HomeMy WebLinkAboutD_Critical_Areas_Exemption_Decision_LUA17000224_20170425CITYOF—“Renton0PLANNINGDIVISIONCERTIFICATEOFEXEMPTIONFROMCRITICALAREASREGULATIONSEVALUATIONFORM&DECISIONDATE:April25,2017PROJECTNUMBER:LUA7-000224PROJECTNAME:WSDOT1-405/SR167-DirectConnectorProject:CriticalAreasExemptionPROJECTMANAGER:ClarkH.Close,SeniorPlannerAPPLICANT/CONTACT:LindaCooley/WSDOT/600108thAveNE,Suite400/Bellevue,WA98004PROJECTLOCATION:SR167/1-405InterchangePROJECTDESCRIPTION:Theapplicant,WashingtonStateDepartmentofTransportation(WSDOT)NorthwestRegion,isrequestingaCriticalAreasExemptiontoallowadditionaltemporarywetlandbufferimpactsforthe1-405/SR167Interchange-DirectConnectorProject(LUA15-000522).TheapplicantreceivedapprovalforaCriticalAreasPermitforthe1-405/SR167Interchange-DirectConnectorProjectonDecember4,2015.Thecriticalareasexemptionisnecessarytoallowtruckstoaccesstheexistinghaulroadfromthehillslopeexcavationareanearthenorthboundon-rampto1-405fromnorthboundSR167.Installationofthetemporaryaccessroadwouldresultinanadditional5,321squarefeetofPantherCreekwetlandbufferimpact.Theareaiscurrentlydominatedbyblackberrieswithalderandbigleafmaplestrees.WSDOT’sDesign-BuildContractor,AtkinsonConstructionwouldextendthehaulroadalongtheeastsideofRollingHillsCreek.Thetemporarybufferimpactsareneededtoextendtheexistingquarryspallhaulroad.ThiswouldallowtruckstohaulfillmaterialandlargewoodydebrisfromtheTalbotHillslopeexcavationworkareadirectlytotheRollingHillsCreekchannelrestorationareaandtheSR167fillareas.Thetemporarilydisturbedareaswouldbere-vegetatedwithindigenousplantsappropriatetothesiteconditions.Followingtheadditionalroadworkandthenewchannelreconstruction,WSDOTisproposingthefollowingstepstorestorethewetlandbuffer:•Removalofanyhaulroadsurfacing(e.g.hogfuel)anddecompactionofhaulroadbyrippingto18”minimumdepth;•Proposedrestorationplantingareasnotimpactedbyconstructiontraffictobedecompactedto12”minimumdepth;•Proposedrestorationplantingareastoreceive4”finecompostamendmentincorporatedintodecompactedexistingsoilto10”depth.Asanalternative,12”depth CityofRentonDepartmentofCommunity&EconomicDevelopmentCertificateofExemptionfromCriticalAreasRegulationsWSDOT1-405/SR167-DirectConnectorProject:CriticalAreasExemptionLUAI7-000224LUAApril25,2017Page2of4importtopsoilmaybeused,perTech.Requirement2.15.4.14;•Plantingareastobetoppedwith3”depthbarkorwoodchipmulch,perTech.Requirement2.15.4.18;•Proposedrestorationplantingtoconsistofanativetreeandshrubmixsuitedtoupland,similartoCorridorTreeMix(minustheNorwayMaple)andCorridorShrubMixshownonp.30ofAppendixL2.Treespacingtobe12’o.c.,andshrubspacingtobe4’o.c.;and•Newplantswouldreceivefive(5)yearsofplantestablishmentmaintenancetoensuresuccessoftherestoration.CRITICALAREA:Protectedslopes,sensitiveslopes,highlandslidehazardareas,highseismicareas,erosionhazardareas,andwetlands.EXEMPTIONJUSTIFICATION:RentonMunicipalCode(RMC)4-3-050CriticalAreasRegulationsSubsectionsC.3.f.iTemporaryWetlandImpactsandC.3.a.iiiApprovedRestorationandMitigationPlan.FINDINGS:TheproposeddevelopmentisconsistentwiththefollowingfindingspursuanttoRMCsection4-3-050C.2.d:i.TheactivityisnotprohibitedbythisoranyotherprovisionoftheRentonMunicipalCodeorStateorFederallaworregulation;ii.TheactivitywillbeconductedusingbestmanagementpracticesasspecifiedbyindustrystandardsorapplicableFederalagenciesorscientificprinciples;iii.Impactsareminimizedand,whereapplicable,disturbedareasareimmediatelyrestored;iv.Wherewaterbodyorbufferdisturbancehasoccurredinaccordancewithanexemptionduringconstructionorotheractivities,revegetationwithnativevegetationshallberequired;v.Ifahazardousmaterial,activity,and/orfacilitythatisexemptpursuanttothisSectionhasasignificantorsubstantialpotentialtodegradegroundwaterquality,thentheAdministratormayrequirecompliancewiththeWellheadProtectionArearequirementsofthisSectionotherwiserelevanttothathazardousmaterial,activity,and/orfacility.Suchdeterminationswillbebaseduponsiteand/orchemical-specificdata.DECISION:AnexemptionfromthecriticalareasregulationsisApprovedwithConditions.
