An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). Conditions were imposed as mitigation measures by the Environmental Review Committee under their authority of Section 4-9-070D Renton Municipal Code. These conditions are necessary to mitigate environmental impacts identified during the environmental review process. Because other agencies of jurisdiction may be involved, the lead agency will not act on this proposal for fourteen (14) days. A. Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS-M with a 14-day Appeal Period. B. Mitigation Measures The applicant shall comply with the regulations regarding designation of dangerous waste per WAC 173-303-070, and the applicant shall provide a waste disposal plan prior to demolition permit issuance. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Earth Impacts: A majority of the site is relatively flat, with the steepest slope on site less than 1 percent. The existing underground storage tanks (USTs) will be removed from their original UST cavity and the excavation will be backfilled with a commercial borrow source with ¾ minus (or similar) rock. The existing UST cavity is approximately 28 feet by 33 feet with an estimated depth of 12 feet below ground surface. The existing UST cavity will be backfilled and paved to match the existing parking area. No tree removal or grading activities are proposed as part of the demolition activities. It is anticipated that the City’s currently adopted erosion control, construction, and drainage regulations would adequately mitigate for any impacts that could result from the proposed demolition and removal; therefore, no further mitigation is recommended. Mitigation Measure: None recommended. Nexus: Not Applicable. 2. Air Impacts: Demolition activities may result in temporary additional dust, which could impact the air on and around the project site. It is anticipated that air quality would return to its previous condition once demolition activities have been completed. The applicant would be required to comply with Best Management Practices regarding d ust control and air quality; therefore, no further mitigation is recommended. Mitigation Measures: No further mitigation recommended. Nexus: Not applicable. 3. Plants Impacts: No tree removal is proposed as part of the demolition activities. Tree protection measures as required by City Code would be implemented to ensure that trees are not damaged as a result of canopy demolition; therefore, no further mitigation is recommended. Mitigation Measures: No further mitigation recommended. Nexus: Not applicable. 4. Environmental Health a. Environmental Health Hazards Impacts: The applicant states that a release of approximately 750 gallons of gasoline occurred in May of 1997 from one of the three onsite petroleum underground storage tanks (USTs). In July of 1997, three groundwater monitoring wells were installed at the site. Subsequent investigations led to a No Further Action (NFA) determination by the Washington State Department of Ecology (DOE) in April of 2000 (See Exhibit 4). In addition, a Phase II Environmental Site Assessment (ESA) was completed in 2012. The Phase II included the collection of soil samples from direct push borings and groundwater samples from the existing monitoring wells. The results did not indicate the presence of petrole um hydrocarbons. The Phase II ESA indicated that groundwater was observed between 55 and 60 feet below ground surface (bgs). The decommissioning of USTs in Washington State is regulated by DOE. The applicant is required to provide 30-day notice for the decommissioning. In addition, soil and groundwater (if encountered) samples will be collected and analyzed in accordance with the DOE regulations. A comment from the Department of Ecology (DOE) was received during the public comment period (Exhibit 5). In summary, DOE’s comment states that the project must be properly designated per WAC 173 -303- 070, Designation of dangerous waste. Based on the Department of Ecology’s request for the project to comply with WAC 173-303-070, staff recommends as a mitigation measure that the applicant comply with the regulations regarding designation of dangerous waste per WAC 173 -303- 070, and that the applicant provide a waste disposal plan prior to demolition permit issuance. Provided the applicant complies with all of the Depa rtment of Ecology requirements and the required mitigation measure, staff does not anticipate any Environmental Health impacts would result from the project. Mitigation Measures: The applicant shall comply with the regulations regarding designation of dangerous waste per WAC 173-303-070, and the applicant shall provide a waste disposal plan prior to demolition permit issuance. Based on the provided construction mitigation description, work would be performed during normal business hours (Monday – Friday; 7:30am to 5:30pm). Project Narrative: The Site is located at 2801 NE Sunset Blvd in Renton, Washington. The Site is situated in the NW quarter of Section 9, Township 23, Range 5. The site is located at an elevation of approximately 100 feet above mean sea level (amsl). The subject site is flat with a regional topographic slope to the west-northwest. The Site is zone Center Village (CV) and is within the Commercial and Mixed Use (CMU) designation. Site improvements include a 20,219 square foot convenience store and a fueling canopy and fuel dispensers. The Site has been historically used as a service station and the current fuel system consists of three steel USTs (two 12,000-gallon and one 10,000-gallon) and two dispensers. Boring logs from the Phase II Environmental Site Assessment in 2012 indicated the subsurface soils are comprised of sand with some clay underlain by sandy clays beginning at approximately 25 feet below ground surface (bgs). Groundwater at the Site has been observed in onsite monitoring wells at between approximately 55 feet and 60 feet bgs. The existing USTs will be removed from their original UST cavity and the excavation will be backfilled with a commercial borrow source with ¾ minus (or similar) rock. The existing UST cavity is approximately 28 feet by 33 feet with an estimate depth of 12 feet bgs. No grading will be completed. The existing UST cavity will be backfilled and paved to match the existing parking area. It is estimated that approximately 400 cubic yards of ¾-minus rock will be used to backfill the UST excavation. The fueling canopy and all ancillary UST piping will also be removed. The estimated project costs are approximately $90,000. The project work will utilize standard heavy equipment and will the project will take between 1 and 2 weeks to complete. Work will be done during normal business hours (730 to 540) during the standard work week. No job trailers or other temporary structures will be used. Once the project is complete, the only visual change will be the removal of the existing fueling canopy. 6. Environmental Checklist: Attached. 7. Construction Mitigation Description: The construction dates will be based on the City of Renton’s acceptance of this land use and SEPA application. We anticipate that the project will commence within 30 days of approval by the City of Renton. We anticipate that the project will take between 1 and 2 weeks to complete. As noted above, project work will commence Monday through Friday between the hours of 7:30 am and 5:30 pm. The limited soils removed from the UST excavation will be stockpiled on plastic and bermed as necessary to minimize stormwater runoff. When possible, we will direct load soils into the transportation vehicles. Due to the small nature of this project, we do not anticipate that any traffic control or traffic impacts will be necessary. We anticipate that the project work will be limited to the UST nest area and fueling canopy. All equipment will be staged onsite. Limited in bound and outbound trucks will be needed for the removal of the USTs, soil over burden and the importation of backfill. The final source for the backfill and the disposal location for the USTs has not been finalized and will be based on field conditions and subcontractor availability. 10.
