January 14, 1982 OFFICE OF THE LAND USE BEARING EXAMINER CITY OF RENTON REPORT AND DECISION . APPELLANT: Gary and Tom Carner FILE NO. ECF-091-81 R-081-81 ) LOCATION: 4508 N.E. 4th Street SUMMARY OF APPEAL: The appellants have appealed a Final Declaration of Significance issued by the Environmental Review Committee for a proposed rezone from the G zoning district to a B-1 classification on the subject site. SUMMARY OF DECISION: The decision of the Environmental Review Committee is affirmed. PUBLIC HEARING: After reviewing the letter of appeal , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 12, 1982 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The Examiner explained the public hearing process for appeals of environmental determinations made by the Environmental Review Committee (ERC) , noting that the issue is not whether a rezone should or should not be granted but rather whether the city has carried out its responsibility under the State Environmental Policy Act in determining whether the proposal will have more than a moderate effect on the environment, and if so, whether an Environmental Impact Statement should be prepared for the project. Testimony by the appellant was then requested. Responding was: Gary L. Carner 3405 Talbot Road S. Renton, WA 98055 Mr. Carner objected to the requirement imposed on the applicant by the Environmental Review Committee to prepare an Environmental Impact Statement for the requested rezone since the proposal would be limited to a 576 square foot addition to an existing building, such addition to be smaller in size than an average two-car garage. There would be no impact to sewers or storm drainage utilities in the area due to minimal change in the character of the property and no additional plumbing is proposed in the expansion area. Citing the ERC's concern regarding increased generation of traffic onto N.E. 4th Street, Mr. Carner noted that due to the nature of the business, a maximum of four or five customers utilize the facility on a busy day causing insignificant impact on existing traffic generation rates. In reviewing the matter with the ERC, Mr. Carner had inquired if impact from only the proposed addition would require an EIS, and he was told that the proposal in itself would not require such review; however, an EIS was being required by the city for all newly annexed property located east of Union Avenue N.E. He concluded by stating that the subject property is less than one-half an acre in size, the proposal would cause no significant impact upon the environment, and preparation of an EIS would cost between four and twenty thousand dollars which would render the proposal impractical to pursue. The Examiner invited testimony in support of the appellant 's position. There was no response. He then requested testimony by a member of the Environmental Review Committee, David R. Clemens, Policy Development Director. Mr. Clemens reviewed the city's responsibility under state enabling legislation and city ordinances to review potential consequences of proposed action, in this case, a rezone of one-half acre to the B-1 zoning district. Although that zone allows the current use proposed by the applicant, it also allows expanded uses of business and high density multiple family residential development, or a potential for between 15 and 20 dwelling units. Mr. Clemens stated the city's position that a density of that level would create potentially adverse impact upon the community and set a precedent for rezone and development of many more acres in the immediate vicinity. Although the requested proposal would not impact water courses downstream, development of the property to its fullest potential under the B-1 zone standards would have an adverse effect. Mr. Clemens also expressed the ERC's concern regarding congested traffic on N.E. 4th Street west of the subject site which would be exacerbated upon increased development of multiple family residential uses. The availability of public services was discussed, and it was noted that although the area ECF-091-81 Page Two is only lightly developed at the current time, the potential exists for impact upon the city's available services including police and fire; and sanitary sewers are unavailable east of Union Avenue to serve the subject site. To mitigate impacts from these factors, an Environmental Impact Statement should be required prior to rezone of the property. The Examiner entered the following exhibit into the record: Exhibit #1 : Appeal File containing letter of appeal and other pertinent documents The Examiner then requested Mr. Clemens to designate the subject site on the display map and aerial photographs. Mr. Clemens denoted the location of the site on N.E. 4th Street slightly west of Duvall Avenue N.E. Referencing the first concern of the ERC, storm drainage, he noted that the swale located south of N.E. 4th Street extends around the Heather Downs subdivision and out through the Maplewood Golf Course, and