David Clemens, Policy Development Director, explained the policy adopted by the City Council on July 25, 1983, whereby annexation petitions may be considered in conjunction with rezone applications during a simultaneous review process, noting the first of the two required public hearings was held on October 10, 1983. The location of the subject site was designated on vicinity maps, with access proposed from both 84th Avenue South and Raymond Ave. SW. Petitioners Olga and Roland Watson represent 100% of the assessed valuation, and in accordance with city requirements, they agreed to accept the city's bonded indebtedness, Comprehensive Plan, and Zoning Ordinance on July 25, 1983 during the public hearing to consider the 10% petition. Continued Mr. Clemens reported that the requested rezone from G-I General Classification) to R-1 (Single Family Residential) was approved by the Hearing Examiner on September 21, 1983, and forwarded to the City Council for final disposition. Approval of both the annexation and rezone would allow future development of a single family residential plat containing approximately 13 lots. Continued Upon inquiry by Councilman Stredicke, Mr. Clemens explained location of sanitary sewer easement and noted the petitioner will be required to extend sewer easterly to Seneca Avenue SW through dedicated easement. He also outlined procedures to be followed for completion of the matter: upon approval of the annexation and rezone requests by Council, the rezone should be referred to Ways Means Committee to await approval of the annexation request which will be forwarded to the King County Boundary Review Board by the Policy Development Department. AU )IENCE COMMENT Paul Friedrich, Assistant Administrator of Valley General Lora Range Plan - Hospital, indicated completion of the Final Draft of VGH Valley General Long Range Plan, recently submitted to Council members, HOE pital and requested comments on behalf of the hospital's Strateaic Planning Committee. Mayor Shinpoch indicated that written comments from Policy Development Director Clemens require additional time for review by Council members. Councilman Stredicke commended VGH Administration for its efforts in gathering input for the Strategic Plan. He inquired if proposals exist to implement income-producing activities by the hospital and whether they would be available to only hospital participants or to the entire community. Mr. Friedrich indicated the plan addresses anticipated revenue in a global sense, and any activities would be available to the entire hospital district. Mayor Shinpoch echoed Councilman Stredicke's comments of appreciation for the efforts of the hospital, and assured submission of city comments soon. Renton, WA 98055 RE: WATSON ANNEXATION/REZONE REQUEST On July 25, 1983, the City Council adopted a policy whereby annexation petitions can be considered in conjunction with rezoning applications for the property in question. This applic ation represents the first use of this procedure. e subject site is 3.3 acres located east of 84th Ave. S. between N.W. 4th and N.W. 5th Stree'.s, near the crest of the west hill area. The proposal calls for annexation of the subject property and rezoning from the G-1 classification applied with the adoption of annexation to an R-1, Single-Family Residential classification. The City Council, at its meeting of July 25, 1983, did consider the 10% petition application submitted by this prope ay owner which represented 100% of the assessed valuation within the annexing area. The subject annexation represents single property owned by one property owner. On September 13, 1983, the Land Use Hearing Examiner considered the rezone application R-05 -83, and on September 21, 1983, the Examiner submitted his recommendation to the Council, which was to approve the reclassification of this subject site to R-1 Singl':-Family) upon annexation into the City. In accordance with state law, City Council must hold two public hearings a minimum of 30 days apart on both the annexation and propo:.ed rezone request. This public hearing represents the first of those two required public hearings. The second public hearing must be at least 30 days hence, which would be November 14, 1983. Mayor Shinpoch and City Council October 6, 1983 Page 2 Inasmuch as this is a new application, we would suggest the following procedure. 1. Accept public testimony on the subject rezone application and annexation application at this public hearing. 2. After receiving public comment at this October 10th public hearing, set November 14, 1983 as the time and place for the second required public hearing not sooner than 30 days following this public hearing. 3. At the November 14th public hearing, accept public comment on both the rezone application and the annexation application. 4. After the close of the November 14th public hearing, refer the Watson annexation and Watson rezone application R-054-83 to the Planning and Development Committee for final report and recommendation on both subjects. 5. If the Planning and Development Committee can consider this subject at its November 17th meeting, City Council could take final action on this annexation and rezone at its meeting of November 21. 