We have checked the revised legal description of the restrictive covenants
for the subject rezone and found it to be satisfactory and consistent
with the Rezone Ordinance No. 3738.
However, to cancel the previously recorded covenants, the following
caption must be typed on the top of the revised covenants before its
recording.
This document hereby supersedes and revokes the previously recorded
Declaration of Restrictive Covenants, filed under King County Recording
No. 8307220599."

WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No . 1628 known as the "Code of General Ordinances of
the City of Renton" , as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has

SUBJECT: LEGAL DESCRIPTION
During the final review of the legal description for the Penor Rezone, a discrepancy
was discovered. The legal description that was contained in the master application
did not correspond with the accompanying maps. Both the Environmental Review Committee
and the Hearing Examiner reviewed the proposal based on 3.25 acres; however, the
legal description was actually 5.00 acres. The applicant had only intended to rezone
the 3.25 acres and the legal description should have stated that it was a portion of
the large parcel. The legal description on the Environmental Checklist was correct.
The applicant submitted an erroneous legal description but because it included all
of the smaller 3.25 acre parcel, it was still legally published and reviewed in the
public hearing process.
The City Council in passage of Ordinance 3738, utilized the correct legal description
to correspond with the 3.25 acres.
The restrictive covenants should utilize the same legal description as Ordinance 3738
and, therefore, must be refiled.
The legal description should be:
Lots 2,3, and 4 of King County Short-Plat No. 478037, recorded under King County
Auditor's File No. 7809270893, records of King County, Washington; being a portion
of the following described property;
The West 686.00 feet of the South 318.00 feet of the Southeast quarter of the South

annexation-rezone process would be basically simultaneous ,
Council would adopt the annexation ordinance first, directly
followed by the rezone ordinance. Mr. Clemens outlined the
proposed policy to include: 1 ) Hearing, review and recommen-
dation by the Hearing Examiner; 2) Two public hearings by the
Council (30 days apart) ; 3) Council approval , modification , or
disapproval . Rezoning processes would halt at this time and

indicated current revision of the City Code with anticipation of
further recommended changes, and options available to Council
to adopt either resolutions or policies for various city matters.
Councilman Mathews opposed application of a lesser per diem rate

Khoury/West AVENUE STREET VACATION PUBLIC HEARING. CARRIED. Correspondence
Street Vacation was read from Public Works Director Houghton reporting that the
of Gen Seng subject roadway, platted in 1904, has never been opened to the
Avenue traveling public, and because it is unnecessary for future use,
VAC-Ol -83 no easements are required. However, due to development
potential of the vacated property, a Class "C" street vacation
category requiring a fee should be applied. It was further
recommended that Section V of Ordinance No. 3635, street
vacation procedures , should be followed, specifically the
section requiring abandonment and denial of the petition if
the compensation determined by Council has not been paid
within 90 days of that decision. Mr. Houghton designated
the location of the subject site on a display map, and advised
the petition had not been signed by one of the abutting property
owners on the southwestern side of Gen Seng Avenue.
Continued James C. Hanken, 1300 Seattle Tower, Seattle, legal counsel for
the petitioners, confirmed that the street has never been used,
a fully developed access roadway lies parallel to it, and
approval of the Street vacation will allow the highest and best
use of the property. Responding to Councilman Rockhill ' s inquiry
regarding potential problems caused by failure of the owner
who has not signed the petition to pay his share of the assessed
value, City Attorney Warren explained division of the vacated
property to abutting property owners on each side of the road,
discussed options available to property owners to negotiate
purchase of the vacated land from each other, and indicated
right of the City Council to delete any portion if the owner
refuses to pay. Councilman Stredicke supported inclusion of
the entire street in the vacation procedure at this time to
avoid duplication of effort in the future when other property
owners may petition the city. Mayor Shinpoch explained privilege
of property owners to choose not to sign the petition. MOVED BY

INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their successors, heirs and assigns,
hereby agree and covenant to participate in, sign a petition in support of, and
accept any future Local Improvement District (LID) or city initiated proposal, and
pay their fair share therefore, for the purposes of providing the necessary off-site
improvements required by the Renton Subdivision Ordinance. Said improvements
shall include, but may not be limited to, the installation of roadway improvements
to Talbot Road S. and/or S. 55th Street, as necessary to serve the area in the
future.
These covenants are imposed in lieu of Section 9-1105(6) of Title IX of Ordinance
1628 of the City of Renton.

