CityofRentonDepartmentofCommunity&EconomicDevelopmentCertificateofExemptionfromCriticalAreasRegulationsCriticalAreaMitigationLUAI7-0006Q5CRITICALAREA:CategoryIllwetlandandbufferandaTypeNsstreamandbuffer.EXEMPTIONJUSTIFICATION:Anycriticalareaand/orbufferrestorationorothermitigationactivitieswhichhavebeenapprovedbytheCity.FINDINGS:TheproposeddevelopmentisconsistentwiththefollowingfindingspursuanttoRMCsection4-3-OSOC.2.d:i.TheactivityisnotprohibitedbythisoranyotherprovisionoftheRentonMunicipalCodeorStateorFederallaworregulation;ii.TheactivitywillbeconductedusingbestmanagementpracticesasspecifiedbyindustrystandardsorapplicableFederalagenciesorscientificprinciples;iii.Impactsareminimizedand,whereapplicable,disturbedareasareimmediatelyrestored;iv.Wherewaterbodyorbufferdisturbancehasoccurredinaccordancewithanexemptionduringconstructionorotheractivities,revegetationwithnativevegetationshallberequired;v.Ifahazardousmaterial,activity,and/orfacilitythatisexemptpursuanttothisSectionhasasignificantorsubstantialpotentialtodegradegroundwaterquality,thentheAdministratormayrequirecompliancewiththeWellheadProtectionArearequirementsofthisSectionotherwiserelevanttothathazardousmaterial,activity,and/orfacility.SuchdeterminationswillbebasedDECISION:AnexemptionfromtheCriticalAreasRegulationsisherebyApprovedwithCondiflons*.CONDITIONS:1.AninstallationsuretyshallbeprovidedtotheCitypriortothecommencementofanyrestorationorenhancementactivities.Acopyofasignedcontractfortheinstallationofthewetlandandstreammitigationplantings,signage,andfencingshallbesubmittedtotheCurrentPlanningProjectManagerforreviewandapproval.Uponapprovalofthecontractproposal,theapplicantshallprovideaninstallationsuretydevice(aletterofcreditorirrevocablesetasideletter)setatanamounttotaling125%ofthecosttoguaranteetheinstallationofthemitigationproject.Page2of4 CityofRentonDepartmentofCommunity&EconomicDevelopmentCertificateofExemptionfromCriticalAreasRegulationsCriticalAreaMitigationLUAI7-0D0605CONDITIONS:2.Aftercompletionoftheinstallationofthemitigationactivities(plants,signage,fencing,etc.)pursuanttotheapprovedplan,theapplicantshallberequiredtoprovidemewithwrittenverificationthattheinstallationisinconformancewiththeapprovedplan.3.Acopyoftheas-builtplansoftheapprovedmitigationplan,shallbesubmittedtotheCurrentPlanningProjectManager;unlessplantingsareinstalledasexactlyperplan.4.Uponcompletionoftheinstallationofthemitigation,theapplicantshallberequiredtoprovideamaintenanceandmonitoringsuretydevice.PleaseprovidiacopyofthesignedmaintenanceandmonitoringcontracttotheCurrentPlanningProjectManagerforreviewandapproval.Adraft(followedbyafinal)maintenanceandmonitoringcontract(orcontracts)forourreviewpriortoexecutionofthecontractshallbeprovided.ThedraftcontractlanguageshallensurecompliancewithboththeperformancestandardsoftheapprovedmitigationplanaswellthemaintenanceandmonitoringstandardsoftheRentonMunicipalCode.Thescopeofthecontractshallclearlycoverthecostofplantmaintenanceandreplacementaswell.Thelanguageinthecontractshallalsoguaranteethat“structures,improvements,andmitigationperformsatisfactorilyforaperiodof5years”(e.g.addprovisionsforplantreplacementandweedremovalreferencingcompliancewiththesurvivalratesnotedinthefinalapprovedwetlandmitigationplan.Thecontractmustincludequarterlymonitoringreportsforthefirstyearandannualreportsthereafter.ThedraftcontractshallbefollowedupwithafinalsignedcontractoncetheCurrentPlanningProjectManagerapprovesthedraftversion.OncetheCurrentPlanningProjectManagerapprovesthecontractproposal,theapplicantshallprovideamaintenancesuretydevice(aletterofcreditorirrevocablesetasideletter)setatanamounttotaling125%ofthecosttoguaranteesatisfactoryperformanceforaminimumoffiveyears.5.AllcriticalareasandtheirbuffersshallbeplacedinaNativeGrowthProtectionEasement.AdraftnativegrowthprotectioneasementshallbeprovidedtotheCurrentPlanningProjectManagerforreviewandapprovalpriortothecompletionoftheinstallationofthemitigation.TheNativeGrowthProtectionEasementshallberecordedpriortothecommencementofthemaintenanceandmonitoringperiod.SIGNATURE&DATEOFDECISION:October05,2017JenniferHenning,PlanningDirec’torDatePage3of4