additional development of the basin will increase storm runoff into that area unless properly mitigated. Regarding traffic, the major N.E. 3rd/N.E. 4th Street corridor has a very high service demand level and the committee is concerned regarding any development which would cause further impact. Mr. Clemens referenced the Ullrich appeal a few months prior for which similar concerns were expressed, and advised that because of the uncertainty of the precise impacts of development, an impact statement should be prepared. Citing the most critical concern, unavailability of sanitary sewer lines, Mr. Clemens advised the most logical extension of sewers to serve the area would fall into two categories, to the existing system west of Union Avenue N.E. or to the new trunk facility located through the drainage canyon and connecting to the Metro line in the Maple Valley Highway. Although the area proposed for development by the appellant is minor, concerns of the committee relate to the consequences of development of the entire site. The Examiner inquired if the committee would modify its stand if the applicant signed restrictive covenants to limit development only to business/commercial use or reduced the rezone to only the area proposed for the addition. Mr. Clemens stated that modification would possibly alter the committee's decision; however, it must be reviewed and considered by the ERC membership. Mr. Carner clarified that the property had been purchased two years earlier for the purpose of construction of a floor covering store, and the current request is solely for the proposed addition, not development of the entire site. The addition, he noted, would provide storage and display space for the business. He indicated concern that the ERC had based its decision on the highest possible development of the property, and not upon the current request of the applicant; furthermore, all future development of the site would be subject to review during building permit application. Mr. Carner discussed the zoning on the property prior to annexation, R-900-high density multifamily residential , which was automatically changed to G-General upon annexation into the city. He concluded by stating his desire to obtain a permit to construct an addition to the existing building for storage and display purposes, which should not cause impact to sewers, drainage or traffic. The Examiner advised that two options exist for disposition of the matter, either he could review the appeal as submitted including development potential for the entire site, or withdrawal of the application and resubmission of a request for rezone of only the area proposed for the addition. If the latter option was desired, the appeal could then be dismissed by the Examiner. Mr. Carner opted to proceed with review of the appeal . The Examiner requested further testimony. Responding was: Mary Ellen Hamblin 13025 138th Avenue S.E. Renton, WA 98056 Ms. Hamblin, representing the Open Space Coalition of Southeast King County, advised that the organization is interested in preservation of the natural drainage ways that run north of the subject site in an east-west direction and are part of the Class I habitat in the vicinity of Honey Dew Elementary School on Union Avenue N.E. She supported the city's concern regarding environmental impact which she felt was appropriate prior to any rezone to B-1 in the area. Mr. Carner requested clarification of the area encompassed by the rezone review. Mr. Clemens clarified that the subject application pertains only to the one-half acre of property owned by the Carners. The Examiner further explained that precedent setting influence for future rezones is also a concern of the city. The Examiner requested further comments. Since there were none, the hearing was closed at 9:28 a.m. ECF-091-81 Page Three FINDINGS, CONCLUSIONS & DECISION: FINDINGS: 1 . The appellants, Gary and Tom Carner, filed an application to reclassify approximately one-half acre of property from G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to B-1 (Business/Commercial ) . The application was reviewed by the Environmental Review Committee (ERC) which issued a final Declaration of Significance (DS) . The appellants then appealed that declaration pursuant to Section. 4-3011 (B) . The appeal was heard on January 12, 1982. 2. The subject property is located in the vicinity of 4508 N.E. 4th Street. The site is located on the north side of N.E. 4th Street between Union Avenue N.E. and Duvall Avenue N.E. 3. A commercial building is located on the subject site near N.E. 4th Street. The applicant has proposed an addition of about 576 square feet, 24 feet by 24 feet, to serve as storage for the existing building. Commercial uses are not permitted in the G zone, and therefore the applicant requested the reclassification. 