6. Following adoption or modification to the proposed rezone and annexation, normal processing for the annexation will proceed with final action by the City Council to occur with the annexation ordinance being adopted prior to the adoption of the rezone ordinance for rezone R-054-83. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval, subject to the approval of the subsequent annexation by the City Council and subsequently by the King County Boundary Review Board. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on September 6, 1983. PUELIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 13, 1983, at 10:00 a.m. in the Council Chambers of the Ren' on Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following were entered into the record as exhibits: Exhibit #1: Yellow file containing the application, staff report, and other pertinent documents. Exhibit #2: Assessor's Map showing the subject property in red cross-hatched markings, and the proposed annexation boundary in yellow markings. Exhibit #3: Site Plan showing topography of the area. Roger Blaylock, Zoning Administrator, presented the staff report, noting that a simultaneous requ:st has also been filed by the applicants requesting annexation of the subject property into the city; the property is now located in King County. Bob Bergstrom, Engineering Supervisor for the Public Works Department, reported that the subj€ct property is generally within the Renton water service area; that there is an 8" water main on 84th Avenue S. which will be reconstructed to 10" or 12"; there is a municipal water supp:y 6" main in two locations; sewers lie on Seneca N.W. and extend along the northern edge of tl.e property to Raymond N.W. There are storm drains in Seneca N.W. that discharge to ditches, and storm water detention will be required of this property. Mr. Blaylock stated staff recommends approval of the rezone request subject to approval of the annexation request by the City Council and subsequent approval by the King County Boundary Revi,rw Board. ROWLAND S. & OLGA A. WATSON R-054-83 September 21, 1983 Page 2 The Examiner called on the applicant or representative. Testifying was: Rowland S. Watson 12614 - 84th Avenue So. Seattle, WA 98178 Mr. Watson stated he is in agreement with the staff report and recommendation. He questioned the off-site improvements to 84th Avenue S. which may be required of him. Mr. Blaylock explained that they were requirements of the subdivision ordinance and should he subdivide the property, those restrictions would apply. The Examiner called for further testimony in support of the application. There was none offered. The Examiner then called for testimony in opposition to the application, or any questions. Responding was: Jimmy Damascus 467 Seneca N.W. Renton, WA 98055 Mr. Damascus stated he was concerned with drainage from the subject site since his property is located below Mr. Watson's. He stated there is already a severe water problem and feels if the vegetation is removed, it will exacerbate the problem. Mr. Blaylock noted the storm water issue would be addressed at the appropriate times to prevent this from becoming a problem. The Examiner noted the applicant would not be required to alleviate the existing natural seepage from the hill. The Examiner called for further testimony. There being none, the hearing was closed at 10:25 a.m.. The Examiner noted his recommendation to the Council would be issued within 14 days; that there would be no final action taken until the City Council's decision on the applicant's annexation request. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Rowland J. and Olga A. Watson, filed a request for approval of a reclassification of approximately 3.3 acres of property from G- 1 (General; Single-Family Residential; Minimum lot size - 35,000 sq. ft.) to R-1 (Single-Family Residential; Minimum lot size - 7,200 sq. ft.). 2. The application file containing the application, the State Environmental Policy Act documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3.Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4.Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5.There was no opposition voiced regarding the proposal. 6. The subject property is located just west of the current westerly city boundary in a portion of unincorporated Ring County. The site is located on the east side of Raymond Ave. N.W. (84th Ave. S.). The subject site is undergoing concurrent review of an annexation request by the City of Renton. The City Council will review both this rezone request and the annexation after review and approval by the Boundary Review Board. Reclassification of the property would be contingent upon annexation. ROWLAND S. & OLGA A. WATSON R-(154-83 September 21, 1983 Page 3 7. The subject site with a slope of about 3 to 1 slopes down toward the east. The greatest elevation, approximately 320 feet, is realized along Raymond Avenue, while the lowest elevation, approximately 210 feet, occurs along the eastern property line. 8. The subject lot is roughly L-shaped. The dimensions range from approximately 210 to 400 feet wide and from 275 to 510 feet long. 9. The area in which the subject site is located is currently served by the City of Renton water system. Sewers with sufficient capacity can be extended to the subject site. 10 The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single-family homes. 