One project location is along the Cedar River located within Township 23 North, Range 5 East, Section 17. The area is also within the Shoreline Jurisdiction of Cedar River, Reach B (CR-B), designated Shoreline High Intensity. All repairs will be contained within existing legally established right-of-way (ROW) spanning approximately 1.47 acres. The proposed work will include roadway grinding, repaving, and utility vault adjustments specific to storm water management and water valves. The Cedar River runs adjacent to the northeastern project terminus and work will be conducted approximated 15.2 feet from the ordinary high water mark of the Cedar River. There will be no net increase in impervious surface area and the project is not anticipated to have any aquatic impacts. No excavation or fill will occur as a part of this project and no trees will be removed as part of this project. Sediment and erosion best management practices will be utilized to ensure the Cedar River is not impacted by this project, including installation of silt fences and compost socks. The proposal would be exempt from SEPA in accordance with WAC 197-11-800(3) Repair, remodeling, maintenance activities. WATER BODY/REACH: Cedar River Reach B EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development Permit is hereby Approved on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the following reasons: DocuSign Envelope ID: D58B753E-6054-49CC-BA6D-6D47D1051C43 D_Street_Patch_and_Overlay_181029 Maintenance and Repair: Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. a. “Normal maintenance” includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. b. “Normal repair” means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to the shoreline resource or environment. c. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including, but not limited to, its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment. The proposed development is: Consistent with the policies of the Shoreline Management Act. Consistent with the guidelines of the Department of Ecology where no Master Program has been finally approved or adopted by the Department. Consistent with the City of Renton Shoreline Master Program. SIGNATURE & DATE OF DECISION: Jennifer Henning Date RECONSIDERATION: Within 14 days of the decision date, any party of record may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14 day appeal time frame. APPEALS: The administrative land use decision will become final if not appealed in writing together with the required fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 on or before 5:00 pm, on November 12, 2018 (RCW 43.21.C075(3); WAC 197-11-680). RMC 4-8-110 governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall, 7th Floor, (425) 430-6510.
