OasisChurchLease00fileNo.:LUA-06-130,CU-HDecember12,2006Page2ThehearingopenedwithapresentationofthestaffreportbyJillDing,SeniorPlanner,DevelopmentServices,CityofRenton,1055SGradyWay,Renton,Washington98055.TheprojectsiteislocatedwithintheCommercialArterial(CA)Zone,itisdesignatedasEmploymentAreaValleyontheCity’sComprehensiveLandUseMap.AccesstothepropertywouldbeviaEastValleyRoadlocatedtothewestoftheproperty.Theproposalistoconvertanexisting17,193squarefootofficespaceintoachurchthatwouldbeoperatedbytheOasisSeattleChurchwithapproximately400members.ServiceswouldbeheldonThursdayfrom6-9p.m.andonSundayfrom8a.m.to2p.m.Themainassemblyroomwouldhave168totalseatsforthecongregation.Nonewconstructionisplannedatthistime.Theydoproposetousetheexistingonsiteparkinglotfortheparkingrequiredbythechurch.TheproposalisconsistentwiththePublic’sFacilitiesLandUseElement.Theexistingbuildingcompliedwiththesetback,landscaping,buildinglotcoverage,andheightrequirements.Itisnotexpectedthattherewouldbeanyadverseimpactinrelationshiptotrafficornoiseonthesurroundingproperties.Thebuildingwouldberequiredtobeincompliancewithallapplicablebuildingandfirecodes.UtilitiesStaffhasindicatedthatallexistingpublicutilitiesarecurrentlysufficienttoservetheproposeddevelopmentassociatedwiththisconditionalusepermit.JamesHester,OasisSeattleChurch,2400EastValleyRoad,Renton98055statedthattheyhavealreadyhavethebusinesspermit,thechurchhasbeeninworkingorderforoverayear.TheywereundertheimpressionthataConditionalUsePermitwasnotrequiredatthattime,sincebeingnotifiedtheyhavebeenworkingtowardsbeingincompliance.However,duringthatyeartheyhavebeenfireinspectedandeverythinghasbeenapproved.TheExaminercalledforfurthertestimonyregardingthisproject.Therewasnooneelsewishingtospeak,andnofurthercommentsfromstaff.Thehearingclosedat9:48a.m.FINDINGS,CONCLUSIONS&RECOMMENDATIONHavingreviewedtherecordinthismatter,theExaminernowmakesandentersthefollowing:FINDINGS:1.Theapplicant,JimHester,forOasisSeattleChurch,filedarequestforapprovalofaConditionalUsePermittoestablishachurchinanexistingofficebuilding.2.Theyellowfilecontainingthestaffreport,theStateEnvironmentalPolicyAct(SEPA)documentationandotherpertinentmaterialswasenteredintotherecordasExhibit#1.3.TheEnvironmentalReviewCommittee(ERC),theCity’sresponsibleofficial,issuedaDeterminationofNon-Significance(DNS-M)forthesubjectproposal.4.Thesubjectproposalwasreviewedbyalldepartmentswithaninterestinthematter.5.Thesubjectsiteislocatedat2400EastValleyRoad.ThesubjectsiteislocatedontheeastsideofEastValleyjustnorthofSW27thStreet.$R-167runsalongtheeasternpropertyline. 0DOasisChurchLeasefileNo.:LUA-06-130,CU-HDecember12,2006Page36.ThemapelementoftheComprehensivePlandesignatestheareainwhichthesubjectsiteislocatedassuitableforthedevelopmentofemploymentgeneratinguses,butdoesnotmandatesuchdevelopmentwithoutconsiderationofotherpoliciesofthePlan.TheComprehensivePlanpermitschurchesinmostneighborhoodsgivenappropriateaccess.7.ThesubjectsiteandneighboringsitesalongtheeastsideofEastValleyRoadarezonedCA(CommercialArterial)whilepropertywestofthatstreetiszonedforlightandmediumindustrialuses.8.Thesubjectsiteisatriangularparcelcontainingthreeofficebuildingsalignednorthtosouth.Thesubjectsiteis5.62acresor244,807squarefeet.Theexistingofficebuildingislocatedinthemiddleoftheparcel.9.Theexistingbuildingisonestoryandisapproximately17,193squarefeet.Parkingisprimarilylocatedsouthandwestofthebuilding.Asnoted,therearetwootherofficebuildingsonthesitewithadditionalparking.10.Thechurchhasalreadysetupoccupancybutlearnedthattheyneededappropriatepermitsandhave,therefore,submittedanapplicationforaConditionalUsePermit.11.Thechurchhasamembershipofapproximately400parishioners.Theywouldbeattendingservicesondifferentdays,therebylimitingthetotalnumberatthechurchasanyonetime.ServiceswouldoccuronThursdayeveningsfrom6to9pmandatmultipleservicesonSunday.Therewouldbeseatingfor168peopleinthemainassemblyhail.12.Theapplicantproposesnochangestotheexternalappearanceofthebuildingorproperty.Currentdrivewayconfigurationandlandscapingwouldbeunaltered.13.Thecomplexrequiresonly38parkingstallsandthesitecontains305parkingstalls.Staffandtheapplicantnotedthattheparkingdemandswouldbeathoursdifferentthanthosegenerallyrequiredbytheadjoiningofficeuses.CONCLUSIONS:1.TheapplicantforaConditionalUsePermitmustdemonstratethattheuseisinthepublicinterest,willnotimpairthehealth,safetyorwelfareofthegeneralpublicandisincompliancewiththecriteriafoundinSection4-31-36(C)whichprovidesinpartthat:a.TheproposalgenerallyconformswiththeComprehensivePlan;b.Thereisageneralcommunityneedfortheproposeduseattheproposedlocation;c.Therewillbenoundueimpactsonadjacentproperty;d.Theproposeduseiscompatibleinscalewiththeadjacentresidentialuses,ifany;e.Parking,unlessotherwisepermitted,willnotoccurintherequiredyards;f.Trafficandpedestriancirculationwillbesafeandadequatefortheproposedproject;g.Noise,lightandglarewillnotcauseanadverseaffectonneighboringproperty; 00OasisChurchLeasefileNo.:LUA-06-130,CU-HDecember12,2006Page4h.Landscapingshallbesufficienttobuffertheusefromrights-of-wayandneighboringpropertywhereappropriate;andi.Adequatepublicservicesareavailabletoservetheproposal.Therequestedconditionaluseappearsjustifiedandshouldbeapproved.2.TheComprehensivePlandesignatesthissiteforemploymentgeneratingusesbutpermitschurchesinmostareasoftheCityaslongasthereisgoodvehicularaccess.EastValleyRoadprovidesmorethanadequateaccess.Whiletheusewillnotgenerateasmuchemploymentasanofficebuildingorcommercialuse,itcancatertothoseinthecommunitywhomightwanttoworshipafterwork.Clearly,beinglocatedinacommercialareaavoidstwooftheprimeissuesofchurches-parkingandtrafficinaresidentialneighborhood.3.Thisofficegenerallyavoidsmakingdeterminationsaboutcommunityneedswhenreviewingreligiousinstitutions.Itisprobablyaninappropriatecriteriagiventhevarietyofreligiousdenominationsthatexist.Whileothercriteriamaybeusedtodetermineiftheuseisappropriateorintrusive,thisoneseemsinappropriateforgovernmentalreview.4.Thechurch’sproposedhoursofoperation,ThursdayeveningandSundaywouldnotimpactadjacentproperties.Thechurch,withoutbenefitofthispermit,hasbeenoperatingwithoutcomplaintuptillnow,soitappearstobeareasonableneighbor.Thecurrentcomplexofthreeofficebuildingsandassociatedparkingprovidessufficientparkingandreasonableaccess.Parishionersalreadyattendservicesandthetrafficalreadyexists.5.Nonewstructuresorexteriorchangesareproposedsothereshouldbenoadditionalvisualimpactsonsurroundingproperties.ThelargeeasternbufferprovidedbySR-167andthewetlandsisolatesthepropertyfromanyresidentialuses.6.Theparkinglotismorethanadequatesincetheuseonlyrequiresapproximately3$parkingspacesandover300areavailable.7.Thereshouldnotbeanyundueoradversenoise,lightorglareproblems.8.Theexistingcommercialcomplexhaslandscapingintheparkingareaandalongtheperimeterofthesite.Thereisalsolandscapingadjacenttothebuilding.9.Tnconclusion,theconversionoftheofficespacetochurchassemblyappearsreasonable.DECISION:TheproposedConditionalUsePermitisapproved.