DURATION
These covenants shall run with the land and expire on December 31, 2025. If at any
time improvements are installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further '
documentation.
Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton or any
prcperty owners adjoining subject property who are adversely affected by said breach.

Department Report, examining available
information on file with the application and
field checking the property and surrounding
area, the Examiner conducted a public hearing
on the subject as follows:
The hearing was opened on June 14, 1983, at 9:20 a.m. in the Council Chambers of the Renton
Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The Examiner entered the following into the record:

the area.
Roger Blaylock, Zoning Administrator, presented the staff report, noting that the existing lots
were created as a part of a short plat in King County in 1978; that Talbot Road S. at S. 55th
Street will ultimately become a major arterial and it would seem appropriate to look at some
type of sudivision at that time that would not front on that street. He indicated the final test
is timeliness to determine whether this request is appropriate at this time; this is the first
parcel to be developed in the general area, and the rezoning and development of the site would
be the first step in stabilizing the general area. Also, that the city has had a tremendous
amount of pressure from the public as to whether they could place multiple family dwellings in
this arca and, hopefully, this development will start the trend back to single family dwellings in
compliance with the Comprehensive Plan.
Mr. Blaylock continued by advising that the Utilities Engineering Division of the city advises
that a ;pedal assessment for water is applicable and this development charge will be applied at
the time of development.
Mr. Blaylock then stated the Policy Development Department has expressed preliminary
concerns with participation in areawide improvements that may be necessary when the area is
actuall•t developed. The project represents potential development of 12 to 19 lots maximum,
and should be required to participate in areawide traffic improvements to Talbot Road S. and
possibly the extension south of 55th Street across SR 167 which is located to the west of the
subject site.

Mr. Blaylock indicated these evaluations and concerns are so far in the future that it is difficult
to put a handle on them at this time, but there is a possibility of requiring restrictive covenants
to participate in an L.I.D. for the improvements of Talbot. Road S., if that was a general
improvement of the entire length of the street.
In closing, Mr. Blaylock stated the staff recommendation is to grant the request for rezone,
subject to filing of restrictive covenants to participate in an L.I.D. for the improvement of
Talbot Road S.
The Examiner called upon the applicant or representative for testimony. Testifying was:

Mr. Walburn did not testify, but merely indicated he was in attendance to support the applicant.
The Examiner then called for testimony in opposition to the request. Testifying was:

Ms. Wilson inquired of the lot size and asked how many, at a maximum, lots would be included
within the develoment. Mr. Blaylock responded by stating the lot size was 7,200 sq. ft., and
there would be a maximum of 19 lots/residences allowed in the development.
The E:aminer also noted that this number could decrease to 18 or 17, depending upon the
amount of land required for the installation of roads and cul-de--sacs.
The Examiner further advised Ms. Wilson that the development would have to go through a
subdivision or short plat process which would require additional hearings, and that she would be
notifie3 of such hearings and allowed the opportunity to express her concerns at that time also.
The EEaminer called for further testimony in support of or opposition to the proposal. There
being none, the Examiner closed the hearing at 9:40 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this
matter, the Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Charlie C. Penor, filed a request for approval of a reclassification of
approximately 3.25 acres of property from G-1 (General; Single Family Residential;
minimum lot size - 35,000 sq. ft.) to R-1 (Single Family Residential; minimum lot size -
7,200 sq. ft.).
2. The application file containing the application, SEPA (State Environmental Policy Act;
1 CW 43.21C) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered into the record as Exhibit #1.
3. l ursuant to the City of Renton's Environmental Ordinance and Sepa, a Declaration of
Non-Significance (DNS) has been issued for the subject proposal by the Environmental
1 eview Committee (ERC), the city's responsible official.
4. Hans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. The subject property is located in the extreme southerly portion of the city at the
intersection of Talbot Road S. and S. 55th Street (S. 192nd Street).

