A Major legal question arose concerning the recording of the final plat under Section 9-1106(3)(0). As a result of the unusual circumstances surrounding the presentation of the final mylars by the applicant. to the city and the subsequent review and approval by the Public Works Department after the expiration period, the Building and Zoning Department sought an official legal position from the City Attorney. As I understand the facts , the final plat was approved by Resolution adopted by the City Council on August 16, 1982 . By the terms of both Section 9-1106 (3) (J) and (0) , this plat would expire unless the plat was recorded within six months after the approval by the City Council. This expiration would have occurred on February 16 , 1983. As I understand it , the applicant submitted the mylars for recording on January 11 , 1983 , however, the legal descriptions set forth on the mylars were not approved by the Public Works Department until April 13 , 1983. Now you are presenting the question as to whether the delay on the part of the City in approval of the mylars as timely presented by the applicant would require the applicant to refile for preliminary or tentative plat approval as set forth in the City Code Section cited above. In our opinion, the delay of recording of the document was occasioned by the City' s review of the mylars as timely presented by the applicant. We do not address the question of whether this delay was appropriate since apparently some good faith dispute was presented over the adequacy of the legal description. However , we see no reason why this delay should be attributed to the applicant and the applicant be required to resubmit the plat. You also raise the question of whether the City Code Sections quoted above in effect abrogate the provisions of RCW 58 . 17 . 140 which provide that a final plat must be submitted for approval by the City within three years of the date of preliminary plat approval . 11117: ' Roger Blaylock Page 2 August 29, 1983 We see no conflict between the provisions of the State law cited above and our City Code. The applicant may delay application for final plat approval up to three years after preliminary plat approval. However, having once submitted his final plat for approval, the applicant should be subject to the provisions of our City Code requiring completion of the final plat approval process within six months after approval thereof by the City Council in order to expedite the completion of the final platting process , to encourage the prompt use of land which has been sub- divided, to discourage unnecessary delays attributed to tardy inattention to detail , and to reduce the possibility of an error in the administration of the Subdivision Code on the part of the City staff due to the approval process being drawn out unnecessarily. Accordingly, we would suggest that this final plat be submitted to the necessary City officials for their approval and for recording in the office of the King County Recorder. I have your Memo of August 19 , 1983 , regarding the possible expiration of the Poitras final plat approval . As I understand the facts , the final plat was approved by Resolution adopted by the City Council on August 16 , 1982 . By the terms of both Section 9-1106 (3) (J) and (0) , this plat would expire unless the plat was recorded withi:i six months after the approval by the City Council . This expiration would have occurred on February 16, 1983 . As I understand it , the applicant submitted the mylars for recording on January 11, 1983 , however , the legal descriptions set forth on the mylars were not approved by the Public Works Department until April 13 , 1983 . Now you are presenting the question as to whether the delay on the part of the City in approval of the mylars as timely presented by the applicant would require the applicant to refile for preliminary or tentative plat approval as set forth in the City Code Section cited above . In o , opinion, the delay of recording of the document was occasioned by`t . e City' s review of the mylars as timely presented by the applicant. We do not address the question of whether this delay was appropriate since apparently some good faith dispute was presented over the adequacy of the legal description. However , _we see_ no reasoK1 why this delay should be attributed to the applicant and the applicant be required to resubmit the plat. You also raise the question of whether the City Code Sections quoted above in effect abrogate the provisions of RCW 58 . 17 . 