DEPARTMENTOFCOMMUNITYMEM0RANDUMDATE:September21,2017TO:FILELUA7-000366—DemundShorelineExemptionFROM:MonaDavis,SeniorPlannerSUBJECT:LUA17-000366DemundShorelineExemptionRevision2811MountainViewAvenueNorthTheapplicantwasissuedaCertificateofExemptionfromShorelineSubstantialDevelopmentunderLandUsepermitfileLUA7-000366,SMEonJune9,2017fortheproposedreplacementofanexistingsecondstorydeckonasingle-familyresidencelocatedonLakeWashington’sshoreline.Theapplicantproposedtorepairthedecayedwallframingandguardrailthatislocatedonthesouthwestsideofthehome.Therepairworkdidnotincreasethebuildingfootprint,squarefootageorheight.Theprojectwasconsiderednormalmaintenanceandrepairofexistingdevelopment.Uponcommencementofconstruction,itwasdeterminedthatthedeckandportionofthehousebelowwerebeyondminimalrepairandwouldrequireamoreextensiverepairbyremovingandreplacingthedeckandofficespacebelowthedeck.Theproposalistoreplacetheexistingdeckandofficeareabelowwithalikedeckandofficeareautilizingallnewmaterials.Therepairworkwillnotincreasethebuildingfootprint,squarefootageorheightofwhatisexisting.Anewbuildingpermitwillbesubmittedtoreplacetheexistingbuildingpermit(B17002014).InaccordancewithWAC73-27-100,theproposedrevisiontotheapprovedShorelineExemptionisconsistentwiththepoliciesoftheWashingtonAdministrativeCode(WAC):Apermitrevisionisrequitedwhenevertheapplicantproposessubstantivechangestothedesign,termsorconditionsofaprojectfromthatwhichisapprovedinthepermit.Changesatesubstantiveiftheymateriallyaltertheprojectinamannerthatrelatestoitsconformancetothetermsandconditionsofthepermit,themasterprogramand/orthepoliciesandprovisionsofchapter90.58RCW.Changeswhicharenotsubstantiveineffectdonotrequireapprovalofarevision.Staffhasfoundthattheabovedescribedchangesarenotsubstantive;therefore,anewpermitisnotrequiredfortheproposedchanges.Furthermore,inaccordancewithRentonMunicipalCodeRMC4.9.190.C.3,theproposedrevisiontotheapprovedShorelineExemptionisalsoconsistentwiththepoliciesoftheShorelineManagementActandtheCityofRentonShorelineMasterProgram.LUA7-000366DemundShorelineExemption