6. The property consists of three single-family lots of a four-lot subdivision approved by
King County in September of 1978 prior to annexation into the city.
7. The subject site was annexed into the city in December of 1978 by Ordinance 3268, at
which time it was automatically zoned G-1.
8. Any further subdivision prior to the expiration of the five years would require application
and approval of a preliminary and final plat by the city.
9. The site slopes upward to the east at slopes ranging from 8 to 10 percent. The three lots
each contain one single family dwelling and residential landscaping.
10. The approval of the rezone would permit further subdivision of the three lots into
approximately 19 lots as long as there was compliance with city and state law.
11. The maximum development of 19 lots would increase the population of the area by 48
residents; increase the school age population by approximately 12 students; and increase
the average daily vehicle trip count by approximately 190 trips per day.
12. Sewer service is provided by the Cascade Sewer District, while water is provided by the
City of Renton. The report contains no information regarding the ability of Cascade to
serve further development in this area.
The city has installed a major water line along Talbot Road connecting the Springbrook
watershed to the city proper.
13. The three parcels are located approximately one mile south of the intersection of S. 43rd
Street and Talbot Road S. At or near that intersection are a number of large complexes
and proposed complexes, including the Valley General Hospital, the One Valley Place
development, and the Gateway apartments.
14. The intervening property is largely undeveloped rural pasture and scattered single family
development. There are some smaller, approximately 7,200 sq. ft. single family
subdivisions in King County south and east of the subject site.
15. `"he Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of single family uses.
16. While Talbot Road S. is a designated arterial, S. 55th Street is not currently designated
for arterial purposes. The Building and Zoning Department has recommended that the
applicant participate in any LID formed for the improvement of Talbot Road S., and
similar reasoning would be applicable to any LID formed for S. 55th Street. South 55th
street is the only east-west street in this general area south of S. 43rd Street and
potentially could serve as an arterial.
CONCLUSIONS:
1. The proponent of a rezone must demonstrate that the request is in the public interest and
gill not impair the public health, safety and welfare in addition to compliance with at
least one of the three criteria listed in Section 4-3010, which provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or land use
analysis; or
t. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area in
which the subject site is located since the last rezoning of the property or area.
The applicant has demonstrated that the request to reclassify the subject property is
j•istified.
2. The proposed zoning complies with the Comprehensive Plan designation of the site as
siltable for single family uses.

3. '''here has been rapid growth in the areas to the north near the Valley General Hospital
f.nd the potential subdivision of the subject property into smaller single family parcels will
provide additional residential opportunities and choices in this growing area.
4. The city has recently modernized the water system through this area and can support the
potential increased population.
5. The record does not indicate the capacity of the sewer system serving this area, and
therefore, the applicant will have to provide assurance from the Cascade Sewer District
that the site can be adequately served as a condition of the rezone.
6. The applicant's proposal will ultimately result in further population and traffic in this
area, and therefore, the applicant must be willing to participate in any roadway
improvements necessary to serve the area in the future and such participation should be a
condition of approval.
7. "he request appears warranted, and therefore the City Council should approve the request.
R E C 0 ViMENDATIO N:
The City Council should approve the reclassification of the subject site from G-1 to R-1,
subjec. to the following conditions:
1. The applicant execute restrictive covenants to participate in any LID formed for the
improvement of Talbot Road S. and/or S. 55th Street.
2. The applicant provide written assurance that the Cascade Sewer District can provide
sanitary sewer service to the subject site.

C. H::STORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #3268 which
became effective December 13, 1978. The property was zoned G-1, General
Use, upon annexation to the City and has not been changed since
annexation.
D. PHYSICAL BACKGROUND:
1. Topography: The property slopes upward approximately 8 - 10% from
west to east.
2. Soils: Alderwood Gravelly Loam (AgC) . Permeability is moderately
rapid in the surface layer and subsoil and very slow in the
substratum. Runoff is slow to medium and the erosion hazard is
moderate.

3. Vegetation: A large portion of the property is covered in pasture
land while areas immediately surrounding the single family
residence consists of urban vegetation (lawn and ornamental plants) .
4. Wildlife: The existing vegetation provides some habitat for birds
and small mammals.
5. Water: No surface water was observed.
6. Land Use: Three (3) single family residences and open space.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding area consists of a scattered distribution of single
family residences on large lots along with large undeveloped parcels.
F. PUBLIC SERVICES:
1. Water and Sewer: A sixteen-inch water line is located adjacent to
the subject site along Talbot Road S. Sewer service is provided by
Cascade Sewer District.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements .
3. Transit: METRO Transit Routes #156 and #912 run adjacent to the
subject property on Talbot Road South (108th Avenue S.E. ) .

Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, issued a
declaration of non-significance on May 25, 1983.