140 which provide that a final plat must be submitted for approval by the City within three years of the date of preliminary plat approval . As I understand the facts , the final plat was approved by Resolution adopted by the City Council on August 16, 1982 . By the terms of both Section 9-1106 (.3) (.J) and (0) , this plat would expire unless the plat was recorded within six months after the approval by the City Council . This expiration would have occurred on February 16 , 1983 . As I understand it, the applicant submitted the mylars for recording on January 11, 1983 , however, the legal descriptions . set forth on the mylars were not approved by the Public Works Department until April 13 , 1983. Now you are presenting the question as to whether the delay on the part of the City in approval of the mylars as timely presented by the applicant would require the applicant to refile for preliminary or tentative plat approval as set forth in the City Code Section cited above . In our opinion, the delay of recording of the document was occasioned by the City' s review of the mylars as timely presented by the 1 applicant. We do not address the question of whether this delay was appropriate since apparently some good faith dispute was presented over the adequacy of the legal description. However , we see no reason why this delay should be attributed to the applicant and the applicant be required to resubmit the plat. You also raise th.e question of whether the City Code Sections quoted above in effect abrogate the provisions of RCW 58 . 17 .140 which provide that a final plat must be submitted for approval by the City within three years of the date of preliminary plat approval . • Roger Blaylock Page 2 August 29, 1983 We see no conflict between the provisions. of the State law cited above and our City Code. He is also considering using officers on disability to help in this problem. Silent Witness Public Safety Committee Chairman Hughes also noted that the Silent Witness Program Program had been discussed with Chief Wallis. This program was started in 1972 as the Citizens' Council Against Crime and offers cash rewards to citizens providing information leading to the arrest of people involved in violent crime. No public hearing is held in conjunction with final plat applications . FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Mike Mastro (R. W. Poitras) , filed a request for approval of a final plat for four lots located on the south side of N.E. 4th Street west of Union Avenue N.E. 2. The application file containing the application, SEPA documentation, the Building and Zoning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. The subject property consists of three commercial lots and the residential lot immediately south of the commercial properties containing the Mastro apartment complex. 7. The approximately 8.99 acre parcel had been short platted, and further platting required the filing of a final plat. 8. A trip generation fee was assessed against the property during the original short plat proceeding amounting to $27,800. The fee was predicated upon the subject property generating 1 ,390 vehicle trips per day. The Public Works Department at that time calculated a pro rata cost per trip for certain transportation-related capital projects to be $20.00 per trip. 9. The city further instituted a systems development fee which replaced certain other fees. The fee of $2,988 was assessed for the project. There is no information in the record regarding the breakdown of this fee for commercial versus residential development. Nor does the record reflect the proportion of the systems development fee benefitting traffic-related capital costs. 10. The legislative history of the systems development charge reflects the City Council 's concern about growing capital expenditures related to new growth in the city while balancing the effect of passing all such costs on to new home purchasers. The systems development fee reflected a compromise solution and did not replace all fees on a one to one ratio. I " FP-093-81 Page Two 11 . The applicant has complied with the conditions imposed during the initial review of the plat. 12. The applicant has complained about the impacts of other fees not a direct consequence of the platting process but authorized under one or more city ordinances. CONCLUSIONS: 1 . The final plat appears to serve the public use and interest. The final plat is a technical requirement to replat any property previously platted. The applicant has met the technical requirements of the state statute by filing the final plat. 2. The applicant h'as, though, been assessed for the traffic generated by the subject proposal under two different formulas. When the plat was originally submitted, the applicant was required to pay for the direct traffic-related impacts of the subject proposal upon the capital transportation system. It would be both unfair and inappropriate to assess a further fee incorporating to some extent the same capital costs. Imposing the full systems development fee would have that result. Since the record fails to demonstrate what proportion of the systems development fee is attributable to the capital costs of the !'city's transportation system, the matter must be resolved by the city staff. Therefore, that portion of the systems 'development fee so attributable should be returned to the applicant. 3. The other fees questioned by the applicant are not a result of the platting process but were assessed under other authorizations not the subject of the platting process. We have also paid permit fees of $1 ,549.63 with respect to this job, and also a sewer usage fee of $3,134.97. This latter amount is not understandable in that this complex feeds both storm and sanitary into lines on the adjacent apartment complex. You will recall that we paid for both running the sanitary to the metro line and the storm to the south edge of the cemetary.
