Cooley, Washington State Department of Transportation — Applicant SIMULTANEOUS FILING OF Permit #2018-NW4202 Approved Shoreline Substantial Development Permit (SDP) #3700 Approved Shoreline Variance #550 Dear Ms. Cooley: On May 16, 2018, we received the City of Renton (City) decision on your shoreline SDP and variance to widen Interstate 405 (I-405) to add one new lane in each direction to create a dual lane express toll system. Work proposed within the City shoreline jurisdiction includes roadway, bridge, and trail replacement and expansion in the Urban Conservancy shoreline environment designation (SED) at May Creek and Shoreline Residential SED adjacent to Lake Washington. Local governments, after reviewing SDPs for compliance, are required to submit them to Ecology. We have received and filed your approved SDP. By law, we must review all shoreline variances for compliance with: • The Shoreline Management Act (Chapter 90.58 RCW). • Ecology's variance permit approval criteria (Chapter 173-27470 WAC). • The City Local Shoreline Master Program. After reviewing shoreline varian ce permits for compliance, we must decide whether to approve, approve with conditions, or disapprove them. Our Decision: We approve this variance allowing the proposed May Creek Trail and Eastside Railroad Corridor Trail segments to deviate from the six-foot maximum width and pervious surface material requirements of RMC 4-3-091).4.d.1, provided your project complies with the conditions required by the City. What Happens Newt 0 Before you begin activities authorized by this permit, the law requires you wait at least 21 days from the date this letter was mailed, the "date of filing." This waiting period allows anyone (including you) who disagrees with any aspect of this permit to appeal the decision to the state Shorelines Hearings Board (SHB). You must wait for the conclusion of an appeal before you can begin the activities authorized by this permit. The SHB will notify you by letter if they receive an appeal. We recommend you contact the SHB before you begin permit activities to ensure they have not received an appeal. You may reach them at (3 60) 664-9160 or http://www.eluho.wa.gov/Board/SHB.