4. The reclassification of the subject site from G to B-1 would enable the subject property to be developed with high density multifamily housing as well as the commercial expansion the applicant has proposed. The half acre would permit the establishment of up to approximately 30 dwelling units if developed to full R-4 densities. 5. The population density with its resultant demands on public services and traffic impacts of such development were used as the basis for the Declaration of Significance by the ERC. 6. There are no public sewer lines or storm drainage systems east of Union Avenue N.E. The city is in the process of analyzing the needs and locational requirements for such systems in the area. 7. A drainage way runs in the vicinity and wends its way eventually to the Maple Valley Golf Course. Additional storm water would find its way into this system changing the flow and velocity in the drainage feature; the impacts of such storm water are unknown. 8. The city indicated that there is a significant amount of undeveloped acreage in the vicinity of the subject site and the precedent of the proposed rezone and lack of both sanitary and storm sewer systems and the impacts of traffic on the heavily traveled N.E. 4th Street corridor would have a significant impact on the environment. 9. The appellant indicated that the only plans were for the commercial expansion, and the potential development of the site was a future possibility which should not be considered at this time. 10. The surrounding area is sparsely developed and designated for commercial development. The area is classified G as is the subject property. 11 . The area was annexed into the city from King County where the zoning was R-900 which permitted high density development. Upon annexation, a property is automatically reclassified as G. While no specific hearing is held on the reclassification, a public hearing is held for the annexation, and parties agreeing to annexation are aware of the effects of annexation. Annexation to the city itself is probably more than sufficient change of circumstances to permit a reclassification of the properties annexed. CONCLUSIONS: 1 . The decision of the governmental agency acting as the responsible official is entitled to "substantial weight" (RCW 43.21C.090) . Therefore, the determination of the Environmental Review Committee, the city's responsible official , is entitled to substantial weight, and the appellant has the burden of demonstrating that the determination was in error. The burden is further defined as whether the decision was arbitrary and capricious in light of the record. (Short v. Clallam County, 22 Wn.App.825, 829, 1979) . A decision is "arbitrary and capricious" if there is no support for it in the record and it is therefore a willful and unreasoning action, in disregard of facts and circumstances. (Stempel v. Dep' t of Water Resources, 82 Wn.2d 109, 114, 1973) 2. The policies of SEPA are more clearly safeguarded when agency action results in ECF-091-81 Page Four full disclosure of the impacts of a proposal upon the environment. (Norway Hill v. King County Council , 87 Wn.2d 267, 1976) The issuance of a Declaration of Significance by the ERC requires the completion of an environmental impact statement which does result in full disclosure. 3. There was no contention that the subject proposal was not a major action capable of significantly affecting the quality of the environment; therefore, the ERC had to determine whether the proposal would or would not have a significant adverse effect on the quality of the environment. A major action is determined to have a significant adverse effect on the quality of the environment if more than a moderate effect on the quality of the environment is a reasonable probability (Norway, at 278) . "The nature of the existing environment is an important factor. The same project may have a significant adverse impact in one location, but not in another location." (WAC 197-10-360(2) ) "It should also be remembered that proposals designed to improve the environment may also have adverse environmental impacts. The question at the threshold determination is not whether the beneficial aspects of a proposal outweigh its adverse impacts, but rather, if the proposal involves any significant adverse impacts upon the quality of the environment. If it does,. an EIS is required." (WAC 197-10-360(3)) 4. Subject to court decisions and to the criteria enumerated by the Washington Courts in analyzing the environmental threshold determinations, the decision of the ERC must be affirmed and an EIS is required. There are too many unanswered questions about the impacts of the proposal . The proposal is a major action, and the location of the subject property in an area without sewer service and along the N.E. 4th Street corridor is such to bring the proposal into the category of those which have an adverse impact on the quality of the environment. 