SHINPOCH, MAYOR • PLANNING DEPARTMENT 9 235- 2550 9gTE0 SEPSEoO P December 3, 1981 MEMORANDUM TO: PLANNING AND DEVELOPMENT COMMITTEEI t FROM: POLICY DEVELOPMENT DEPARTMENT RE: APPEAL OF SHORT PLAT 074-81, W-075-81; BITNEY SHORT PLAT The following is a review of the applicant's letter of appeal. 1.The applicant argues that the request for off-site improvements is unrealistic. a. The subdivision ordinance is clear and specific with regard to the requirement of off-site improvements. Sections. 9-1108-3 and 9-1105-6 apply. 2.The applicant argues that 958 feet of improvements for the forty (40) acre site is 3. not appropriate. a. Although the applicant argues that the site is generally not developable for single family homes, the site is clearly developable for other uses, including the extension of the mobile home park which has been discussed as part of the Comprehensive Plan review. The applicant's argument with regards to the amount of frontage improvements as compared to the acreage is not significant. Even a very minor residential plat would have far greater frontage improvements per acre than this application. As a further example, Burlington Northern subdivided approximately 500 acres and has constructed many miles of street improvements awaiting future development applications. STAFF ANALYSIS: As noted in the Planning Department staff report to the Hearing Examiner, all departments which commented on the request for the waiver recommended its denial. Subdivision Ordinance Section 9-1109 sets forth three criteria which must be met in order to approve a waiver: first, special physical conditions; second, not creating a circumstance different from other properties in the vicinity; and, third, that it not be detrimental to the public. Based upon our review of this application, there are no physical circumstances which suggest that the waiver should be approved. Any and all property owners subdividing property would be subject to the same improvement requirements, and waiver of the proposed improvements would clearly be detrimental to the public interest in that only half of a street exists along Union Avenue in this vicinity. Improvement of the westerly half of the street, as a part of this plat, will reduce the adverse public impact. PLANNING AND DEVELO"MENT COMMITTEE DECL:MBER 3, 1981 PAGE TWO The applicant has not asserted any errors in fact or law as required for any appeal of a Hearing Examiner decision. MOVED BY ROCKHILL, SECOND CLYMER, SP-065•-81 (Fill) SUSPEND RULES AND ADVANCE TO PLANNING AND DEVELOPMENT COMMITTEE Renton Treatment REPORT, AGENDA ITEM 7. CARRIED. The Planning and Development Plant Committee report noted review of the Special Permit SP-065-81 for the Renton Treatment Plant at 1200 Monster Road to preload seven acres with 126,000 cu. yds. fill materials to support a future building program to increase the capacity of the existing sewage treatment plant. The Land Use Hearing Examiner Fred Kaufman, on 9/8/81 , recommended approval with conditions. METRO requested reconsideration of Condition 4 contained in the 9/8/81 Examiner decision, which was upheld by the Examiner 9/16/81. METRO filed appeal of requirement for easement conveyance for natural drainage. The Planning and Development Committee report found the Examiner in error in conditioning the granting of the Special Permit upon the execution by Metro of a natural drainage easement, since such requirement is not related to the application presented and is not within considerations under Code Section 4-2303(2) (A) in grant- ing a Special Permit. The Committee report concluded that the Hearing Examiner's Conclusions No. 7 and 8 are erroneous as a matter of law. The committee recommended the decision be modified by deleting Condition No.4 and affirming report. MOVED CLYMER, SECOND ROCKHILL, CONCUR IN THE PLANNING AND DEVELOPMENT REPORT. Upon inquiry by Council President Stredicke, Committee Chairman Rockhill explained the fill permit was requested entirely within the berm at the treatment plant site. MOTION CARRIED. CORRESPODENCE Letter from Mayor Shinpoch explained potential problem; an area Proposed Appeal church has preliminary plans to construct a facility adjacent to of Fire lode their existing building. The Fire Marshall has informed the Decision church authorities that their proposal is unacceptable without extensive protection to the existing structure. The minister has sought an appeal of the decision; however, specific plans have not been submitted; hence a specific denial has not occurred. The Fire Code allows for appeal of administrative decision via a Board of Appeals to be comprised of five members "qualified by training and experience to pass upon pertinent matters." The Mayor's letter expressed opinion the Board of Adjustment, nor the Hearing Examiner meet these requirements and an Appeals Board does not exist. The letter stated willingness to work with Council to resolve dilema and suggested referral to the Public Safety Committee, urging an early meeting to study the issue and make recommendation. PLANNING DIPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on September 16, 1981 . PUBLIC HEAZING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: At the applicant 's request , the public hearing scheduled for September 22, 1981 was continued to October 13, 1981 . CONTINUATION: The hearing was opened on October 13, 1981 at 9:00 a.m. in the Council Chambers of the Renton Muricipal Building. Parties w shing to testify were affirmed by the Examiner. Steve Munson, Planning Department, presented the Planning Department report, and entered the following exhibits into the -ecord: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat Map with staff comments The Examiner requested