L. DEPARTMENT ANALYSIS;
1. The applicant, Charlie C. Penor, is requesting a rezone of 3.25
acres located on the northeast corner of South 55th Street and
Talbot Road South from G-1, general use, to R-1, residential.
2. The Environmental Review Committee determined that there were no
adverse impacts on the environment or on adjacent properties and
issued a declaration of non-significance on May 25, 1983.
3. The Land Use Hearing Examiner must review four specific criteria
under Section 4-3014(C) to determine that the circumstances
surrounding the rezone request are adequate to recommend approval
of the reclassification. The following evidence clearly
demonstrates the rezone request is appropriate.
a. That substantial evidence was presented demonstrating that the
subject reclassification appears not to have been specifically
considered at the time of the last area land use analysis and
area zoning.
The subject site was annexed to the City by Ordinance #3268 in
December 1978. Both the city-wide comprehensive plan map
adopted in 1975 and the Southeast Quadrant update adopted in
1980, clearly show that the area is designated for single
family residential.
b. That the property is potential classified for the proposed
zone being requested pursuant to the policies set forth in the
Comprehensive Plan and the conditions have been met that would
indicate that the change is appropriate.
The Comprehensive Plan Map designates the subject area as
Single Family. The rezone can be considered in conformance
with the general residential goals and policies established in
the 1981 Policy Statement.
c. That since the last previous land use analysis of the area,
zoning of the subject property, authorized public
improvements, permitted private development or other
circumstances affecting the subject property have undergone
significant and material change.
Since 1978, the general area has been under substantial
pressure for development. Major development is now occurring
around the hospital located approximately one mile to the
north. The City has improved the major water transmission
lines in Talbot Road South that connects the main City
Springbrook watershed to the Valley General Hospital area.

d. Timeliness: The final test to determine whether a rezone
request is appropriate is to address the question of
timeliness. The subject property is the first parcel to be
developed in this general area in a small lot single family.
Rezoning and development of the site would be the first step
in stablizing this general area for single family residential
from the pressures of developments surrounding the hospital to
the north. During the last several years, many inquiries have
been made as to expansion of office and multiple family uses
to the south even into this general area. A positive action
in rezoning would provide a timely notice that the City was
intent on continuing the single family character of this
general area. Thus, it would appear timely to allow the
rezoning of the subject site.
4. Attached are departmental comments for the public's and Examiner's
review. The developer will be responsible for adjacent off-site
improvement including water and sewer extensions. The City of
Renton provides the water service, while Cascade Sewer District
provides the sanitary sewer service. The Utilities Engineering
Division advises that a special assessment for water is applicable
and that a systems development charge will be applied for both
water and sewer at the time of development.
5. The Policy Development Department has expressed some preliminary
concerns with participation in area traffic improvements that may
be necessary when the area is actually developed. The project
represents a potential development of 12 to 19 units maximum and it
should be required to participate in the area traffic improvements
to Talbot Road South and possibly the extension of South 55th
Street across SR-167. However, preliminary evaluations are so far
in the future for these improvements that it might be more
appropriate to require participation in a L.I.D. for the
improvement of Talbot Road South. In the recent past, the City has
tried to require incremental improvements instead of participation
in an L.I.D. but since this is the first rezone in the general area
it would appear untimely to make that requirement at this point.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the rezone
request, file R-034-83, be recommended for approval subject to the
filing of restrictive covenants to participate in an L.I.D. for the
improvement of Talbot Road South.

The owners of the property herein describrd are Charlie C. Fenor and
Josefina C. Penor, residing at 520 55th. Street South, Renton, Wash.
T he subject property was short platted 27 September, 1978 under the
jurisdiction of King County, into four lots as described in the acc-
ompanying site plat. This property has since that time been incorp-
orated into the City of Renton, and is classified under G-1 zoning
regulations.
The Penors, at this time , wish to apply to the City of Renton for
rezoning approval of the entire area from the present G-1 classif-
ication to R-1 .
Justification for the rezone is based on the following facts:
1 . The subject property is designated as single family resident-
ial on the comprehensive plan.
2. The property has not been considered for rezoning since
annexation to the City of Renton in 1978.
3. The area concerned is served by both City of Renton sewer and
water utilities.
Upon receipt of the approval for rezoning , the owners will apply
for a short plat, in September, 1983 for a portion of this property
Lot#4). This short plat will consist of four lots, each 82 foot
frontage x 144 feet deep, fronting of 55th. Street South. Each lot
will contain 11808 square feet, which more than meets the require-
ments for minimum lot size under R-1 zoning regulations.
The owners will, upon approval of the short plat, construct single
family dwellings on the unoccupied lots. Each home will be approx-
imately 1090 to 1200 square feet of living area with attached single
car garages. Each home will be situated on the lot to meet all
setback requirements as per City of Renton specifications.
