I looked over the narrative and you can’t just say that the modification meets. You need to provide additional details.
Including why, what are the differences in spaces, how, etc.

Please find attached the narrative requesting a modification to the open space requirement found in RMC 4‐9‐150 E. I
have included the narrative along with the original and updated site plans for review. I have done all I can do in an
attempt to meet the letter of the code by reducing building depths and adjusting buildings on site. While I was able to
get close I was still unable to achieve the 15’ requirement but have been able to provide very similar to larger amounts
of usable square footages. Please let me know if this will be acceptable or if I need to juice it up more.

Hello David,
In a prior circumstance we allowed the developer to request a modification to this requirement. We will consider the
square footage of the front yard, and other open space on site. This would be a $154.50 fee with a narrative describing
compliance with modification criteria found in RMC 4‐9‐250.
a. Will meet the objectives and safety, function, appearance, environmental
protection and maintainability intended by the Code requirements, based
upon sound engineering judgment; and
b. Will not be injurious to other property(ies) in the vicinity; and
c. Conform to the intent and purpose of the Code; and
d. Can be shown to be justified and required for the use and situation intended;
ans
e. Will not create adverse impacts to other property(ies) in the vicinity; and

Good Afternoon Rocale,

I have a pretty big problem with the Grant place project particularly with regard to private open space. I am guessing we
missed this because of the age of the project but I am being required to have private open space having a dimension of
15’ in any direction. I don’t have this on any of the units and am not sure what or how I can get this. My buildings 1, 2, 3,
6, 7 & 8 have widths of the unit but only 11’ of depth from the front of the unit to the sidewalk and buildings 4 and 5
only 9’. The driveways at buildings 4 & 5 are 8.5 feet deep and I could possibly pull the buildings inward to gain the 5’
need to get to 15’ but then the buildings will only be about 22’ apart.
Is there any way we can get the depth of 15’ departed since most lot widths are 20 feet plus with only the E1 units
having 16’‐6”. If not then I will have no choice but to re‐design units I guess.