5. The proposal is not as the appellant argues, a 576 square foot expansion, but a rezone of one-half acre of property to a B-1 classification. B-1 could permit high density multifamily development. The impacts of such development on the unsewered area, which also lacks storm drainage and is located along the N.E. 4th Street corridor, would have "more than a moderate effect on the quality of the environment" and an EIS is required. 6. WAC 197-10-060 makes it clear that the "total proposal including its direct and indirect impacts" should be reviewed when making an environmental determination. The total proposal is the proposed action, together with all proposed activity functionally related to it. Future activities are functionally related to the present proposal if. . . (b) The present proposal facilitates or is a necessary prerequisite to future activities." (WAC 197-10-060(2) (b)) The impacts of a proposal include its direct impacts as well as its reasonably anticipated indirect impacts. Indirect impacts are those which result from any activity which is induced by a proposal . These include, but are not limited to, impacts resulting from growth induced by the proposal , or the likelihood that the present action will serve as a precedent for future actions. (For example, adoption of a zoning ordinance will encourage or tend to cause particular types of projects. )" (WAC 197-10-060(3)) (Emphasis supplied) 7. In the present case, the applicant proposed only a rezone, but the classification would permit multiple family development and has the potential of generating similar requests in the area. Other areas surrounding the subject site, besides being sparsely developed, are also zoned G, and the reclassification of the subject site could induce similar requests in the immediate area. The entire proposal would therefore include such potential secondary or indirect impacts. 8. The ERC's determination that a full EIS is required is reasonable in light of the record. Requiring an EIS is more consistent with the policies of SEPA. The provision of an EIS will enable the decision maker to fully evaluate the project. The policy enunciated in "Norway Hill " was that public agencies should foster the environmental full disclosure goals of SEPA. "An affirmative threshold determination should be overturned only if found to be arbitrary and capricious or contrary to law." Short at 830) Whether or not a proposal should or should not be approved should be based on firm environmental evidence before the decision is made. (Norway at 279) The decision of the ERC should be affirmed. The action of the ERC is not willful and unreasoning action, in disregard of the facts and circumstances. Only the preparation of an EIS would allow a reasoned ELr-u91-81 Page Five decision to be made on whether or not the proposal should be permitted and under what circumstances. Therefore, the decision of the ERC is affirmed. 9. The applicant is free to reapply for a more limited rezone to permit the proposed expansion, but such proposal would be subject to similar scrutiny, and the ERC is free to reach the same or similar conclusions even for a limited rezone. APPROVAL OF MINUTES: Moved by NELSON, seconded by CLEMENS, that the minutes of the December 16, 1981 meeting be approved as read. MOTION CARRIED 3. CORRESPONDENCE: Chairman Houghton read letter from Renon School District relative off-site improvements along Monroe Ave./Renton Vocational-Technical Institute. He indicated that Mr. Belmondo had also come in and talked about engaging the services of Mike Yuhl to develop plans and specifications for said off-site improvements. He had been informed that he should complete the installation of improvements or submit a bond; therefore, he was asking for a deferral. Discussion ensued about assurance and it was decided that a letter should be written asking for a Letter of Credit in the amount of money the district has allocated for the project. 4. REFERRALS FROM CITY COUNCIL: None 5. REFERRALS FROM OTHER DEPARTMENTS a. Application for Sign Variance, 4508 N.E. 4th, Gary & Tom Carner/continued. Ron Nelson advised that this had been continued to give the applicant an opportunity to explain what was obstructing the sign that caused it to be brought out closer to the front of the property. Mr. Carner replied that nothing was obstructing the sign but rather that it was back so far that it was not visible. Further that the property line was 42' back from the center of the street. Ron Nelson explained that when they approved the plan it set the sign back too far. Dave Clemens asked Mr. Carner if other than inconvenience of the sign back so far was there any physical obstruction of the view. Mr. Carner advised that it was obstructed by trees and shrubs. He went on to say that as the old sign had been out farther and it caused no vehicular obstruction that they were requesting same for new sign and, further, that they want to set it on the property line. Recommendations were read from departments and discussion followed about the height of the sign and question was raised about future plans for widening of this street. Chairman Houghton stated