11. An existing single-family home is located on the western end of the subject site. The remainder of the subject site is undeveloped and is covered with natural vegetation. 12. The area in which the subject site is located consists predominantly of single-family homes on approximately 7,200 sq. ft. lots. The site is zoned R-S 7200 under the King County code which, with minor exceptions, provides for development similar to that permitted under the R-1 requested by the applicant under the City of Renton's zoning code. 13. Without reclassification, the site would be limited to development of approximately 3-5 homes under the G zoning which would automatically occur upon annexation. The current King County zoning and the proposed Renton zoning would accommodate approximately 13 single--family homes on the site. 14. The request, if granted, could result in an increase in population in the city of approximately 33 people. Traffic generated by the potential development would be 130 trips per day. The school age population would increase by an additional 3 students. 15. The potential increases must be analyzed with an eye to the fact that these increases would be possible if the site were to remain under the jurisdiction of King Councy since the current King County zoning would allow the same results as annexation and rezoning. The only time the potential increases would not be realized would be if the site were annexed but the zoning held to G. 16. The Public Works Department has indicated a concern with the steep slopes of the subject site and their impact on storm drainage as a result of development. That department has raised the "red flag" because the costs of a system to contain the storm water may be substantial. 17. The city is in the process of updating the water supply system serving the West Hill area in which the subject site is located. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest, will not impair the public health, safety and welfare, and in addition, is in compliance with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject request has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. ROWLAND S. & OLGA A. WATSON R-054-83 September 21, 1983 Page 4 The applicant has demonstrated that the request to reclassify the subject site is warranted once the site is annexed into the City of Renton. 2. The city has plans to update the water system serving the area surrounding the subject site. The sewer system is capable of serving the subject site with an extension from the existing city mains in the area. These public improvements, both existing and planned, would enable the further development of the subject site. 3. The Comprehensive Plan designation for the subject site is compatible with the requested R-1 zoning. The Comprehensive Plan recommends single-family development and that is what would be permitted under the requested zoning. Further, the request only permits the applicants to develop the land in a fashion similar to that now allowed under the King County zoning, thereby preserving the applicant's existing development rights. 4. The existing development pattern, that is approximately 7,200 sq. ft. lots, would be continued on the subject site and would prove compatible and appropriate in the area. 5. While the storm drainage patterns of the area are of concern (the adjoining lower neighboring property is prone to flooding), the applicants, as a condition of development, will have to provide a positive storm drainage retention system on the subject site which maintains the current discharge rates. 6. In conclusion, the site generally appears capable of development permitted in the R-1 zone and the City Council should approve the reclassification of the subject site upon approval of the annexation of the subject site into the city. RECOMMENDATION: The City Council should approve the reclassification of the subject site to R-1 upon annexation into the city. ORDERED THIS 21st day of September, 1983. Fred J. This means that parties to a land use dec.sion may not communicate in private with any decision-maker concerning the proposal.Decision-makers in the land use process include both the Hearing Examiner and members of the Cit r Council. All communications concerning the the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. Pur;uant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before October 5, 1983. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing maymaleawrittenrequestforreviewbytheExaminerwithinfourteen (14) days from the date of the Examiner's decision. Clemens Policy Development Director U SUB 1ECT: WATSON ANNEXATION AND REZONE The Policy Development Department recently received the application for 75% petition from Mr. Roland Watson along with a rezone application, which was submitted to the Building and Zoning Department (R-054-83). Mr. Watson intends to utilize the recently adopted City Council policy which allows simultaneous consideration of the annexation and rezone applications. The rezone application and annexation will be reviewed by the Environmental Review Committee on Wednesday, September 21st, and we anticipate app-oval of a declaration of non-significance for the annexation and rezone. Once the Environmental Review Committee's decision has been made, the Building and Zoring Department will be able to determine at which meeting of the Hearing Examiner the rezone application can be considered. Simultaneously with determination of the ExF miner's hearing date, this office will prepare an agenda bill for City Council cor sideration to set a public hearing to consider the annexation and rezone for not sooner than four weeks following the Examiner's hearing. This will allow the Hearing Examiner two) weeks to prepare his recommendation to the City Council and two weeks for potential appeal of the Examiner's recommendation. At the close of the City Council's public hearing on the annexation and rezone, it must set a :second public hearing for not less than 30 days following the initial public hearing to again consider both the annexation and rezone. Following the City Council's second hearing, the City Council may act accordingly on both the rezone application and annexation application. The rezone ordinance cannot be adopted until completion of the annexation process. Any ordinance prepared as a result of approval of the rezoning of the subject property would be held in abeyance until adoption of the annexation ordinance. Watson, are requesting a rezone of approximately 3.3 acres from G-1 to R-1 for a future single-family residential short plat. 2.The Environmental Review Committee determined that there were no adverse impacts on the environment or on adjacent properties and issued a Declaration of Non-significance on August 24, 1983. 3.The Land Use Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification. The following evidence demonstrates the rezone request is appropriate: a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The owners of the subject site are currently going through the annexation process to bring the property into the City of Renton. They are being allowed to file an application to rezone the property concurrently with the annexation application as a result of a recent policy adopted by the City Council on July 25, 1983. The policy allows the simultaneous review of annexation and rezone applications. Cities have been granted the power. as provided for by RCW 35A.14.330. to prepare a proposed zoning regulation to become effective upon the annexation of any area which might reasonably be expected to be annexed by the code city at any future time." A public hearing before the Council on the annexation proposal is scheduled for October 10, 1983, and must be followed by a second hearing not less than 30 days from the October hearing. Both the Comprehensive Plan Map revised in 1983 and the Central Renton Comprehensive Plan update adopted in 1983 designate the area as single-family residential. Thus, the rezone proposal is occurring after the area-wide Comprehensive Plan analysis was approved. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the comprehensive planning and conditions have been met which would indicate that the change is appropriate. The proposal is in compliance with the single-family designation as shown on the Comprehensive Plan for the City of Renton and with the purpose and intent of the Comprehensive Plan's goals and policies. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements permitted private development or other circumstances affecting the subject property have undergone significant and material change. No major development or public improvements have been completed in this area since the adoption of the Central Renton Area Plan in March, 1983. However, in the area, single-family residential projects have been developed during the last few years. d. Timeliness: The final test to determine whether a rezone is appropriate is to address the question of timeliness. Development of single-family residences on the subject site is in keeping with development in the area. It appears that 30 to 50 square foot residences have been built n recent years within one-half mile of the subject site. In addition, the city proposes to upgrade water service in the area with the development of a water storage tank near the subject site. 4. Departmental comments are attached for review. All the departments approved the proposal. Two of the departments, though, based their approval on certain conditions being met at the time the applicant proposes subdividing the subject site. These conditions are as follows: a. The F ire Prevention Bureau requires an adequate turn-around on Raymond Avenue N.W. and a fire hydrant, if determined necessary, at the time of development. These must be constructed according to city code and standards. b. The Engineering Division of the Public Works Department requires the extension of the sanitary sewer and storm drainage systems to serve the subject site. This division may also require the development of a storm drainage detention area due to the inadequacy of the downstream system. c. The Traffic Engineering Division of the Public Works Department requires off-site improvements along 84th Avenue S. (Raymond Avenue N.W.). d. The Utilities Engineering Division of the Public Works Department will apply a systems development charge if both water and sewer at the time of development.
