SUBJECT: Retroactive Application of ULS Code
BACKGROUND: In 2016, Ordinance 5818 was adopted which established a process and
standards for the subdivision of land underlying individual townhouse
units, referred to as “Unit Lot Subdivisions” (ULS). One purpose of the
ULS code is to provide an alternative to condominiums that allows
ownership of the land. In order to afford existing townhouse owners the
opportunity to build equity in land, a provision was included in the ULS
code that allows it to apply to existing townhouse developments.
DECISION: The application of ULS code to existing townhouse developments will
have a provision that requires the development to have obtained a
Certificate of Occupancy before the adoption date of Ord. 5818 (10-17-
2016).
JUSTIFICATION: ULS code requires certain improvements that would not be required of
townhouse development that does not utilize the ULS code. Once the
ULS code was adopted, developers had the option of creating
condominiums or creating fee-simple townhouse units; if a developer
opted to create condominiums they should not have the option to utilize
ULS code and circumvent those higher standards required.

PROCESS: To appeal this determination, a written appeal--accompanied by the
required filing fee--must be filed with the City's Hearing Examiner (1055
South Grady Way, Renton, WA 98057, 425-430-6515) no more than 14
days from the date of this decision. Your submittal should explain the
basis for the appeal. Section 4-8-110 of the Renton Municipal Code
provides further information on the appeal process.

B. APPLICABILITY:
The provisions of this Section shall only apply to the subdivisions of land
underlying existing or proposed townhouse dwelling units in the R-10, R-
14, RMF, and CV zones in the following cases:.
1. New Townhome Development: Subdivisions intended for the
purpose of new townhouse development.
2. Existing Townhome Development: Subdivisions when the existing
townhouse developments have received a Certificate of Occupancy
before October 17, 2016.