that there would be no 4 BOARD OF PUBLIC WORKS 2- December 30, 1981 problem because they have 42' of R/W and 18 additional feet out of the paving, plus a problem with funding for any widening in the foreseeable future. Moved by NELSON, seconded by CLEMENS, that the deferral be granted per Building Depart- ments recommendations, i.e. , sign set back 1' back of property line and a height restriction of 10' . MOTION CARRIED b. Application for Home Business License, 107 Main Ave. S. #402, Cedar River Photographics. Discussion followed as to this not being a home business license technically under the City Ordinance. Moved by CLEMENS, seconded by NORRIS, that this be referred to appropriate City Departments for their action. MOTION CARRIED. c. Application for Home Business License, 1705 Pierce Ave. S.E. , Sewing Consultant. The application was read and determination made that there would be customers or clientele. Moved by NELSON, seconded by CLEMENS, that the application be denied on the basis of there being customers on the site which is not allowed as home business usage. MOTION CARRIED d. Deferral Off-Site Improvements, Homecraft Land Development Co. , Inc. , btwn. N.E. 3rd fT N.E. 4th Sts. , West of Edmonds Ave. N.E. Moved by NORRIS, seconded by MATHEWS to postpone this matter until the ERC requested review has been reconsid- ered. CLEMENS call for discussion and asked that Mr. Snell, who was present, be given time to explain why this item was before the Board. Mr. Snell advised he was with Hazzard Tousley f Brain who represented Homecraft. He went on to say that the motion made had no particular bearing upon their request as the Hearing Examiner in his statement said that any question of deferral of improve- ments to Edmonds should be referred to the Board. He stated that they have a short plat that needs to be filed and that they can not get the plat recorded unless they obtain a deferral or have the improvements installed. Also they need to have the short plat recorded the first part of the new year. Chairman Houghton clarified that this request really had nothing to do with Homecraft per se but that they were going back to the original short plat and in order to have it recorded they must have a deferment of improvements and post bond. Mr. Clemens explained that the problem would be the extent of the deferral and stated that the key question would be whether the Hearing Examiner would agree or disagree as to whether the intersection would have to be improved. He went on to address that fact that if the proponent was willing to bond for the full improvement of the intersection, a two piece bond - one for street improvements, the other for intersection, then if the Hearing Examiner disagreed and the City ultimately does not prevail and would have to go to Court, at least the deferral would be insured. Ron Nelson asked about the length of the deferral which the applicant had originally requested, that of a 3 year period. He explained that the Fire Department had doubts as to access for emergency purposes, especially in that time frame. Jim Mathews advised that they had no problem with access but with access routes as addressed in the Environmental Review, i.e. , response routes. He went on to say that their approach is one of consistency, i.e. , on projects of larger scale, they have required full access roads to be installed. Mr. Clemens asked the applicant for an estimate and he responded with a 100,000 figure. Mr. Nelson reminded the Board that there was a motion before them on postponing this matter. The project is located in portions of Renton and Bellevue, in addition to unincorporated KingCounty. The project itself will consist of three distinct elements. The three major elements will be the provision of a right shoulder HOV lane on Interstate 405 for the entire length of the project; the construction of a 140-car park and ride lot at May Creek Interchange Milepost 6.63); and the construction of two half-mile sections of bicycle/pedestrian trail between May Creek Interchange and Coal Creek Interchange (MP 7.92 to MP 8.55 and MP 9.77 to MP 10.25). In addition to these improvements, the existing roadway will be resurfaced between the North Renton and the May Creek Interchanges. In coordination with the Federal Highway Administration (FHWA) and other state and local agencies, the proposed improvements have been developed as documented in the general and specific goals of transportation plans for this region. The WSDOT and FHWA prepared and made available to the public, an Environmental Assessment in response to the National Environmental Policy Act of 1969, which identifies the social, economic, and environmental impacts of the proposed action. The Environmental Assessment was available for public review and comment for a period of 30 days. The Notice of Availability appeared in the Seattle Times and the Seattle Post Intelligencer on December 19, 1980. Comments were accepted through January 19, 1981.
