with the land and expire on December 31 , 2025. If at any time improvements are installed pursuant to these covenants, the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining subject property who are adversely affected by any violation or breach of these restrictive covenants. Reasonable attorneys' fees incurred during an enforcement proceeding will be borne by the parties whom the court determines are in error and shall be entered as a judgment in such action. r t / Vincent G. SUMMARY OF REQLEST: The applicant seeks a rezone of the subject site from G to B-1 to bring it into conformance with the Comprehensive Plan. SUMMARY OF Planning Department: Approval subject to conditions. RECOMMENDATION: Hearing Examiner: Approval subject to conditions and execution of restrictive covenants. PLANNING DEPAR1MENT The Planning Department preliminary report was received by the REPORT: Examiner on August 26, 1981 . PUBLIC HEARING After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 1 , 1981 , at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Associate Planner, presented the Planning Department report and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: King County Assessor's Map Exhibit #3: Vicinity Map showing adjacent uses and zoning The Examiner inquired regarding the Council ' s intent to include the subject site in the sewer moratorium. Mr. Blaylock responded that it is included as a part of L. I .D. 321 formed by Shannon O'Neil . It was indicated that further clarification would be obtained from the Rentcn City Council . In discussing previous rezones in the area, Mr. Blaylock noted that item #2 of the Planning Department Analysis should be corrected to read, "the parcel adjacert to the southeast" rather then "south." The Examiner confirmed with Mr. Blaylock that the property was zoned for commercial uses prior to annexation to the City. Mr. Blaylock advised that there are no immediate plans to change the use of the site, which has beer Honeydew Nursery for many years. The Examiner inquired regarding the number of residential units that could be built on the site, should it be zoned to B-1 but used for residential purposes, and was advised by Mr. Blaylock that, considering its size, pro) imity to single family residential areas to the north and west , and access to Duvall Averue N.E. , approximately thirty units would be appropriate. The Examiner requested testimony by the applicant. Responding was: Vincent Stewart 1537 Duvall Avenue N.E. Renton, WA 98056 Mr. Stewart was asked by the Examiner about his feelings concerning possible restric- tions on the Ase of his property to commercial uses only, should it be zoned B-1 . It was pointed oit that the Zoning Ordinance allows other than business use in the B-1 zone but that residential use would create a greater impact on sewers. Mr. Stewart indicated that restriction to commercial uses would be acceptable. The Examiner requested testimony in support or opposition to the application. There was no response. He then invited final comments from the Planning Department staff. Since R-067-81 Page Two no further comments were offered, the hearing regarding File No. R-067-81 was closed by the Examiner at 9:15 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a reclassification of approximately 45,585 square feet of property from G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to B-1 (Business/Commercial ) . 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located on the west side of Duvall Avenue N.E. about 300 feet north of Sunset Boulevard N.E. The site is essentially level . A nursery business occupies the site. There are some natural Douglas fir trees along the northern property line. 6. The Comprehensive Plan designates the area in which the subject property is located as suitable for the development of commercial uses. 7. A real estate office and used car lot are located south of the subject site. A lumber yard is located west of the site. Single family residences are located north and northeast of the site. 8. The subject site was annexed into the city in October of 1974 by Ordinance No. 2894 at which time the present G zoning was applied. The site was zoned for commercial purposes prior to its annexation. Upon annexation, the site was automatically zoned G. 9. Property to the west of the subject site is zoned G, the zoning of the subject site. Immediately north of the subject site is an island of property which is part of unincorporated King County and which contains single family homes. Immediately south of the subject site is property zored B-1 , the classification requested for the subject site. Similarly, B-1 zoned property is located east of the site across Duvall Avenue N.E. , and south of the site across Sunset Boulevard N.E. The easterly B-1 zoned property was reclassified to B-1 within the last year or so. 10. The sewer system in the area is at capacity and the Engineering Division advises that development of the subject site could lead to further impacts on the system. The subject site was included within an LID for the area. The properties sponsoring the LID were to be exempted from the construction moratorium (Resolution No. 2392) imposed by the City Council on April 13, 1981 because of lack of sewer capacity. The intent of the Council was to exempt properties on the east side of Duvall . The number of hookups permitted was also limited even within the exempted areas. No evidence was submitted as to whether the hookups have exceeded the permissible number of 361 or whether sufficient capacity still exists. 