testimony by the applicant. Representing the applicant was: David Millard Land Planning & Management 22627 152nd S.E. Kent, WA 98031 Mr. Mill3rd indicated basic concurrence with the recommendations contained in the staff report w; th a few points of clarification. He advised that sanitary sewer lines exist on two sides of the property which are being constructed under a Local Improvement District assessmeit. He submitted an exhibit to illustrate the topographical elements which had dictated the short plat configuration as proposed. Exhibit #3: Topographical Map Mr. Millard indicated that Lot 1 comprises the Leisure Estates South Annex, Lots 2 and 3 comprise the remaining uplands area of the property which terminate at the crest of the slope, and Lot 4 is the lowlands area of property containing an abandoned gravel pit area. A second exhibit was entered showing the common line of Lots 2 and 3 which had been dictated by the boundary of the South Annex of Leisure Estates to provide for possible future (.:xpansion. Exhibit #4: Leisure Estates Plan Mr. Millard asked that the waiver request be modified to extend only to the frontage on Lots 2, 3 and 4 and not Lot 1 , since the city has already required that the frontage of Sh. Pl . 074-81 Page Two that street be improved depending on final design approval , and since no plans for development of the other three parcels exist at this time, he requested that the waiver of st eet improvements be extended just to the south 990 feet of the proposed short plat. The E aminer noted that the applicant proposes dedicating a 30-foot right-of-way along the easte n boundary of the property for roadway purposes. He inquired if Lot 3 would be utili ed for purposes of expansion of Leisure Estates Mobile Home Park. Mr. Millard advis d that the lot would not be used for purposes of expansion although that had been the o iginal intent , and it is the applicant 's desire to develop the parcel as a separate mobil home park. Responding to the Examiner's inquiry regarding the possibility of provi ing access via a roadway rather than a 60-foot dogleg as proposed, Mr. Millard stated that the 60-foot dogleg was added at the request of the City of Renton, and the applicant would prefer that it be eliminated because of future plans to combine Lots 2 and 3. The Examiner inquired if the request should be modified to a 3-lot short plat if the combination of those two lots is proposed. Mr. Millard preferred retaining the flexibility which would be available with the allowable four-lot plat. Responding to the Examiner's inquiry regarding ownership of and access to the property located to the west of the site, Roger Blaylock, Associate Planner, stated that the site is owned by King County and access is via Monroe Avenue N.E. Responding to the Examiner's inquiry regarding the possibility of providing a city street running in an east-west direction, Mr. Blaylock advised that topographical constraints due to existing gravel pits have precluded the proposal . The Examiner requested testimony in support of the application. There was no response. He then requested testimony in opposition. Responding was: David Riggle 4213 S.E. 4th Place Renton, WA 98056 Mr. Riggle, resident in the adjacent subdivision of Heather Downs , objected to approval of the requested waiver of off-site improvements. He noted that other developers in the area have complied with the city' s improvement requirements, and amenities such as curbs , gutters, sidewalks and street lighting are necessary in the area to protect children and pedestrians. He also described heavy traffic generation and the narrow street configuration south of the Leisure Estates development which further support denial of the waiver and requirement of installation of improvements. Responding in opposition was: Curt Pedersen 4524 S.E. 4th Street Renton, WA 98056 Mr. Pedersen corrected the record to indicate that the subject site is located in the southeast quadrant of the city, not the northeast quadrant. He further discussed the narrow width of Union Avenue S.E. which causes cars to go off the road in order to pass and creates a dangerous safety hazard for pedestrians and bicyclists. He stated that the area contains many older homes which were developed without requirements for installation of off-site improvements , and recent increase of new construction further impacts traffic and access near the subject site. He supported denial of the waiver and requirement to widen Union Avenue S.E. and provide appropriate off-site improvements. The Examiner requested further testimony in support or opposition to the application. There was no response. He then invited final comments from the Planning Department staff. Mr. Blaylock advised that the department 's objection to the waiver request concerned the possibility that Lot 4 may be developed prior to development of Lots 2 and 3 which would result in an inconsistent parcel not connecting to the improved street width on Union Avenue S.E. The Examiner requested final comments. Since none were offered, the hearing regarding File No. Short Plat 074-81 and W-075-81 was closed by the Examiner at 9:28 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Dean Bitney, filed a request for approval of a four-lot short plat together with a waiver of the required off-site improvements. 2. The application file containing the application, SEPA documentation, the Planning Department report , and other pertinent documents was entered into the record as Exhibit #1 . Sh. Pl . 0 31 Page Three 11 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Fct of 1971 , RCW 43.21C, as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located on the west side of Union Avenue S.E. in the vicinity of the _eisure Estates Mobile Home Park. 6. The subject site was annexed into the city in 1977 by Ordinance No. 3143. 