HomeMy WebLinkAboutL Easement No Build 181126 v1.pdfWHEN RECORDED RETURN TO: _______________________ _______________________ _______________________ Document Title: “No Build” Easement Reference Number: Grantor: Seattle Area Plumbers Trust and Union Local 32 Grantee: City of Renton Legal Description: See Exhibits A, B and C Tax Parcel Number: 242304-9122-05 “No Build” Easement The undersigned owner of the property herein described, Seattle Area Plumbing and Pipefitting Industry Journeymen and Apprentice Training Trust (the “Trust”) and United Association Local 32 of Journeymen and Apprentices of the Plumbing and Pipefitting Industry of the United States and Canada (the “Union”) (collectively the “Grantor”) do hereby impose as an easement running with the land upon property currently owned by the Trust, see Exhibit A hereto. The Trust property is legally described on Exhibit B hereto. A portion of the Trust property will be purchased by the Union pursuant to a Lease Purchase Agreement between the Trust and the Union, dated July 10, 2018, upon completion of a Binding Site Plan subdividing Proposed Lot 2, currently being processed by the City of Renton. Proposed Lot 2 is legally described on Exhibit C hereto. Upon completion of the sale of Proposed Lot 2 by the Trust to the Union, there will be two Easement Areas: one located on Proposed Lot 1 and the other located on Proposed Lot 2. The Trust and the Union mutually agree that this Easement shall be effective upon execution and recording of this No Build Easement Agreement, notwithstanding that the sale of Proposed Lot 2 by the Trust to the Union has not yet occurred. 1. Purpose of the Easement. The purpose of the No Build Easement is to impose certain building restrictions on the Easement Areas. Consequently, this Easement shall restrict the placement or construction of buildings or structures in or encroaching upon the Easement Areas for the purposes of Fire Separation between the buildings. This Easement shall in no event restrict the placement of structures or items in the Easement Areas that are not considered a part of a building or structure but are an accommodation thereto, such as parking, pathways, signage, utilities and landscaping. 2. Description of the Easement Areas. The Easement Areas are set forth on the Sketch attached hereto as Exhibit A and are described in general as the rectangular “crosshatched” areas within the “balloon” encirclement on the Sketch on each end of the “Proposed Building Addition” and further identified on the Sketch designated as “Proposed No-Build Easement.” 3. Duration of the Easement. Upon recordation of this document, the Easement granted herein shall be a covenant running with the land and their existence shall be perpetual unless the exterior walls and openings of either building facing the No Build Easement are brought into compliance with the Building Code of the City of Renton based on fire separation distance. 4. Successors and Assigns. The rights and obligations of the parties hereto shall inure to the benefit of and be binding upon their respective successors and assigns. Dated this__ day of November, 2018.