11 . Presently, the B-1 zone would permit the development of high density multifamily dwellings on the subject site. The Planning Department analysis fails to reveal the impacts of such development of the subject site or surrounding area. The zoning code would permit approximately 50 to 70 units depending on the mix of studio, and one and two bedroom units. 12. The applicant indicated willingness to restrict use of the subject property to only commercial uses defined in the zoning code. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 3014 which provides in R-067-81 Page Three part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. While the applicant has demonstrated that the request is compatible with the three criteria, there remains the question of the impact of the proposal on the sewers in the area and the intent of the City Council in exempting certain properties from the moratorium. 2. The adjacert land to the south and east is currently zoned B-1 . The site is currently used for ccmmercial purposes, a nursery, and the site was zoned for commercial uses prior to its annexation. The proposed B-1 classification is also compatible with the Comprehensive Plan which designates the site for commercial uses. But the B-1 zoning would also permit the development of high density multifamily housing which would be both incompatible with the Comprehensive Plan and incompatible with the limited sewer service available in the area. 3. A sewer moratorium is in effect for the area in which the property is located. Since the properly was also incorporated within the Shannon O'Neil LID (LID 321 ) it may be exempt, bur the question remains as to whether that exemption was to apply to the subject sire or whether the LID was expanded to include the subject site after the exemption ',as created. The languae of the exemption is that the moratorium is not in effect for the: Small LID proposed by Shannon O'Neil to serve the northeast corner of Sunset and Duvall Avenue N.E. ." (Emphasis supplied) The subject site is not on the northeast side of thc: intersection. 4. If the subject site was included in the LID to avoid the effects of the moratorium, then a rezone which would allow further expansion of uses on the subject site should not be permitted. The City Council will review this recommendation and will make the final decision, and therefore they should determine the intent of the moratorium and the exceptions to that moratorium. 5. Further, the number of hookups and/or equivalents was not presented at the hearing and the approval of a reclassification should be conditioned upon receipt of that information. 6. The applicant has requested B-1 zoning for the subject site and indicated that the purpose was to free the land for further commercial development under compatible zoning. Therefore, use of the property for residential purposes was not considered by the Planning Department or the Environmental Review Committee. The impacts of high density development on the single family uses to the north and northeast of the subject site were not evaluated nor were the impacts of traffic on residential uses studied. The impacts on the inadequate sewers could be substantial and therefore zoning which would allow such potential development should not be approved and restricticns on such development would be in order. Therefore, the applicant should execute restrictive covenants to limit the use of the subject site to only those commercial uses now permitted in the zoning code and restrict the site so that multifamily housing cannot be constructed. 7. Besides limiting the potential impact of high density multifamily development on the sewers in the area, the limitation on development would also prevent the usurption of land tfe Comprehensive Plan had designated for commercial uses by residential uses. RECOMMENDATIOt : The City Council should approve the requested reclassification of the subject property from G to B-1 subject to the following conditions. 1 . The City Council determination of the intent of the exemption to the moratorium and whether ii applies to the subject property. 2. ISTORY/BACKGROU D : The subject site was annexed into the City by Ordinance 2894 of October 25, 1974 at which time the present zoning classification was applied. D. PHYSICAL BACKGROUND: 1 . Topography: The site is essentially level. 2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderatelyrapid in the surfacepc layer and subsoil and very slow in the substratum. Runoff is slow to moderate, and the erosion hazard is moderate. This soil is used for timber, pasture, berries, row crops, and for urban development. 