7. A steep, 60 to 70 foot high, cliff is located in the central area of the subject site running from the northwest to the east. The slope ranges from about six to 15% in this area. The lower elevations are the result of quarrying operations on the site. The site also generally slopes from the northeast to the southwest. The vegetation on the site consists primarily of scrub brush and blackberries. 8. The applicant proposes creating four lots on the subject site. The lots range in size from about 3.2 acres to 19.6 acres. Proposed Lot 1 is currently part of the South Annex of the Leisure Estates Mobile Home Park. 9. The proposed property lines would generally follow the steep contours of the subject site, ,egregating the uplands area from the lowlands. 10. The applicant proposes dedicating a 30-foot wide strip along the eastern boundary of the subject site for roadway purposes. Union Avenue north of the subject site has been improved along the Leisure Estates property or will be so improved. The applicant has requested a waiver of the required off-site improvements on Union along only those portions of the subject site south of the Scuth Annex of Leisure Estates. 11 . There was opposition to the waiver by residents of Heather Downs subdivision who use Union Avenue to access their property to the south. The road now narrows to less than full width, slowing traffic and causing potential safety problems. There are no sidewalks along the subject site. The Planning Department indicated that the waiver would create a gap in the full width of Union and could result in non-contiguous full width sections alternating with unimproved roadway causing safety problems as the roadway narrows and widens along this block front. 12. Sewer and water are available in the immediate vicinity and will be capable of serving the subject site. Latecomers ' fees may be required. Utility easements subject to approval of the Department of Public Works will have to appear on the face of the plat. 13. The subject site is zoned both G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) and T (Trailer Park) . 14. The 1::omprehensive Plan designates the area in which the subject site is located as suitable for the development of single family and greenbelt uses. CONCLUSI )NS: 1 . The proposed short plat appears to serve the public use and interest. The division of the subject site will enable the sale to individual purchasers of smaller lots and the division will also permit the reasonable separation of upland lots from lowland lots along topographic features. 2. The separation of Lot 1 , which is developed as part of the Leisure Estates complex and which is zoned T, will integrate that property with the northerly portion of Leisure Estates and facilitate the combination of compatible uses. 3. The requested waiver is not in the public interest. The provision of a consistent, ful -width street will facilitate safer movement of vehicles in this area rather that an alternating full-width and less than full-width street. The provision of off-site improvements will also provide for a sidewalk to allow safe pedestrian movement in this area. 4. The potential sale of each of the lots with frontage along Union Avenue S.E. in this area could lead to inconsistent widening of Union Avenue and this is not in the public Sh. Land Use: The site is undeveloped except for existing mobile homes on Lot #1 of the proposed Short Plat. E. NEIGHBORHOOD CHARACTERISTICS: The surrounding properties are a combination of single family residence, mobile home dwellings, power transmission lines, and undeveloped properties . F. PUBLIC SERVICES: 1 . Water and Sewer: A twelve-inch water main extends north-south along the east side of Union Avenue S.E. to the east of the subject site. 2. Fire Protection: Provided by the City of Renton as per Ordinance requirements. 3. Transit : Metro Transit Route 107 operates along Union Avenue N.E. approximately three-fourths of a mile north of the subject site. 4 . Schools : Honeydew Elementary School is located approximately one mile north of the subject site. The subject proposal is compatible with the existing zoning and land use of adjacent properties. 3. All of the proposed lots meet the minimum requirements of the Subdivision Ordinance for size and frontage. Lot #1 , however, exceeds the 22 : 1 ratio of Section 9-1108-23F3a of the Subdivision Ordinance. It is also the South Annex of the existing Leisure Estates Mobile Home Park. It could, therefore, be incorporated into that plat and the 21 : 1 standard would be satisfied. 4 . Suitable utilities are available to the subject site, although sewer and water lines will have to be extended to service the property. In addition, a latecomer' s agreement for utilities must be provided. 5 . The Fire Department advises that a 20 ' paved access with proper turn radius must be provided to the site. Additional fire hydrants will also be required. This comment is more appropriate when a specific development is proposed. 6. A storm water retention system will be required as per Engineering Division comment. Sewer easements must also be shown on the short plat. In addition, a title report will be required. See other comments. 7 . The applicant has applied for a waiver of the required off-site improvements on Union Avenue S.E. Similar improvements have recently been installed on the east side of the street. The Police Department also advises that the traffic volumes on the street dictate installation at this time. The Building Department and Traffic Engineering and Engineering Division concur in this . It would seem, therefore, that the request should be denied.
