HomeMy WebLinkAboutD_Reconsideration Decision_Skyhorse_181203.pdf December 3, 2018 Chad Allen, PE Encompass Engineering & Surveying 165 NE Juniper St, #201 Issaquah, WA 98027 SUBJECT: Reconsideration of Condition of Approval #4 for the Skyhorse Short Plat (LUA17-000550, SHPL, MOD) Dear Mr. Allen: We received your timely request for reconsideration with regard to Condition of Approval #4 for the Skyhorse Preliminary Short Plat. Condition #4 states “A tree retention tract shall be provided to the east of Lots 5 and 6 for any trees in excess of the minimum density requirements based on the required 24 and 30 gross equivalent of caliper inches required for each lot.” In your request, you stated that this requirement would render Lots 5 & 6 as almost unbuildable. You also inquired about the possibility of removing the excess trees in lieu of creating a tree tract. Staff has reviewed the request and determined that there is a typo within Condition #4 that should be corrected. Condition #4 refers to the eastern portion of Lots 5 and 6, however the intent was to require the tree tract on the eastern portion of proposed Lots 7 and 8. The proposed lot depth for Lots 7 and 8 is currently 170 feet, which is 70 feet deeper than the minimum lot depth of 100 feet required in the R-4 zone; therefore a tree tract could be accommodated on the eastern portion of Lots 7 and 8 without rendering these lots as unbuildable. Staff does not support the removal of excess trees in lieu of creating a tree tract as this would not be consistent with the purpose of the City’s tree retention and land clearing regulations. As stated in RMC 4-4-130A one purpose for the City’s tree regulations is to promote land development practices that result in minimal adverse disturbance to existing vegetation and soils within the City. Retention of significant trees is imperative to implementing the purpose of the regulations. Decision: Therefore the Condition #4 of the Skyhorse Short Plat, LUA17-000550 is amended to read as follows: A tree retention tract shall be provided to the east of Lots 7 and 8 for any trees DocuSign Envelope ID: ED03D213-E197-45B1-BE6F-7AE52379A709 in excess of the minimum density requirements based on the required 30 gross equivalent of caliper inches required for each lot. This decision to amend the original Skyhorse Preliminary Short Plat Decision is subject to a 14- day appeal period. The above decision will become final if not appealed in writing together with the required fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 by 5:00 pm on Wednesday December 17, 2018.