3. Vegetation: Most of the natural growth has been removed except for some Douglas Fir trees along the northerly property line. 4 . Wildlife: Some of the site may be suitable for wildlife habitat. 5. The subject property if approximately, according to the King County assessor, 40, 907 square feet in size. The subject property fronts on Duvall Ave. N. E. to the west, where the property has its access, and is approximately 150 feet north of S.E. Renton-Issaquah Road ( Sunset Blvd. ) . The property is presently zoned G ( General ) in the City of Renton, with this request of a B-1 ( Business ) rezone application being attached. I shall proceed to show that the attached rezone request is both appropriate and timely. BRIEF SITE HISTORY The subject property has, for several years, been a garden nursery. The subject property was originally vacant land until approximately 10 years ago when Jack Stewart, brother of the proponent, went to, then, King County and requested and was permitted, a business zoning for the entire Lot 11 of Joseph P. Marshall Tracts. At that time, the current nursery was vacant land. Jack Stewart built the nursery about one year later and remains a nursery to this day. In November of 1972, Jack sold the property to brother Vincent and his wife Lois Stewart. Approximately two years ago, circa 1979, the City of Renton annexed the Honeydew Nursery and surrounding properties into the city limits thus giving the property an automatic G ( General ) zoning until a future request was made. Since the time of the annexation of this and surrounding properties to the City of Renton, massive changes have took place in the neigh- borhood. To the South, directly accross Sunset Blvd. is a large shopping center consisting of Ernst Hardware, Pay n' Save, McDonald' s fast foods, Burger King Hamburgers, and other fast food and stores. To the East of the nursery os a 7-11 store, located on the Northeast corner of Duvall and Sunset. Around the 7-11 store, Shannon-O'Neil has a business complex proposed for construction. To the Southeast of the intersection of Duvall and Sunset is an Exxon Station. Surrounding the Honeydew nursery at the present time are Collins Lumber to the West, and a car lot of the Northwest corner of Duvall and Sunset. All of which are zoned for B-1 in the City of Renton. Appropriateness of Rezone Request The preceeding brief history of the subject property denotes several items to show the appropriateness of our zoning request. The following is to shed more light on those items. Item #1 Item A. of the rezone procedure guidelines put out by the City of Renton Planning Department states " . .the proponent must show that the current zoning of the property preceded the last Comprehensive Plan amendment in the area of the property and any rezoning which occured subsequent to the Comprehensive Plan amendment. " Since, as our history of the site states, the property was only annexed to the City of Renton two years ago with a G ( General ) zoning; and the current Comprehensive Plan calls for a B-1 zoning for the subject, with the property having already been zoned for Business in King County, it shows clearly that the property preceeded any and all Comprehensive Plans of the City of Renton and meets with the City of Renton' s current Comprehensive Plans. Iten #2 To quote item B. on the procedure list. . . . " That since the last previ- ous Comprehensive Plan analysis or rezoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone signif- icant and material changes. . . " By both visual observations and by the history that was previously stated, it should be very clear that with the annexation of the area into the city limits opened the door for much development in the surrounding area of the Honeydew Nursery, almost all of the B-1 type useage. It should also be mentioned at this time that currently, L. I.D. 321 for sewers are on the drawing board and are expected to be in- stalled tuis summer. These sewers were NOT included in Resolution 2392 which was a moratorium for the connection of sanitary sewers. The resolution clearly states in item #4 of page 2 that the Shannon O'Neil L. I.D. is to be excluded from the moritorium. This gives the subject property all of the necessary utilities for any current use and for a-y future development that a furure owner may require. Item #3 The last item is as follows. . . " That the property is potentially zoned for the reclassification being requested pursuant tp policies set forth in the comprehensive plan and conditions have been met which would indicate the change is appropriate. " The current Comprehensive Plan calls for a B-1 zoning on the subject property. The property has, or will have in the very near future, all of tha utilities necessary to meet the requirements of the Renton Planning Department. And the recent development of the area surrounding the subject property makes it clear that this property fits into the plan for the entire neighborhood. Timeliness By looking at all of the items listed above and their explainations , together with a visual observation, it is clear that the subject property is overdue for its zoning change to make it compatable with the surrounding neighborhood.
