Conditioned Shoreline Conditional Use Permit #2018-NW4492
Dear Chris Erickson:
On December 19, 2018, we received the City of Renton decision on your shoreline conditional
use permit (CUP) authorizing the expansion of an existing overwater trail use on the May Creek
trestle. This application was determined complete with the submission of additional information
on January 22, 2019. The project is located on King County parcel number 3224059005 at the
existing May Creek railroad trestle. The May Creek trestle crosses May Creek approximately
300 feet north of N 41St Street, just west of Lake Washington Blvd N in Renton. The project area
is located within the Urban Conservancy and adjacent Aquatic shoreline environment
designations of May Creek (Reach A), a shoreline of statewide significance.
By law, we must review all shoreline CUPs for compliance with:
• The Shoreline Management Act (Chapter 90.58 RCW).
• Ecology's CUP approval criteria (Chapter 173-27460 WAC).
• The Local Shoreline Master Program (SMP).

er reviewing shoreline CUPS for compliance, we must decide whether to approve, approve
with conditions, or disapprove them.
Our Decision:
We approve your shoreline CUP provided your project complies with the conditions required by
the City of Renton and the following additional conditions:
1. The applicant shall provide an analysis of how the proposed overwater trail design meets
the requirements of Renton Municipal Code 4-3-090E.10(d) or provide design revisions
necessary to meet these standards. The analysis or revised design shall be submitted to
Ecology for review and approval prior to the City's issuance of construction permits and
prior to the start of construction.

2. The applicant shall demonstrate consistency with mitigation sequencing requirements in
the Renton SMP related to the expansion of the overwater trail use. This demonstration
shall include an analysis of shade impacts associated with the installation of the solid
surface decking (as proposed) or final approved design, if revised prior to construction.
Based on this analysis, proposed mitigation measures should be implemented consistent
with the Eastside Rail Corridor Environmental Impact Statement. A final mitigation plan
shall be submitted to Ecology for review and approval prior to the City's issuance of
construction permits and prior to the start of construction.
Please note, however, that other federal, state, and local permits may be required in
addition to this shoreline permit.
What Happens Next?
Before you begin activities authorized by this permit, the law requires you wait at least 21 days
from the date this letter was mailed, the "date of filing." This waiting period allows anyone
(including you) who disagrees with any aspect of this permit to appeal the decision to the state
Shorelines Hearings Board (SHB). You must wait for the conclusion of an appeal before you can
begin the activities authorized by this permit.
The SHB will notify you by letter if they receive an appeal. We recommend you contact the SHB
before you begin permit activities to ensure they have not received an appeal. You may reach
