SUBJECT: Denial of Temporary Use Permits
BACKGROUND: The language in RMC 4-9-240.J establishes administrative powers and
decision criteria for temporary use permits. This gives the Administrator
the power to accept, modify, or condition a temporary use permit.
However, specific mention of denial powers were omitted. This does not
mirror the powers given to the Administrator for other discretionary
permits within the code. For the sake of clarity, explicit mention of denial
powers should be included.
DECISION: Amend RMC 4-9-240.J Temporary Use Permits to add denial as an
administrative power available to the Administrator.
JUSTIFICATION: Denial is an option given to the Administrator for all other discretionary
land use actions and was unintentionally omitted from RMC 4 -9-240.J.
Inclusion of denial powers is especially relevant to temporary use permits
because temporary uses allow activities that are otherwise disallowed on
a permanent basis. Without denial powers this privilege could be abused
through continuous renewal of a temporary use permit.

APPEAL
PROCESS: To appeal this determination, a written appeal--accompanied by the
required filing fee--must be filed with the City's Hearing Examiner (1055
South Grady Way, Renton, WA 98057, 425-430-6515) no more than 14
days from the date of this decision. Your submittal should explain the
basis for the appeal. Section 4-8-110 of the Renton Municipal Code
provides further information on the appeal process.
